This a running list of all the essays and reports I’ve already rolled out on the governance of artificial intelligence (AI), machine learning (ML), and robotics. Why have I decided to spend so much time on this issue? Because this will become the most important technological revolution of our lifetimes. Every segment of the economy will be touched in some fashion by AI, ML, robotics, and the power of computational science. It should be equally clear that public policy will be radically transformed along the way.

Eventually, all policy will involve AI policy and computational considerations. As AI “eats the world,” it eats the world of public policy along with it. The stakes here are profound for individuals, economies, and nations. As a result, AI policy will be the most important technology policy fight of the next decade, and perhaps next quarter century. Those who are passionate about the freedom to innovate need to prepare to meet the challenge as proposals to regulate AI proliferate.

There are many socio-technical concerns surrounding algorithmic systems that deserve serious consideration and appropriate governance steps to ensure that these systems are beneficial to society. However, there is an equally compelling public interest in ensuring that AI innovations are developed and made widely available to help improve human well-being across many dimensions. And that’s the case that I’ll be dedicating my life to making in coming years.

Ronald Reagan's presidential portrait, circa 1981With many conservative policymakers and organizations taking a sudden pro-censorial turn and suggesting that government regulation of social media platforms is warranted, it’s a good time for them to re-read President Ronald Reagan’s 1987 veto of Fairness Doctrine legislation. Here’s the key line:

History has shown that the dan­gers of an overly timid or biased press cannot be averted through bureaucratic regulation, but only through the freedom and compe­tition that the First Amendment sought to guarantee.

That wisdom is just as applicable today when some conservatives suggest that government intervention is needed to address what they regardless as “bias” or “unfair” treatment on Twitter, Facebook, YouTube, or whatever else. Ignoring the fact that such meddling would likely violate property rights and freedom of contract — principles that most conservatives say they hold dear — efforts to empower the Federal Communications Commission, the Federal Trade Commission, or other regulators would be hugely misguided on First Amendment grounds.

President Reagan understood that there was a better way to approach these issues that was rooted in innovation and First Amendment protections. Here’s hoping that conservatives remember his sage advice. Read his entire veto message here.

There is a war going on in the conservative movement over free speech issues and FCC Commissioner Mike O’Reilly just became a causality of that skirmish. Neil Chilson and I just posted a new essay about this over on the Federalist Society blog. As we note there:

Plenty of people claim to favor freedom of expression, but increasingly the First Amendment has more fair-weather friends than die-hard defenders. Michael O’Rielly, a Commissioner at the Federal Communications Commission (FCC), found that out the hard way this week. Last week, O’Rielly delivered an important speech before the Media Institute highlighting a variety of problematic myths about the First Amendment, as well as “a particularly ominous development in this space.” In a previous political era, O’Rielly’s remarks would have been mainstream conservative fare. But his well-worded warnings are timely with many Democrats and Republicans – including some in the White House – looking to resurrect analog-era speech mandates and let Big Government reassert control over speech decisions in the United States.

Shortly after delivering his remarks, the White House yanked O’Rielly’s nomination to be reappointed to the agency. It was a shocking development that was likely motivated by growing animosities between Republicans on the question of how much control the federal government–and the FCC in particular–should exercise over speech platforms, including platforms that the FCC has no authority to regulate.

For the 30 years that I have been covering media and technology policy, I’ve heard conservatives rail against the Fairness Doctrine, Net Neutrality and arbitrary Big Government only to see many of them now reverse suit and become the biggest defenders of these things as it pertains to speech controls and FCC regulation. It will certainly be interesting to see what a potential future Biden Administration does with the various new regulations that some in the GOP are seeking to impose.

But all hope is not lost. There are still brave voices in Republican and conservative circles who continue to stand up the the First Amendment, freedom of speech, and limits on federal regulatory meddling with speech platforms and outcomes. Commissioner O’Reilly basically lost his job because he acted as the equivalent of an intellectual whistle-blower; he called out the ideological rot seen in recent statements and actions by the White House, Senator Josh Hawley, and many other Republicans.

There is nothing remotely “conservative” about calls for reinvigorating the Fairness Doctrine and FCC speech controls. That represents repressive regulation that betrays the First Amendment and which will ultimately backfire badly and come back to haunt conservatives down the road.

The ongoing ride-sharing wars in New York City are interesting to watch because they signal the potential move by state and local officials to use infrastructure management as an indirect form of innovation control or competition suppression. It is getting harder for state and local officials to defend barriers to entry and innovation using traditional regulatory rationales and methods, which are usually little more than a front for cronyist protectionism schemes. Now that the public has increasingly enjoyed new choices and better services in this and other fields thanks to technological innovation, it is very hard to convince citizens they would be better off without more of the same.

If, however, policymakers claim that they are limiting entry or innovation based on concerns about how disruptive actors supposedly negatively affect local infrastructure (in the form of traffic or sidewalk congestion, aesthetic nuisance, deteriorating infrastructure, etc.), that narrative can perhaps make it easier to sell the resulting regulations to the public or, more importantly, the courts. Going forward, I suspect that this will become a commonly-used playbook for many state and local officials looking to limit the reach of new technologies, including ride-sharing companies, electric scooters, driverless cars, drones, and many others.

To be clear, infrastructure control is both (a) a legitimate state and local prerogative; and (b) something that has been used in the past to control innovation and entry in other sectors. But I suspect that this approach is about to become far more prevalent because a full-frontal defense of barriers to innovation is far more likely to face serious public and legal challenges. For example, limiting ride-sharing competition in NYC on the grounds that it hurts local taxi cartels is unappealing to citizens and the courts alike. So, NYC is now making it all about traffic congestion. Even if that regulatory rationale is bunk, it is a much harder narrative to counter in the court of public opinion or the courts of law. For that reason, we can expect more and more state and local governments to just flip the narrative about innovation regulation going forward in this fashion.

How should defenders of innovation and competition respond to state and local efforts to use infrastructure control as an indirect form of innovation regulation? First, call them out on it if it really is just naked protectionism by another name. Second, to the extent there may be something their asserted concerns about infrastructure problems, propose alternative solutions that do not freeze innovation and new entry outright. The best approach is to borrow a page out of Coase’s playbook and use smarter pricing and property rights solutions. Or perhaps use unique funding mechanisms for new and better infrastructure that could accommodate ongoing entry and innovation.

For example, my Mercatus colleague Salim Furth recently penned a column (“Let Private Companies Pay for More Bike Lanes”) in which he noted how the electric scooter company Bird has offered cities a dollar a day per scooter to help build protected bike lanes. In doing so, Furth notes, Bird is:

offering to enter the long tradition of private provision of public goods. The original subway lines were private. Private institutions have frequently built or maintained public parks. Radio broadcasts, a textbook example of a public good, are largely private in the US. Companies often provide public entertainment because they benefit from the attraction.

In a similar way, Uber has already supported usage-based road pricing to alleviate congestion.  We could imagine still other examples like this for emerging technology companies. Drone manufacturers could help create or pay for “aerial sidewalks” or easements so they can deliver goods more efficiently. Scooter and dockless bike companies could help pay for bike and scooter paths either directly or through promotional efforts. Driverless car fleet providers could help build or cover the cost of new parking garages or for road improvements that would help make autonomous systems work better in local communities.

That is the pro-consumer, pro-innovation path forward. Hopefully, state and local officials will embrace such forward-looking reform ideas instead of seeking to indirectly control new entry and competition under the guise of infrastructure management.

I’ve been thinking about the “right to try” movement a lot lately. It refers to the growing movement (especially at the state level here in the U.S.) to allow individuals to experiment with alternative medical treatments, therapies, and devices that are restricted or prohibited in some fashion (typically by the Food and Drug Administration). I think there are compelling ethical reasons for allowing citizens to determine their own course of treatment in terms of what they ingest into their bodies or what medical devices they use, especially when they are facing the possibility of death and have exhausted all other options.

But I also favor a more general “right to try” that allows citizens to make their own health decisions in other circumstances. Such a general freedom entails some risks, of course, but the better way to deal with those potential downsides is to educate citizens about the trade-offs associated with various treatments and devices, not to forbid them from seeking them out at all.

The Costs of Control

But this debate isn’t just about ethics. There’s also the question of the costs associated with regulatory control. Practically speaking, with each passing day it becomes harder and harder for governments to control unapproved medical devices, drugs, therapies, etc.  Correspondingly, that significantly raises the costs of enforcement and makes one wonder exactly how far the FDA or other regulators will go to stop or slow the advent of new technologies.

I have written about this “cost of control” problem in various law review articles as well as my little Permissionless Innovation book and pointed out that, when enforcement challenges and costs reach a certain threshold, the case for preemptive control grows far weaker simply because of (1) the massive resources that regulators would have to pour into the task on crafting a workable enforcement regime; and/or (2) the massive loss of liberty it would entail for society more generally to devise such solutions. With the rise of the Internet of Things, wearable devices, mobile medical apps, and other networked health and fitness technologies, these issues are going to become increasingly ripe for academic and policy consideration.

A Hypothetical Regulatory Scenario

Here’s an interesting case study to consider in this regard:  Can  3D printing  of prosthetics be controlled? Clearly prosthetics are medical devices in the traditional regulatory sense, but few people are going to the FDA and asking for permission or a “right to try” new 3D-printed limbs. They’re just doing it. And the results have been incredibly exciting, as my Mercatus Center colleague Robert Graboyes has noted.

But let’s imagine what the regulators might do if they really wanted to impose their will and limit the right to try in this context:

  • Could government officials ban 3D printers outright? I don’t see how. The technology is already too diffuse and is utilized for so many alternative (and uncontroversial) uses that it doesn’t seem likely such a control regime would work or be acceptable. And if any government did take this extreme step, “global innovation arbitrage” would kick in. That is, innovators would just move offshore.
  • Could government officials ban the inputs used by 3D printers? Again, I don’t see how. After all, we are primarily talking about plastics and glue here!
  • Could government officials ban 3D printer blueprints? Two problems with that. First, such blueprints are a form of free speech and government efforts to censor them would represent a form of prior restraint that would violate the First Amendment of the U.S. Constitution. Second, even ignoring the First Amendment issues, information control is just damned hard and I don’t see how you could suppress such blueprints effectively when are they are freely available across the Internet. Or, people would just “torrent” them, as they do (illegally) with copyrighted files today.
  • Could government officials ban and/or fine specific companies (especially those with deep pockets)? Perhaps, but that is likely a losing strategy since 3D printing is already so highly decentralized and is done by average citizens in the comfort of their own home (and often for no monetary gain). So, attempting to go after a handful of corporate players and “make an example out of them” to deter others from experimenting isn’t likely to work. And, again, it’ll just lead to more offshoring and undergrounding of these devices and innovative activities.
  • Could government officials ban the sale of certain 3D printing applications? They could try, but enterprising minds would likely start using alternative payment methods (like Bitcoin) to conduct their deals. But the question of payments is largely irrelevant in many fields because much of this activity is non-commercial and open-source in character. People are freely distributing blueprints for 3D-printed prosthetics, for example, and they are even giving away the actual 3D-printed prosthetic devices to those who need them.
  • Could government officials just create a licensing / approval regime for narrowly-targeted 3D printed medical devices? Of course, but for all the reasons outlined above, it would likely be pretty easy to evade such a regime. Moreover, the very effort to enforce such a licensing regime would likely deter many beneficial innovations in the process, while also leading to the old cronyist problems associated with firms engaging in rent-seeking and courting favor with regulators in order to survive or prosper.

Anyway, you get the point: The practicality of control makes a difference and at some point the enormous costs associated with enforcement become an ethical matter in its own right. Stated differently, it’s not just that citizens should generally be at liberty to determine their own treatments and decide what drugs they ingest and what medical devices they use, it’s also the case that regulatory efforts aimed at limiting that right have so many corresponding enforcement costs that can spillover on to society more generally. And that’s an ethical matter of a different sort when you get right down to it. But, at a minimum, it’s an increasingly costly strategy and the costs associated with such technological control regimes should be considered closely and quantified where possible.

The Need for a Shift toward Risk Education

Let’s return to the question I raised above regarding the educational role that the FDA, or governments more generally, could play in the future. As I noted, a world in which citizens are granted the liberty to make more of their own health decisions is a world in which they could, at times, be rolling the dice with their health and lives. The highly paternalistic approach of modern food and drug regulation is rooted in the belief that citizens simply cannot be trusted to make such decisions on their own because they will never be able to appreciate the relative risks. You might be surprised to hear that I am somewhat sympathetic to that argument. People can and do make rash and unwise decisions about their health based on misinformation or a general lack of quality information presented in an easy-to-understand fashion. As a result, policymakers have taken the right to make these decisions away from us in many circumstances.

Although motivated by the best of intentions, paternalistic controls are not the optimal way to address these concerns. The better approach is rooted in risk education. To reiterate, the wise way to deal with the potential downsides associated with freedom of choice is to educate citizens about the relative risks associated with various medical treatments and devices, not to forbid them from seeking them out at all.

What does that mean for the future of the FDA? If the agency was smart, it would recognize that traditional command-and-control regulation is no longer a sensible strategy; it’s increasingly unworkable and imposes too many other costs on innovators and personal liberty. Thus, the agency needs to reorient its focus toward becoming a risk educator. Their goal should be to help create a more fully-informed citizenry that is empowered with more and better information about relative risk trade-offs.

Overcoming the Opposition & Getting Consent Mechanisms Right

Such an approach (i.e., shifting the FDA’s mission from being primarily a risk regulator to becoming a risk educator) will encounter opposition from strident defenders and opponents of the FDA alike.

The defenders of the FDA and its traditional approach will continue to insist that people can  never be trusted to make such decisions on their own, regardless of how much information they have at their disposal or how many warnings we might give them. The problem with that position is that it treats citizens like ignorant sheep and denies them the most basic of all human rights: The right to live a life of your own choosing and to make the ultimate determinations about your own health and welfare. And, again, blindly defending the old system isn’t wise because traditional command-and-control regulatory methods are increasingly impractical and incredibly costly to enforce.

