Sen. Amy Klobuchar just released a letter to Facebook demanding the site require “a prominent safety button or link on the profile pages of users under the age of 18″—akin to the so-called “panic button” app launched earlier this week by the UK’s Child Exploitation & Online Protection Centre (CEOP). She doesn’t seem to realize that this app is available to all Facebook users, not just those in the UK. But her focus on empowerment tools and education is admirable, and it’s certainly a fair question to ask what sites like Facebook and MySpace are doing in these areas.

Unfortunately, Klobuchar’s letter also engages in blatant fear-mongering:

Recent research has shown that one in four American teenagers have been victims of a cyber predator.  And when teens experience abusive behavior online, only ten percent discuss it with their parents and even fewer report the misconduct to law enforcement.  It’s clear that teenagers need to know how to respond to a cyber attack and I believe we need stronger reporting mechanisms to keep our kids safe.

Klobuchar doesn’t actually cite anything, so it’s not clear what research she’s relying on. The 25% statistic is particularly incendiary, suggesting a nationwide cyber-predation crisis—perhaps leading the public to believe 8 or 9 million teens have been lured into sexual encounters offline. Perhaps the Senator considers every cyber-bully a cyber predator—which might get to the 25% number. But there are two serious problem with that moral equivalence.

First, to equate child predation with peer bullying is to engage in a dangerous game of defining deviancy down. Predation and bullying are radically different things. The first (sexual abuse) is a clear and heinous crime that can lead to long-term psychological damage. The second might be a crime in certain circumstances, but generally not.  And it is even less likely to be a crime when it occurs among young peers, which research shows constitutes the vast majority of cases. As Adam Thierer and I noted in our Congressional testimony last year, there are legitimate concerns about cyberbullying, but it’s something best dealt with by parents and schools rather than prosecutors (like Klobuchar in her pre-Senate career).

Second, a series of official taskforces have concluded that the cyberpredator technopanic is vastly overblown. NTIA’s Online Safety and Technology Working Group final 2010 report concluded that “several studies, including some funded by the U.S. Department of Justice, have shown that the statistical probability of a young person being physically harmed by an adult who they first met online is extremely low,” (OSTWG Report at 10-11). Harvard’s 2009 Berkman Center Internet Safety Technical Task Force report concluded:

cases [of adult to child sexual encounters on social networks] typically involved post-pubescent youth who were aware that they were meeting an adult male for the purpose of engaging in sexual activity…. the risk profile for the use of different genres of social media depends on the type of risk, common uses by minors, and the psychosocial makeup of minors who use them…. Youth identify most sexual solicitors as being other adolescents (48%; 43%) or young adults between the ages of 18 and 21 (20%; 30%) and that youth typically ignore or deflect solicitations without experiencing distress.

A number of other task force reports have reached similar conclusions, all agreeing that education and empowerment are the answer. In particular, a 2008 study found that use of popular social networking sites such as MySpace and Facebook does not appear to increase their risk of being victimized by online predators. In particular, the study noted that the 500 arrests made nation-wide for Internet-initiated sex crimes accounted for just 7% of all statutory rapes”—i.e., for adult-on minor sex.

The letter goes on to ask about Facebook’s Internet safety page (she could have just Googled “Facebook Safety” and found it and its wealth of resources) and whether Facebook has a report abuse system—see the “Report Abuse” button at the bottom of any profile, page or group, which produces this dialogue box for user profiles:

MySpace has similar reporting mechanisms (and this form) and resources for kids & parents. Both sites employ hundreds of people to respond to such requests, decide when to take down content, and when to bring in law enforcement—which is a pretty big commitment from sites that don’t charge users a penny.

If the good Senator or her staff had had Googled (or Binged) “Facebook safety advisory board,” she would have found a number of press releases about the group, which Facebook launched last December to interface with child safety experts.

Again, it’s a fair question whether Facebook could do even more than it’s already done. For example, the “report abuse” link could probably be moved to a more prominent location on the page. But with its incendiary rhetoric and easily answered questions, Klobuchar’s letter seems intended more to make headlines and score political points than to really move the ball forward on her stated objective, which we should all share: enhancing education and empowerment solutions. Playing fast and loose with the facts—and throwing more fuel on the fire of a technopanic in the process—is unwise and unconstructive.

What Unites Advocates of Speech Controls & Privacy Regulation? [pdf]

Anyone who has spent time following debates about speech and privacy regulation comes to recognize the striking parallels between these two policy arenas. In this paper we will highlight the common rhetoric, proposals, and tactics that unite these regulatory movements. Moreover, we will argue that, at root, what often animates calls for regulation of both speech and privacy are two remarkably elitist beliefs:

  1. People are too ignorant (or simply too busy) to be trusted to make wise decisions for themselves (or their children); and/or,
  2. All or most people share essentially the same values or concerns and, therefore, “community standards” should trump household (or individual) standards.

While our use of the term “elitism” may unduly offend some understandably sensitive to populist demagoguery, our aim here is not to launch a broadside against elitism as Time magazine culture critic William H. Henry once defined it: “The willingness to assert unyieldingly that one idea, contribution or attainment is better than another.”[1] Rather, our aim here is to critique that elitism which rises to the level of political condescension and legal sanction. We attack not so much the beliefs of some leaders, activists, or intellectuals that they have a better idea of what it in the public’s best interest than the public itself does, but rather the imposition of those beliefs through coercive, top-down mandates.

That sort of elitism—elitism enforced by law—is often the objective of speech and privacy regulatory advocates. Our goal is to identify the common themes that unite these regulatory movements, explain why such political elitism is unwarranted, and make it clear how it threatens individual liberty as well as the future of free and open Internet. As an alternative to this elitist vision, we advocate an empowerment agenda: fostering an environment in which users have the tools and information they need to make decisions for themselves and their families.

I. The Elitism of Speech Regulation

First, consider how those two elitist beliefs identified above are on display when lawmakers or regulatory advocates make efforts to control speech or content.[2] Calls to regulate free speech are often premised on the belief that something must be done to “protect The Children.”[3] Personal and parental responsibility [4] are regarded as inadequate safeguards [5] since some parents will inevitably fall down on the job by not adequately shielding their children’s eyes and ears from potentially objectionable (or supposedly harmful) speech. Therefore, government must regulate content that is indecent, profane, excessively violent, and so on. The definition of those things is then left to unelected bureaucrats and judges to make on our behalf.

But it’s not just about “The Children.” Some regulatory advocates believe that even the choices made by consenting adults must be disregarded because some people fail to understand the supposedly destructive nature of the speech they are consuming. Government must act to protect people from making what some regulatory advocates regard as destructive or even immoral choices that could bring harm to them or their loved ones.

In sum, regulatory advocates are essentially saying that people cannot be trusted or left to their own devices and, therefore, government must intervene and establish a baseline “community standard” on behalf of the entire citizenry to tell them what‘s best for them.[6] Even if those citizens have tools and information at their disposal to make sensible decisions about objectionable content, that’s not good enough because they might not do the job properly. Government must do it for them!

II. The Elitism of Privacy Regulation

This same mentality motivates calls for privacy regulations. Those who call for government interventions to “protect privacy” often claim that people too willingly surrender personal information about themselves and that they don’t understand the adverse consequences of those actions.[7] Alternatively, regulatory advocates claim that advertising and marketing efforts are inherently “manipulative” and that people do not realize they are being duped into surrendering personal information or into buying products or services they supposedly don’t need.[8] Of course, those regulatory advocates rarely pause to explain to us how it is that they were not also duped and manipulated by the same things—again revealing their deeply-rooted elitism! (As discussed below, this makes it clear how the psychological phenomenon of “third-person effect hypothesis” is driving much of this debate.)

“Protecting The Children” is also used as a rhetorical cover for regulation here, but not as often in debates over speech controls.[9] Instead, regulatory advocates mostly focus on adults who are presumed not to know what is in their own best interest—necessitating paternalistic government intervention on their behalf.

III. Intellectual Schizophrenia on Both the Left & Right

What is particularly interesting about all this is the way these two issues expose a sort of intellectual schizophrenia at work on both the Left and Right of the political spectrum. Left-leaning policymakers and intellectuals typically decry censorship efforts (except where “commercial speech,” “hate speech” and “bias” are at issue), but are quick to rally around proposals to layer privacy regulations on the Internet. The opposite is often true of many on the Right of the political spectrum: They typically declare privacy regulations to be paternalistic and antithetical to free enterprise (or perhaps just erosive of efforts to legislate morality),[10] but in the next breath advocate controls on content they find objectionable.

Few on either side stop to consider the relationship between speech and privacy. In fact, they are but two sides of the same coin. After all, what is your “right to privacy” but a right to stop me from observing you and speaking about you?[11] “Protecting privacy,” therefore, typically means restricting speech rights in the process. Advocates of privacy regulation often insist that the use, processing and collection of information are “conduct” unprotected by the First Amendment, but in fact, the First Amendment broadly protects the gathering and distribution of information as part of the process of communication (“speech”).[12] Similarly, attempts to “clean up” speech or “protect The Children,” often require regulations that would betray the privacy of adults by expanding the role of government, and impose serious burdens on businesses and markets—such as age verification mandates [13] or extensive data retention requirements.[14]

IV. Common Tactics & Regulatory Mechanisms

The two movements also share common political tactics and regulatory approaches. Privacy advocates generally favor “opt-in” mandates as the federal “baseline standard” for any website collecting information about users, especially their browsing habits (regardless of whether the information is “personally identifiable”). In other words, the law would create a property right in such “personal information” (ironically, many advocates of this approach criticize or reject intellectual property.) In a similar vein, many advocates of speech controls push for mandatory parental control tools or restrictive default settings.[15] That is, if government won’t censor speech outright, regulatory advocates want lawmakers to at least (1) require that media, computing and communications devices be shipped to market with parental controls embedded or included (as proposed in Australia and with China’s “Green Dam” filter),[16] and possibly, (2) that such controls be defaulted to their most restrictive position—forcing users to opt-out of the controls later if they want to consume media rated above a certain threshold.

More sophisticated advocates of speech controls and privacy regulation will likely argue that their paternalism is less elitist or intrusive because they merely want to “nudge” the public into making “better” decisions. Economist Richard Thaler and legal scholar Cass Sunstein (director of President Obama’s Office of Information and Regulatory Affairs, responsible for analyzing most new federal regulations) popularized this approach with their 2008 book Nudge: Improving Decisions about Health, Wealth, and Happiness. Based on behavioral economics studies, they argue that both government and private actors must inevitably make decisions about “choice architecture” and that, by setting defaults, incentives and rules smartly, “choice architects” can and should improve decision-making without blocking, fencing-off or significantly burdening choices.[17]

In this regard, Sunstein and Thaler’s approach parallels the work of Lawrence Lessig, one of the most influential Internet policy thinkers. Lessig has argued that the “architecture” of “code” (how software is written) “regulates” all online activities and requires government oversight and intervention to keep in check. Otherwise, he warned ominously a decade ago, “Left to itself, cyberspace will become a perfect tool of control.”[18] Lessig’s hyper-pessimistic predictions have proven unwarranted, however. Far from fostering a world of “perfect control,” code and cyberspace have proven remarkably difficult to regulate, but nonetheless has generally benefited consumers and citizens without centralized direction.[19] Still, Lessig, Sunstein, and others of this ilk persist in their advocacy of “nudges” of many varieties to impose their will on cyberspace through mandates from above.

But while it might be possible to define “better decisions” and argue that poor choice architecture leads people to choose things they clearly don’t want in contexts like investment decisions and mortgages, how can elites know what other people really want in highly subjective contexts like privacy and speech? Should they rely on opinion polls—the highly subjective results of which depend heavily on “choice architecture” of question-crafting—to guess what the right default should be?[20] Was the Chinese proposal to mandate deployment of “Green Dam” just a harmless “nudge” because users weren’t barred from uninstalling the filtering software that must accompany their computers (i.e., “opting-out”)? The problem becomes even more difficult where trade-offs among competing values are inevitable. For example, data collection about Internet users raises privacy concerns for some but benefits all, creating more funding for “free” content (i.e., speech) and services users prefer by making more valuable the advertising that supports online publishers. In short, regulations of speech and privacy are likely to be pure paternalism, even when billed as “libertarian paternalism as Thaler and Sunstein label their approach.[21]

What might be called “regulatory blackmail” is also a time-honored tradition among both advocates of speech controls and privacy regulation. When censorship advocates have previously been impeded by the First Amendment, they have worked behind the scenes with lawmakers or regulatory agencies to use indirect pressure and strong-arming tactics to extract “voluntary concessions” from companies or others.[22] For example, in 2004, the FCC strong-armed radio giant Clear Channel into agreeing to a “voluntary” consent decree that involved taking Howard Stern off the air.[23] Similarly, in 2008, XM and Sirius Satellite Radio finally agreed to set aside 4% of their system capacity for use by politically favored racial minorities (a kind of speech control) as a “voluntary condition” of their merger—after the FCC had sat on their application for nearly 16 months.[24] This race-based preference would have been unconstitutional if the FCC had imposed it directly.[25] While the FTC has been far less prone to such abuse and actually plays a key role in holding companies to their promises, its current Chairman, Jon Leibowitz, has hung the “regulatory sword of Damocles” over the heads of the online advertising industry, threatening them with a “day of reckoning” if he doesn’t get what he wants from industry self-regulatory efforts.”[26] The sword could actually fall if the FTC turns self-regulation into the European model of “co-regulation,” where the government steers and industry simply rows.[27]

V. The Crisis Mentality that Drives Regulation

Speech and privacy regulatory advocates share another trait in common: an affinity for the use of a crisis mentality as a method of spurring political action. In his 1995 book The Vision of the Anointed: Self-Congratulation as a Basis for Social Policy, political philosopher and economist Thomas Sowell formulated a model that he argued drives ideological crusades to expand government power over our lives and economy. “The great ideological crusades of the twentieth-century intellectuals have ranged across the most disparate fields,” noted Sowell. But what they all had in common, he argued, was “their moral exaltation of the anointed above others, who are to have their different views nullified and superseded by the views of the anointed, imposed via the power of government.”[28] These government-expanding crusades shared several key elements, which Sowell identified as follows:

  1. Assertion of a great danger to the whole society, a danger to which the masses of people are oblivious.
  2. An urgent need for government action to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many, in response to the prescient conclusions of the few.
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes.

