LenoreSkenazyI absolutely adore Lenore Skenazy. As I pointed out in my review of her brilliant new book, Free-Range Kids: Giving Our Children the Freedom We Had Without Going Nuts with Worry, she is rare voice of sanity in modern debates about parenting and child safety issues.  If you are a hyper-concerned helicopter parent who constantly obsesses about keeping your kids “safe” from the world around them, then I beg you to read her book and her outstanding blog of the same name.  It will completely change the way you look at the world and how your go about raising your kids.  It is that good.

Skenazy address and debunks a wide variety of “child safety” myths in her book, including many from the online child safety front that I spend so much time dealing with in my work.  In one of her recent posts, she addresses the rather silly concerns of one elementary school teacher who wanted an author of children’s books to speak to her fourth grade class using Skype.  However, “since the school and the author are 1000 miles apart, the author suggested using the video-chat service Skype. The teacher said no — not unless he could come up with a way the kids could see HIM, but not vice versa.”  When Skenazy pointed out how this concern was likely greatly overblown, one commenter on her site responded: “The teacher is likely (legitimately) concerned that the kids’ faces could end up plastered all over the Internet.”  Skenazy responds to that notion with a rant worthy of a George Carlin monologue, albeit without as much swearing, mind you:

Excuse me? Legitimately concerned that (1) A children’s author she has invited will turn around and take photos of her class and post them without permission?  That that’s what men do all the time? Can’t trust ‘em for a second? (2) That boring photos of a 4th grade class are so exciting that they will take the Internet by storm? (Because, of course, there are so few photos of school children available.) (3) That someone will see this particular photo, obsessively focus on the kid in the third row and move heaven and earth to come find this child and stalk, rape or kill him/her? And that we must keep Third Row Kid safe at all costs?

These are insane fantasies! Perfect, text-book examples of the way so many of us now jump to the absolutely WORST CASE SCENARIO and then work backward from it, preventing something harmless or even wonderful from ever taking place just in case. Using this method of risk calculation, a teacher could politely request that from now on, no one serve her students lunch at school. Because what if one of the lunch ladies is secretly a psychopath and she is intent on murdering the kids one by one? It COULD happen, right? Let’s be prepared for the ABSOLUTE WORST! After all, we’re only thinking about the good of the children!

A terrific Radio Berkman podcast this week on “Adventures in Anonymity” featuring Sam Bayard, a fellow at the Harvard Berkman Center and the Assistant Director of the Berkman Center’s Citizen Media Law Project.  Along with host Daniel Dennis Jones, Bayard discusses the intersection of anonymity, free speech, defamation law, privacy, and more.  In addition to sorting through the sticky legal and ethical issues, their discussion includes some really excellent historical perspectives on anonymous speech.  They also get into the recent “skank” blogger case and the AutoAdmit case.  I discussed those cases and some of these issues more generally in these essays:

“Schools in Beijing are quietly removing the Green Dam filter, which was required for all school computers in July, due to complaints over problems with the software,” notes this Reuters report. Even though China backed down on their earlier requirement to have the Green Dam filter installed on all computers, according to Reuters “schools were still ordered by the Ministry of Industry and Information Technology to install the web filter, which Chinese officials said would block pornography and other unhealthy content.”  The Reuters article mentions a notice carried on the home page of one Beijing high school that reads: “We will remove all Green Dam software from computers in the school as it has strong conflicts with teaching software we need for normal work.”  The article also cites a school technology director, who confirmed that the software had been taken off most computers, as saying “It has seriously influenced our normal work.”

Ironically, many educators and librarians in the United States can sympathize since they currently live under similar requirements.  Under the Children’s Internet Protection Act (CIPA) of 2000, publicly funded schools and libraries must implement a mandatory filtering scheme or run the risk of losing their funding. As the Federal Communications Commission summarizes:

[CIPA] imposes certain types of requirements on any school or library that receives funding for Internet access or internal connections from the E-rate program… Schools and libraries subject to CIPA may not receive the discounts offered by the E-rate program unless they certify that they have an Internet safety policy and technology protection measures in place. An Internet safety policy must include technology protection measures to block or filter Internet access to pictures that are: (a) are obscene, (b) child pornography, or (c) harmful to minors (for computers that are accessed by minors).

Of course, nobody wants kids viewing porn in schools, but CIPA has been know the block far more than that and has become a real pain for many educators, librarians, and school administrators who have to occasionally get around these filters to teach their students about legitimate subjects. Anyway, I just find it ironic that some American lawmakers have been making a beef about mandatory Internet filtering by the Chinese when we have our own mandatory filtering regime right here in the states. Cyberbullying constitutes one of the largest growth categories of recent cyberlaw legislative proposals, and many state legislatures have already enacted measures aimed at combating this problem using a variety of approaches.  Those attempting to monitor ongoing developments in this field might find it useful to examine this National Conference of State Legislatures (NCSL) compendium of recent state cyberbullying bills.