Opponents of the FDA, by contrast, will insist that the agency can’t even be trusted to provide us with good information for us to make these decisions on our own. Additionally, critics will likely argue that the agency might give us the wrong information or try to “nudge” us in certain directions. I share some of those concerns, but I am willing to live with that possibility so long as we are moving toward a world in which that is the only real power that the FDA possess over me and my fellow citizens. Because if all the agency is doing is providing us with information about risk trade-offs, then at least we still remain free to seek out alternative information from other experts and then choose our own courses of action.

The tricky issue here is getting consent mechanisms right. In fact, it’s the lynchpin of the new regime I am suggesting. In other words, even if we could agree that a more fully-informed citizenry should be left free to make these decisions on their own, we need to make sure that those individuals have provided clear and informed consent to the parties they might need to contract with when seeking alternative treatments. That’s particularly essential in a litigious society like America, where the threat of liability always looms large over doctors, nurses, hospital, insurers, and medical innovators. Those parties will only be willing to go along with an expanded “right to try” regime if they can be assured they won’t be held to blame when citizens make controversial choices that they advised them against, or at least clearly laid out all the potential risks and other alternatives at their disposal. This will require not only an evolution of statutory law and regulatory standards, but also of the common law and insurance norms.

Once we get all that figured out—and it will, no doubt, take some time—we’ll be on our way to a better world where the idea of having a “right to try” is the norm instead of the exception.

IoT paperThe Mercatus Center at George Mason University has just released my latest working paper, “The Internet of Things and Wearable Technology: Addressing Privacy and Security Concerns without Derailing Innovation.” The “Internet of Things” (IoT) generally refers to “smart” devices that are connected to both the Internet and other devices. Wearable technologies are IoT devices that are worn somewhere on the body and which gather data about us for various purposes. These technologies promise to usher in the next wave of Internet-enabled services and data-driven innovation. Basically, the Internet will be “baked in” to almost everything that consumers own and come into contact with.

Some critics are worried about the privacy and security implications of the Internet of Things and wearable technology, however, and are proposing regulation to address these concerns. In my new 93-page article, I explain why preemptive, top-down regulation would derail the many life-enriching innovations that could come from these new IoT technologies. Building on a recent book of mine, I argue that “permissionless innovation,” which allows new technology to flourish and develop in a relatively unabated fashion, is the superior approach to the Internet of Things.

As I note in the paper and my earlier book, if we spend all our time living in fear of the worst-case scenarios — and basing public policies on them — then best-case scenarios can never come about. As the old saying goes: nothing ventured, nothing gained. Precautionary principle-based regulation paralyzes progress and must be avoided.  We instead need to find constructive, “bottom-up” solutions to the privacy and security risks accompanying these new IoT technologies instead of top-down controls that would limit the development of life-enriching IoT innovations.

The better alternative is to deal with concerns creatively as they develop, using a balanced, layered approach  involving many different solutions, including: educational efforts, technological empowerment tools, social norms, public and watchdog pressure, industry best practices and self-regulation, transparency, torts and products liability law, and targeted enforcement of existing legal standards as needed.

Generally speaking, patience, humility, and forbearance by policymakers is crucial to allowing greater innovation and consumer choice in this arena. Importantly, policymakers should not forget that societal and individual adaptation will play a role here, just as it has during so many other turbulent technological transformations.

On Thursday, it was my great pleasure to present a draft of my forthcoming paper, “The Internet of Things & Wearable Technology: Addressing Privacy & Security Concerns without Derailing Innovation,” at a conference that took place at the Federal Communications Commission on “Regulating the Evolving Broadband Ecosystem.” The 3-day event was co-sponsored by the American Enterprise Institute and the University of Nebraska College of Law.

The 65-page working paper I presented is still going through final peer review and copyediting, but I posted a very rough first draft on SSRN for conference participants. I expect the paper to be released as a Mercatus Center working paper in October and then I hope to find a home for it in a law review. I will post the final version once it is released. [UPDATE:The final version of this working paper was released on November 19, 2014.]

In the meantime, however, I thought I would post the 46 slides I presented at the conference, which offer an overview of the nature of the Internet of Things and wearable technology, the potential economic opportunities that exist in this space, and the various privacy and security challenges that could hold this technological revolution back. I also outlined some constructive solutions to those concerns. I plan to be very active on these issues in coming months.

Is Privacy an Unalienable Right? Last week, it was my great pleasure to be invited on NPR’s “On Point with Tom Ashbrook,” to debate Jeffrey Rosen, a leading privacy scholar and the president and chief executive of the National Constitution Center. In an editorial in the previous Sunday’s New York Times (“Madison’s Privacy Blind Spot”), Rosen proposed “constitutional amendment to prohibit unreasonable searches and seizures of our persons and electronic effects, whether by the government or by private corporations like Google and AT&T.” He said his proposed amendment would limit “outrageous and unreasonable” collection practices and would even disallow consumers from sharing their personal information with private actors even if they saw an advantage in doing so.

I responded to Rosen’s proposal in an essay posted on the IAPP  Privacy Perspectives blog, “Do We Need A Constitutional Amendment Restricting Private-Sector Data Collection?” In my essay, I argued that there are several legal, economic, and practical problems with Rosen’s proposal. You can head over to the IAPP blog to read my entire response but the gist of it is that “a constitutional amendment [governing private data collection] would be too sweeping in effect and that better alternatives exist to deal with the privacy concerns he identifies.” There are very good reasons we treat public and private actors differently under the law and there “are all far more practical and less-restrictive steps that can be taken without resorting to the sort of constitutional sledgehammer that Jeff Rosen favors. We can protect privacy without rewriting the Constitution or upending the information economy,” I concluded.

But I wanted to elaborate on one particular thing I found particularly interesting about Rosen’s comments when we were on NPR together. During the show, Rosen kept stressing how we needed to adopt a more European construction of privacy as “dignity rights” and he even said his proposed privacy amendment would even disallow individuals from surrendering their private data or their privacy because he viewed these rights as “unalienable.” In other words, from Rosen’s perspective, privacy pretty much trumps  everything, even if you want to trade it off against other values. 

Privacy Paternalism?

I’ve been seeing more and more privacy advocates and scholars adopt this attitude, including Anita Allen, Julie Cohen, Siva Vaidhyanathan, and others. Allen, for example, says that privacy is such a “foundational” human right that it some cases the law should override individual choice when consumers act against their own privacy interests. Cohen and Vaidhyanathan make similar arguments in their recent books. Vaidhyanathan claims that consumers are being tricked by the “smokescreen” of “free” online services and “freedom of choice.” Although he admits that no one is forced to use online services and that consumers are also able to opt-out of most of services or data collection practices, he argues that “such choices mean very little” because “the design of the system rigs it in favor of the interests of the company and against the interests of users.” “Celebrating freedom and user autonomy is one of the great rhetorical ploys of the global information economy,” he says.“We are conditioned to believe that having more choices–empty though they may be–is the very essence of human freedom. But meaningful freedom implies real control over the conditions of one’s life.” These are the sort of arguments I increasingly hear made by privacy scholars when claiming that consumers simply can’t be left free to make choices for themselves in this regard.  In an interesting recent article in the Harvard Law Review , privacy scholar  Daniel Solove notes that what binds these thinkers and their work together is, in essence, a sort of privacy paternalism. The point of most modern privacy advocacy has been to better empower consumers to make privacy decisions for themselves. But, Solove notes, “t he implication [of these privacy scholar’s work] is that the law must override individual consent in certain instances.” Yet, if that choice is taken away from us by law, Solove notes, then privacy regulation, “risks becoming too paternalistic. Regulation that sidesteps consent denies people the freedom to make choices,” Solove argues.

Jeff Rosen now appears to be adopting the sort of approach Solove identifies by claiming that privacy is an “unalienable right” such that it cannot be traded away for other things. By making that choice for us, Rosen’s proposed amendment would, therefore, suffer from that same sort of privacy paternalism Solove identifies. In a forthcoming law review aritcle that will appear in the  Maine Law Review, I identify some of the problems associated with privacy paternalism. Most obviously, these scholars should keep in mind that not everyone shares the same privacy values as they do and that many of us will voluntarily trade some of our data for the innovative information services and devices that we desire. If imposed in the form of legal sanctions, privacy paternalism would open the door to almost boundless controls on the activities of both producers and consumers of digital services, potentially limiting future innovations in this space.

For example, when we were on  NPR together, Rosen mentioned wireless geolocation technology as a potential source of serious privacy harm, although he did not make it clear whether he wanted it stopped entirely or what. If used improperly, wireless geolocation technology certainly can raise serious privacy concerns. But wireless geolocation technology is also what powers the mapping and traffic services that most of us now take for granted. Many of us expect — no, we demand — that our digital devices be able to give us real-time mapping and traffic notification capabilities. And most of us are willing to make the minor privacy trade-off associated with sharing our location constantly in exchange for the right to receive these services, which are also provided to us free of charge.

So, what would Rosen’s proposed amendment have to say about this trade-off? Would these wireless geolocation technologies be banned altogether, even if consumers desire them? It isn’t really clear at this point because he hasn’t offered us many details about his proposal. But, to the extent it would preempt these technological capabilities on the grounds that our locational privacy is somehow in unalienable right, then that seems like a fairly paternalistic approach to policy and it it would seem to confirm Thomas Lenard and Paul Rubin’s claim that “many of the privacy advocates and writers on the subject do not trust the consumers for whom they purport to advocate.”

Such paternalism is particularly problematic in this case since privacy is such a highly subjective value and one that evolves over time. As Solove notes, “the correct choices regarding privacy and data use are not always clear. For example, although extensive self-exposure can have disastrous consequences, many people use social media successfully and productively.” Privacy norms and ethics are changing faster than ever today. One day’s “creepy” tool or service is often the next day’s “killer app.”

Balancing Values; Considering Costs

As I will discuss in my forthcoming  Maine Law Review article and I also discussed in my recent George Mason University Law Review  article, at least here in the United States, consumer protection standards have traditionally depended on a clear showing of actual, not prospective or hypothetical, harm. In some cases, when the potential harm associated with a particular practice or technology is extreme in character and poses a direct threat to physical well-being, law has preempted the general presumption that ongoing experimentation and innovation should be allowed by default. But these are extremely rare scenarios, at least as it pertains to privacy concerns under American law, and they mostly involved health and safety measures aimed at preemptively avoiding catastrophic harm to individual or environmental well-being. In the vast majority of other cases, our culture has not accepted that paternalistic idea that law must “save us from ourselves” (i.e., our own irrationality or mistakes). As Solove notes in his recent essay, “People make decisions all the time that are not in their best interests. People relinquish rights and take bad risks, and the law often does not stop them.” Sometimes privacy advocates also ignore the costs of preemptive policy action and don’t bother conducting a serious review of the potential costs of their regulatory proposals. As a result, preemptive policy action is almost always the preferred remedy to any alleged harm. “By limiting or conditioning the collection of information, regulators can limit market manipulation at the activity level,” Ryan Calo argues in a recent paper. “We could imagine the government fashioning a rule — perhaps inadvisable for other reasons―that limits the collection of information about consumers in order to reduce asymmetries of information.” [*Clarification: In a comment down below and a subsequent Twitter exchange, Ryan clarifies that he ultimately does not come down in favor of such a rule, preferring instead to find various other incentives to solve these problems. I thank him for this clarification — and definitely welcome it! — although I found his position somewhat murky after debating him personally on these issues recently. Nonetheless, I apologize if I mischaracterized his position in any way here.]

Unfortunately, Professor Calo does not fully consider the corresponding cost of such regulatory proposals in calling for the enactment of such a rule. If preemptive regulation slowed or ended certain information practices, it could stifle the provision of new and better services that consumers demand, as I have noted elsewhere. It might also trump other choices or values that consumers care about. While privacy is obviously an incredibly important value, we cannot assume that it is the only value, or the most important value, at stake here. Consumers also care about having access to a constantly growing array of innovative goods and services, and they also care about getting those goods and services at a reasonable price.

Moving from “Rights Talk” to Practical Privacy Solutions

This is the point in the essay where some readers are getting pretty frustrated with me and thinking I am some sort of nihilist who doesn’t give a damn about privacy. I assure you that nothing is further from the truth and that I care very deeply about privacy.

But if you really care about expanding the horizons of privacy protection in our modern world, at some point you have to accept that all the “rights talk” and top-down enforcement efforts in the world are not necessarily going to help as much as you wish they would. The same thing is true for online safety, digital security, and IP protection efforts: No matter how much you might wish the opposite was true, information control is just really, really hard. Legal and regulatory approaches to bottling up information flows will inevitably be several steps behind cutting-edge technological developments. (I’ve discussed these issues in several essays here, including: “Privacy as an Information Control Regime: The Challenges Ahead,” “Copyright, Privacy, Property Rights & Information Control: Common Themes, Common Challenges,” and “When It Comes to Information Control, Everybody Has a Pet Issue & Everyone Will Be Disappointed.”)

That doesn’t mean we should surrender in our efforts to identify more concrete privacy harms, but we should recognize that it will always be a hugely contentious matter and that a great many people will gladly trade away their privacy in a way that others will consider outrageous. In a free society, we must allow them to do so if they derive greater utility from other things. A paternalistic approach based on a sort of privacy fundamentalism will deny them the right to make that choice for themselves. And, practically speaking, no matter how much some might think that privacy values are “unalienable,” the reality is that there will be no way to stop many others from making different choices and relinquishing their privacy all the time.

Educating and empowering citizens is the better way to address this issue. We can try to teach them to make better privacy choices and treat their information, and information about others, with far greater care. We should also work to provide citizens more tools to help accomplish those goals. And if the problem is “information asymmetry” or some general lack of awareness about certain data collection and use practices, then let’s work even harder to make sure consumers are aware of those practices and what they can do about them.