We see this model at work on a daily basis today with our government’s various efforts to reshape our economy, but the model is equally applicable to debates over speech controls and privacy regulation. In particular, the various “technopanics”[29] we have witnessed in recent years fit this model. For example, consider how this model plays out in the debate over online social networking:

  1. Assertion of a great danger to the whole society [online sexual predators], a danger to which the masses of people are oblivious.
  2. An urgent need for government action [such as mandatory online age verification [30] or the Deleting Online Predators Act [31]] to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many [must stop kids and adults from being online together on same sites], in response to the prescient conclusions of the few [some state Attorneys General].[32]
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes [child safety researchers and others are told that their research is meaningless or offbase].[33]

We also see this model in play in other debates, such as efforts to regulate “excessively violent” video games and television programming.[34] And consider how this model plays out on the privacy front:

  1. Assertion of a great danger to the whole society [amorphous privacy violations], a danger to which the masses of people are oblivious.
  2. An urgent need for government action [“baseline federal privacy regulation”] to avert impending catastrophe.
  3. A need for government to drastically curtail the dangerous behavior of the many [anyone who shares information online], in response to the prescient conclusions of the few [a handful of privacy advocacy groups].
  4. A disdainful dismissal of arguments to the contrary as either uninformed, irresponsible, or motivated by unworthy purposes [any suggestion that privacy concerns are being overblown and that most information-sharing is socially beneficial is dismissed out-of-hand].

Worse yet, regulatory intervention in these cases simply begets more and more intervention to correct the inevitable failures of, or dissatisfaction with, previous interventions.[35] Thus, the “crisis” cycle never ends.

VI. Third-Person Effect Hypothesis as an Explanation

Something more profound than simple political elitism seems to be at work here, however. A phenomenon psychologists refer to as the “third-person effect hypothesis” can explain many calls for government intervention, especially in the media world.[36] Simply stated, speech and privacy critics sometimes seem to only see and hear in media or communications what they want to see and hear—or what they don’t want to see or hear. When they encounter perspectives or preferences that are at odds with their own, they are more likely to be concerned about the impact of those things on others throughout society and come to believe that government must “do something” to correct those perspectives. Many people desire regulation because they think it will be good for others, not necessarily for themselves. The regulation they desire has a very specific purpose in mind: “re-tilting” speech or market behavior in their desired direction.

The third-person effect hypothesis was first formulated by W. Phillips Davison in a seminal 1983 article:

In its broadest formulation, this hypothesis predicts that people will tend to overestimate the influence that mass communications have on the attitudes and behavior of others. More specifically, individuals who are members of an audience that is exposed to a persuasive communication (whether or not this communication is intended to be persuasive) will expect the communication to have a greater effect on others than on themselves.[37]

Davison used this hypothesis to explain how media critics on both the Left and Right seemed to simultaneously find “bias” in the same content or reports when they couldn’t possibly both be correct. In reality, their own personal preferences were biasing their ability to fairly evaluate that content. Davison’s article prompted further research by many other psychologists, social scientists, and public opinion experts to test just how powerful this phenomenon was in explaining calls for censorship and other social phenomena.[38] In these studies, third-person effect has been shown to be the primary explanation for why many people fear—or even want to ban—various types of speech or expression, including news,[39] misogynistic rap lyrics,[40] television violence,[41] video games,[42] and pornography.[43] In each case, the subjects surveyed expressed strong misgivings about allowing others to see or hear too much of the speech or expression in question, but greatly discounted the impact of that speech on themselves. Such studies thus reveal the strong paternalistic instinct behind proposals to regulate speech. As Davison notes:

Insofar as faith and morals are concerned… it is difficult to find a censor who will admit to having been adversely affected by the information whose dissemination is to be prohibited. Even the censor’s friends are usually safe from the pollution. It is the general public that must be protected. Or else, it is youthful members of the general public, or those with impressionable minds.[44]

It’s easy to see how this same phenomenon is at work in debates about privacy. Regulatory advocates imagine their preferences are “correct” (right for everyone) and that the masses are being duped by external forces beyond their control or comprehension, even though the advocates themselves are somehow immune from the brain-washing and privy to some higher truth that the hoi polloi simply cannot fathom. Again, this is Sowell’s “Vision of the Anointed” at work.

Consider the flare-up in 2004 over the introduction of Gmail, Google’s free email service. At a time when Yahoo! mail (then as now the leading webmail provider) offered customers less than 10 megabytes of email storage, Gmail offered an astounding gigabyte of storage that would grow over time (now over 7 GB). Rather than charging some users for more storage or special features, Google paid for the service by showing advertisements next to each email “contextually” targeted to keywords in that email—a far more profitable form of advertising than “dumb banner” ads previously used by other webmail providers.[45] Self-appointed (or, to extend Sowell’s framework, “self-anointed”) privacy advocates howled that Google was going to “read users’ email,” and led a crusade to ban such algorithmic contextual targeting.[46] Thierer responded to these critics by pointing out that the service was purely voluntary and noted:

you don’t speak for me and a lot of other people in this world who will be more than happy to cut this deal with Google. So do us a favor and don’t ask the government to shut down a service just because you don’t like it. Privacy is a subjective condition and your value preferences are not representative of everyone else’s values in our diverse nation. Stop trying to coercively force your values and choices on others. We can decide these things on our own, thank you very much.[47]

Interestingly, however, the frenzy of hysterical indignation about Gmail was followed by a collective cyber-yawn: Users increasingly understood that algorithms, not humans, were doing the “reading” and that, if they didn’t like it, they didn’t have to use it. Today, nearly 150 million of people around the world use Gmail, and it has a steadily growing share of the webmail market. Even though cyber-consumers have embraced the service, some privacy advocates persist in their effort to shut down Gmail. They appear determined to stop at nothing to impose their will on others—the essence of political elitism—even if that means cutting off free email service for 150 million people![48]

A similar debate has played out more recently regarding targeted online advertising in general. Advertising on search engines is, much like Gmail, targeted “contextually” based on search terms entered by users and most advertising on other websites is based on the nature of content on a site or page. But certain data is collected about users as they browse to make that advertising more effective—by measuring its performance, reducing fraud, preventing over-exposure, etc. Some privacy advocates have insisted that industry self-regulation of such practices (even if enforced by the FTC) is inadequate and have called for preemptive regulation. They are even more offended by “behavioral advertising” which allows publishers whose content would have little value as the basis for contextually targeting advertising on their own sites to compete for more highly valued advertising by showing ads to users based on other sites they’ve visited. In both cases, data collection can increase the funding available to publishers to produce more of the content and services preferred by users, thus conferring an enormous indirect benefit on users, but also directly benefits users by increasing the relevance of the advertising they see.[49] For some of the more extreme advocates of privacy regulation, however, there are no trade-offs, only absolutist “solutions:” To them, privacy is so obviously desirable that they feel at ease in deciding what’s best for everyone else. Such absolutists often respond with righteous indignation and conspiratorial fulmination when challenged to identify the harm against which they’re protecting consumers, while disdainfully dismissing all talk of the benefits of online advertising as self-serving industry propaganda.[50]

VII. The Principled Alternative: Trust People & Empower Them

There is an alternative to this elitist mentality: freedom and personal responsibility. Individuals should be permitted to live a life of their own, even if they sometimes make mistakes or choices that are at odds with what elites think is best for them. [51]

Of course, the world isn’t perfect. In an ideal world, adults would be fully empowered to tailor speech and privacy decisions to their own values and preferences. Specifically, in an ideal world, adults (and parents) would have (1) the information necessary to make informed decisions and (2) the tools and methods necessary to act upon that information. Importantly, those tools and methods would give them the ability to not only block the things they don’t like—objectionable content, annoying ads or the collection of data about them—while also finding the things they want.

Achieving that ideal is likely impossible, but the good news is that we are moving closer to it with each passing day. Citizens have more tools and methods at their disposal than ever before which enable them to make decisions for themselves and their families. And this is true for both parental controls [52] and privacy controls.[53]

Of course, some speech and privacy elitists will argue that we can’t trust empowerment tools ( e.g., filters, rating systems, or other controls) that are created by companies or other affected parties. But rather than trying to enhance those tools and educate users about how to use them, these elitists skip right past user empowerment and channel their energies into regulations that would impose a top-down, one-size-fits all standard on all adults and families—or even into trying to craft the perfect “nudge” that will help users make what elites believe to be the “right” decisions. Of course, these tools can, and should, be improved. Those groups worried about speech/content and privacy issues should focus on how we might drive such protections from the bottom-up by empowering individuals instead of government bureaucrats. The goal in both cases should be a “let-a-thousand-flowers-bloom” approach, which offers diverse tools and strategies for our diverse citizenry.[54] We need not accept “one-size-fits” all approaches, whether they be regulatory mandates or “nudges,” based on the presumption that elites know best.

Finally, it is vital not to lose sight of what’s ultimately at stake here. If regulatory approaches trump the empowerment agenda we have described, the future of a free and open Internet—indeed, as technology converges, the future of all media—is at risk.[55] By imposing technological solutions from the top-down that can never keep pace with technological change, regulation necessarily forecloses freedom and innovation.[56] By contrast, individual empowerment allows innovation to flourish. The better approach across the board is education, not regulation.[57] Empowerment, not elitism, is the path forward. The digital elite should be leading this effort by developing and promoting technologies of empowerment, not crafting regulatory mandates to force their will upon us.[58]

The Economist magazine has just released an important feature article entitled, “Sex Laws: Unjust and Ineffective.” In an indirect way, the article makes a point that I have been trying to get across in my work on this issue: If you want to keep your kids safe from real sex offenders, we need to scrap our current sex offender registries and completely rethink the way we define and punish sex offenses in this country.  That’s because, currently, a significant percentage of those people listed in sex offender registries pose almost no threat to children, making it difficult for us to know who really does pose a threat to our kids and what we should do about them.

Simply stated, we’ve dumbed-down the notion of “sex crimes” in this country. As a nation, we have foolishly come to equate almost all sex offenses equally.  While sex offender registry laws vary from state to state, many basically say that that two teens caught engaging in consensual oral sex in high school belong on the same list alongside child rapists. That is insanity. And it leaves many in the public, especially parents, thinking that the whole world is full of predators lurking on every corner just waiting to snatch, rape, and kill their children. [ For the actual facts, see the appendix I have included down below: “Is America Suffering from a National Child Abduction Epidemic”?]  In reality, as The Economist feature story points out, the truth is quite different:

Every American state keeps a register of sex offenders. California has had one since 1947, but most states started theirs in the 1990s. Many people assume that anyone listed on a sex-offender registry must be a rapist or a child molester. But most states spread the net much more widely. A report by Sarah Tofte of Human Rights Watch, a pressure group, found that at least five states required men to register if they were caught visiting prostitutes. At least 13 required it for urinating in public (in two of which, only if a child was present). No fewer than 29 states required registration for teenagers who had consensual sex with another teenager. And 32 states registered flashers and streakers. Because so many offences require registration, the number of registered sex offenders in America has exploded. As of December last year, there were 674,000 of them, according to the National Centre for Missing and Exploited Children. If they were all crammed into a single state, it would be more populous than Wyoming, Vermont or North Dakota. As a share of its population, America registers more than four times as many people as Britain, which is unusually harsh on sex offenders. America’s registers keep swelling, not least because in 17 states, registration is for life.
Georgia has more than 17,000 registered sex offenders. Some are highly dangerous. But many are not. And it is fiendishly hard for anyone browsing the registry to tell the one from the other. The Georgia Sex Offender Registration Review Board, an official body, assessed a sample of offenders on the registry last year and concluded that 65% of them posed little threat. Another 30% were potentially threatening, and 5% were clearly dangerous. The board recommended that the first group be allowed to live and work wherever they liked. The second group could reasonably be barred from living or working in certain places, said the board, and the third group should be subject to tight restrictions and a lifetime of monitoring. A very small number “just over 100” are classified as “predators”, which means they have a compulsion to commit sex offences. When not in jail, predators must wear ankle bracelets that track where they are.

Let’s repeat a few key numbers here: 674,000 registered offenders, “more populous than Wyoming, Vermont or North Dakota.”  Those are the kind of numbers that send sensationalistic media outlets and average parents alike into a tizzy. Rarely does anyone stop to ask what those numbers mean or who these people are on the sex offender registries. But, as The Economist notes, when you dig below the surface and start taking a serious look at who these people are and what they have done to land on the list, a very different story emerges. We’re polluting these lists with petty offenders (flashers and streakers) and people who should have been dealt with in different ways (like teens who were caught in the act).

What about the real bad guys?  As the Georgia Review Board found, only 5% of those on their sex offender registry were “clearly dangerous” and “should be subject to tight restrictions and a lifetime of monitoring.”  These would be your true scum of the Earth; the sick fiends who really have preyed on children or raped repeatedly.  Here’s a question I want answered about these scum: Why do we need a sex offender registry for them at all? Why are they not behind bars for life?  Why don’t we cut off their privates!  I am deadly serious here.  If anyone raped one of my children, I would go after him and snip his manhood myself… slowly… with a dull, rusty blade.  Any yet we release these people to re-offend. And then we put them on a list. A list that had teens on it who made a stupid mistake in high school in the back of car and got caught. DOES THIS MAKE ANY DAMN SENSE???  (And yes, I am shouting when I use all caps!  Because I am sick and tired of this nonsense.)

Here is the sobering fact to consider: a 2003 Department of Justice study reported that the average sentence for child molesters was approximately seven years and, on average, they were released after serving just three of those seven years. That is an extremely troubling statistic. If you have young children in your home, it is even more upsetting. When our government is putting people who viciously hurt innocent children behind bars for just seven years and then letting them out after only three, then our government has failed us at a very fundamental level.

Worse yet, policymakers then point fingers at everyone else and scold Internet companies and ISPs for not doing enough to protect children from predators, all the while conveniently ignoring the government’s own failed policies that allow those predators to be on the streets and behind keyboards in the first place!  It is not “market failure” at work when child predators are lurking online; it is government failure in the extreme. We are never going to solve this problem until we hunt down the real bad guys and lock them up for a long, long time.