In June, Berin Szoka and I published a PFF white paper, “Cyberbullying Legislation: Why Education is Preferable to Regulation.”  That paper mostly address federal legislation and, in particular, we contrasted the approaches set forth in Rep. Linda Sánchez’s (D-CA) “Megan Meier Cyberbullying Prevention Act,” versus the “School and Family Education about the Internet (SAFE Internet) Act,” which was introduced in the Senate by Sen. Robert Menendez (D-NJ) and in the House by Rep. Debbie Wasserman Schultz (D-FL).  Whereas the Sánchez bill would create a new federal felony to address these problems, the SAFE Internet Act proposes an education-based approach to the issue.

Generally speaking, Berin and I favor the latter approach, to the extent federal legislators feel the need to act. But we argued that state experimentation on this front may be the better way to go at this time.  As the NCSL survey suggests, states are pursing a variety of strategies and will continue to do so.  In light of that, I’m not sure why any federal legislation is needed at this time.  If the feds are really eager to push something at the national level, perhaps a generic public awareness / PSA campaign would make the most sense while more tailored state-based experimentation continues.  This is rare example of where state-based experimentation with a cyberlaw issue actually makes a lot of sense.

I cannot in strong enough terms recommend that everyone read Gordon Crovitz’s latest Wall Street Journal column, “Free Speech, Now that Speech is Free.”  It perfectly encapsulates everything we stand for here and makes the case that I have made again and again: Speech regulation — of all flavors — makes less and less sense in a world of information abundance and user empowerment, and it is a complete affront to our First Amendment rights.  As Crovitz argues:

The Constitution was drafted at a time when there were few media outlets, and few people could be heard. Since then, technology has made it possible for everyone to express their views. The cost of expressing opinions continues to fall. Now that speech is no longer expensive, it’s time to return to the Founders’ intention that speech be free and that Congress not abridge anyone’s right to speak.

Amen brother!  In his essay today, Crovitz specifically takes on America’s increasingly insane campaign finance laws, which make a mockery of the First Amendment.  In the wake of last week’s Supreme Court arguments in the Citizens United case, Crovitz points out the insulting stupidity and sheer futility of these analog era, scarcity-oriented laws:

Over at Ars Technica, Matt Lasar does a nice job pointing out how the FCC’s quarterly indecency complaint totals have again been inflated by one group: the Parents Television Council. This is something Lasar has written about before and he’s one of the few journalists who continues to ask sharp questions about the ongoing manipulation of these statistics by PTC. As Lasar notes in his latest piece:

for the first quarter of this year, show the viewers relatively calm at 578 complaints in January, then 505 in February, followed by 179,997 in March? 179,997? Um, did we miss something? Did television really get that much more indecent in March? No worries. In these situations, we know what to do. We go over and check out the Parents Television Council‘s website. And sure enough, there’s a plausible instigator—a PTC viewer action alert crusade against a March 8 episode of the animated comedy show the PTC just loves to hate, Fox TV’s Family Guy.

This “complaint box stuffing” is something I wrote quite a bit about in the past, especially in my 2005 paper, “Examining the FCC’s Complaint-Driven Broadcast Indecency Enforcement Process.” As I pointed out there, “The PTC’s increasingly effective use of computer-generated campaigns against specific TV programs is a leading factor in explaining the large jump in indecency complaints in recent years.” Specifically, as I noted in that paper (as well as a Supreme Court filing with my friends at CDT), the FCC quietly and without major notice made two methodological changes to its tallying of broadcast indecency complaints in 2003 & 2004 that PTC  requested: Continue reading →

Today I was invited to the Federal Communications Commission (FCC) to testify at one of the agency’s Broadband Working Group workshops. This particular workshop was on “Broadband Consumer Context,” which focused on “a range of challenges and opportunities as the internet becomes a focal point for commercial transactions, social networking, and a host of activities pertaining to information gathering and exchange.”

I was asked to address the issue of whether there is a relationship between online safety concerns and broadband uptake. In my testimony, I noted that, in my 15 years of research in this area, I have never unearthed any substantive empirical evidence suggesting a correlation between parental concerns about online activity and overall household broadband uptake. I have seen occasional anecdotal news stories discussing the concerns some parents have had about their kids online that led them to reject online connectivity, but these stories have been exceedingly rare (and I haven’t seen any in recent memory).

I also argued that I did not think it at all surprising that such anecdotes are harder to find, or that empirical evidence on this front seems non-existent. I argued that there were four logical explanations for why parental concerns about online safety haven’t “moved the broadband needle” much in the negative direction:

  1. Not every home has children present
  2. Parents use a variety of household media rules to control media & Internet usage
  3. A vibrant marketplace of parental control technologies exists
  4. Likely that most parents believe that the benefits of broadband outweigh the potential downsides

Meetup.com founder Scott Heiferman explains how Meetup is all about “The Pursuit of Community” in the New York Times.

A Meetup is about the simple idea of using the Internet to get people off the Internet. People feel a need to commiserate or get together and talk about what’s important to them. Our biggest categories are moms, small business, health support and fitness.