It’s all part of the media literacy and digital citizenship agenda that we need to be investing much more of time and resources into. I outlined that approach in much more detail in this law review article. We need diverse tools and strategies for a diverse citizenry. We need to be talking to both consumers and developers about smarter data hygiene and sensible digital ethics. We need more transparency. We need more privacy privacy professionals working inside organizations to craft sensible data collection and use policies. And so on. Only by working to change attitudes about privacy, online “Netiquette,” and more ethical data use, can we really start to make a dent in this problem.

If nothing else, we must understand the limitations of information control in such highly context-specific harm scenarios. Prof. Rosen might want to ask himself how long it would take to even get his proposed constitutional amendment in place and what the chances are such a movement would even been successful. But, again, and far more importantly, Prof. Rosen and advocates of similar regulatory approaches should remember that their values are not shared by everyone and that, in a free society, a value as inherently subjective as privacy is likely to remain a hugely contentious, every-changing matter, especially when elevated to the level of constitutional rights talk. We need practical solutions to our privacy problems, not pie-in-the-sky Hail Mary schemes that are unlikely to go anywhere and, even if they did, would end up being too heavy-handed and potentially override individual autonomy in the process.

GMLR coverI’m pleased to announce the release of my latest law review article, “A Framework for Benefit-Cost Analysis in Digital Privacy Debates.” It appears in the new edition of the George Mason University Law Review. (Vol. 20, No. 4, Summer 2013)

This is the second of two complimentary law review articles I am releasing this year dealing with privacy policy. The first, “The Pursuit of Privacy in a World Where Information Control is Failing,” was published in Vol. 36 of the Harvard Journal of Law & Public Policy this Spring. (FYI: Both articles focus on privacy claims made against private actors — namely, efforts to limit private data collection — and not on privacy rights against governments.)

My new article on benefit-cost analysis in privacy debates makes a seemingly contradictory argument: benefit-cost analysis (“BCA”) is extremely challenging in online child safety and digital privacy debates, yet it remains essential that analysts and policymakers attempt to conduct such reviews. While we will never be able to perfectly determine either the benefits or costs of online safety or privacy controls, the very act of conducting a regulatory impact analysis (“RIA”) will help us to better understand the trade-offs associated with various regulatory proposals.

However, precisely because those benefits and costs remain so remarkably subjective and contentious, I argue that we should look to employ less-restrictive solutions — education and awareness efforts, empowerment tools, alternative enforcement mechanisms, etc. — before resorting to potentially costly and cumbersome legal and regulatory regimes that could disrupt the digital economy and the efficient provision of services that consumers desire. This model has worked fairly effectively in the online safety context and can be applied to digital privacy concerns as well.

The article is organized as follows. Part I examines the use of BCA by federal agencies to assess the utility of government regulations. Part II considers how BCA can be applied to online privacy regulation and the challenges federal officials face when determining the potential benefits of regulation. Part III then elaborates on the cost considerations and other trade-offs that regulators face when evaluating the impact of privacy-related regulations. Part IV discusses alternative measures that can be taken by government regulators when attempting to address online safety and privacy concerns. This article concludes that policymakers must consider BCA when proposing new rules but also recognize the utility of alternative remedies such as education and awareness campaigns, to address consumer concerns about online safety and privacy.

Black Code coverRonald J. Deibert is the director of The Citizen Lab at the University of Toronto’s Munk School of Global Affairs and the author of an important new book, Black Code: Inside the Battle for Cyberspace, an in-depth look at the growing insecurity of the Internet. Specifically, Deibert’s book is a meticulous examination of the “malicious threats that are growing from the inside out” and which “threaten to destroy the fragile ecosystem we have come to take for granted.” (p. 14) It is also a remarkably timely book in light of the recent revelations about NSA surveillance and how it is being facilitated with the assistance of various tech and telecom giants.

The clear and colloquial tone that Deibert employs in the text helps make arcane Internet security issues interesting and accessible. Indeed, some chapters of the book almost feel like they were pulled from the pages of techno-thriller, complete with villainous characters, unexpected plot twists, and shocking conclusions. “Cyber crime has become one of the world’s largest growth businesses,” Deibert notes (p. 144) and his chapters focus on many prominent recent examples, including cyber-crime syndicates like Koobface, government cyber-spying schemes like GhostNet, state-sanctioned sabotage like Stuxnet, and the vexing issue of zero-day exploit sales.

Deibert is uniquely qualified to narrate this tale not just because he is a gifted story-teller but also because he has had a front row seat in the unfolding play that we might refer to as “How Cyberspace Grew Less Secure.” Indeed, he and his colleagues at The Citizen Lab have occasionally been major players in this drama as they have researched and uncovered various online vulnerabilities affecting millions of people across the globe. (I have previously reviewed and showered praise on a couple important books that Deibert co-edited with scholars from The Citizen Lab and Harvard’s Berkman Center, including: Access Controlled: The Shaping of Power, Rights, and Rule in Cyberspace and Access Denied: The Practice and Policy of Global Internet Filtering. They are truly outstanding resources worthy of your attention.)

Black Code’s Many Meanings

So, what is “black code” and why should we be worried about it? Deibert uses the term as a metaphor for many closely related concerns. Most generally it includes “that which is hidden, obscured from the view of the average Internet user.” (p. 6) More concretely, it refers to “the criminal forces that are increasingly insinuating themselves into cyberspace, gradually subverting it from the inside out.” (p. 7) “Those who take advantage of the Internet’s vulnerabilities today are not just juvenile pranksters or frat house brats,” Deibert notes, “they are organized criminal groups, armed militants, and nation states.” (p. 7-8) Which leads to the final way Deibert uses the term “black code.” It also, he says, “refers to the growing influence of national security agencies, and the expanding network of contractors and companies with whom they work.” (p. 8)

Deibert is worried about the way these forces and factors are working together to undermine online stability and security, and even delegitimize liberal democracy itself. His thesis is probably most succinctly captured in this passage from Chapter 7:

We live in an era of unprecedented access to information, and many political parties campaign on platforms of transparency and openness. And yet, at the same time, we are gradually shifting the policing of cyberspace to a dark world largely free from public accountability and independent oversight. In entrusting more and more information to third parties, we are signing away legal protections that should be guaranteed by those who have our data. Perversely, in liberal democratic countries we are lowering the standards around basic rights to privacy just as the center of cyberspace gravity is shifting to less democratic parts of the world. (p. 130-1)

What Deibert is grappling with in this book is the same fundamental problem that has long plagued the Internet: How do you preserve the benefits associated with the most open and interconnected “network of networks” the world has ever known while also remedying the various vulnerabilities and pathologies created by that same openness and interconnectedness?  Deibert acknowledges this problem, noting:

Ever since the Internet emerged from the world of academia into the world of the rest of us, its growth trajectory has been shadowed by a grey economy that thrives on opportunities for enrichment made possible by an open, globally connected infrastructure. (p. 141)

The Paradox of the Net’s Open, Interconnected Nature

Again, paradoxically, this inherent instability and vulnerability is due precisely to the Net’s open and globally interconnected nature. And many governments are looking to exploit that fact. “These unfortunate by-products of an open, dynamic network are exacerbated by increasing assertions of state power,” Deibert notes. (p. 233)

More generally, this uncomfortable fact—that the Net’s open, interconnected nature leads to both enormous benefits as well as huge vulnerabilities—isn’t just true for criminal online activity or the cyber-espionage activities that various nation-states are pursuing today. It is equally true for everything online today. There is a sort of yin and the yang to the Net that is simply undeniable and completely unavoidable. For one issue after another we find that the Net’s greatest blessing—its open, interconnected nature—is also its greatest curse.

For example, as I noted here recently in my review of Abraham H. Foxman and Christopher Wolf ‘s new book, Viral Hate: Containing Its Spread on the Internet, the open and interconnected Internet gives us “the most widely accessible, unrestricted communications platform the world has ever known” but also  means we have to tolerate a great many imbeciles “who use it to spew insulting, vile, and hateful comments.” The same is true for other types of online speech and content: You have access to an abundance of informational riches, but there’s also no avoiding all the garbage out there now, too.

Similarly, as I noted in my essay, “Privacy as an Information Control Regime: The Challenges Ahead,” the open and interconnected Internet has given us historically unparalleled platforms for social interaction and commerce. But that same openness and interconnectedness has left us with a world of hyper-exposure and a variety of privacy and surveillance threats—not just from governments and large corporations, but also from each other.

And then there’s the never-ending story of digital copyright. On one hand, the open and globally interconnected network or networks has provided us with an amazing platform for sharing knowledge, art, and expression. On the other hand, as I noted in this essay on “The Twilight of Copyright,” creators of expressive works have less security than ever before in terms of how they can control and monetize their artistic and scientific inventions.

I could go on and on—as I did in my essays on “Copyright, Privacy, Property Rights & Information Control: Common Themes, Common Challenges” and “When It Comes to Information Control, Everybody Has a Pet Issue & Everyone Will Be Disappointed”—but the moral of the story is pretty clear: The Internet giveth and the Internet taketh away. Openness and interconnectedness offer us enormous benefits but also force us to confront major risks as the price of admission to this wonderful network.

Will the Whole System Collapse?

The uncomfortable question that Deibert’s book tees up for discussion is: When will this balance get completely out of whack in terms of online security? Or, has it already? In some portions of the text, he hints that may already be the case. Consider this passage in Chapter 11 in which Deibert discusses whether the Chicken Little-ism of digital security worry-warts like Eugene Kaspersky and Richard Clarke is warranted:

Eugene Kaspersky, Richard Clarke, and others may sound like broken records or self-serving fear mongers, but there is no denying the evolving cyberspace ecosystem around us: we are building a digital edifice for the entire planet, and it sits above us like a house of cards. We are wrapping ourselves in expanding layers of digital instructions, protocols, and authentication mechanisms, some them open scrutinized, and regulated, but many closed, amorphous, and poised for abuse, buried in the black arts of espionage, intelligence gathering, and cyber and military affairs. Is it only a matter of time before the whole system collapses? (p. 186)

That sounds horrific, but is it really the case that the entire system really about to collapse? And, if so, what are we going to do about it?

This raises a small problem with Deibert’s book. He does such a nice job itemizing and describing these security vulnerabilities that by the time the reader wades through 230 pages and nears the end of the book, they are left in a highly demoralized state, searching for some hope and a concrete set of practical solutions. Unfortunately, they won’t find an abundance of either in Deibert’s brief closing chapter, “Toward Distributed Security and Stewardship in Cyberspace.”

Don’t get me wrong; I agree with the general thrust of Deibert’s framework, which I describe below. The problem is that it is highly aspirational in nature and lacks specifics. Perhaps that is simply because there are no easy answers here. Digital security is damn hard and, as with most other online pathologies out there, no silver-bullet solutions exist.

Deibert notes that some government officials will seek to exploit those vulnerabilities—many of which they created themselves—to expand their authority over the Internet. “Faced with mounting problems and pressures to do something, too many policy-makers are tempted by extreme solutions,” he notes. (p. 234) He worries about “a movement towards clamp down” that would be “antithetical to the principles of liberal democratic government” by undermining checks and balances and accountability. (p. 235) In turn, this will undermine the “mixed common-pool resource” that is the current Internet.

Deibert’s alternative cyber security strategy to counter the push to “clamp down” is based on three interrelated notions or components:

  1. Principles of restraint or “mutual restraint”: “Securing cyberspace requires a reinforcement, rather than a relaxation, of restraint on power, including checks and balances on governments, law enforcement, intelligence agencies, and on the private sector,” he argues. (p. 239)
  2. “Distributed security”: “The Internet functions precisely because of the absence of centralized control, because of thousands of loosely coordinated monitoring mechanisms,” Deibert notes. “While these decentralized mechanisms are not perfect and can occasionally fail, they form the basis of a coherent distributed security strategy. Bottom-up, ‘grassroots’ solutions to the Internet’s security problems are consistent with principles of openness, avoid heavy-handedness, and provide checks and balances against the concentrations of power,” he observes. (p. 240)
  3. “Stewardship” which Deibert defines as “an ethic of responsible behavior in regard to shared resources” and which, he argues, “would moderate the dangerously escalating exercise of state power in cyberspace by defining limits and setting thresholds of accountability and mutual restraint.” (p. 243)

Again, as an aspirational vision statement this all generally sounds fairly sensible, but the details are lacking. I think Deibert would have been wise to spend a bit more time developing this alternative “bottom-up” vision of how online security should work and bolstering it with case studies.

Digital Security without Top-Down Controls

Luckily, as my Mercatus Center colleague Eli Dourado noted in an important June 2012 white paper, distributed security and stewardship strategies are already working reasonably well today. Dourado’s paper, “Internet Security Without Law: How Service Providers Create Order Online,” documented the many informal institutions that enforce network security norms on the Internet and shows how cooperation among a remarkably varied set of actors improves online security without extensive regulation or punishing legal liability. “These informal institutions carry out the functions of a formal legal system—they establish and enforce rules for the prevention, punishment, and redress of cybersecurity-related harms,” Dourado noted.

For example, a diverse array of computer security incident response teams (CSIRTs) operates around the globe and share their research and coordinate their responses to viruses and other online attacks. Individual Internet service providers (ISPs), domain name registrars, and hosting companies, work with these CSIRTs and other individuals and organizations to address security vulnerabilities. A growing market for private security consultants and software providers also competes to offer increasingly sophisticated suites of security products for businesses, households, and governments.

A great deal of security knowledge is also “crowd-sourced” today via online discussion forums and security blogs that feature contributions from experts and average users alike. University-based computer science and cyberlaw centers (like Citizen Lab) and experts have also helped by creating projects like “Stop Badware,” which originated at Harvard University but then grew into a broader non-profit organization with diverse financial support.

Dourado continues on in his paper to show how these informal, bottom-up efforts to coordinate security responses offer several advantages over top-down government solutions, such as administrative regulation or punishing liability regimes.

Dourado’s description of the ideal approach to online security is entirely consistent with Deibert’s vision in Black Code. In fact, Deibert notes, “It is important to remind ourselves that in spite of the threats, cyberspace runs well and largely without persistent disruption. On a technical level, this efficiency is founded on open and distributed networks of local engineers who share information as peers,” he observes. (p. 240) That is exactly right, but I wish Deibert would have spent more time discussing how this system works in practice today and how it can be tweaked and improved to head off the heavy-handed and very costly top-down solutions that we both dread.