In the meantime, however, as Lenore Skenazy argues, parents might want to just “burn your sex offender maps” because they instill a sense of dread and panic in us about the world around us based simply on the large number of people on them — even though they tell you little about who is an actual threat to your child.  I have parents in my neighborhood who tell me they won’t let their kids ride their bike down the sidewalks in our very safe and fairly affluent neighborhood in McLean, Virgina because they have heard there are sex offenders in the area. I ask them if they have ever examined those “offenders” to see what they are on the list for.  They haven’t bothered.  I have.  Not one of the sex offenders in my area had anything to with sex crimes against children.  Strangely, most of the sex offenders in my area are listed as just  being convicted of “sodomy.”  I always wonder, was that consensual sodomy that occurred when it was still a crime in Virginia? (That is, before the Supreme Court struck down such laws in the 2003 case of Lawrence v. Texas). If so, that’s not a crime in my book and those people do not belong on any sex offender list.  Of course, if it was actual rape, that’s a very serious crime and it deserves conviction. Either way, these are not sex crimes against children even though that’s the impression many parents have when parents see or hear about these sex offender registries.  So, when only a small percentage of those on the lists are the ones we truly need to fear (the child molesters and rapists), isn’t there a better solution? Like: LOCK THEM UP AND THROW AWAY THE KEY!  Or, if we are not going to do that, at least create a separate registry for these more serious offenders. Call it the “Scum of the Earth List” and make these people were bright neon monitoring bracelets and anklets so we can see them.

At a minimum, we need follow the advice Human Rights Watch has set forth, as The Economist summarizes:

Human Rights Watch urges America to scale back its sex-offender registries. Those convicted of minor, non-violent offences should not be required to register, says Ms Tofte. Nor should juveniles. Sex offenders should be individually assessed, and only those judged likely to rape someone or abuse a child should be registered. Such decisions should be regularly reviewed and offenders who are rehabilitated (or who grow too old to reoffend) should be removed from the registry. The information on sex-offender registries should be held by the police, not published online, says Ms Tofte, and released “on a need-to-know basis”. Blanket bans on all sex offenders living and working in certain areas should be abolished. Instead, it makes sense for the most dangerous offenders sometimes to face tailored restrictions as a condition of parole.

To clarify my own views: I think lists of serious sex offenders (again, if we aren’t locking them up for longer periods) should be made public, but the lesser offenses (like cases of consensual teen sex in high school) should be kept private so it doesn’t stigmatize those people for life and drive the average public batty in the meantime.

We need to bring some sanity back to America’s sex laws.  And we need to do if for the children. Our kids are not going to be safer (or saner) by artificially inflating sex offender rolls with people who don’t belong on the list in the first place.  That just leads to fear, confusion, and a misplaced sense of justice. We need to punish the true scum more aggressively, and then find more sensible approaches to deal with others.  And let’s get out of the business of putting teenagers on these lists altogether.  That’s just nuts.

A final reason I care deeply about setting things right on this front is because concerns about online child safety — and overblown fears about child predators in particular — are leading to many calls for increased Internet regulation. Down below, I have pasted in an excerpt from my “Parental Controls & Online Child Protection” report in which I explain why this “technopanic” mentality about kids and the Internet is unwarranted.


Appendix: Is America Suffering from a National Child Abduction Epidemic? [ excerpt fromParental Controls & Online Child Protection,” by Adam Thierer, PFF, ver. 4.0, 2009.]

Debates about online child safety are often driven by fear — fear of bad guys lurking online and waiting to snatch up our children. Indeed, there have been a handful of highly publicized cases of minors being contacted and later abducted or abused by child predators on social networking sites.[1] Such cases do not mean that a national epidemic of Internet-related child abductions is occurring, however. The reality is quite different. As Internet safety expert Larry Magid has noted:

Contrary to what some people might imply, most kids who become victims of online sex predators are not abducted. They are lured after being groomed by their predators. And, though any case is tragic, the fact is that such crimes are relatively rare considering the millions of children and teens that go online every day. Despite thousands of arrests of would-be predators caught up in sting operations, tragic cases like this don’t appear to occur very often.[2]

Indeed, generally speaking, abductions by strangers “represent an extremely small portion of all missing children [cases].”  That conclusion was a central finding of the 2002 National Incidence Studies of Missing, Abducted, Runaway, and Thrownaway Children (NISMART), a study conducted by the Department of Justice’s Office of Juvenile Justice and Delinquency Prevention.[3] Although the survey is several years old and suffers from some data and methodological deficiencies, it remains the most comprehensive survey of missing and abducted children in the United States.

The NISMART survey broke down juvenile abductions into two categories—family versus non-family. It found that the vast majority of kidnapping victims were abducted by family, friends of the family, or people who had a close relationships with (or the trust of) the minors. Only 115 of the estimated 260,000 abductions—or less than a tenth of a percent—fit the stereotypical abduction scenario that parents most fear: complete strangers snatching children and transporting them miles away.[4] And Lenore Skenazy, author of Free-Range Kids: Giving Our Children the Freedom We Had Without Going Nuts with Worry, notes that, “the chances of any one American child being kidnapped and killed by a stranger are almost infinitesimally small: .00007 percent.”[5]

Despite those findings, public policy debates and media reports remain preoccupied with the horror stories about abductions by random strangers, leaving the impression that the problem is much larger than the more serious issues of family or acquaintance abductions.[6]

Research has shown that this conclusion is also true of child abuse and sex offenders in general, not just abductions. As psychologist Anna C. Salter, author of Predators: Pedophiles, Rapists, and Other Sex Offenders, points out, “[Sex offenders] are part of our communities, part of our network of friends, worse yet, sometimes part of our families.”[7] And former FBI special agent Kenneth V. Lanning, author of Child Molesters: A Behavior Analysis, notes the following:

The often forgotten piece in the puzzle of the sexual victimization of children is acquaintance molestation. This seems to be the most difficult manifestation of the problem for society and the law to face. People seem more willing to accept a sinister stranger from a different location or father/stepfather from a different socioeconomic background as a child molester than a clergy member, next-door neighbor, law-enforcement officer, pediatrician, teacher, or volunteer with direct access to children. The acquaintance molester, by definition, is one of us. He is not just an external threat. We cannot easily distinguish him from us or identify him by physical traits. These kinds of molesters have always existed, but society and the criminal-justice system have been reluctant to accept the reality of these cases.[8]

Clearly, the problem of family and acquaintance abductions and sex abuse predated the rise of the Internet, and it will unlikely be diminished by age verification of minors on social networking websites or other websites. But the argument could be made that abductions by strangers — while exceedingly rare — could be reduced even further by age-verifying minors or adults before they enter certain sites.

This potential reduction may be true, but it is important to remember that predators can’t magically reach through a computer screen and grab our kids. Predators must meet them somewhere in the physical world (i.e., a mall, park, playground, etc.). The danger of the Internet is that it allows predators to groom minors over a protracted period, while doing so from a distance. However, the fact that they are doing so from a distance—and over electronic communications networks, no less—means we have actually gained some important advantages in our effort to combat child predation. Many of the predators leave digital tracks for us to follow. Thus, to the extent that disturbing things are happening online or being facilitated by the Internet in any fashion, at least there is a digital record of those activities or crimes. The electronic tracks have made it easier to recover children or to track perpetrators on many occasions.[9]

Of course, digital records have also made it easier to catch minors engaging in foolish behavior after they post information or photos about their actions online.[10] In past generations, parents often warned their kids to behave themselves in public or else “it will go down on your permanent record.” It was largely just a scare tactic, because there really was no permanent record of the mundane activities of youth. Today, however—for better or for worse—the Internet is becoming “your permanent record.” No doubt, this raises some serious, long-term privacy concerns, but the one positive aspect is that the existence of electronic records makes it easier for parents, website operators, or law enforcement officials to deal with online troublemakers of all varieties.[11] That is why education is essential to make sure both kids and their parents understand that serious consequences are associated with what they post online.

In an earlier post, I mentioned an important new online child safety task force report that has just been released from the “Point Smart. Click Safe.” Blue Ribbon Working Group. It’s a great report and I encourage you to read the whole thing. It was my great pleasure to serve on this task force, and as we started finalizing our conclusions and recommendations, I started thinking about how much of what we were finding and recommending was consistent with what past online safety task forces had also concluded.

By way of background, over the past decade, five major online safety task forces or blue ribbon commissions have been convened to study online safety issues. Two of these task forces were convened in the United States and issued reports in 2000 (“COPA Commission”) and 2002 (“Thornburgh Commission“). Another was commissioned by the British government in 2007 and issued in a major report in March 2008 (“Byron Review“). Finally, two additional online safety task forces were formed in the U.S. in 2008 and concluded their work, respectively, in January (“Internet Safety Technical Task Force“) and July (“Point Smart. Click Safe.“) of 2009. [And yet another task force — the Online Safety Technology Working Group — was recently formed and has now gotten underway.]

In a new PFF white paper, ” Five Online Safety Task Forces Agree: Education, Empowerment & Self-Regulation Are the Answer,” I walk through a chronological summary of each of these past task forces [click on covers of each report below to read them in their entirety] and highlight some of the similar themes and recommendations from them.

ISTTF cover Point Smart Click Safe report cover Altogether, these five task forces heard from hundreds of experts and produced thousands of pages of testimony and reports on a wide variety of issues related to online child safety. While each of these task forces had different origins and unique membership, what is striking about them is the general unanimity of their conclusions. Among the common themes or recommendations of these five task forces:

  • Education is the primary solution to most online child safety concerns. These task forces consistently stressed the importance of media literacy, awareness-building efforts, public service announcements, targeted intervention techniques, and better mentoring and parenting strategies.
  • There is no single “silver-bullet” solution or technological “quick-fix” to child safety concerns. That is especially the case in light of the rapid pace of change in the digital world.
  • Empowering parents and guardians with a diverse array of tools, however, can help families, caretakers, and schools to exercise more control over online content and communications.
  • Technological tools and parental controls are most effective as part of a “layered” approach to child safety that views them as one of many strategies or solutions.
  • The best technical control measures are those that work in tandem with educational strategies and approaches to better guide and mentor children to make wise choices. Thus, technical solutions can supplement, but can never supplant, the educational and mentoring role.
  • Industry should formulate best practices and self-regulatory systems to empower users with more information and tools so they can make appropriate decisions for themselves and their families. And those best practices, which often take the form of an industry code of conduct or default control settings, should constantly be refined to take into account new social concerns, cultural norms, and technological developments.
  • Government should avoid inflexible, top-down technological mandates. Instead, policymakers should focus on encouraging collaborative, multifaceted, multi-stakeholder initiatives and approaches to enhance online safety. Additional resources for education and awareness-building efforts are also crucial. Finally, governments should ensure appropriate penalties are in place to punish serious crimes against children and also make sure law enforcement agencies have adequate resources to police crimes and punish wrong-doers.

The consistency of these findings from those five previous task forces is important and it should guide future discussions among policymakers, the press, and the general public regarding online child safety.  As I note in the paper, the findings are particularly relevant today since Congress and the Obama Administration — including 3 federal agencies (NTIA, FCC, & FTC) are actively studying these issues. So, in light of all that, I hope this short paper can shed some light on the collective wisdom of the past task forces. While more study of online child safety issues is always welcome — including additional task forces or working groups if policymakers deem them necessary — thanks to the work of these five task forces, we now have better vision of what is needed to address online safety concerns.

free-range-coverWhen it comes to theories about how to best raise kids, I’m a big believer in what might be referred to “a resiliency approach” to child-rearing.  That is, instead of endlessly coddling our children and hovering over them like “helicopter parents,” as so many parents do today, I believe it makes more sense to instill some core values and common sense principles and then give them some breathing room to live life and learn lessons from it.  Yes, that includes making mistakes.  And, oh yes, your little darlings might actually gets some bump and bruises along the way — or at least have their egos bruised in the process.  But this is how kids learn lessons and become responsible adults and citizens.  Wrapping them in bubble wrap and filling their heads without nothing but fear about the outside would will ultimately lead to the opposite: sheltered, immature, irresponsible, and unprepared young adults — many of whom expect someone else (the government, their college, their employer, or still their parents!) to be there to take care of them well into their 20’s or even 30’s.  Again, you gotta let kids live a little and learn from their experiences.

This explains why I find Lenore Skenazy’s new book, Free-Range Kids: Giving Our Children the Freedom We Had Without Going Nuts with Worry , to be such a breath of fresh air.  [Here’s her blog of the same name.] She argues that “if we try to prevent every possible danger of difficult in our child’s everyday life, that child never gets a chance to grow up.” (p. 5) As she told Salon recently:

You want kids to feel like the world isn’t so dangerous. You want to teach them how to cross the street safely. You want to teach them that you never go off with a stranger. You teach them what to do in an emergency, and then you assume that generally emergencies don’t happen, but they’re prepared if they do. Then, you let them go out. The fun of childhood is not holding your mom’s hand. The fun of childhood is when you don’t have to hold your mom’s hand, when you’ve done something that you can feel proud of. To take all those possibilities away from our kids seems like saying: “I’m giving you the greatest gift of all, I’m giving you safety. Oh, and by the way I’m taking away your childhood and any sense of self-confidence or pride. I hope you don’t mind.”

Exactly right, in my opinion. Again, let kids live and learn from it.  Teach lessons but then encourage ‘learning by doing’ and let them understand these things for themselves.  That is resiliency theory in a nutshell.

When writing about Gever Tulley’s brilliant “Tinkering School” in this post last year, I noted how I have already started teaching my kids how to use various tools even though they are both under the age of 8.  One of my safety-obsessed yuppie friends stopped by one day to get something and saw my kids playing with hammers, nails, and saws and he thought I was nuts.  But it is he who is nuts for shielding his kids to the joys of learning to build something with their own hands (and for denying them the skills to actually do some honest-to-God manual labor when they get older)!  Have my kids hammered their thumbs on occasion? Yep.  Have they cut or poked their fingers? Check.  But you know what? They bounced back and learned how to be more careful. It’s not like I put a nail gun or power saw in their hands and let them go at it!  But there will be a day that they will be competent enough to know how to use such tools properly, especially because I drill some basic lessons into them each time we pull out those tools. Without me even saying so anymore, they already put on their safety goggles and take other common sense precautions before they use such tools.