When we were designing the site, we were wrong about almost everything we thought people would want to use it for. I thought it would be a niche lifestyle venture, perhaps for fan clubs. I had no idea that people would form new types of P.T.A.’s, chambers of commerce or health support groups. And we weren’t thinking that anyone would want to meet about politics, but there are thousands of these Meetups.

People have organized more than 200,000 monthly Meetups in more than 100 countries. There’s nothing more powerful than a community coming together around a purpose. We spend increasingly more time in front of screens. We’re more connected technologically, but we’re less connected physically.

Heiferman’s vision of technology bringing people together in pursuit of shared interests,passions and causes, from the political to the charitable to the trivial, would have delighted Alexis de Tocqueville, whose 1835 classic Democracy in America identified voluntary association as the unique genius of the American character.

Tocqueville concluded that representative democracy had flourished in America, rather than leading to murderous despotism as it had in Tocqueville’s revolutionary France, because, among other things, Americans built a rich civic society interposed between the atomized individual and the state. Rather than suppressing political associations as factions dangerous to the health of the state, Americans embraced political associations (parties and causes), which served as “large free schools, where all the members of the community go to learn the general theory of association.” Americans would apply that art in every other walk of life, from today’s AIDS Walks or PTA meetings to groups of rock climber enthusiasts: “The art of association then becomes… the mother of action, studied and applied by all.” Tocqueville concludes: Continue reading →

GI JoeSometimes the most revealing conversations about policy issues happen with our loved ones at the breakfast table. Although loyal TLF readers may remember my partner Michael as my “Posterboy for Advertising’s Pro-Consumer Quid Pro Quo,” he doesn’t usually get into the policy issues I cover.  But this morning, we fell into a conversation about the bitterly contentious issue of marketing to kids:

Michael: Growing up in South Korea, on a military base, we didn’t have any commercials on television. We had three channels and all they showed was public service announcements.

Sounds like paradise for anti-advertising zealots like Jeff Chester and the media reformistas who want to re-create the old media scarcity in the name of “media democracy“! Anyway:

We moved back to the U.S. when I was nine, and suddenly, during all my favorite cartoons, there were ads for toys. It was exciting—and more than a little bit overwhelming! It wasn’t just that I wanted these toys; it was that felt this incredible sense of urgency: I thought we had to go get the toys right now or they’d be gone!

What did Rousseau call his innocent man, the Noble Savage? That’s what we were: The noble savage, coming into this world of sophisticated toy advertisements.

But it didn’t take long for me to get over this initial bewilderment. My parents explained to me that we didn’t really have to go to the store right away. (They also explained to me that I couldn’t haggle with the staff at Toys ‘R Us the same way I’d haggled with street vendors back in Korea—something that utterly mystified the staff.) After one trip to Toys Toys ‘R Us, I got the toys I wanted most and, over the next few months, realized that they weren’t anywhere near as exciting as I had imagined.

After that, I enjoyed the toy ads on TV, but I lost interest in many of the toys I already had, preferring to create my own toys or play outside.

I explained that advertising of toys to kids has long been the cause celebre of anti-advertising crusaders:

Michael: But kids are acquisitive, too! How are they supposed to know about the latest toys if you can’t advertise to them? And what’s the big deal, anyway? I got used to toy ads and I think most kids would, too. The thing that’s different is incentive programs at stores.

Dan GillmorIn a post earlier this week, I discussed Randy Cohen’s “guideline” for anonymous blogging. Specifically, Cohen argued in a recent New York Times piece that, “The effects of anonymous posting have become so baleful that it should be forsworn unless there is a reasonable fear of retribution.  By posting openly, we support the conditions in which honest conversation can flourish.”  While sympathetic to that guideline, I noted I agreed with it as an ethical principle, not a legal matter.  In others words, what might make sense as a “best practice” for the Internet and its users would not make sense as a regulatory standard.  I prefer using social norms and public pressure to drive these standards, not regulation that could have an unintended chilling effect on beneficial forms of anonymous online speech.

Dan Gillmor of the Center for Citizen Media of the Harvard Berkman Center has a new column up at the UK Guardian in which he takes a slightly different cut at a new standard or social norm for dealing with some of the more caustic anonymous speech out there:

One of the norms we’d be wise to establish is this: People who don’t stand behind their words deserve, in almost every case, no respect for what they say. In many cases, anonymity is a hiding place that harbours cowardice, not honour. The more we can encourage people to use their real names, the better. But if we try to force this, we’ll create more trouble than we fix.  But we don’t want, in the end, to turn everything over to the lawyers. The rest of us — the audience, if you will — need to establish some new norms as well.

Specifically, Gillmor argues that, ” We need to readjust our internal BS meters in a media-saturated age,” because “We are far too prone to accepting what we see and hear.”  I think Gillmor has too little faith in most digital denizens; most of us take anonymous comments with a grain of salt and assume that the ugliest of those comments are often untrue.  And that’s generally the “principle” he recommends each of us adopt going forward: Continue reading →