Toward Resiliency

But there’s one other thing I wish Deibert would have explored in the book: resiliency, or how we have adapted to various cyber-vulnerabilities over time.

For example, in another recent Mercatus Center study entitled “Beyond Cyber Doom: Cyber Attack Scenarios and the Evidence of History,” Sean Lawson, an assistant professor in the Department of Communication at the University of Utah, has stressed the importance of resiliency as it pertains to cybersecurity and concerns about “cyberwar.” “Research by historians of technology, military historians, and disaster sociologists has shown consistently that modern technological and social systems are more resilient than military and disaster planners often assume,” he writes. “Just as more resilient technological systems can better respond in the event of failure, so too are strong social systems better able to respond in the event of disaster of any type.”

More generally, as I noted in my recent law review article on “technopanics” and “threat inflation” in information technology policy debates:

while it is certainly true that “more could be done” to secure networks and critical systems, panic is unwarranted because much is already being done to harden systems and educate the public about risks. Various digital attacks will continue, but consumers, companies, and others organizations are learning to cope and become more resilient in the face of those threats.

What Professor Lawson and I are getting at in our respective articles is that the ability of organizations, institutions, and individuals to bounce back from adversity is a frequently unheralded feature of various systems and that it deserves more serious study. (See Andrew Zolli and Ann Marie Healy’s nice book, Resilience: Why Things Bounce Back, for more on this general topic). In the context of online security, what is most remarkable to me is not that the Internet suffers from vulnerabilities due to its open and interconnected nature; it’s that we don’t suffer far more damage as a result.

This gets us back to that very profound question that Deibert poses in Black Code: “Is it only a matter of time before the whole system collapses?” The better question, I think, is: why hasn’t the system already collapsed? Perhaps the answer is, because things haven’t gotten bad enough yet. But I believe that the more realistic answer is that: individuals and institutions often learn how to cope and become resilient in the face of adversity. This is partially the case online because of the stewardship and distributed, decentralized security we already see at work today that makes digital life tolerable.

But it has to be something more than that. After all, many of the security problems that Deibert describes in his book are quite serious and already affect millions of us today. How, then, are we getting by right now? Again, I think the answer has to be that adaptation and resiliency are at work on many different levels of online life.

Consider, for example, how we have learned to deal with spam, viruses, online porn, various online advertising and privacy concerns, and so on. Our adaptation to these threats and annoyances has not been perfectly smooth, of course. No doubt, some people would still like “something to be done” about these things. But isn’t it remarkable how we have, nonetheless, carried on with online commerce and interactive social life even as these problems have persisted?

Conclusion

Going forward, therefore, perhaps there are some reasons for hope. Perhaps the various generic strategies that Deibert outlines in his book, coupled with the remarkable ability of humans to roll with the punches and adapt, will help us come out of this just fine (or at least reasonably well).

Of course, it could also be the case that these security concerns just multiply and that the Internet then morphs into sometime quite different than the interconnected “network of networks” we know today. As I noted in my 2009 essay on “Internet Security Concerns, Online Anonymity, and Splinternets,” we might be moving toward a world with more separate dis­connected digital networks and online “gated communities.” This could take place spontaneously over time and be driven by corporations seeking to satisfy the demand of some consumers for safer and more secure online experiences. As I noted in my review of Jonathan Zittrain’s book, The Future of the Internet, I am actually fine with some of that. I think we can live in a hybrid world of “walled gardens” alongside of the “Wild West” open Internet, so long as this occurs in a spontaneous, organic, bottom-up fashion. If, however, this “splintering” of the Net is done from the top-down through intentional (or even incidental) government action, then it is far more problematic. We already see signs, for example, that Russia is pushing even more strongly in that direction in the wake of the NSA leaks. (See “N.S.A. Leaks Revive Push in Russia to Control Net,” New York Times, July 14.) The Russians have been using amorphous security concerns to push for greater Internet control for some time now. Of course, China has been there for years. So have many Middle Eastern countries. Of course, there’s no guarantee that their respective “splinternets” are, or would be, any more secure than today’s Internet, but it sure would make those networks far more susceptible to state control and surveillance. If that’s our future, then it certainly is a dismal one.

Anyway, read Ron Deibert’s Black Code for an interesting exploration of these and other issues. It’s an excellent contribution to field of Internet policy studies and a book that I’ll be recommending to others for many years to come.

HJLPP coverI’m excited to announce the release of my latest law review article, “The Pursuit of Privacy in a World Where Information Control is Failing,” which appears in the next edition (vol. 36) of the Harvard Journal of Law & Public Policy. This is the first of two complimentary law review articles that I will be releasing this year dealing with privacy policy. The second, which will be published later this summer by the George Mason University Law Review, is entitled, “A Framework for Benefit-Cost Analysis in Digital Privacy Debates.” (FYI: Both articles focus on privacy claims made against private actors — namely, efforts to limit private data collection — and not on privacy rights against governments.)

The new Harvard Journal article is divided into three major sections. Part I focuses on some of normative challenges we face when discussing privacy and argues that there may never be a widely accepted, coherent legal standard for privacy rights or harms here in the United States. It also explores the tensions between expanded privacy regulation and online free speech. Part II turns to the many enforcement challenges that are often ignored when privacy policies are being proposed or formulated and argues that legislative and regulatory efforts aimed at protecting privacy must now be seen as an increasingly intractable information control problem. Most of the problems policymakers and average individuals face when it comes to controlling the flow of private information online are similar to the challenges they face when trying to control the free flow of digitalized bits in other information policy contexts, such as online safety, cybersecurity, and digital copyright.

If the effectiveness of law and regulation is limited by the normative considerations discussed in Part I and the practical enforcement complications discussed in Part II, what alternatives remain to assist privacy-sensitive individuals? I address that question in Part III of the paper and argue that the approach America has adopted to deal with concerns about objectionable online speech and child safety offers a path forward on the privacy front as well. A so-called “3-E” solution that combines consumer education, user empowerment, and selective enforcement of existing targeted laws and other legal standards (torts, anti-fraud laws, contract law, and so on), has helped society achieve a reasonable balance in terms of addressing online safety while also safeguarding other important values, especially freedom of expression.  That does not mean perfect online safety exists, not only because the term means very different things to different people, but because it would be impossible to achieve in the first instance as a result of information control complications. But the “3-E” approach has the advantage of enhancing online safety without sweeping regulations being imposed that could undermine the many benefits information networks and online services offer individuals and society.  This same framework can guide online privacy decisions—both at the individual household level and the public policy level.

Andrew Orlowski of The Register (U.K.) recently posted a very interesting essay making the case for treating online copyright and privacy as essentially the same problem in need of the same solution: increased property rights. In his essay (“‘Don’t break the internet’: How an idiot’s slogan stole your privacy“), he argues that, “The absence of permissions on our personal data and the absence of permissions on digital copyright objects are two sides of the same coin. Economically and legally they’re an absence of property rights – and an insistence on preserving the internet as a childlike, utopian world, where nobody owns anything, or ever turns a request down. But as we’ve seen, you can build things like libraries with permissions too – and create new markets.” He argues that “no matter what law you pass, it won’t work unless there’s ownership attached to data, and you, as the individual, are the ultimate owner. From the basis of ownership, we can then agree what kind of rights are associated with the data – eg, the right to exclude people from it, the right to sell it or exchange it – and then build a permission-based world on top of that.”

And so, he concludes, we should set aside concerns about Internet regulation and information control and get down to the business of engineering solutions that would help us property-tize both intangible creations and intangible facts about ourselves to better shield our intellectual creations and our privacy in the information age. He builds on the thoughts of Mark Bide, a tech consultant:

For Bide, privacy and content markets are just a technical challenges that need to be addressed intelligently.”You can take two views,” he told me. “One is that every piece of information flowing around a network is a good thing, and we should know everything about everybody, and have no constraints on access to it all.” People who believe this, he added, tend to be inflexible – there is no half-way house. “The alternative view is that we can take the technology to make privacy and intellectual property work on the network. The function of copyright is to allow creators and people who invest in creation to define how it can be used. That’s the purpose of it. “So which way do we want to do it?” he asks. “Do we want to throw up our hands and do nothing? The workings of a civilised society need both privacy and creator’s rights.”  But this a new way of thinking about things: it will be met with cognitive dissonance. Copyright activists who fight property rights on the internet and have never seen a copyright law they like, generally do like their privacy. They want to preserve it, and will support laws that do. But to succeed, they’ll need to argue for stronger property rights. They have yet to realise that their opponents in the copyright wars have been arguing for those too, for years. Both sides of the copyright “fight” actually need the same thing. This is odd, I said to Bide. How can he account for this irony? “Ah,” says Bide. “Privacy and copyright are two things nobody cares about unless it’s their own privacy, and their own copyright.”

These are important insights that get at a fundamental truth that all too many people ignore today: At root, most information control efforts are related and solutions for one problem can often be used to address others. But there’s another insight that Orlowski ignores: Whether we are discussing copyright, privacy, online speech and child safety, or cybersecurity, all these efforts to control the free flow of digitized bits over decentralized global networks will be increasingly complex, costly, and riddled with myriad unintended consequences. Importantly, that is true whether you seek to control information flows through top-down administrative regulation or by assigning and enforcing property rights in intellectual creations or private information.

Let me elaborate a bit (and I apologize for the rambling mess of rant that follows).

Parallels in Debates over Copyright & Privacy Protection

In several essays here over the past few years I have attempted to draw parallels between the battles over protecting digital copyright and online privacy, as well as battle over online safety/speech and cybersecurity. Here are a few of those essays in case you’re interested in seeing the evolution of my thinking about this:

In those essays I have argued that a combination of selective morality and wishful thinking are at work in the information policy world these days. In essence, people hate Internet regulation… until they love it! Here’s how I summarized that fact during the debate over SOPA:

… conservatives rush out and breathlessly denounce each and every effort to impose Net neutrality regulation because of the danger of empowering an already over-zealous bunch of bumbling bureaucrats at the FCC. (And I agree with them.) Yet, with their next breath many conservatives praise SOPA even though it also empowers government to muck with the inner workings of the Internet. Some of those conservatives are also turning a blind eye to the growing appetite of the defense/security community to meddle with the Net’s architecture in the name of avoiding any number of non-catastrophes. Meanwhile, the liberals decry SOPA and want it stopped at all costs. There’s never been a copyright protection measure they liked, of course, but each time one pops up we hear them claim that our analog era Congress is not well-positioned to be designing industrial policy schemes for the Internet. (And I generally agree with them.) But most liberals do a complete 180 whenever online privacy or Net neutrality regulations are the subject of congressional inquiry. Suddenly, the cyber-oafs in Congress are considered veritable technocratic philosopher kings who we should trust to guard our cyber-freedoms to lead us to the digital promised land.

Again, it’s both selective morality and wishful thinking. It’s selective morality in that some folks think certain values are sacrosanct and deserving of a “by-any-means-necessary” enforcement attitude, yet they are often just as likely to denounce similar information control efforts when it comes to issues or values they don’t give a damn about.  And it is wishful thinking in that you can’t run around insisting that “information wants to be free” in some contexts but then express outrage when something that you want to bottle up turns out to “just want to be free” as well!

But the important takeaway here is that, consistent with what Orlowski argues, I believe that online copyright and privacy are essentially the same problem: It’s an information control problem.

Potential Costs of Control

Once you start thinking about Internet policy debates as a single issue — namely, information control — you can begin to investigate the potential costs of control in a somewhat more objective fashion. Of course, challenging issues remain:

  1. Which method of control should we choose? On one hand, there are many varieties of administrative regulation, technical infrastructure controls, and device mandates. On the other hand, there are property rights and liability / tort schemes. And there are many hybrid enforcement models, such as increasingly popular “co-regulation” models, government standard-setting, and “nudging” of system defaults. Each method will entail different costs and trade-offs.
  2. What metric(s) should we use when attempting to determine whether the benefits of control exceed the costs? Ask any advocate of information control about whether the costs might exceed the benefits of regulation for their pet issue and they will typically suggest that either (a) there are no costs or that (b) the benefits dwarf any costs that may exist. But all too often the benefits they identify are extremely subjective and amorphous in character (“privacy,” “safety,” and “security” are hard to quantify, after all) while the costs are very real and increasingly substantial.

In my view, these practical questions are increasingly the most interesting issues to explore in the field of cyberlaw and digital economics. We can debate the normative or ethical considerations until we’re all blue in the face and ready to rip each other’s heads off, but I am less and less interested in such squabbles. Instead, I keep coming back to the question of how we’ll go about controlling info flows and how much effort and resources it makes sense to expend in pursuit of each of the values identified above. Some of the specific considerations I find myself asking in every paper I write these days include:

(A) Will the proposed form of information control tie us up in the courts forever, lead to increasingly onerous and unworkable liability norms, and end up yielding outrageous litigation costs?

(B) Will the proposed form of information control require a significant increase in regulatory bureaucracy? How many levels of government will need to be involved in the proposed enforcement scheme? How many new offices and officials will need to be empowered in the hope of achieving some measure of control?

(C) What are the alternatives to the proposed form of information control? Are there less costly or less restrictive means of addressing the concern in question? For example, education and empowerment effort are often an effective way to address many online safety and digital privacy concerns. Can we use those methods in conjunction with social norms, public pressure, self-regulation, informal contracting, and other methods to address these and other concerns?

For me, the costs associated with the A & B are increasing so rapidly that I almost always default to C as the better approach. Importantly, although A & B will be less onerous or costly when the solution is of the increased property-ization variety than of the administrative regulation variety, that does not mean property rights-based solutions for information are costless. Indeed, I increasingly find myself concluding that C solutions are more cost-effective even compared to increased property rights.