Why is it that things have gotten so out of whack, with parents instilling so much fear in their kids about the world?  Skenazy rightly notes that the fundamental problem is that “a lot of parents today are really bad at assessing risk.” (p. 5)  Parents today suffer from “extravagant worry,” she notes. “Extravagant in that it inflates remote possibilities into looming threats that we think we have to watch out for.” (p. 93) “Worrying,” she argues, “has become our national pastime.” (p. 94) “What has changed over the past generation or so is than now people worry… about every activity, even ones that used to be considered simple and pleasant,” she says. (p. 42). Camping, ball games, bike rides, walking to school, etc., are increasingly going out of style. “Millions of moms and almost (but not quite as many) dads now see the world as so fraught with danger that they can’t possibly let their children explore it.” (p. 5)  “And the result is a lot of people so busy preparing for the hideous and unpredictable future that they think nothing of trampling the safe and happy present.” (p. 44)

This has spawned the rise of what Skenazy refers to as the “Just In Case” and “Total Control” mentalities that exist among many parents throughout society today. Many modern parents seem to believe that with just enough safety locks, knee pads, toilet locks, stair gates, and so on, they can keep their kids perfectly safe from all the harms of the world —  both real or (more likely) imagined. Alas, Skenazy argues, “Control is a figment of our imagination. Seeking it only make us more anxious.” (p. 92)  Worse yet, after wrapping those kids in all that bubble wrap, a lot of these same parents force nonsense on them like Baby Einstein videos and Mozart tapes at very young ages hoping that will make those kids geniuses in later life.  It’s more likely they’ll grow up to be Ted Kaczynski.

But if Skenazy is right in arguing that most parents now behave as if “normal childhood has just become too risky to permit,” think of the long-term consequences that has on kids.  Such a relentlessly fear-based mentality breeds distrust, even loathing, of the outside world and all others in it.  Moreover, as I mentioned at the outset, excessive coddling makes it impossible to learn life lessons and build resiliency and responsibility into youngster such that they can go on to become productive citizens.

Skenazy also has some common sense thoughts on the over-hyped issue of Internet sexual predation. As she told Salon:

The world online turns out to be not very different from the world offline. There are some really seedy neighborhoods where you wouldn’t want your kids hanging out, especially if they were wearing high-heeled shoes and fishnets stockings at night. If your kids don’t go there, then your kids are not going to be stalked by predators just looking up prom pictures on Facebook.

Again, exactly right.  And yet, as I have pointed out here before, an irrational “techno-panic” has taken place in recent years over this issue even though the research just doesn’t back up the claim that predators are lurking on every cyber-corner.  Moreover, there’s not a stalker or a child abductor hanging out on every real world corner either. As she notes in the book, “the number of children abducted and killed by strangers [has held] pretty steady over the years — about 1 in 1.5 million. Put another way, the chances of any one American child being kidnapped and killed by a stranger are almost infinitesimally small: .00007 percent.” (p. 16)  And yet, parents today are practically paralyzed by the fear that if they let their kids out of their sight for even a millisecond, they will be snatched.

Skenazy blames sensationalized news coverage for much of this, and I tend to agree.  Even though there are many other tragic ways young kids die each year — and do so in far greater numbers — the media tends to focus on the freakishly rare missing child or abduction scenario until they have whipped up a full-blown public panic.  Incidentally, when those exceedingly rare abductions do take place, it is almost never at the hands of a complete stranger. As psychologist Anna C. Salter, author of Predators: Pedophiles, Rapists, and Other Sex Offenders, points out, “[Sex offenders] are part of our communities, part of our network of friends, worse yet, sometimes part of our families.” Same goes for the abductions. In the vast majority of cases, it is relatives or parties close to the family (say, a disgruntled nanny) who snatches the child.  In other words, instead of being obsessed about letting your kids ride their bike around the neighborhood or play in the center of the mall, parents should be far more concerned with those they marry, date, or employ!!

In any event, read Lenore Skenazy’s Free-Range Kids.  It is beautifully written and immensely enjoyable. She is an insanely gifted writer that will keep you thinking and laughing at the same time.  That’s a rare gift, and her book is a much-needed gift to over-worried parents everywhere.  Read this book, stop worrying, and then tell you kid to go outside and play!


P.S. Quick closing rant… Can I just tell you how much I hate the scumbag trial lawyers who have made it impossible for my kids to experience the joys of diving boards at the local pool.  Steve Moore of The Wall Street Journal, who takes his kids to the same McLean pool my kids go to, explains how some greedy leeches lawyers have made it impossible for pools like ours to keep high-dive board around like we had growing up.  Maybe we should just ban pools altogether while we’re at it.  Fence-off all the lakes and streams, too.  After all, kids could drown!!

Incidentally, this reminds me of the most sensible thing every written about online child safety. In 2002, a blue-ribbon panel of experts was convened by the National Research Council of the National Academy of Sciences to study how best to protect children in our new, interactive, “always-on” multimedia world.  Under the leadership of former U.S. Attorney General Richard Thornburgh, the group produced a massive report that outlined a sweeping array of methods and technological controls for dealing with potentially objectionable media content or online dangers. Ultimately, however, the experts used a compelling metaphor to explain why education and sensible mentoring was the most important tool on which parents and policymakers should rely:

Technology-in the form of fences around pools, pool alarms, and locks-can help protect children from drowning in swimming pools. However, teaching a child to swim-and when to avoid pools-is a far safer approach than relying on locks, fences, and alarms to prevent him or her from drowning. Does this mean that parents should not buy fences, alarms, or locks? Of course not-because they do provide some benefit. But parents cannot rely exclusively on those devices to keep their children safe from drowning, and most parents recognize that a child who knows how to swim is less likely to be harmed than one who does not. Furthermore, teaching a child to swim and to exercise good judgment about bodies of water to avoid has applicability and relevance far beyond swimming pools-as any parent who takes a child to the beach can testify. (p. 187)

A child who knows how to swim is less likely to be harmed than one who does not.”  We could apply that lesson to just about everything in this world.  Teach your children well, and then let them live and learn.  And swim!

As Berin mentioned last week, we have a new paper out on proposals to expand the Children’s Online Privacy Protection Act (COPPA) of 1998.   We generically refer to those COPPA-expansion efforts as “COPPA 2.0.” Hence, the title of our paper: “COPPA 2.0: The New Battle over Privacy, Age Verification, Online Safety & Free Speech.”  To recap what Berin already noted, in the name of improving online child safety, some legislators and state attorneys general (AGs) are advocating the expansion of COPPA’s “verifiable parental consent” model of age verification before certain sites or services may collect, or enable the sharing of, personal information for children.

Unlike “COPPA 1.0,” however, which only applied to children under the age of 13, “COPPA 2.0” would apply to all minors up to age 17.  Moreover, the range of sites covered by the new law would generally be expanded to include just about any site or service with social networking functionality.

Since Berin has already summarized our general concerns with efforts to expand COPPA’s “verifiable parental consent” online age verification system to cover more online users and sites, I thought I would focus here on what I believe will be the most controversial (and important) part of our paper — our discussion about how COPPA 2.0 affects the speech rights of both adults and adolescents.

Remember COPA?

To understand why COPPA expansion will raise serious First Amendment issues, we first need to step back and recall the legal battle over the Children’s Online Protection Act (COPA), another 1998 law sometimes confused with COPPA.  Both COPPA and COPA rest on a stratification of users by age, but the approach of the two laws is very different: While COPPA requires age verification if content is “directed at” minors under age 13, COPA would have required that all website operators restrict access to material deemed “harmful to minors” by minors under the age of 17 and therefore requires age verification of all users who attempt to access such content (in order to identify minors). COPPA is focused on certain kinds of potentially harmful contacts while COPA is focused on potentially harmful content.

But by expanding the age range of COPPA to include adolescents, COPPA 2.0 proposals essentially converge with COPA, reaching the same practical consequence: age verification mandates for large numbers of adults as users (not as parents). Only the scope of sites covered by the laws is different: under COPA, sites deemed “harmful to minors,” and, under COPPA 2.0, adolescent-oriented or certain social networking sites. Thus, to the extent that COPPA 2.0 proposals require age verification of adults, they would be subject to constitutional attacks similar to those against COPA.  But COPPA 2.0 proposals would also burden the rights of adults to communicate with adolescents and the free speech rights of adolescents.

Finally, the fact that COPPA (like COPA) applies only to commercial sites would do little to protect it from constitutional attack, because in a world of user-generated content, the commercial nature of a site has little to do with the commercial/non-commercial nature of the speech carried on it. For example, obviously commercial sites like MySpace and Facebook serve as platforms for a wide variety of not-for-profit and political communications.

How COPPA 2.0 Would Impact the Free Speech Rights of Adults

After a decade-long court battle over the constitutionality of COPA, the U.S. Supreme Court in January 2009 rejected the government’s latest request to revive the law, meaning it is likely dead. Three of the key reasons the courts struck down COPA would also apply to COPPA 2.0 proposals.

(1) First, like COPA, COPPA  2.0 would raise burden the speech rights of adults to access information subject to age verification requirements, both by making speech more difficult and by stigmatizing it.  In 2003, the Third Circuit noted that age verification requirements “will likely deter many adults from accessing restricted content, because many Web users are simply unwilling to provide identification information in order to gain access to content, especially where the information they wish to access is sensitive or controversial.” In 2008, in striking down COPA for the third and final time, the Third Circuit approvingly quoted the district court, which had noted that part of the reason age verification requirements deterred users from accessing restricted content was “because Internet users are concerned about security on the Internet and because Internet users are afraid of fraud and identity theft on the Internet.” The district court had held that: “Requiring users to go through an age verification process would lead to a distinct loss of personal privacy” by threatening their anonymity.

By imposing broad age verification requirements, COPPA 2.0 would restrict the rights of adults to send and receive information anonymously just as COPA did. If anything, the speech burdened by COPPA 2.0 deserves more protection, not less, than the speech burdened by COPA: Where COPA merely burdened access to content deemed “harmful to minors” (viz., pornography), COPPA 2.0 would burden access to material by adults as well as minors not because that material is harmful or obscene but merely because it is “directed at” minors! Thus, the content covered by COPPA 2.0 proposals could include not merely pornography, but communications about political nature, which deserved the highest degree of First Amendment protection.

(2) Second, like COPA, COPPA expansion threatens the speech rights of website operators. The necessary corollary of blocking adults from accessing certain content anonymously — and thereby deterring some users from accessing that content — is that COPPA 2.0, like COPA, would necessarily reduce the audience size of websites subject to age verification mandates. Furthermore, such mandates would encourage websites to self-censor themselves to avoid offering content they fear could be considered “directed at” adolescents because doing so might subject them to an age verification mandate — or to legal liability if they fail to implement age verification. The substantial cost of age verification could significantly impact, if not make impossible, the business models of many personal information-collecting (PI) sites, which generally do not charge for content and rely instead on advertising revenues. The Third Circuit cited all of these burdens on the free speech rights of website operators in striking down COPA.

(3) Third, less restrictive alternatives are available to COPPA 2.0, just as they were for COPA.

The Third Circuit drew on the Supreme Court’s 2004 decision striking down COPA on the grounds that “blocking and filtering software is an alternative that is less restrictive than COPA, and, in addition, likely more effective as a means of restricting children’s access to materials harmful to them.” Similarly, parental control software already empowers parents to restrict their kids’ access to PI-collecting sites. (It’s particularly easy for parents to restrict access to the leading social networking sites that seem to be driving so much of the push for COPPA 2.0, so that their kids.)

Thus, the free speech rights burdened COPPA 2.0 proposals are at least as important as those burdened by COPA, and blocking software already empowers parents to restrict their kids’ access to PI-collecting sites, just as it allows parents to restrict access to pornography. Of course, if COPPA 2.0 laws were actually enacted and subject to legal challenge, the outcome of the case would depend largely on the level of constitutional scrutiny involved. COPPA 2.0 advocates might argue that, whatever the rights at stake, a lower level of constitutional scrutiny should apply because COPPA 2.0 does not target a special category of content. If true, this could mean that, although age verification mandates to restrict access to “harmful” material are unconstitutional, far more sweeping mandates restricting access to non-harmful information could be constitutional. Such inconsistency is indeed a perverse consequence of the fact that our First Amendment jurisprudence focuses not on the rights at stake, but on whether a regulation is “content-neutral” in deciding what level of scrutiny to apply—which, in turn, often determines the outcome of the case. But in this case, COPPA 2.0 proposals likely would be subject to strict scrutiny to the extent that they are, like COPA, focused on a certain category of content: that “directed at” adolescents (rather than “harmful to minors”).

Legislators who attempt to escape strict scrutiny by defining the scope of their bill not by its targeted audience but by reference to specific functional capabilities (in the definition of “social networking site”) will likely find that a court will see through such window-dressing: If they recognize that such bills are nonetheless aimed at a certain category of adolescent-oriented content, they will apply strict scrutiny anyway. But even under intermediate scrutiny, COPPA 2.0 proposals would be subject to serious attack.

Minors Have Speech Rights, Too!

In addition, in COPPA 2.0 approaches, the government would restrict the ability of adolescents to access content, not because it could be harmful to them or because it is obscene, but merely because it is “directed to” them. While the First Amendment rights of minors may not be on par with those of adults, adolescents do have the right to access certain types of information and express themselves in certain ways. The Supreme Court has held (in Planned Parenthood of Cent. Mo. v. Danforth) that “constitutional rights do not mature and come into being magically only when one attains the state-defined age of majority.” It remains unclear how an expanded COPPA model might interfere with the First Amendment rights of adolescents, but it is clear that privacy and speech rights would come into conflict under COPPA 2.0, as they do in other contexts.

For example, how might the parental-consent based model limit the ability of adolescents to obtain information about “safer sex” or how to deal with trauma, depression, family abuse, or addiction. Would an abusive father authorize a teen to visit a website about how to report child abuse? Would a parent of an adolescent struggling with their sexual identity let their kid participate in a self-help social networking page for gay and lesbian youth? What rights are at play here and how do we reconcile them?

Maintaining the ability of kids to participate online interactions goes beyond content that most people would recognize as “serious”—from the perspective of both First Amendment values and the education of children. As a recent MacArthur Foundation study of the online youth Internet use concluded:

Contrary to adult perceptions, while hanging out online, youth are picking up basic social and technological skills they need to fully participate in contemporary society. Erecting barriers to participation deprives teens of access to these forms of learning. Participation in the digital age means more than being able to access “serious” online information and culture.

It was at least in part in recognition of such difficult First Amendment questions that Congress removed the requirement in the initial legislative draft of COPPA that would have required PI-based sites to “use reasonable efforts to provide the parents with notice and an opportunity to prevent or curtail the collection or use of personal information collected from children over the age of 12 and under the age of 17.”

Even if parents have an absolute right to block their adolescents’ access to such data, they can already exercise that right by applying strict controls on the computers in their home. COPPA 2.0 proposals go well beyond recognizing this right by setting the default to “parental consent required” for adolescents to access a wide range of content—meaning that parents must “opt-in” on behalf of their children before their children can participate in PI-collecting sites. This, in turn, burdens the ability of adolescents to communicate, because their parents might censor (rightly or wrongly) certain information, or simply fail to understand the technologies involved or to be actively engaged. But whatever the free speech rights of adolescents, if anyone should be interfering with those rights, it should be their parents — not the government.

Some parents may object that, however effective parental control software may be in the home, it does not allow parents to control what their kids’ access outside the home. This argument is understandable on some level, but in the end, it amounts to a demand that roadblocks be put up everywhere for the sake of particularly sensitive parents at the expense of everyone else in society, including potentially huge numbers of adult users — and of online anonymity in general.

But Illinois’s COPPA 2.0 proposal goes even further, not merely expanding COPPA to cover a particular variety of social networking sites, but requiring that such sites “allow the parent or guardian of the minor unrestricted access to the profile webpage of the minor at all times.” Congress considered just such a parental access mandate in the initial draft of COPPA legislation back in 1998, but ultimately removed it from the final version of the legislation, apparently because even some of COPPA’s supporters worried, given the bill’s initial application to the 13-16 age bracket, that “The establishment of a parental right to access all personal information about a teenager may intrude on older minors’ privacy, rather than protect.”

What about Communication between Adolescents & Adults?

Finally, COPPA 2.0 could infringe on the free speech rights of adults to communicate with adolescents online by driving PI-collecting sites to segregate users by age or to attempt to block access by adolescents. The vast majority of adult-minor interactions online are not of a harassing or predatory nature—indeed, they generally involve adults looking to help or assist minors in various ways. As the MacArthur Foundation study cited above concluded:

In contexts of peer-based learning, adults … have an important role to play, though it is not the conventionally authoritative one. In friendship-driven practices, direct adult participation is often unwelcome, but in interest-driven groups we found a much stronger role for more experiences participants to play. Unlike instructors in formal educational settings, however, these adults are passionate hobbyists and creators, and youth see them as experienced peers, not as people who have authority over them. These adults exert tremendous influence in setting communal norms and what educators might call “learning goals,” though they do not have direct authority over newcomers.

A substantial portion of those interactions involve parents talking to their own kids, older and younger siblings communicating with one another, teachers and mentors talking to their students, or even co-workers of different ages communicating. Even when adult-minor communications involve complete strangers, there is typically a socially-beneficial purpose. Think of two people — one an adult and one a minor — debating politics on a discussion board, or creating a Wikipedia entry together. What about a presidential campaign website that involves millions of volunteers of all ages communicating and collaborating to a common purpose? There are countless other examples. How would such interactions be affected by COPPA 2.0? Restricting such interactions would raise profound First Amendment concerns about freedom of speech as well as of association.

In any First Amendment analysis, a court must consider not only the free speech rights at stake and the availability of less restrictive alternatives to regulation, but the governmental interest being advanced. Again, neither COPPA nor the COPPA 2.0 proposals discussed herein (e.g., the New Jersey and Illinois proposals) requires exclusion of older users from a website, nor directly governs the sharing of personal information among users (where that sharing does not also constitute collection by the site itself). But separation of adolescents from adults is likely to be an indirect effect of COPPA 2.0 requirements—as COPPA 2.0 advocates probably realize—because, once PI-collecting sites are required to age-verify users, they will face reputational, political and potentially legal pressure to make interactions between adolescents and children more difficult in the name of “child safety.” More subtly, if PI-collecting site operators have an incentive to avoid being considered “directed at” adolescents, they will also have an incentive to discourage adolescent participation on their site—which achieves a similar result.

Here, one must further ask if attempting to quarantine children from adults (however indirectly) actually advances, on net, a strong governmental interest in child protection. Such a quarantine is unlikely to stop adults with truly nefarious intentions from communicating with minors, as systems designed to exclude participation by adults in a “kids-only” or “adolescents-only” area can be easily circumvented. Given the lack of strong identity records for minors, it’s much easier for an adult to pretend to be a minor than vice versa. The effect of age stratification on truly bad actors is likely to be marginal at best—or harmful at worst: Building walls around adolescents through age-verification might actually make it easier for predators to target teens, since a predator who gains access to a supposedly teen-only site will be less likely to be exposed as a predator by targeting an adult they think is a teen. So for the sake of marginal (if any) gains in child protection, would we not be excluding beneficial interaction between adults and minors?

To hear some of the advocates of COPPA 2.0 talk about how teens currently behave online, one might think that online environments in which adolescents were left to their own devices—imagine a “Teen MySpace” for the 13-17 crowd, walled off from the rest of MySpace—would be far worse, perhaps an online version of Lord of the Flies. These concerns are clearly exaggerated: The critics frequently complain about “the way kids talk to each other these days” while looking at their own past adolescent banter with rose-colored lenses. What is clear is that adolescents (and young adults) behave better in online environments where adults are present, too. Perhaps the best demonstration of this fact has been the uproar from adolescents and young adults that has accompanied Facebook’s explosive growth in popularity among older users in recent months. Many kids hate the idea of adults joining Facebook precisely because the presence of adults encourages kids to “self-regulate” by exercising better judgment and following better netiquette.

Anne Collier, founder and executive director of the child safety advocacy organization Net Family News, Inc. and editor of NetFamilyNews.org and ConnectSafely.org, suggests that the push for “segregation” by age (e.g., creating a teen-only version of Second Life) for safety’s sake is “losing steam” because:

it’s a response to the predator panic teens and parents have been subjected to in U.S. society, not to the realities of youth on the social Web. What nearly a decade of peer-reviewed academic research shows is that peer-to-peer behavior is the online risk that affects many more youth, the vast majority of online kids who are not already at-risk youth offline. Segregating teens from adults online doesn’t address harassment, defamation, imposter profiles, cyberbullying, etc. It may help keep online predators away from kids (even though online predation, or abuse resulting from online communication, constitutes only 1% of overall child sexual exploitation…), which is a great outcome, but it’s not enough unless all that parents are worried about is predators.

Collier discusses the particularly acute problem of “actual or perceived sexual orientation and gender expression,” which the Salt Lake Tribune has noted are “two of the top three reasons secondary school students said their peers were most often bullied at school.” This kind of harassment recently attracted widespread public attention after two 11-year-old boys committed suicide after experiencing anti-gay harassment and bullying at school. Nationwide, “Lesbian, gay, bisexual, transgender and questioning youth are up to four times more likely to attempt suicide than their heterosexual peers.” This child safety risk is painfully real, with anti-gay harassment being only its most obvious form. But “segregating” teens from adults seems likely to aggravate this problem by removing adults from the mix as a potential source of discipline.

Of course, adults play a critical role in disciplining interaction among the 0-12 age bracket, but not as direct participants in on-site interaction. Again, how many adults actually want to use Club Penguin? Instead, parents can supervise what their kids do online through parental control software. Parents could, of course, use that same software to monitor what their adolescent kids do, too. But as kids get older, most parents realize that the training wheels have to come off at some point. Few parents will want to spy on their 17-year old until the day before the kid starts college (or enlists in the military or gets married). But most parents probably would prefer that, if their kids are interacting in an online environment, they think twice about what they do and say online. It is by no means clear that restricting online interaction between teens and adults will serve that end.

Online child safety — especially the fear of predators lurking on social networking sites (SNS) — continues to spur calls by state and federal lawmakers for regulation.  At first, some federal lawmakers advocated outright bans on SNS in schools and libraries via the Deleting Online Predators Act (DOPA).  Meanwhile, state and local lawmakers — specifically state Attorneys General (AGs) — have been even more vociferous in their calls for regulation in the form of mandatory age verification for social networking sites, which would cover a broad swath of online sites and activities according to their definitions of SNS. But the question that ultimately gets lost in this debate is: Just how much risk do social networking sites really pose for teens?  Which risks are real and which are overblown? And what’s the best way to deal with the risks that we find to be legitimate?

Nancy Willard CSRIU Nancy Willard devotes her life to answering those questions. Willard is one of America’s leading experts on online safety and risk prevention. She runs the Center for Safe and Responsible Internet Use and she is the author of two outstanding books, Cyberbullying and Cyberthreats and Cyber-Safe Kids, Cyber-Savvy Teens.  In my opinion, Willard’s general approach to online child safety is the most enlightened, level-headed, and likely to be effective. That’s because Willard focuses on putting fears in perspective, identifying the actual risks that kids face online, and devising sensible strategies to deal with risks and problems as they are discovered. Her approach is holistic and built upon sound data, targeted risk-identification strategies, and time-tested education and mentoring methods. For my money, it’s the most sensible approach to online safety issues. In fact, when other parents ask me for “just one thing” to read on the topic, I usually recommend Willard’s work — especially her amazing book Cyber-Safe Kids, Cyber-Savvy Teens. And her background in early childhood education, special education for “at risk” children with emotional and behavior difficulties, as well as experience in computer law, means she is uniquely suited to be analyzing these issues.  In sum, this is woman we should all be closely listening to on these issues.

Recently, Willard has been responding to criticisms that state AGs have leveled against the Internet Safety Technical Task Force (ISTTF) and its final report. [Disclaimer: I was a member of the ISTTF.] I’ve already outlined the ISTTF’s work at length here, but the three key takeaways from the report were that:

  1. the risk of predation on social network sites has been over-stated; the data suggest that cyber-bullying is the bigger problem on SNS;
  2. there is no silver-bullet technical solution to online child safety concerns, and mandatory age verification, in particular, would not make kids safer online but could even create bigger problems in the long-run;
  3. education and empowerment are the real keys to keeping kids safer online.

The response from some state AGs to these findings was quite hostile, with some arguing that the ISTTF did not take online risks seriously enough, or that we relied on “outdated and inadequate” data in reaching our conclusions.  Willard addresses those arguments in a new white paper: “Research that is ‘Outdated and Inadequate?’ An Analysis of the Pennsylvania Child Predator Unit Arrests in Response to Attorney General Criticism of the Berkman Task Force Report.”  In this study, she analyzes data from arrest records from Pennsylvania’s Child Predator Unit to determine exactly how these individuals were operating online. Although it’s just one state’s worth of data — that’s all that seems to have been made publicly available in a single database at this time — it can give us a clue to what might be going on out there. The results are illuminating.

Here’s what Willard found:

The search yielded 143 responses. As noted by the Attorney General, 183 predators had been arrested. All of these arrests were described in the press releases dated from March 21, 2005 to January 13, 2009 – thus allowing for a full analysis of the arrests of sexual predators in the state Pennsylvania for the last 4 years by the Attorney General’s Child Predator Unit. The analysis of the arrests that involved predatory actions, excluding the arrests for child pornography, revealed the following:
  • Only 8 incidents involved actual teen victims with whom the Internet was used to form a relationship.
    • In 4 of these incidents, teens or parents reported the contact. The other 4 cases were discovered in an analysis of the computer files of a predator who had been arrested in a sting operation. Five of the cases had led to inappropriate sexual contact. The other situations were discovered prior to any actual contact.
  • There were 166 arrests as a result of sting activities where the predator contacted an undercover agent who was posing as a 12 – 14 year old, generally a girl.
    • The vast majority of the stings, 144, occurred in chat rooms. Eleven stings occurred through instant messaging. Nine of the arrests failed to specify the location, but the description bore significant similarity to the chat room incidents. One involved an advertisement that had been placed on Craig’s List.
    • There were only 12 reports of predators being deceptive about their age.
    • The descriptions of these chats incidents bear out what the research reviewed by the [ISTTF’s] Research Advisory Board found – that online predators are rarely deceptive about their interests.

Specifically,”Because the attorneys general have been focusing their attention on the social networking sites, MySpace and Facebook,” Willard made sure to give “special attention to any case that mentioned any activity occurring on either of these two sites.” Here’s what she found in that regard:

  • One of the incidents involving an actual teen victim, communications took place on MySpace. This was a rearrest of a person who had already been arrested through a sting.
  • A police officer who was arrested for sexual abuse of many teens with whom he had interacted with in the line of duty also had a MySpace account with friendship links to teen girl, but there was no assertion that these communications had led to sexual activity.
  • One predator in a sting provided the agent with a link to his Facebook page.
  • In 5 of the stings that took place in a chat room, reference was made to the fact that the predator had either looked at the teen’s MySpace account or suggested the teen look at his profile.

Importantly, Willard points out, “Despite the establishment of one or more public profiles on MySpace [by the PA Child Predator Unit], there has apparently not been one successful sting operation initiated on MySpace in the more than two years during which these sting profiles have been in existence.”

From these findings, Willard concludes that:

The insight gained through an analysis of the Pennsylvania Attorney General’s press releases on arrests for online sexual predation provide strong support for the validity of the conclusions of the Berkman Research Advisory Board and demonstrate the need for greater collaboration between law enforcement and researchers to address the actual risks to young people from sexual predators online.

In other words, the Pennsylvania data seem to confirm that predation is not as serious of a risk on SNS as some AGs had claimed. “It appears that chat rooms are far less safe than social networking sites and that there is limited inclination and ability of predators to use social networking sites to contact potential teen victims,” Willard notes. Consequently, she argues:

Attention must be paid to the obvious risks related to chat room communications, as well as the risk factors that are being manifested by the young people who may still be frequenting these chat rooms, especially the chat rooms where sexual relations are being discussed. It appears that rather than seek ways to discourage teens from participating in social networking sites, these sites are destinations that should be encouraged as much safe than the alternatives. A focus must be placed on improving the protective features of chat rooms that are frequented by minors.