Practical Advice Once You Accept the Increasing Costs & Complications of Control

At this point, readers may be thinking: “Wait a minute, this dude is just some kooky libertarian who doesn’t want any form of information control, so he’s just trying to rationalize anarchy here.” No, I’m not. I certainly favor less control across the board than most people, but I also understand that there are times, at the margin, when some forms of “control” are necessary. But my views on the wisdom of control are heavily influenced by the costs of control. The costs of control — broadly defined — are a key factor in every cost-benefit analysis I do related to the wisdom of Net regulation and information control methods — even when one of those methods is increased “property-ization.” And because I have come to believe that those costs are going up and that most information control efforts will not work well in practice, I have boiled down my advice on this front to two simple principles:

  1. Choose your info control battles wisely. Figure out where the most serious harms or threats lie and then target the info control solution accordingly and forget about the rest. For example, in child safety debates, that would mean going after child porn rings but leaving run-of-the-mill adult porn alone entirely. In copyright, it would mean nailing the largest commercial mass piracy sites but accepting a certain amount of casual sharing. In the field of personal info, it means singling out health and financial information and data for special protections and likely giving up on most other forms of info control. And so on. In essence, these are where the greatest potential harms lie that most people would consider intolerable. As you move further away from such issues, the case for control becomes harder and harder and the costs will almost certainly exceed the benefits.
  2. Have a good backup plan in mind when those info control plans fail anyway. That backup plan should generally be based on education, empowerment, coping strategies, and resiliency. Again, these are the “C” solutions mentioned above. [I developed this model more robustly in the second half of this recent paper.] This approach won’t be perfect but it will likely be what you’ll end up relying on anyway, so you better start thinking about plowing more resources into this alternative approach even while you’re trying to devise info control mechanisms.

Let me just say a brief word to my market-oriented friends who are dismayed by my inclusion of property rights in the mix of “information control” efforts. I’m a big believer in the importance of property rights in many contexts, but context does matter. More specifically, physicality matters. It is easy to create property rights in tangible goods and almost always right to do so. Property rights in intangible ideas and creations raise special issues, however. Because ideas are non-rivalrous and have public good qualities, it makes property-ization more complicated and less effective. Property rights in facts can also come into conflict with other values and more well-established rights, especially freedom of speech and expression.

On the privacy front, Eugene Volokh made this point in his famous 2000 law review article, “Freedom of Speech, Information Privacy, and the Troubling Implications of a Right to Stop People from Speaking About You,” when he noted that, “The difficulty[with] the right to information privacy — the right to control other people’s communication of personally identifiable information about you — is a right to have the government stop people from speaking about you. And the First Amendment (which is already our basic code of “fair information practices”) generally bars the government from “control[ling the communication] of information,” either by direct regulation or through the authorization of private lawsuits.” That doesn’t mean free speech values should always trump privacy values, but denying this tension is just plain silly. If you want to propertytize all personal information, then you better be prepared to explain how that plays out in practice. How far are you prepared to go to ban the dissemination of facts? Would you place prior restraint on the press to accomplish it? Would you ban a historian from writing a biographies that reveal intimate facts about the subject? Would you shut down all the online sites and services that rely on a certain amount of personal information to fuel their free offerings?

Likewise, copyright law was far more effective in the analog age when we were still pressing music on vinyl and plastic. As soon as digitization become widespread, it was pretty much game over for traditional copyright law and now we are off and running with all sorts of convoluted and increasingly costly regulatory regimes. It’s not that I don’t want these some of these schemes to work — I’ve been a long-time copyright defender — but, again, the practicality of control simply must be considered here. I am not will to “pay any price, bear any burden” in defense of protecting intellectual property rights even as I remain outraged by the staggering amount of free-riding at work every single second of the day on the Internet. So, adopting the framework I outlined about, we might try targeted solutions to go after the biggest of those freeloaders — commercial mass piracy hubs — but we should generally avoid the sort of ham-handed technical control methods we saw in SOPA and other fights, like the broadcast flag battle among others. But, generally speaking, property rights just aren’t going to work as well in this space going forward. I’ve come to believe that the best hope lies in massive consolidation of content and conduit. In other words, pipe and device owners need to buy out all the content-creating industries and just embed a small fee in their monthly services to cross-subsidize content. This is essentially a private collective licensing solution and it is not unprecedented. Nor is it perfect. It will be very leaky. Plenty of piracy will still take place. But it will probably offer creators a better chance of finding a sustainable revenue stream than the current system does. The old copyright system that served them and us so well is dying and they had better start thinking of alternatives like this. Of course, antitrust law may never allow it, so I could be wasting my breath here. (Just look at all the grief that antitrust officials both here and abroad are giving Apple and eBook sellers for working together even though that it probably the best scheme devised in recent memory to sustain publishing in an age of mass piracy. Policymakers should be encouraging more of that sort of thing, not punishing it.)

An Uncertain Future

So, to wrap up… I can imagine a future in which both heavy-handed, top-down info control efforts and property / liability solutions are failing almost universally because of the ubiquitous, instantaneous, quicksilver-like flow of information across decentralized digital networks. Some utopians will argue that such a world will be better in every way than the one we live in today. I do not share such hyper-optimism. While I believe that, on balance, the free flow if information generally benefits society, I also understand how it creates enormous angst and intractable challenges for many. It’s a world in which copyright is a hollow shell of its former self that offers creators very little protection for their expressive works. And it’s a world in which personal privacy is harder to safeguard with each passing day because no matter how hard we try to property-tize facts about ourselves, that enforcement model simply breaks down at some point or becomes socially and economically intolerable. As with copyright, efforts to property-tize personal information will lose the battle against data sharing. As computer scientist Ben Adida argued in his essay, “(Your) Information Wants to be Free,” “unfortunately, information replication doesn’t discriminate: your personal data, credit cards and medical problems alike, also want to be free. Keeping it secret is really, really hard.”

Indeed, and it is growing harder by the day. Contrary to what Orlowski suggests, therefore, this isn’t a simple engineering problem. I wish it were as easy as he suggests to build “permissions-based markets” because they could have real benefits for individuals and society. But it is most certainly not that simple. It is far more costly and complicated than ever to devise workable information control schemes on one hand and “permissions-based” property rights schemes on the other. In some cases, I might still be willing to try the latter, but unlike Orlowski, I just don’t place much faith in the success of the endeavor.

Over at Forbes I have posted some thoughts on the new privacy framework (Consumer Data Privacy in a Networked World) that the Obama Administration released today. In my essay, “The Problem with Obama’s “Let’s Be More Like Europe” Privacy Plan,” I hammer home the same point I’ve made here before many times: Regulation is not a costless exercise. No matter how well-intentioned regulatory proposals may be, they can often have unforeseen, unintended consequences. This is equally true for privacy controls. I discuss how a new privacy regulatory regime could drive up prices for services that currently are free or inexpensive, limit new digital services and innovations, create barriers to entry for new entrants and entrepreneurs, negatively impact the competitiveness of existing U.S. Internet operators, and, more generally, increase the horizons of government power over the Internet.

Here’s a sharp editorial from The Economist about Internet governance entitled,  “In Praise of Chaos: Governments’ Attempts to Control the Internet Should be Resisted.” In the wake of the recent Internet Governance Forum meeting, many folks are once again debating the question of who rules the Net? Along with Wayne Crews, I edited a huge collection of essays on that topic back in 2003 and it’s a subject that continues to interest me greatly. As I noted here last week, many of those who desire greater centralization of control over Net governance decisions are using the fear that “fragmentation” will occur without some sort of greater plan for the Net’s future. I believe these fears are greatly overstated and are being used to justify expanded government meddling with online culture and economics.

The new Economist piece nicely brings into focus the key question about who or what we should trust to guide the future of the Internet. It rightly notes that the current state of Net governance is, well, messy. But that’s not such a bad thing when compared to the alternative:

the internet is shambolically governed. It is run by a hotch-potch of organisations with three- to five-letter acronyms. Many of their meetings, both online and offline, are open to the public. Some—like the Internet Governance Forum, which held its annual meeting in Nairobi this week—are just talking shops. Decision-making is slow and often unpredictable.
It is in short a bit chaotic. But sometimes chaos, even one that adherents like to claim somewhat disingenuously is a “multi-stakeholder” approach, is not disastrous: the internet mostly works. And the shambles is a lot better than the alternative—which nearly always in this case means governments bringing the internet under their control.

Quite right, and the editorial continues on to pose the crucial question about today’s situation:

Imagine if the ITU, a classic example of a sluggish international bureaucracy with antiquated diplomatic rituals, or indeed any other inter-governmental organisation, had been put in charge of the nascent global network two decades ago. Would it have produced a world-changing fount of innovation? We think not.

Indeed, it would be hard to imagine top-down design and central planning could have given rise to today’s Internet. While very few global officials propose the wholesale government takeover of the Net today, we should nonetheless be skeptical about calls to have international bureaucracies exert greater authority over the Internet, regardless of the justification. Messy governance beats top-down planning.

It seems peculiar to me that some of the same individuals and groups who so vociferously opposed a “broadcast flag” technological mandate in past years are now in a mad rush to have federal policymakers mandate a “Do Not Track” regulatory regime for privacy purposes. The broadcast flag debate, you will recall, centered around the wisdom of mandating a technological fix to the copyright arms race before digitized high-definition broadcast signals were effectively “Napster-ized.” At least that was the fear six or seven years ago. TV broadcasters and some content companies wanted the Federal Communications Commission (FCC) to recognize and enforce a string of code that would have been embedded in digital broadcast program signals such that mass redistribution of video programming could have been prevented.

Flash forward to the present debate about mandating a “Do Not Track” scheme to help protect privacy online. As I noted in my filing last week to the Federal Trade Commission, at root, Do Not Track is just another “information control regime.” Much like the broadcast flag proposal, it’s an attempt to use a technological quick-fix to solve a complex problem. When it comes to such information control efforts, however, there aren’t many good examples of simple fixes or silver-bullet solutions that have worked, at least not for very long. The debates over Wikileaks, online porn, Internet hate speech, and Spam all demonstrate how challenging it can be to put information back into the bottle once it is released into the digital wild.

To be clear, I am not opposed to technological solutions like broadcast flag or Do Not Track, but I am opposed to forcing them upon the Internet and digital markets in a top-down, centrally-planned fashion. While I am skeptical that either scheme would work well in practice (whether voluntary or mandated), my concern in these debates is that forcing such solutions by law will have many unintended consequences, not the least of which will be the gradual growth of invasive cyberspace controls in these or other contexts. After all, if we can have “broadcast flags” and “Do Not Track” schemes, why not “flag” mandates for objectionable speech or “Do Not Porn” browser mandates?

From 2002-2005, when the broadcast flag wars were really raging, groups like the Electronic Frontier Foundation and Center for Democracy & Technology made several legitimate legal and practical arguments against a mandatory broadcast flag regime. But their principled case against broadcast flag mandates came down to an underlying fear about government encroachment on the Internet and the specter of more far-reaching regulation of cyberspace. For example, in a December 2003 report, CDT noted that even if other details could be worked out, “the [broadcast] flag approach will still pose unresolved concerns regarding technical regulation of computers and the Internet by the government [and] the impact of regulations on innovation and future consumer uses” was also problematic.

Importantly, EFF and CDT hammered broadcast flag proponents on the question of jurisdictional authority. They rightly asked where the FCC  got the authority to impose such rules at all and worried about the spillover effects of such arbitrary mandates in other Internet contexts. (The broadcast flag scheme was eventually tossed out by the D.C. Court of Appeals because of the FCC’s lack of authority.)

So, why wouldn’t these same concerns and arguments apply to Do Not Track regulation? CDT and EFF seem to care little that the Federal Trade Commission is aggressively pushing this new information control regime on the Internet.  Indeed, CDT and EFF are two of the biggest cheerleaders for FTC action in this regard.  Sorry, but I just don’t get it.  If it was misguided for regulators to push a broadcast flag regime upon cyberspace, isn’t it just as misguided for them to be pushing Do Not Track? I suspect this inconsistency has something to do with CDT and EFF being inherently skeptical of the benefits of most online copyright protection schemes while being more sympathetic to legal efforts aimed at protecting personal privacy online. Simply stated, they think there’s something to the notion of privacy “rights” and will bend over backward to engineer an information control regime to protect against the “unauthorized” flow of personal information online. When it comes to the “unauthorized” flow of copyrighted bits of information online, however, they aren’t nearly as interested in inviting the code cops in.

But even if one sympathizes with that distinction — absolute privacy “rights”  vs. minimal copy-“rights” — all the same concerns and criticisms that CDT and EFF raised earlier about the broadcast flag regulatory scheme would seemingly apply to the Do Not Track regime. Both regimes face formidable enforcement challenges and raise the specter of broader government control of cyberspace. There’s just no getting around that reality, and Do Not Track defenders who deny it are basically hiding from the ugly truth that they are greasing the skids for future information control efforts and regimes — both here and abroad.

I suppose that they might also argue that regulation is justified where it ensures more “choice” for consumers.  But forcing “choice” upon online markets isn’t exactly the same thing as allowing it evolve in a natural, non-destructive fashion. As I noted in my filing, many others besides me are concerned about what mandatory Do Not Track would mean for the online ecosystem of mostly “free” content and services. Lauren Weinstein, co-founder of People For Internet Responsibility (PFIR), worries that the “ability [of Do Not Track concepts] to cause major collateral damage to the Internet ecosystem of free Web services is being unwisely ignored or minimized by many Do Not Track proponents.” And in a brilliant Huffington Post column this week about the rise of a privacy techno-panic, Jeff Jarvis said, “I also worry that efforts to bring in a ‘Do Not Track’ list and other demonization of ad targeting could cripple the revenue of the media and news industries even as they struggle to find sustainability; it could kill news outlets and reduce journalism.”

Weinstein and Jarvis are right. There is no free lunch. While groups like EFF and CDT who support Do Not Track regulation are well-intentioned in their aims, the reality is that government regulation that attempts to create a cost-free opt-out for data collection and targeted online advertising will likely have damaging consequences for the future provision of online content and services. In terms of direct costs to consumers, Do Not Track could result in higher prices for service as paywalls go up or, at a minimum, advertising will become less relevant to consumers and, therefore, more “intrusive” in other ways.