We need to know more about which chat rooms are in question and why some youth visit those chat rooms. More importantly, how can we develop sensible messages for youth about the dangers of chat rooms that are targeted to adults and adult sexual activity?

But it is vitally important not to lose sight of the big picture here. As Willard summarizes it:

The incidents of online sexual predation are rare. Far more children and teens are being sexually abused by family members and acquaintances. It is imperative that we remain focused on the issue of child sexual abuse – regardless of how the abusive relationship is initiated.

Indeed, volumes of research on child abuse, child predation, and child abduction all point to this same conclusion: Your kids are actually more at risk from known acquaintances — especially family members — than they are from random strangers (including random strangers they might meet online).

Of course, this doesn’t mean we shouldn’t continue to develop sensible educational messages for youth about proper online behavior and how to report legitimate problems or troubling interactions that they experience online. Again, Willard has done this elsewhere and many of us (including those of us involved in the Berkman Center task force) have long been pushing for increased resources for online safety education and media literacy efforts as the first, best step towards improving online youth safety. We need to get AGs and other policymakers to work together with us to get this important task started — now!

Finally, Willard correctly notes that the AGs and other law enforcement agencies need to be willing to release more data like the Pennsylvania AG did such that further analysis of this problem is possible. If the AGs’ primary complaint with the ISTTF report was that the data we used was somewhat dated, then the best solution to that problem is for the AGs and other law enforcement agencies to open up their records to the child safety community so that risk researchers like Willard can get a better feel for what’s going on out there and devise strategies to deal with it.  Unfortunately, there’s still too much horn-locking going on between these communities and, sadly, I think some AGs are using this issue to create an atmosphere of fear for political gain. We need to find ways to communicate actual risks — such as those that kids would face in some specific, adult-oriented chat rooms — without going overboard and making parents and the general public think that there’s a bogeyman on every cyber-corner of the Internet.

I’ve spent a lot of time in recent years trying to debunk various myths about online child safety or at least put those risks into perspective. Too often, press reports and public policy initiatives are being driven by myths, irrational fears, or unjustified “moral panics.”  Luckily, the New York Times reports that there’s another study out this week that helps us see things in a more level-headed light. This new MacArthur Foundation report is entitled Living and Learning with New Media: Summary of Findings from the Digital Youth Project. This white paper is a summary of three years of research on kids’ informal learning with digital media. The survey incorporates the insights from 800 youth and young adults and over 5000 hours of online observations. The information will eventually be contained in a book from MIT Press (“Hanging Out, Messing Around, Geeking Out: Living and Learning with New Media.”)

From the summary of the study on the MacArthur website:

“It might surprise parents to learn that it is not a waste of time for their teens to hang out online,” said Mizuko Ito, University of California, Irvine researcher and the report’s lead author. “There are myths about kids spending time online – that it is dangerous or making them lazy. But we found that spending time online is essential for young people to pick up the social and technical skills they need to be competent citizens in the digital age.”

Importantly, regarding the concerns many parents and policymakers have about online predation, Ms. Ito told the New York Times that, “Those concerns about predators and stranger danger have been overblown.” “There’s been some confusion about what kids are actually doing online. Mostly, they’re socializing with their friends, people they’ve met at school or camp or sports.”

In the report, according to the summary, the researchers “identified two distinctive categories of teen engagement with digital media: friendship-driven and interest-driven. While friendship-driven participation centered on “hanging out” with existing friends, interest-driven participation involved accessing online information and communities that may not be present in the local peer group.” The specific findings of the study are as follows:

  • There is a generation gap in how youth and adults view the value of online activity.
    • Adults tend to be in the dark about what youth are doing online, and often view online activity as risky or an unproductive distraction.
    • Youth understand the social value of online activity and are generally highly motivated to participate.
  • Youth are navigating complex social and technical worlds by participating online.
    • Young people are learning basic social and technical skills that they need to fully participate in contemporary society.
    • The social worlds that youth are negotiating have new kinds of dynamics, as online socializing is permanent, public, involves managing elaborate networks of friends and acquaintances, and is always on.
  • Young people are motivated to learn from their peers online.
    • The Internet provides new kinds of public spaces for youth to interact and receive feedback from one another.
    • Young people respect each other’s authority online and are more motivated to learn from each other than from adults.
  • Most youth are not taking full advantage of the learning opportunities of the Internet.
    • Most youth use the Internet socially, but other learning opportunities exist.
    • Youth can connect with people in different locations and of different ages who share their interests, making it possible to pursue interests that might not be popular or valued with their local peer groups.
    • “Geeked-out” learning opportunities are abundant – subjects like astronomy, creative writing, and foreign languages.

These findings are consistent with the much of the existing research already out there about online youth behavior and Internet interactions. As I have mentioned here before, over the past year, I have been serving on the Internet Safety Technical Task Force (ISTTF), which was formed following a January 2008 agreement between social networking website operator MySpace.com and 49 state Attorneys General. As part their “Joint Statement on Key Principles of Social Networking Safety,” MySpace promised the AGs it would expand online safety tools, improve education efforts, and expand its cooperation with law enforcement. Importantly, they also agreed to create the ISTTF to study online safety issues and technologies.

The Berkman Center for Internet & Society at Harvard Law School was tapped to run the ISTTF, and the Task Force included a wide diversity of child safety groups, non-profit organization, and Internet companies. During a session the Task Force held in Washington, DC on April 30th, we heard from several of the nation’s top researchers in the field of online child safety. The presentations were quite enlightening and the videos of the sessions — as well as supporting materials — have all been posted on a special Berkman Center website. I just wanted to share all of those links with you here so that you have access to these wonderful materials. As you will see, they tell the same story the new MacArthur report does: Almost everything the press and policymakers have told us about online child actions and safety has been wrong.

When the final ISTTF report comes out later this year, it will include a massive compendium of all the relevant surveys and academic research done in this field. This week, I have been up at Harvard University participating in another meeting of the Internet Safety Technical Task Force (ISTTF), of which I am a member. The ISTTF was organized earlier this year pursuant to an agreement between 49 state attorneys general (AGs) and social networking giant MySpace.com. A group of experts from academia, non-profit organizations, and industry were appointed to the Task Force, which is charged with evaluating the market for online child safety tools and methods and issuing a report on the matter to the AGs at the end of this year.  ISTTF members have been meeting privately and publicly in both Cambridge, MA and Washington, D.C. The Task Force has been very ably chaired by John Palfrey, co-director of Harvard’s Berkman Center for Internet & Society.

Although the ISTTF is looking at a wide variety of tools and methods associated with online child protection (ex: filters, monitoring tools, educational campaigns, etc.), many of the AGs who crafted the agreement with MySpace that led to the Task Force’s formation have made it clear that they are most interested in having the ISTTF evaluate age verification / online verification technologies.  In fact, at the start of this week’s session at Harvard Law School, AGs Martha Coakely of Massachusetts and Richard Blumenthal of Connecticut both spoke and made it abundantly clear they expect the Task Force to develop age and identify-verification tools for social networking sites (SNS). AG Blumenthal said we need to deal with “the dangers of anonymity” and repeated his standard line about online age verification: “If we can put a man on the moon, we can make the Internet safe.”  [Of course, putting a man on the moon took hundreds of billions of dollars and a decade to accomplish, but never mind that fact! Moreover, one could also argue that if we can put a man on the moon we can cure hunger, AIDS, and the common cold, but some things are obviously easier said than done. Finally, putting a man on the moon didn’t require all Americans or their kids to give up their anonymity or privacy rights in order to accomplish the feat!]

On many occasions here before, I have outlined various questions and reservations about proposals to mandate online age verification.  Last year, I also published a lengthy white paper on the issue and hosted a lively debate on Capitol Hill [transcript here] about this.  I also have discussed age verification in my book on parental controls and online child safety. [Braden Cox also talked about his experiences up at Harvard this week here, and CNet’s Chris Soghoian had a brutal assessment of this week’s proposals on his “Surveillance State” blog.]

In this essay, I will discuss the new fault lines in the debate over online age verification and outline where I think we are heading next on this front.  I will argue:

  • There is now widespread understanding that it is extraordinarily difficult to verify the ages and identities of minors online using the methods we typically use to verify adults. Because of this, age verification proponents are increasingly proposing two alternative models of verifying kids before they go online or visit SNS…
  • First, for those who continue to believe that we must do whatever we can to verify kids themselves, schools and school records are increasingly being viewed as the primary mechanism to facilitate that. This raises two serious questions: Do we want schools to serve as DMVs for our children? And, do we want more school records or information about our kids being accessed or put online?
  • Second, for those who are uncomfortable with the idea of verifying kids or using schools, or school records, to accomplish that task, parental permission-based forms of authentication are becoming the preferred regulatory approach. Under this scheme, which might build upon the regulatory model found in the Children’s Online Privacy Protection Act of 1998 (COPPA), parents or guardians would be verified somehow and then would vouch for their children before they were allowed on a SNS, however defined.  But how do we establish a clear link between parents and kids?  And will parents be willing to surrender a great deal more information (about themselves and their kids) before their kids can go online? And, is it sensible to use a law that was meant to protect the privacy and personal information of children to potentially gather a great deal more information about them, and their parents?
  • It remains very unclear how either of those two verification methods would make children safer online. Indeed, that could actually make kids less safe by compromising their personal information and creating a false sense of security online for them and their parents.
  • It is highly unlikely the Internet Safety Technical Task Force will be able to reach consensus on this complicated, controversial issue. A small camp will likely flock to the sort of proposals mentioned above. Another, larger camp (including me) will flock to education-based approaches to child safety as well increased reliance on other parental empowerment tools and strategies, industry self-regulatory efforts, social norms, and better intervention strategies for troubled youth. But the age verification debate will go on and, as was the case over the past two years, the legal battleground will be state capitals across America, with AGs likely pushing for age verification mandates regardless of what the Task Force concludes.

How We Could Verify Kids, and Why We Should Not Do It

Let’s assume that we want to achieve AG Blumenthal’s “man-on-the-moon” dream of verifying all kids before they go online. How would we do it?  There are really only two solutions: (1) full-blown national ID cards for kids, or (2) tapping school records about kids to somehow age-verify kids (sort of a “National ID card-Lite” scheme).

National ID Cards for Kids

The first scheme is fairly straightforward, but incredibly frightening to those of us who care about civil liberties. Basically, government could demand that all minors be issued the equivalent of a domestic passport or a national ID card. After all, minors aged 14 to 17 are already required to obtain a passport before they travel overseas. Minors under 14 must have both parents or legal guardians appear together to vouch for the child when applying for a passport. Conceivably, government could simply extend this model to incorporate a domestic identification requirement. Once the youngster had been issued such a domestic passport, it could be requested by others — including social networking sites — as proof of age. Sites could cross-reference a government national ID database to verify identity.

Clearly, however, imposing such a solution domestically would raise serious privacy concerns because it would require the collection, retention and processing of sensitive information about children.  Adults are not required to carry such a domestic passport or national ID card, so why should children? Indeed, all the same privacy concerns related to national ID cards for adults would be amplified with children because, as a society, we generally take extra precautions to protect the privacy of minors and their personal information. And a national ID card for kids would need to include a great deal of information about themselves to allow the card to be used by third parties online as an age-verifying tool. Government would need to issue an age-verified identity, user name, and password to every child.

Particularly concerning is the fact that a national ID card for children would require the creation of more government databases and bureaucracy. The potential for “mission creep” then enters the picture in that more tracking of children by government (and others) becomes possible. What other uses might there be for such information? We don’t know, and we probably don’t want to find out.

The costs of setting up and enforcing such a system would be substantial and must also be considered. Although the cost of digital storage continues to fall, we’re talking about potentially massive digital databases here. But the more important cost factor is the human time and effort that would go into  collecting, processing, and organizing such records and databases.

For those reasons, a government-issued ID card or age verification scheme for kids is a nonstarter. It would raise grave privacy concerns, induce public paranoia, probably encourage a great deal of evasion, and require significant government expenditure to enforce. Moreover, a national ID card would do little to prevent youngsters from visiting offshore sites.

Using the Schools to Help Verify Kids

So, let’s work from the assumption that National ID cards for kids is not going to fly as an online identity authentication solution.  The only other realistic scheme would involve getting the schools involved in the process.  Why?  Because to paraphrase Willy Sutton: “That’s where the data is.”  Schools have more information about our children than probably every other institution or organization combined.  They have very detailed records about kids, their ages and much more, which makes schools a logical candidate for participation in a possible age verification system for minors.  But involving schools in any age verification scheme would raise serious privacy concerns and administrative problems.

Depending on how the scheme worked, the administrative burdens imposed on schools could be significant. Someone at each school would have to be in charge of answering phones calls and e-mails from potentially hundreds of website operators looking to age-verify minors. Who will be liable if things go wrong? The school? The school district? An employee in the school’s administrative department who accidentally releases thousands of digital records? And will schools receive the additional funding needed to administer whatever scheme is mandated?

Moreover, if schools are required to create more accessible databases containing personal information about minors, who else besides social networking websites would be given access? Data breaches would become a real concern for both students and schools alike. Such a scheme could run up against federal or state laws. For example, the Family Education Rights and Privacy Act of 1974 makes it illegal to release school records without written permission from parents. Both parents and government officials have long demanded that access to school records be tightly guarded because, as a society, we take the privacy of our children very seriously.

Thus, serious questions remain about the wisdom and practicality of roping the schools into the age verification process. Most schools and school districts are already over-burdened with federal and state mandates and probably wouldn’t like the sound of additional mandates of this variety.  But what if a technology vendor could serve as the middleman and facilitate the easy transfer of some basic data about kids from the school system in an effort to provide digital credentials? That’s probably where we are heading.  Even the most vociferous advocates of age verification for minors must realize how absolutely radioactive this issue could become since school records about our kids are in play here.  Identity theft concerns are already running at an all-time high in our country and the thought of being required to surrender more info about our kids in this environment is not going to go over well with many parents.

But, again, what if we could keep to a minimum the amount of data being transferred about the child to the vendor or the SNS?  Perhaps at the beginning of each school year when a minor is registering they could be given a “secure” digital token or ID number that only associated a grade year (i.e., “sophomore”) with their name, and little or no additional info was included in that token in order to minimize the threat of identity theft or privacy violations.  Of course, the fewer pieces of information contained in that token or credential, the less likely it will be a credible verification tool, or the more likely it is it will be easy to forge or defeat (especially by kids themselves).

Regardless, whether we like it or not — and I do not like it one bit — schools are now at the center of the online age verification debate. It will be very interesting to hear what the educational community itself has to say about this development going forward.  Incidentally, no one from the educational community was present at Harvard this week as these proposals were flying.  Something tells me that school administrators and educational officials aren’t going to look too kindly on proposals that would turn them into the equivalent of a DMV for kids.

How about Parental Permission Slips for Online Verification?

Another potential way to go about online verification is to avoid verifying the kids directly and instead just verify parents (or guardians) and then get them to vouch for their children.  Some age verification advocates are now calling for such parental consent-based forms of child verification.  Specifically, they are now attempting to drive regulation through the prism of the Children’s Online Privacy Protection Act (COPPA) of 1998.

By way of background, COPPA required websites that marketed to children under the age of 13 to get “verifiable parental consent” before allowing children access to their sites. Generally speaking, the goal was to make sure that such websites were not collecting personal information about children without getting parental permission. The Federal Trade Commission (FTC), which is responsible for enforcing COPPA, adopted a sliding scale approach to obtaining parental consent. The sliding scale approach allows website operators to use a mix of the methods to comply with the law, including print-and-fax forms, follow-up phone calls and e-mails, and credit card authorizations. The FTC also authorized four “safe harbor” programs operated by private companies that help website operators comply with COPPA.

In a February 2007 report to Congress about the status of the COPPA and its enforcement, the FTC said that no changes to COPPA were necessary at this time because it had “been effective in helping to protect the privacy and safety of young children online.” In discussing the effectiveness of the parental consent methods, however, the agency also said that “none of these mechanisms is foolproof” and that “age verification technologies have not kept pace with other developments, and are not currently available as a substitute for other screening mechanisms.” This seems to imply that the FTC does not regard COPPA’s parental consent methods as the equivalent of perfect age verification.

Nonetheless, what should be evident here is that COPPA’s parental consent framework could serve as a vehicle for pushing through greater regulation of all social networking sites, not just those sites geared toward kids under 13.   Indeed, we have already seen that proposed at the state level.  For example, in the debate that took place over age verification in the North Carolina statehouse last summer, a parental permission-based verification proposal supported by North Carolina Attorney General Roy Cooper was billed as a way to strengthen and expand the COPPA framework.  (Never mind the fact that COPPA is a federal statute, or that the state of North Carolina is likely barred from regulating Internet speech and commerce thanks to the First Amendment and the Commerce Clause of the Constitution!)

In other words, future age verification mandates could arrive in the form of COPPA amendments, or at least cite COPPA’s regulatory framework as precedent.  Specifically, the proposal would be to: (a) extend COPPA’s coverage to kids up to the age of 18 and then (b) broaden the range of SNS sites that are covered by its parental consent requirements.

There are many problems associated with such a proposal, and I will get to some of them in a moment. But here’s the more interesting question that few have asked: Is COPPA really working?  It is very much unclear to me that COPPA actually works as billed, but to the extent it does, it is likely because of the very limited scale and nature of the operations it covers.  As I have said in my past writing on the issue, there is a direct relationship between the size of a site and the likelihood of success in attempting to verify its users / members. Of course, that is hardly surprising.  But let’s get a little more concrete about why that is important.  Here are the two reasons that I believe the COPPA / parental consent regime has generally worked so far, or at least hasn’t failed miserably:

(1) Many smaller sites charge a fee for admission; and

(2) The functionality of those sites is usually tightly limited. They are closed, walled gardens.

Regarding the first point: Obviously, the more a site charges for access, the more likely it is that the parent / guardian pays attention to what their kid is doing.  Of course, that doesn’t mean a bad guy couldn’t still get into those “verified” environments under false pretenses.  And there’s the problem of minors with access to credit cards.  Moreover, even assuming credit cards worked as an age verification method, there is the more practical question of whether lawmakers have the guts to mandate that every social networking site in the land start charging admission for access.  Since almost all SNSs are free-of-charge today, that is not going to be a very popular mandate!

Nonetheless, for very small, niche-oriented social networking sites geared toward younger kids, credit cards and fees are part of the reason people think COPPA has “worked.”  In essence, it acts as a bit of a roadblock or hassle thrown in the way of access, and that gets parents thinking and talking to the kids about those sites. That is the argument put forward by Denise Tayloe of Privo, one of the four FTC-approved COPPA safe harbor providers.   Ironically, Tayloe has noted that one of the problems associated with the current COPPA regime is that “Children quickly learned to lie about their age in order to gain access to the interactive features on their favorite sites. As a result,” she notes, “databases have become tainted with inaccurate information and chaos seems to be king where COPPA is concerned,” she says.

Despite these problems, Tayloe argues that COPPA serves an important role.  Even though “there is no perfect solution” and it is not possible to completely “stop a child from lying and putting themselves at risk,” Tayloe believes that COPPA “provides a platform to educate parents and kids about privacy.”  Of course, providing a platform to educate parents and kids about online privacy or safety is very important, but it is not necessarily synonymous with strict age verification.  And we don’t really have any idea what level of parent-child interaction COPPA incentivizes.  More importantly, we don’t really have any good data regarding the accuracy of claims made pursuant to COPPA’s requirements regarding the relationship between parents and the kids seeking access to the site.  How many people (kids or adults) were able to gain access under false pretenses? We don’t know.

Nonetheless, the operating assumption here is that by creating an added economic hurdle or barrier to entry (in the form of the hassle of filling out paperwork or forms), COPPA gets some parents (perhaps most?) to put more thought into what their kids are doing online, and that somehow improves online safety in larger scheme of things.  The problem is that that does not necessarily mean that their kids are operating in perfectly “secure” or “verified” environments.  The danger is that – to the extent some “bad guys” are getting on those sites under false pretenses – kids and parents may fall prey to a false sense of security after they are told the site is COPPA-verified.  Of course, COPPA wasn’t put on the books to keep “bad guys” away from kids online; it was about keeping site operators from collecting personal information about kids.

The second reason COPPA has “worked” to a limited degree is that SNS sites geared toward younger kids tightly limit functionality.  In essence, the site administrators “cripple” the sort of functionality we find in SNS sites geared toward older kids.  That fact alone makes these sites far less likely to be subject to fraudulent entry or dangerous interactions.   If I am an older teen or a pervert, why would I ever want to gain access to a site that has nothing more than drop-down menus and a few buttons to click on when interacting with others?  Thus, the primary reason that kids are likely safer in those environments has almost nothing to do with COPPA’s parental consent mechanisms and almost everything to do with the fact that most of the sites it covers are tightly controlled walled gardens with very limited functionality.

With these facts in mind, let’s gets back to the ultimate question: What would happen if we tried to apply COPPA to all social networking sites for kids of all ages? The threshold question that would need to be answered remains the same as it does today: How do we verify the parent-child relationship when someone asserts they are the parent or guardian?  That’s a very thorny question.  But let me just list out the many other questions that everyone is overlooking here:

(1) What sort of mechanisms will need to be put in place to guarantee that the parent or guardian is who they claim to be (for both initial enrollment and subsequent visit authentication)?  Sign-and-fax forms can be easily forged, so credit cards (and perhaps mandatory user fees) will likely become the default solution. A third method, follow-up phone calls, just doesn’t seem practical.  But might lawmakers demand a mix of all of the above?

(2) Regardless, how burdensome will those mandates be for parents / guardians?

(3) And how burdensome will those mandates be for SNS site operators? What kind of compliance costs / legal penalties are we talking about?

(4) Will the barriers to site enrollment become economic in character such that it requires previously free social networking sites to charge admission?

(5) If so, could that be a disadvantage to low-income families / youth?

(6) If compliance costs go through the roof for SNS sites, will this be a recipe for massive industry consolidation in order to comply with the mandates?

(7) Who is collecting the massive databases of information created by such a mandate for all SNS? Who has access to that data? What might government use it for?

(8) Will this new regime be applicable to offshore sites? And will kids flock to offshore sites as a result of such mandates on domestic sites? If some do, how will we stop them?

And so on.  Bottom line: The future of age verification battles will likely be increasingly tied up with COPPA and the question of how well parental permission-based forms of authentication might work. It is unlikely, however, that such a framework could be easily applied on “Internet scale.”  There is a world of difference between something like Disney’s “Club Penguin” and MySpace, Xanga or Bebo.  And with social networking capabilities being integrated into every site and service these days — from CNN.com to Microsoft’s Xbox Live service — one wonders how that will magnify the compliance costs and hassles for all involved.  Are parents really going to be expected to verify themselves and then their kids for every “social networking site” their kids want to visit?  That seems unnecessary, unworkable, and potentially counter-productive.

Finally, the irony of a proposal to expand COPPA in this fashion is that lawmakers would be using a law that was meant to protect the privacy and personal information of children to potentially gather a great deal more information about them, and their parents!  It’s important we not overlook the privacy implications of any effort to expand COPPA to do something it was not originally intended to cover.

Conclusion

It will likely be very difficult for the Technical Task Force to reach consensus on these controversial and complicated issues.  There are many challenging technical, legal, and even philosophical issue in play here.  The problem is that this Task Force is charged with looking at technical solutions and yet most child safety advocates and academics on the Task Force are of the mind that technical solutions are only one part — and probably the smallest part — of the sort of “layered solution” to online child safety that I describe in my book on “Parental Controls and Online Child Protection.” As I argue in that book:

“the best answer to the problem of unwanted media exposure or contact with others is for parents to rely on a mix of technological controls, informal household media rules, and, most importantly, education and media literacy efforts.”

In sum, we need to get serious about talking to our kids about online safety and proper online behavior. Education is the key, and government has a major role to play in that regard in the classroom and through awareness-building efforts. And technical tools that empower parents to better monitor and guide their child’s online experiences can help too. Social networking sites and other online service providers can offer more of those tools and also take additional steps to improve the safety of their sites and encourage a dialog about appropriate and inappropriate online behavior. Again, it’s a multi-layered effort with education and communication at the core of the plan.

It’s not like I am saying anything new here. Indeed, that layered approach was the recommended approach of two previous online safety blue ribbon task force efforts: The 2000 COPA Commission and the 2002 National Academy of Sciences “Thornburgh Commission.” And every major book about online child safety published over the last 5 years has come to the same conclusion.

But that is not likely going to be enough for state attorneys general. There is no other way for me to state this than to just come right out and say it: The AGs are looking for a silver-bullet technical solution to a complex problem they do not fully understand.  And age verification schemes are the technical bullet du jour.

Alas, for all the reasons I have stated here and elsewhere, age verification schemes are likely to fail miserably.  Even if age verification systems worked as billed, it is unlikely that kids would really be any better off.  All the academic research in this field points to a single, inescapable conclusion: The primary danger to kids online is not adult predators, it is other kids.  In particular, it is peer-on-peer harassment and cyber-bullying.   As parents and a society, we have to do more — a lot more — to address that problem.

Age verification schemes, however, aren’t going to help us solve that problem.  Worse yet, by creating the illusion of safety, it could compromise our children’s privacy in the process and create a false sense of security when kids or their parents come to believe they are operating in “trusted” online environments.  For the sake of our children, it is essential we not fall prey to such a fatal conceit.

A Response to Sen. On Monday, October 9th, Sen. Joe Lieberman (D-CT) delivered a major address about Internet content and online child safety that was intended to serve as a sort of call-to-arms for policymakers, parents and industry to get more serious about the issue.

In his wide-ranging remarks, Lieberman bemoaned the relentless pace of technological change and how the Internet and digital media technologies were making it increasingly difficult for parents to protect children from objectionable material or, worse yet, child predators. “The Internet is a wondrous, revolutionary medium,” Lieberman said. “But there is too often a thin line between the awe-inspiring and the simply awful, and with each new technological breakthrough, it seems that the opportunities for our children to fall into that awful gap grow greater and graver.”

In this essay, I will dissect Sen. Lieberman’s manifesto and provide a detailed response to his assertions and proposals. I feel this is necessary because his address touches on many of the major themes and proposals that are framing the debate over Internet regulation that is taking place in America today.

BACKGROUND: WHY WE SHOULD TAKE JOE SERIOUSLY

Sen. Lieberman delivered this address while campaigning in Connecticut as he attempts to retain his Senate seat against Democratic Party challenger Ned Lamont. But this was much more than just another stump speech and Sen. Lieberman is certainly no Johnny-come-lately to the debate over media content.

Sen. Lieberman has a long track record of advocacy on media issues, especially video game regulation and rap music lyrics. Over the past two decades there was probably no other member of Congress–with the possible exception of former Democratic Senator Fritz Hollings–who was more vociferous on these matters. In fact, the pressure Sen. Lieberman single-handedly brought to bear on the video game industry back in the mid-90s drove it to adopt a voluntary ratings system. And he supported several other legislative measures through the years, including the Media Marketing Accountability Act of 2001, which proposed federal regulation to control how media / entertainment products were advertised and marketed. (In this 2002 Cato Institute publication, I critiqued the Media Marketing Accountability Act in detail starting on pg. 6).

In other words, when Sen. Lieberman delivers a major address on these issues, it’s worth paying close attention because he is a thought leader in this field. Moreover, he is helping to change to the way Democrats– the traditional defenders of unfettered freedom of speech and expression in Washington–think about these issues. Even if he doesn’t win his re-election bid, he’ll likely remain a major player in this debate and others in Congress will use the playbook he has put together during his two-decade tenure in the Senate. Finally, the concerns that Lieberman raises are real concerns for many parents out there, including my wife and me who are busy raising two Information Age kids.

ARE KIDS REALLY LESS SAFE BECAUSE OF THE NET?