Which leads to my final point. What is perhaps most perplexing about this is how many of the advocates of Do Not Track argue that such a regulatory scheme will slow the “arms race” in the privacy arena. For example, EFF has said “The header-based Do Not Track system appeals because it calls for an armistice in the arms race of online tracking.” And my favorite frenemy Chris Soghoian argues that “opt out mechanisms… [could] finally free us from this cycle of arms races, in which advertising networks innovate around the latest browser privacy control.”  At best, this is highly wishful thinking. At worst, it’s outright deceit aimed at sugar-coating the hard truth: If anything, a Do Not Track mandate will speed up the technological arms race and have many other unintended consequences. Online advertising will almost certainly become more “annoying” and even invasive as a result of such regulation.  And “tracking” techniques aren’t going to be stopped or even slowed as a result of Do Not Track. The important point here is that one intervention will simply beget another and another in an attempt to address the “arms race” and to refine and rework Do Not Track to cover more and more online information flows. One wonders how expansive this new regulatory regime will need to be to deal with the growing scale and volume of online information flows. Really, does anyone think there will be less personal information online in coming years?  Unless we stop the unprecedented voluntary information-sharing and self-revelation of personal data that takes place on social networking sites and via user-generated content sites, there is simply no way in hell this problem is going to be curtailed. When 600 million people use Facebook as an open diary to the world (among many other examples I could cite), it’s hard to imagine we’ll ever be able to stop the mercurial flow of personal information across the Internet. Do Not Track certainly won’t stop it, but the cost of putting such a regulatory regime in place in an attempt to put the genie back in the bottle could be profound for the future of the Internet and online content and culture.

Again, this is essentially the same argument previously set forth against a broadcast flag mandate. As EFF once noted, “the technology mandate proposed… is unnecessary, ineffective, and unwise.”  I agree, and I invite Do Not Track defenders at CDT and EFF (or anyone else) to explain why, conceptually speaking, Do Not Track isn’t just broadcast flag in drag.

Over at MediaFreedom.org, a new site devoted to fighting the fanaticism of radical anti-media freedom groups like Free Press and other “media reformistas,” I’ve started rolling out a 5-part series of essays about “The Battle for Media Freedom.” In Part 1 of the series, I defined what real media freedom is all about, and in Part 2 I discussed the rising “cyber-collectivist” threat to media freedom.  In my latest installment, I offer an analytical framework that better explains the major differences between the antagonists in the battle over media freedom.

Understanding the Origins of Political Struggles

In his many enlightening books, Thomas Sowell, a great economist and an even better political scientist, often warns of the triumph of good intentions over good economics. It’s a theme that F.A. Hayek and Milton Friedman both developed extensively before him. But Sowell has taken this analysis to an entirely differently level in books like A Conflict of Visions: Ideological Origins of Political Struggles, and The Vision of the Anointed: Self-Congratulation as a Basis for Social Policy . Sowell teaches us that no matter how noble one’s intentions might be, it does not mean that those ideas will translate into sound public policy. Nonetheless, since “the anointed” believe their own intentions are pure and their methods are sound, they see nothing wrong with substituting their will for the will of millions of individuals interacting spontaneously and voluntarily in the marketplace. The result is an expansion of the scope of public decision-making and a contraction of the scope of private, voluntary action. As a result, mandates replace markets, and freedom gives way central planning.

Sowell developed two useful paradigms to help us better understand “the origins of political struggles.” He refers to the “constrained” versus “unconstrained” vision and separates these two camps according to how they view the nature of man, society, economy, and politics:

“Constrained Vision” “Unconstrained Vision”
Man is inherently constrained; highly fallible and imperfect Man is inherently unconstrained; just a matter of trying hard enough; man & society are perfectible

The Unconstrained Nature of the Cyber-Collectivist Vision

Sowell’s taxonomy provides a useful frame of reference for today’s debate over communications and media policy. The unconstrained vision crowd here might best be labeled “cyber-collectivists.” This collectivism is not necessarily the hard-edged Marxist brand of collectivism of modern times. It is more the collectivism of Plato’s rule by “philosopher kings” as much as it is modern European “social democrat” collectivism. It generally rejects outright State ownership of the means of production, although there are some exceptions. (Free Press founder Robert McChesney, for example, would go much further than most other collectivists in having the State intervene and directly control or even own media and communications outlets and infrastructure).

Like their many “unconstrained” intellectual predecessors, what unifies the cyber-collectivists is the belief that the State should have a hand in guiding market outcomes toward a “fairer” end. The cyber-collectivists, for example, get indigestion over unequal patterns whether we are talking audience shares or technological diffusion. They are quick to allege “market failure” when some of their preferred media voices only capture miniscule audience shares (even when it’s just the result of consumer demand in action). And when some people or communities gain access to a network or new technology quicker than others, they are often quick to conclude some nefarious plot by greedy capitalists must be to blame.

Of course, in reality, this is just the way things in a free society have always worked. “Liberty upsets patterns” the late Harvard University philosopher Robert Nozick taught us in his 1974 masterpiece “Anarchy, State, and Utopia.” What Nozick meant was that there is a fundamental tension between liberty and egalitarianism such that when people are left to their own devices, some forms of inequality would be inevitable and persistent throughout society. Correspondingly, any attempt to force patterns, or outcomes, upon society requires a surrender of liberty.

All of this is equally true for media and communications policy. Just as there will never be perfect equality of outcomes in the provision of homes, cars, or incomes, there will never be perfect equality of tech gadgets or audience shares for media speakers / outlets.

Speech Redistributionism

The cyber-collectivists are not content with that, however. Just as they call for a redistribution of wealth to rectify the supposed injustice of unequal incomes, so too they call for “something to be done” to “balance” outcomes and ensure “fairer” outcomes. We might call this “media redistributionism” or even “speech redistributionism.”

Consider, for example, a proposal set forth by Cass Sunstein, the prolific University of Chicago law professor (and now Obama Administration official). In his 2001 book Republic.com, in which he suggests that government should consider requiring “electronic sidewalks” in cyberspace to encourage more balance on Internet websites. The state would impose the equivalent of “must carry” mandates on popular or partisan websites, forcing them to carry links to opposing viewpoints. In the name of “media access” or “fairness,” Sunstein and others are apparently willing to let the state impose tyrannical mandates on private website operators, forcing them to open their private property to use by others. Essentially it’s a Fairness Doctrine for the Internet Age.

Elsewhere Sunstein has argued in favor of greater “public interest” regulation to actually change public attitudes and tastes, claiming that there “is a large difference between the public interest and what interests the public.” [See: Television and the Public Interest, 88 California Law Review 499, 501 (2000).] He and many other cyber-collectivist scholars claim that they have a better idea of what interests the public. Essentially, the public doesn’t know what’s best for them, so someone else must tell them—and potentially even force supposedly better choices upon them. For example, Ellen P. Goodman of the Rutgers-Camden School of Law, and currently an adviser to the Federal Communications Commission, believes that, “a proactive media policy must not only correct a poorly functioning market, but also provide diversions around existing media markets and tastes. Proactive media policy can do this by changing consumer wants.”

The thought of having government “change consumer wants” is positively Orwellian and raises the obvious question: according to who’s tastes and values? The viewing and listening public has a broad array of interests and desires that cannot be easily gauged by congressional lawmakers, and certainly not by five unelected bureaucrats at the FCC. As media scholar Benjamin Compaine has correctly noted, “[i]n democracies, there is no universal ‘public interest.’ Rather there are numerous and changing ‘interested publics.’”

And, more practically, how should such goals be accomplished in an age of information abundance? The sheer scale and volume of media activity taking place across an unprecedented variety of communications platforms makes it difficult to imagine how a scarcity-era regulatory regime will be applied going forward. Are we going to have speech patrols standing on every cyber-corner policing the Net for “fairness” violations or determining what is and isn’t “in the public interest”?

Opportunity, Not Outcome, Is What Matters Most

Those of us who subscribe to a more “constrained vision” understand that what is really important is equality of media opportunity, not equality of media outcomes. A focus on the latter is both foolish and destructive. It is foolish because media equality is an impossibility absent extreme measures, which in turn explains why it is destructive. We would need totalitarian government controls on media outputs and consumption in order to achieve anything remotely close to “balance” or “equality” in terms of media results. What counts most is that people have a chance to be heard, not whether millions are listening or whether there is a perfect distribution of digital technology.

Again, that is not enough for the unconstrained visionaries who guide the cyber-collectivist movement. They want action and they want results and they want them now! And, they will always remind us, they have the best of intentions, so we should just trust them. The problem is, intentions + action = control. When they say “something to be done” that is usually code (excuse the pun) for heavy-handed government action to control the messy, un-patterned outcomes of a free marketplace.

And so we arrive at the critical difference between the cyber-freedom and the cyber-collectivist movements: Those of us who adhere to a more constrained view of nature, society and economy (i.e., the cyber-freedom movement) believe that liberty is the default position and that it generally trumps other values. Supposed “market failures” (or “code failures,” as the case may be) are ultimately better addressed by voluntary, spontaneous, bottom-up, marketplace responses than by the coerced, top-down, governmental solutions that the cyber-collectivists call for. Moreover, the decisive advantage of the market-driven approach to correcting code failure comes down to the rapidity and nimbleness of those response(s). Finally, and quite importantly, we in the cyber-freedom movement are not so quick to cry “market failure!” and call in the code cops. We understand that those messy, un-patterned market outcomes are the result of an evolutionary process or trial-and-error and that society and economy benefit from the resulting learning process.

Sure, there may be times when governments may need to intervene at the margins, but we would counsel against abrupt and incessant interventions to correct every supposed “market failure” or “unfair” outcome. After all, those interventions will simply beget more and more interventions to correct the inevitable failures of, or dissatisfaction with, previous interventions. There is simply no sugar-coating the reality that, no matter how well-intentioned, more and more media control is the inevitable prescription.

As I pointed out here before (see, “And so the Comcast-NBC Merger Hysteria Begins: Help Me Document It!“), every time a media merger is proposed we hear all sorts of silly Chicken Little predictions of impending doom as well as preposterous conspiracy theories about supposed nefarious schemes to take over the media universe and control our minds. For good measure, there’s also plenty of talk of “the death of deliberative democracy,” or efforts to weed out one sort of perspective or another.

As history has shown, it’s all complete bunk. But that doesn’t stop critics from concocting asinine theories about media providers seeking to “silence critics.”  Here’s two bits of Chicken Little-ism that I missed in my previous essay documenting this silliness.  First, over at Huffington Post, Marvin Ammori tells us that America is about to become Italy or Argentina because of the deal:

Putting so much power in the hands of one company–and, specifically, its executives–is dangerous for a democracy. There is a reason why autocratic regimes control the media–media shape public opinion and define what is “possible” in politics. We have seen the problem of private media consolidation in many countries. In Italy, Silvio Berlusconi used his massive media empire to win elections and is now Prime Minister (Italy’s longest serving ever). In Argentina, the government had to pass a media consolidation law because of the power of one media company that happens to be far smaller than a combined Comcast-NBCU.

And then we have Wade Norris writing about the deal over at the Daily Kos, saying: “If you don’t want to see the progressive voices on MSNBC silenced, then join the ‘no merger’ petition.”  Ah yes, another automated “stuff-the-online-complaint-ballot-box” petition.  I love those gimmicks.  But ignore fake complaints for a moment and focus on the accusations at hand here. The Ammori-Norris theory is: If Comcast and NBCU are allowed to marry (a) progressive voices will be driven off their platforms and (b) Silvio Berlusconi will take over America democracy will somehow suffer.  Is there really any truth to this?

I find both claims pretty outlandish. I mean, seriously, why would Comcast or NBC silence Rachel Maddow or Keith Olbermann , as Norris suggests in the title of his essay? What possible reason would they have to take two of their MSNBC superstars off the air?  Is that really good business? Would they win a new base of fans with that move? Are Fox News-loving conservatives suddenly going to jump ship and run over to MSNBC because of it?  Finally, can you imagine what a PR nightmare it would be for company?

Moreover, the thing that really kills me about this ‘Comcast-is-out-to-stifle-liberal-voices’ theory is that, for the last couple of years, I’ve heard conservatives whining about how Comcast is supposedly just another big backer of liberal causes. Well, which is it?  The truth it: neither.  Comcast is in the business of … business. They are not ideological puppet-masters hell-bent on steering our opinions one direction or the other.

It’s reminds me of the blather we sometimes hear about how Rupert Murdoch wants to brainwash citizens into subscribing to conservative causes. Whenever I hear that I always ask the accuser who made the movie “The Day After Tomorrow” — a piece of global warming propaganda that must even make the people at Greenpeace blush in embarrassment. Oh, that’s right… Rupert Murdoch’s News Corporation financed and distributed that movie!  So, which does that prove: (A) Rupert Murdoch is hell-bent on programming our minds to accept the fact that global warming would result in a global freeze (how’s that work again?) and leave kids scurrying for the safety of New York City libraries (seriously, have you see that movie? That’s the plot!); or (B) Rupert Murdoch is out to entertain people and make money? If you answered B, congratulations for being a sensible person.  If you answered A, then click here now to start giving money to the Free Press!

By the way, if all these conspiracies had any credence and the mass media and online providers in America really were engaged in a Vast Right Wing Conspiracy to silence liberal voices, then someone needs to explain to me how Obama absolutely crushed the Right in the last election. Seriously, let’s hear your theory. How did he circumvent “the man” and get himself elected?

I’m sorry, but the asinine horror stories that currently dominate public policy discussions about media policy ( and net neutrality regulation , for that matter) have just gotten completely out of control. Sadly, we’ve been here before.  It reminds me of the entertaining debates that took place in Congress back in 2003, following the FCC’s announced plan to tweak media ownership rules.  I documented all the hysteria in this book, but here are some choice gems you may have missed:

  • During the debate on the House floor over an amendment that would have overturned one element of the new FCC rules, Rep. Lynn Woolsey (D-Calif.) said the FCC’s tweaking of the rules was an attempt to impose a centralized “Saddam-style information system in the United States.”
  • Rep. Maurice Hinchey (D-N.Y.) argued that media ownership deregulation amounted to “mind control” by Republicans who were trying to “dumb down” the public. “It’s a well thought out and planned effort to control the political process,” he argued and, “It will wipe out our democracy.” [Quoted in Terry Lane, “Hinchey Pushes Fairness Doctrine Bill to CWA,” Communications Daily, March 31, 2004, p. 9.]
  • Rep. Markey jokingly introduced an amendment that would have deemed the new FCC cross-ownership rules to be “indecent” and require Commissioners who supported the rule to watch the movie Citizen Kane over and over again “until they flinch at the word ‘Rosebud.’” [Quoted in Terry Lane, “House Commerce Committee Raise ‘Indecency’ Fines to $500,000,” Communications Daily, March 4, 2004, p. 2.]
  • Another lawmaker likened the FCC’s new rules to Soviet Union-esque control of the media.

I have come to believe that rational debate about media policy is simply impossible in this country. Facts have become utterly irrelevant.  It’s all about emotion and who can wear more of it on their sleeve.  And the Chicken Littles are really good at shouting louder than everyone else.

What Unites Advocates of Speech Controls & Privacy Regulation? [pdf]

Anyone who has spent time following debates about speech and privacy regulation comes to recognize the striking parallels between these two policy arenas. In this paper we will highlight the common rhetoric, proposals, and tactics that unite these regulatory movements. Moreover, we will argue that, at root, what often animates calls for regulation of both speech and privacy are two remarkably elitist beliefs:

  1. People are too ignorant (or simply too busy) to be trusted to make wise decisions for themselves (or their children); and/or,
  2. All or most people share essentially the same values or concerns and, therefore, “community standards” should trump household (or individual) standards.

While our use of the term “elitism” may unduly offend some understandably sensitive to populist demagoguery, our aim here is not to launch a broadside against elitism as Time magazine culture critic William H. Henry once defined it: “The willingness to assert unyieldingly that one idea, contribution or attainment is better than another.”[1] Rather, our aim here is to critique that elitism which rises to the level of political condescension and legal sanction. We attack not so much the beliefs of some leaders, activists, or intellectuals that they have a better idea of what it in the public’s best interest than the public itself does, but rather the imposition of those beliefs through coercive, top-down mandates.

That sort of elitism—elitism enforced by law—is often the objective of speech and privacy regulatory advocates. Our goal is to identify the common themes that unite these regulatory movements, explain why such political elitism is unwarranted, and make it clear how it threatens individual liberty as well as the future of free and open Internet. As an alternative to this elitist vision, we advocate an empowerment agenda: fostering an environment in which users have the tools and information they need to make decisions for themselves and their families.

I. The Elitism of Speech Regulation

First, consider how those two elitist beliefs identified above are on display when lawmakers or regulatory advocates make efforts to control speech or content.[2] Calls to regulate free speech are often premised on the belief that something must be done to “protect The Children.”[3] Personal and parental responsibility [4] are regarded as inadequate safeguards [5] since some parents will inevitably fall down on the job by not adequately shielding their children’s eyes and ears from potentially objectionable (or supposedly harmful) speech. Therefore, government must regulate content that is indecent, profane, excessively violent, and so on. The definition of those things is then left to unelected bureaucrats and judges to make on our behalf.

But it’s not just about “The Children.” Some regulatory advocates believe that even the choices made by consenting adults must be disregarded because some people fail to understand the supposedly destructive nature of the speech they are consuming. Government must act to protect people from making what some regulatory advocates regard as destructive or even immoral choices that could bring harm to them or their loved ones.

In sum, regulatory advocates are essentially saying that people cannot be trusted or left to their own devices and, therefore, government must intervene and establish a baseline “community standard” on behalf of the entire citizenry to tell them what‘s best for them.[6] Even if those citizens have tools and information at their disposal to make sensible decisions about objectionable content, that’s not good enough because they might not do the job properly. Government must do it for them!

II. The Elitism of Privacy Regulation

This same mentality motivates calls for privacy regulations. Those who call for government interventions to “protect privacy” often claim that people too willingly surrender personal information about themselves and that they don’t understand the adverse consequences of those actions.[7] Alternatively, regulatory advocates claim that advertising and marketing efforts are inherently “manipulative” and that people do not realize they are being duped into surrendering personal information or into buying products or services they supposedly don’t need.[8] Of course, those regulatory advocates rarely pause to explain to us how it is that they were not also duped and manipulated by the same things—again revealing their deeply-rooted elitism! (As discussed below, this makes it clear how the psychological phenomenon of “third-person effect hypothesis” is driving much of this debate.)

“Protecting The Children” is also used as a rhetorical cover for regulation here, but not as often in debates over speech controls.[9] Instead, regulatory advocates mostly focus on adults who are presumed not to know what is in their own best interest—necessitating paternalistic government intervention on their behalf.

III. Intellectual Schizophrenia on Both the Left & Right

What is particularly interesting about all this is the way these two issues expose a sort of intellectual schizophrenia at work on both the Left and Right of the political spectrum. Left-leaning policymakers and intellectuals typically decry censorship efforts (except where “commercial speech,” “hate speech” and “bias” are at issue), but are quick to rally around proposals to layer privacy regulations on the Internet. The opposite is often true of many on the Right of the political spectrum: They typically declare privacy regulations to be paternalistic and antithetical to free enterprise (or perhaps just erosive of efforts to legislate morality),[10] but in the next breath advocate controls on content they find objectionable.

Few on either side stop to consider the relationship between speech and privacy. In fact, they are but two sides of the same coin. After all, what is your “right to privacy” but a right to stop me from observing you and speaking about you?[11] “Protecting privacy,” therefore, typically means restricting speech rights in the process. Advocates of privacy regulation often insist that the use, processing and collection of information are “conduct” unprotected by the First Amendment, but in fact, the First Amendment broadly protects the gathering and distribution of information as part of the process of communication (“speech”).[12] Similarly, attempts to “clean up” speech or “protect The Children,” often require regulations that would betray the privacy of adults by expanding the role of government, and impose serious burdens on businesses and markets—such as age verification mandates [13] or extensive data retention requirements.[14]

IV. Common Tactics & Regulatory Mechanisms

The two movements also share common political tactics and regulatory approaches. Privacy advocates generally favor “opt-in” mandates as the federal “baseline standard” for any website collecting information about users, especially their browsing habits (regardless of whether the information is “personally identifiable”). In other words, the law would create a property right in such “personal information” (ironically, many advocates of this approach criticize or reject intellectual property.) In a similar vein, many advocates of speech controls push for mandatory parental control tools or restrictive default settings.[15] That is, if government won’t censor speech outright, regulatory advocates want lawmakers to at least (1) require that media, computing and communications devices be shipped to market with parental controls embedded or included (as proposed in Australia and with China’s “Green Dam” filter),[16] and possibly, (2) that such controls be defaulted to their most restrictive position—forcing users to opt-out of the controls later if they want to consume media rated above a certain threshold.

More sophisticated advocates of speech controls and privacy regulation will likely argue that their paternalism is less elitist or intrusive because they merely want to “nudge” the public into making “better” decisions. Economist Richard Thaler and legal scholar Cass Sunstein (director of President Obama’s Office of Information and Regulatory Affairs, responsible for analyzing most new federal regulations) popularized this approach with their 2008 book Nudge: Improving Decisions about Health, Wealth, and Happiness. Based on behavioral economics studies, they argue that both government and private actors must inevitably make decisions about “choice architecture” and that, by setting defaults, incentives and rules smartly, “choice architects” can and should improve decision-making without blocking, fencing-off or significantly burdening choices.[17]

In this regard, Sunstein and Thaler’s approach parallels the work of Lawrence Lessig, one of the most influential Internet policy thinkers. Lessig has argued that the “architecture” of “code” (how software is written) “regulates” all online activities and requires government oversight and intervention to keep in check. Otherwise, he warned ominously a decade ago, “Left to itself, cyberspace will become a perfect tool of control.”[18] Lessig’s hyper-pessimistic predictions have proven unwarranted, however. Far from fostering a world of “perfect control,” code and cyberspace have proven remarkably difficult to regulate, but nonetheless has generally benefited consumers and citizens without centralized direction.[19] Still, Lessig, Sunstein, and others of this ilk persist in their advocacy of “nudges” of many varieties to impose their will on cyberspace through mandates from above.

But while it might be possible to define “better decisions” and argue that poor choice architecture leads people to choose things they clearly don’t want in contexts like investment decisions and mortgages, how can elites know what other people really want in highly subjective contexts like privacy and speech? Should they rely on opinion polls—the highly subjective results of which depend heavily on “choice architecture” of question-crafting—to guess what the right default should be?[20] Was the Chinese proposal to mandate deployment of “Green Dam” just a harmless “nudge” because users weren’t barred from uninstalling the filtering software that must accompany their computers (i.e., “opting-out”)? The problem becomes even more difficult where trade-offs among competing values are inevitable. For example, data collection about Internet users raises privacy concerns for some but benefits all, creating more funding for “free” content (i.e., speech) and services users prefer by making more valuable the advertising that supports online publishers. In short, regulations of speech and privacy are likely to be pure paternalism, even when billed as “libertarian paternalism as Thaler and Sunstein label their approach.[21]

What might be called “regulatory blackmail” is also a time-honored tradition among both advocates of speech controls and privacy regulation. When censorship advocates have previously been impeded by the First Amendment, they have worked behind the scenes with lawmakers or regulatory agencies to use indirect pressure and strong-arming tactics to extract “voluntary concessions” from companies or others.[22] For example, in 2004, the FCC strong-armed radio giant Clear Channel into agreeing to a “voluntary” consent decree that involved taking Howard Stern off the air.[23] Similarly, in 2008, XM and Sirius Satellite Radio finally agreed to set aside 4% of their system capacity for use by politically favored racial minorities (a kind of speech control) as a “voluntary condition” of their merger—after the FCC had sat on their application for nearly 16 months.[24] This race-based preference would have been unconstitutional if the FCC had imposed it directly.[25] While the FTC has been far less prone to such abuse and actually plays a key role in holding companies to their promises, its current Chairman, Jon Leibowitz, has hung the “regulatory sword of Damocles” over the heads of the online advertising industry, threatening them with a “day of reckoning” if he doesn’t get what he wants from industry self-regulatory efforts.”[26] The sword could actually fall if the FTC turns self-regulation into the European model of “co-regulation,” where the government steers and industry simply rows.[27]

V. The Crisis Mentality that Drives Regulation

Speech and privacy regulatory advocates share another trait in common: an affinity for the use of a crisis mentality as a method of spurring political action. In his 1995 book The Vision of the Anointed: Self-Congratulation as a Basis for Social Policy, political philosopher and economist Thomas Sowell formulated a model that he argued drives ideological crusades to expand government power over our lives and economy. “The great ideological crusades of the twentieth-century intellectuals have ranged across the most disparate fields,” noted Sowell. But what they all had in common, he argued, was “their moral exaltation of the anointed above others, who are to have their different views nullified and superseded by the views of the anointed, imposed via the power of government.”[28] These government-expanding crusades shared several key elements, which Sowell identified as follows:

  1. Assertion of a great danger to the whole society, a danger to which the masses of people are oblivious.
  2. An urgent need for government action to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many, in response to the prescient conclusions of the few.
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes.

We see this model at work on a daily basis today with our government’s various efforts to reshape our economy, but the model is equally applicable to debates over speech controls and privacy regulation. In particular, the various “technopanics”[29] we have witnessed in recent years fit this model. For example, consider how this model plays out in the debate over online social networking:

  1. Assertion of a great danger to the whole society [online sexual predators], a danger to which the masses of people are oblivious.
  2. An urgent need for government action [such as mandatory online age verification [30] or the Deleting Online Predators Act [31]] to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many [must stop kids and adults from being online together on same sites], in response to the prescient conclusions of the few [some state Attorneys General].[32]
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes [child safety researchers and others are told that their research is meaningless or offbase].[33]

We also see this model in play in other debates, such as efforts to regulate “excessively violent” video games and television programming.[34] And consider how this model plays out on the privacy front:

  1. Assertion of a great danger to the whole society [amorphous privacy violations], a danger to which the masses of people are oblivious.
  2. An urgent need for government action [“baseline federal privacy regulation”] to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many [anyone who shares information online], in response to the prescient conclusions of the few [a handful of privacy advocacy groups].
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes [any suggestion that privacy concerns are being overblown and that most information-sharing is socially beneficial is dismissed out-of-hand].

Worse yet, regulatory intervention in these cases simply begets more and more intervention to correct the inevitable failures of, or dissatisfaction with, previous interventions.[35] Thus, the “crisis” cycle never ends.

VI. Third-Person Effect Hypothesis as an Explanation

Something more profound than simple political elitism seems to be at work here, however. A phenomenon psychologists refer to as the “third-person effect hypothesis” can explain many calls for government intervention, especially in the media world.[36] Simply stated, speech and privacy critics sometimes seem to only see and hear in media or communications what they want to see and hear—or what they don’t want to see or hear. When they encounter perspectives or preferences that are at odds with their own, they are more likely to be concerned about the impact of those things on others throughout society and come to believe that government must “do something” to correct those perspectives. Many people desire regulation because they think it will be good for others, not necessarily for themselves. The regulation they desire has a very specific purpose in mind: “re-tilting” speech or market behavior in their desired direction.

The third-person effect hypothesis was first formulated by W. Phillips Davison in a seminal 1983 article:

In its broadest formulation, this hypothesis predicts that people will tend to overestimate the influence that mass communications have on the attitudes and behavior of others. More specifically, individuals who are members of an audience that is exposed to a persuasive communication (whether or not this communication is intended to be persuasive) will expect the communication to have a greater effect on others than on themselves.[37]

Davison used this hypothesis to explain how media critics on both the Left and Right seemed to simultaneously find “bias” in the same content or reports when they couldn’t possibly both be correct. In reality, their own personal preferences were biasing their ability to fairly evaluate that content. Davison’s article prompted further research by many other psychologists, social scientists, and public opinion experts to test just how powerful this phenomenon was in explaining calls for censorship and other social phenomena.[38] In these studies, third-person effect has been shown to be the primary explanation for why many people fear—or even want to ban—various types of speech or expression, including news,[39] misogynistic rap lyrics,[40] television violence,[41] video games,[42] and pornography.[43] In each case, the subjects surveyed expressed strong misgivings about allowing others to see or hear too much of the speech or expression in question, but greatly discounted the impact of that speech on themselves. Such studies thus reveal the strong paternalistic instinct behind proposals to regulate speech. As Davison notes:

Insofar as faith and morals are concerned… it is difficult to find a censor who will admit to having been adversely affected by the information whose dissemination is to be prohibited. Even the censor’s friends are usually safe from the pollution. It is the general public that must be protected. Or else, it is youthful members of the general public, or those with impressionable minds.[44]

It’s easy to see how this same phenomenon is at work in debates about privacy. Regulatory advocates imagine their preferences are “correct” (right for everyone) and that the masses are being duped by external forces beyond their control or comprehension, even though the advocates themselves are somehow immune from the brain-washing and privy to some higher truth that the hoi polloi simply cannot fathom. Again, this is Sowell’s “Vision of the Anointed” at work.

Consider the flare-up in 2004 over the introduction of Gmail, Google’s free email service. At a time when Yahoo! mail (then as now the leading webmail provider) offered customers less than 10 megabytes of email storage, Gmail offered an astounding gigabyte of storage that would grow over time (now over 7 GB). Rather than charging some users for more storage or special features, Google paid for the service by showing advertisements next to each email “contextually” targeted to keywords in that email—a far more profitable form of advertising than “dumb banner” ads previously used by other webmail providers.[45] Self-appointed (or, to extend Sowell’s framework, “self-anointed”) privacy advocates howled that Google was going to “read users’ email,” and led a crusade to ban such algorithmic contextual targeting.[46] Thierer responded to these critics by pointing out that the service was purely voluntary and noted:

you don’t speak for me and a lot of other people in this world who will be more than happy to cut this deal with Google. So do us a favor and don’t ask the government to shut down a service just because you don’t like it. Privacy is a subjective condition and your value preferences are not representative of everyone else’s values in our diverse nation. Stop trying to coercively force your values and choices on others. We can decide these things on our own, thank you very much.[47]

Interestingly, however, the frenzy of hysterical indignation about Gmail was followed by a collective cyber-yawn: Users increasingly understood that algorithms, not humans, were doing the “reading” and that, if they didn’t like it, they didn’t have to use it. Today, nearly 150 million of people around the world use Gmail, and it has a steadily growing share of the webmail market. Even though cyber-consumers have embraced the service, some privacy advocates persist in their effort to shut down Gmail. They appear determined to stop at nothing to impose their will on others—the essence of political elitism—even if that means cutting off free email service for 150 million people![48]

A similar debate has played out more recently regarding targeted online advertising in general. Advertising on search engines is, much like Gmail, targeted “contextually” based on search terms entered by users and most advertising on other websites is based on the nature of content on a site or page. But certain data is collected about users as they browse to make that advertising more effective—by measuring its performance, reducing fraud, preventing over-exposure, etc. Some privacy advocates have insisted that industry self-regulation of such practices (even if enforced by the FTC) is inadequate and have called for preemptive regulation. They are even more offended by “behavioral advertising” which allows publishers whose content would have little value as the basis for contextually targeting advertising on their own sites to compete for more highly valued advertising by showing ads to users based on other sites they’ve visited. In both cases, data collection can increase the funding available to publishers to produce more of the content and services preferred by users, thus conferring an enormous indirect benefit on users, but also directly benefits users by increasing the relevance of the advertising they see.[49] For some of the more extreme advocates of privacy regulation, however, there are no trade-offs, only absolutist “solutions:” To them, privacy is so obviously desirable that they feel at ease in deciding what’s best for everyone else. Such absolutists often respond with righteous indignation and conspiratorial fulmination when challenged to identify the harm against which they’re protecting consumers, while disdainfully dismissing all talk of the benefits of online advertising as self-serving industry propaganda.[50]

VII. The Principled Alternative: Trust People & Empower Them

There is an alternative to this elitist mentality: freedom and personal responsibility. Individuals should be permitted to live a life of their own, even if they sometimes make mistakes or choices that are at odds with what elites think is best for them. [51]

Of course, the world isn’t perfect. In an ideal world, adults would be fully empowered to tailor speech and privacy decisions to their own values and preferences. Specifically, in an ideal world, adults (and parents) would have (1) the information necessary to make informed decisions and (2) the tools and methods necessary to act upon that information. Importantly, those tools and methods would give them the ability to not only block the things they don’t like—objectionable content, annoying ads or the collection of data about them—while also finding the things they want.

Achieving that ideal is likely impossible, but the good news is that we are moving closer to it with each passing day. Citizens have more tools and methods at their disposal than ever before which enable them to make decisions for themselves and their families. And this is true for both parental controls [52] and privacy controls.[53]

Of course, some speech and privacy elitists will argue that we can’t trust empowerment tools ( e.g., filters, rating systems, or other controls) that are created by companies or other affected parties. But rather than trying to enhance those tools and educate users about how to use them, these elitists skip right past user empowerment and channel their energies into regulations that would impose a top-down, one-size-fits all standard on all adults and families—or even into trying to craft the perfect “nudge” that will help users make what elites believe to be the “right” decisions. Of course, these tools can, and should, be improved. Those groups worried about speech/content and privacy issues should focus on how we might drive such protections from the bottom-up by empowering individuals instead of government bureaucrats. The goal in both cases should be a “let-a-thousand-flowers-bloom” approach, which offers diverse tools and strategies for our diverse citizenry.[54] We need not accept “one-size-fits” all approaches, whether they be regulatory mandates or “nudges,” based on the presumption that elites know best.

Finally, it is vital not to lose sight of what’s ultimately at stake here. If regulatory approaches trump the empowerment agenda we have described, the future of a free and open Internet—indeed, as technology converges, the future of all media—is at risk.[55] By imposing technological solutions from the top-down that can never keep pace with technological change, regulation necessarily forecloses freedom and innovation.[56] By contrast, individual empowerment allows innovation to flourish. The better approach across the board is education, not regulation.[57] Empowerment, not elitism, is the path forward. The digital elite should be leading this effort by developing and promoting technologies of empowerment, not crafting regulatory mandates to force their will upon us.[58]

Vision of the Anointed book coverBerin recently encouraged me to re-read Thomas Sowell’s The Vision of the Anointed: Self-Congratulation as a Basis for Social Policy, which I hadn’t looked at since I first read it back in 1995 or 96.   I’m glad I did since Sowell’s work has always been profoundly influential on my thinking (especially his masterpiece, A Conflict of Visions) and I had forgotten how useful The Vision of the Anointed was in helping me understand the reoccurring model that drives ideological crusades to expand government power over our lives and economy.

“The great ideological crusades of the twentieth-century intellectuals have ranged across the most disparate fields,” Sowell noted in the book.  But what they all had in common, he argued, was “their moral exaltation of the anointed above others, who are to have their different views nullified and superseded by the views of the anointed, imposed via the power of government.” (p. 5)  These elitist, government-expanding crusades shared several key elements, which Sowell identified as follows:

  1. Assertion of a great danger to the whole society, a danger to which the masses of people are oblivious.
  2. An urgent need for government action to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many, in response to the prescient conclusions of the few.
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes.

You can see this model at work on a daily basis today with our government’s various efforts to reshape our economy, but I think this model is equally applicable to debates over social policy and speech control.  In particular, the various “technopanics” I have been writing about recently fit this model. (See 1, 2, 3, 4, 5).  For example, consider how this plays out in the debate over online social networking:

  1. Assertion of a great danger to the whole society [online sexual predators], a danger to which the masses of people are oblivious.
  2. An urgent need for government action [online age verification or the Deleting Online Predators Act] to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many [must stop kids and adults from being online together on same sites], in response to the prescient conclusions of the few [state Attorneys General].
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes [basically, child safety researchers and others are told that their research is meaningless and that they should just buzz off].

And I think you can see how the model has played out in other debates, such as efforts to regulate “excessively violent” video games and television.

Or consider how this model plays out on the privacy front:

  1. Assertion of a great danger to the whole society [amorphous privacy violations], a danger to which the masses of people are oblivious.
  2. An urgent need for government action [“baseline federal privacy regulation”] to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many [stupid people who share information online!], in response to the prescient conclusions of the few [handful of over-zealous privacy advocacy groups].
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes [basically, any suggestion that the issues are being overblown and that most information-sharing is socially beneficial is dismissed out-of-hand].

Again, it’s all blatant elitism when you get right down to it.  And facts are usually the first casualty of the war.

[This represents a bit of a departure from the traditional format of my ongoing “Media Deconsolidiation Series,” but you will see how it ties in…]

So, some guy from the (Un)Free Press — the activist group that wants to regulate every facet of the media and broadband universe — has created a scary looking chart about “Information Control” [seen below]. It’s based loosely on the Periodic Table of Elements, you know, to give it the aura of science and fact. In reality, it’s just another silly scare tactic that tells us very little about the true nature of our modern media marketplace. infocontrolBS

The chart is accompanied by the typical Free Press gloom-and-doom rhetoric about the unfolding media apocalypse. “Nearly everything you see, hear and read that isn’t from a friend — whether on TV, the radio, or even on the Web — comes from a for-profit gatekeeper.”  And then comes the obligatory A.J. Liebling quote about how “Freedom of the press belongs to those who own one,” followed quickly by the typical punch line about how just a handful of companies (in this case 55 of ’em) are puppeteering all our thoughts in America today:

Combined, these 55 powerful media and telecommunications companies raked in total revenues in excess of $700 billion in 2007. Together they own over 540 TV stations, 2000 radio stations, 430 newspapers, 230 magazines, and 80 major cable channels in the United States. They provide paid TV service to approximately 52 million subscribers and broadband Internet service to over 57 million subscribers. They’re the bottlenecks through which our news, our entertainment, and our political discourse must travel. What they want to promote becomes prominent; what they suppress stays out of the mainstream. As such, these companies are the elements of information control.

Oh my God! We are all just brainwashed sheep!

Except we’re not. It amazes me how these “information control” and “media monopoly” myths keep getting widespread circulation. But the first thing to note is how the media reformistas can’t get even their story straight when it comes to how many “monopolists” are supposedly out there today. As I noted in my 2005 book, Media Myths: Making Sense of the Debate over Media Ownership, the critics seem to just pull their numbers out of a hat. Some say as few as 3 companies control everything. Others says 5 or 6. Still others say it might be a few dozen. And now this guy says its 55. Hey, that’s progress that even the Free Press should love!

Regardless of the number, does this really represent the totality of our modern media universe? Do those 55 companies really “own most of the 21st-century presses in America” as the “Info Control” website states? Answer: NOT. EVEN. CLOSE.  Here are the facts. [I happened to have compiled them for a PFF special report entitled Media Metrics: The True State of the Modern Media Marketplace to debunk myths just like this.]

Info Control Debunked

In the table above, I have taken the number of media outlets owned by the 55 companies and then divided it by the total number of media outlets. This gives us the actual percentage of media outlets owned by the 55 media providers listed in the “Information Control” chart.  Needless to say, it’s hard to see how anyone can claim “bottleneck” control or “media monopoly” when an average of just 18% of all those outlets are owned by the 55 companies! And what that number doesn’t tell you is that — as my “Media Deconsolidation” series has been illustrating over the past two years — America’s media marketplace has been growing less concentrated with each passing month. Media companies are selling off and shedding assets and divisions faster than ever. There’s a 24-hour death watch going on over at Twitter these days on the “Media is Dying” thread if you care to follow the carnage in less than 140 characters at a time.

Oh, here’s another problem with the “Information Control” chart: Where exactly does the Internet fit into the picture? Answer: It doesn’t. They’ve conveniently left out the Net, online media, blogging, social networking, podcasting, and other bottom-up, user-generated content and forms of communication.

But let’s ignore the Internet and all those new Digital Age options for a moment. Let’s say this guy had it right and that only 55 companies really did control “Nearly everything you see, hear and read.”  The fact is, that really wouldn’t be the end of the world. 55 competitors would be considered a luxury in just about any other major economic sector.  Care to draw up a “Periodic Chart” for autos, airlines, supermarkets, or semiconductors? If one did, there would be far fewer squares on it. The fact is, even if we accepted the artificial limitations of this chart, we’d still have a lot of choices at our disposal.

But we need not accept those limitations. We live in a different world; a better world. With far more choices and diversity than this silly chart indicates. Indeed, by every conceivable measure we have more media options and diversity than we did 30 years ago. Magnitudes more. I bet the guy who put this chart together isn’t even old enough to remember when three old white guys in bad suits delivered us a half-hour of news each night at 6:30, and if we weren’t lucky enough to be sitting in front of our TVs at that exact moment, then we were screwed. Compare that pre-1980 reality to today and the unprecedented information cornucopia at our disposal. In my lifetime (I’m 40) we have seen the death of mass media and the end of “appointment-based” media consumption.  Media providers no longer call the shots; we the viewing and listening public do.

But shhhhh… we’re not suppose to talk about these meddlesome things called facts. You see, the entire media policy drama in this country is based on a glorious set of mega-myths. There’s a handful of nefarious schemers aiming to program our little minds with corporate propaganda, or so the story goes. They must be stopped. At all costs. Luckily, the enlightened few at the Free Press and other media reformista outfits have managed to avoid the corporate brainwashing — My God, how did they ever do it! — and so they are ready to lead us to the media promised land. But to get there, we must first burn the village to save it. We must destroy free media (as in free-market, for-profit media) to rebuild free media (as in media controlled by government masters). Only then will we enter Information Nirvana and liberate our minds from our evil corporate overlords!

Or so the story goes.