In his address, Lieberman argued that “technology is changing more rapidly than our ability to protect our kids. I believe the time has come to fight back. Not to stop the march of progress–but to help parents keep pace.” Lieberman laments that:

“parental supervision is becoming ever-more challenging now that the Internet is accessible on many kinds of devices, including cell phones. It’s one thing for a parent to turn off the TV, like I did when my daughter was watching that raunchy show more than a decade ago. But today, kids have access to a whole new hidden world of entertainment through a wide variety of devices, many of them small enough to fit in a shirt pocket.”

No doubt there is a great deal of truth in this statement. The world has changed in some very important ways and the Internet and online content creates some new and unique challenges for parents like me.

But Lieberman seems to only focus on the negative aspects of these changes in his remarks. For example, Lieberman uses the Mark Foley scandal to illustrate the supposed dangers of the Internet and instant messaging. “Because of Mark Foley’s use of instant messaging to prey on young pages, more parents are now familiar with that particular risk.”

It is somewhat irresponsible, in my opinion, for Lieberman to suggest that the Foley scandal illustrates the “particular risk” of instant messaging to kids. What the Foley case instead proves is what many studies about child predators have repeatedly made clear: The vast majority of children who are threatened or sexually abused are victimized by family, friends of family and people who have close relationships with (or the trust of) minors. In this case, Rep. Foley already knew the minors and was “grooming” them using frequent instant messages. But the important point here is that Rep. Foley had already met these boys in the real, physical world and had gained their trust there. Does it really make a difference how he communicated with them after that? If Foley has used telephones to groom these minors, would Sen. Lieberman suggest that the Foley case illustrated the “particular risk” of letting kids use phones?

Lieberman also suggests that, along with the Foley scandal, a couple of high profile child predation cases that involved Internet contact, “represent just the tip of an iceberg of indecent activity spurred on by the Internet. One study reported that about one out of every six children online receive a sexual solicitation. That is a frightening statistic–and an even more frightening reality for today’s parents.”

First of all, Sen. Lieberman gets that 1-in-6 number from the second “Youth Internet Safety Survey” (“YISS-2”), but he misreports it. The actual number is one in seven (13%), not one in six. Second, the correct 1-in-7 number is actually a reduction from the 1-in-5 (19%) result from the first (“YISS-1”) survey. So things have improved somewhat (but clearly that is still a troubling number). Third, and perhaps most importantly, what Sen. Lieberman didn’t mention is that a significant percentage of those “solicitations” are kids talking to other kids. When 17-year old Johnny propositions 16-year old Jenny, it’s a “solicitation” for purposes of studies like this. Of course, teens were delivering salacious solicitations to each other long before the Internet came along, but parents (and policymakers) had no way to track it unless they found a dirty note in their school bag or pants pocket. This is not to condone the rude and raunchy behavior that some teens engage in, but let’s be realistic about this issue and understand that, in a certain sense, this problem has always been with us. It’s just far more visible to us now.

That being said, there is no doubt that there are many adult predators out there who are using the Internet and new communications technologies in an attempt to contact kids and groom them. If an adult is using the Net to sexually proposition a child in any fashion, it is a serious problem. (Down below I discuss what we should be doing about it). But, again, let’s put things in a little perspective here. Predators can’t magically reach through a computer screen and grab our kids. They have to meet them somewhere in the physical world (i.e., a mall, a playground, etc). The danger of the Internet is that it allows predators to groom minors over a protracted period of time but they are doing so at a distance.

But the fact that they are doing so at a distance and over electronic communications networks means that we have actually gained some important advantages in our effort to combat child predation. Many of these predators leave digital tracks for us to follow. Hopefully, law enforcement officials are doing whatever it takes to follow those tracks and catch the bad guys before they hurt our kids.

But, like so many other politicians who sound off on this issue, Sen. Lieberman repeatedly shifts the blame and responsibility for this problem back to private companies: “Internet companies, he argues, “[should] come up with more effective software… to keep predators away from [children]” and that “major websites frequented by children should pursue new approaches to block child sex offenders from logging onto them.”

When Lieberman wrote that, did he stop to ask himself what the government is doing to deal with this problem? After all, at root, the most essential role that government has is protection of the people from harm, especially helpless kids. It is not the job of private companies to enforce law and order or bring bad guys to justice. That is the government’s job. And they aren’t doing a very good job of it when it comes to online child safety. Consider this fact: A 2003 Department of Justice study reported that the average sentence for child molesters was approximately seven years and, on average, they were released after serving just three of those seven years.

Now, let me ask an obvious question: WHY ARE THESE CREEPS WALKING THE STREETS? Why is our government only putting people who viciously hurt innocent children behind bars for just seven years and then letting them out after just three? Why is Sen. Lieberman saying that “major websites frequented by children should pursue new approaches to block child sex offenders from logging onto them”? Excuse me, but why are know sex offenders logging on to those sites at all! Why are they not in prison and why have they not been denied access to computers!

This is what gets me so incensed about the debate over online child protection today: Policymakers are fond of pointing fingers at everyone else and scolding them for not doing enough to protect children from predators, all the while conveniently ignoring their own policies that allow those predators to be on the streets and behind keyboards in the first place! It’s not “market failure” at work when child predators are lurking behind keyboards, it is government failure in the extreme.

If those bad guys committed crimes before, then they should probably still be sitting in a jail cell instead of in front of a keyboard trying to lure our children in. And even if they haven’t committed a crime against children before, the government should be using its resources to find those who attempt to lure our children and see if they can catch them in a sting operation before they harm our children. Website operators, ISPs and all online companies will be happy to assist in that effort when a potentially threatening individual is identified or suspected. Most of them already have firm policies in place of working with law enforcement to identify threats and take action against them in conjunction government officials. And all online operators are required by law to report any incidence of child predation or child pornography to the National Center for Missing and Exploited Children (NCMEC) immediately, which they will gladly do when they see it. After that, it’s up to law enforcement to do the right thing and put these predators away for a long, long time.

So when Sen. Lieberman calls for Internet companies to take steps to solve the child predator problem, he is starting in the wrong place. Internet companies will always be willing to do whatever it takes to root out this despicable element online. After all, what good does it do them to have these creeps lurking on their networks and trying to prey on young users? It’s not like that’s good for business.

But the first order of business is for government to get its act in order and get far more serious about protecting our children from online threats. Luckily, the recently passed Child Safety Act is good step in the right direction since it increases mandatory minimums for child predators. But more can be done to train, equip and fund law enforcement efforts to find the bad guys. In the meantime, let’s not blame the Net for all our problems or expect online operators to solve this problem with a simple software fix. That’s a horribly short-sided and completely backwards way of dealing with this problem.

LIEBERMAN’S PLAN FOR THE “BAD PICTURES” PROBLEM

What I have been discussing above is Sen. Lieberman’s plan for how to deal with what I call the “Bad People” problem versus the “Bad Pictures” problem. In my work on these issues, I generally break down online safety and parental control issues into these two major categories and deal with them separately. “Bad pictures” is simply shorthand for all potentially objectionable content, and the “bad people” problem refers to the predators or child pornographers lurking online.

In this next section, I want to address Sen. Lieberman’s 3-prong plan to deal with “Bad Pictures” problems.

1 – Corporate Responsibility Part 1 of Lieberman’s plan is to “demand more corporate responsibility” and this part of the Lieberman’s proposed agenda has three subcomponents: (a) Industry self-censorship; (b) Providing more tools to parents; and, (c) More education efforts.

(a) First, Lieberman suggests that a fair degree of corporate self-censorship is in order.

“The big [media] corporations should also do more to clean up their own act on the Internet… Today I call on the largest businesses involved in the Internet to hold a summit to develop industry standards for protecting children from inappropriate content on the web.”

I find this to be the most troubling aspect of the “corporate responsibility” portion of Lieberman’s manifesto. When lawmakers or regulators call for self-censorship, and even go so far as to suggest what types of content that media creators should self-censor (as Lieberman does at points in his address), then it is tantamount to actual government censorship. Elected leaders have coercive powers at their disposal to threaten media creators or distributors to do things they otherwise might not do. (I provided a recent example of this in an essay last year about how Washington lawmakers and regulators bullied cable and satellite companies into “voluntarily” adopting “family-friendly tiers” of programming.)

There is a fine line between government officials using the power of the bully pulpit to preach morality and the direct censorship of media content.

(b) Lieberman also suggests that digital media operators and distributors should provide more tools to parents to shield their children from potentially objectionable Internet content. “[B]ig Internet companies could also finance a major research and development program to come up with more effective software to keep children away from unsafe Internet sites, and to keep predators away from them.”

It’s tough to argue with this recommendation. Empowering parents by giving them more tools is always a good idea. But it’s also important to acknowledge that some important strides have already been made in terms of parental empowerment. As I documented in my recent study “Parents Have Many Tools to Combat Objectionable Media Content,” families have an unprecedented level of parental control options at their disposal. Certainly there is room for improvement, and critics like Lieberman can always argue that media and communications companies should “do more” to address the concerns parents have. But media producers and digital content distributors are already doing quite a bit in terms of providing filters, set-top box controls, online websites with helpful tips, and so on.

Of course, whether or not parents are taking advantage of the tools and options at their disposal is another matter entirely. Indeed, the biggest problem I have identified in the debate over parental controls and child protection is the old “You can lead a horse to water but you can’t make them drink” conundrum. No matter how good the parental controls or ratings systems are that you give parents, for whatever reason, some of them just never use them. For example, we still can get more than 15% of American households to use the V-Chip even thought that filtering tool is available in every TV set today. And many parents still let their kids watch movies or play video games that are clearly labeled for older, more mature audiences.

Some of this might be due to simple laziness or the (somewhat arrogant) belief by some parents that their kids are different (i.e., “better”) than other kids and so they don’t have to worry about this. But in the forthcoming second edition of my survey of parental control tools and methods, I conclude that the primary reason that many parents don’t bother to use many of the tools at their disposal is because they already use a wide variety of informal “household rules” to tailor their media experience to their family’s specific needs or values. “No TV or video games until you finish your homework” or “No TVs, computers or game consoles in your bedroom,” are two such rules that are popular in many households. But there are countless other informal household rules and these rules are often a far more effective way of dealing with these issues. The parental control tools or technologies that media providers offer simply supplement–not supplant–these rules in many households. And that’s the way is should be. There is no silver-bullet technology that can take over our parenting duties. But parental control tools and technologies can make our job a little easier. (Personally, I look at parental control tools as speed bumps that can slow my kids down a bit before I can talk to them about media content or decide whether or not I want them consuming that content at all).

(c) Education is the final component of Senator Lieberman’s “corporate responsibility” agenda and it is the most commendable portion of it.

“The big Internet companies should fund a national campaign to educate parents about the online risks faced by their children, and how they can best protect their families. That campaign should also focus on teaching kids to be careful about sharing personal information…”

Again, it’s tough to argue with this recommendation. Education is always the best answer, in my opinion, and it should be the first option we turn to before many of the other steps Senator Lieberman recommends in his address. I recently called for all Internet and digital media operators to consider getting together and crafting a voluntary “online code of conduct” to preempt government calls for regulation and a unified education effort was a major component of this code. This education effort would include a significant expenditure of funds to finance public service announcements (PSAs) or sponsor other parental / consumer education efforts to promote awareness. Other educational efforts might include: more clearly-worded and easy-to-implement “how-to” guides with all products or (when applicable) “out-of-the-box” set-up guides to help users immediately enable parental enable controls / filters; clearly displayed links, buttons or phone numbers (i.e., “hotlines”) for parental / child assistance; and more online points of contact and reference to help explain parental controls, ratings or filters.

So, Sen. Lieberman is on solid ground here and I would hope industry would take him up on this part of his challenge. (Moreover, I wouldn’t mind seeing government get far more serious about media literacy efforts in the classroom to teach children how to be savvy media users / consumers.)

2 – Parental Responsibility The second major prong of Lieberman’s plan involves parents. “We also have to demand more parental responsibility,” he argues. He goes on to say that:

“Parents have the first duty to protect their kids and are usually the last line of defense. Now, given the omnipresence of the Internet and the unique challenges that presents, parents need to be more vigilant than ever. It’s no longer enough to keep the computer in the family room when most parents have no idea what chat acronyms mean. Parents need to tell their kids not to share personal information and to tell them when they receive online sexual solicitation.”

Again, it impossible to argue with any of this (although I still think parents can be the FIRST line of defense, not the last as Lieberman suggests). And, as I mentioned above, I believe that household media rules are an essential part–probably the single most important part–of the parental controls and online child protection mix of efforts. In my upcoming study on these issues, I document the many ways that parents can devise practical household rules and create what I refer to as a good “media diet” for their families. Parents need to take a “food pyramid” approach to media consumption: Teach kids the importance of a balanced (media) diet and also teach them what types of things that should probably be avoiding altogether. But just as government doesn’t enforce the food pyramid through regulation, nor should it enforce the media food pyramid idea through force of law. Unfortunately, however, that’s exactly what Sen. Lieberman next proposes.

3 – Government Regulation The third and final component of Sen. Lieberman’s plan involves government regulation. “[P]arents can’t do it all on their own,” he argues. “There are some things that the government can and must do to help make this hard job a little easier. And there are some things that only the government can do prevent crime and keep kids safe.”

In particular, Lieberman used the occasion to highlight the hodge-podge of regulatory proposals contained in a Senate bill (S. 1507) he has co-sponsored called “the Internet Safety and Child Protection Act.” This bill would:

  • Require adult websites to conduct online ID checks using age-verification software.
  • Tax online pornography to fund an Internet Safety and Child Protection Trust Fund.
  • Create a cyber tip line in the Office of Juvenile Justice
  • Establish Internet Crimes Against Children Task Forces in each state
  • Fund research into new filtering technologies
  • And support education programs on child Internet safety.

Let me be clear: I do not oppose all government efforts on this front. In fact, I can support things like federal educations programs on child Internet safety, a federal “cyber tip” line (although such a thing already exists at NCMEC), Internet safety task forces, and perhaps even some federal funding for filters (although I’m very concerned about what sort of strings might be attached to the funding of filters and I’m sure that some of my other friends in the First Amendment community would be absolutely apoplectic about this proposal).

But ideas like taxing online pornography and age-verification mandates raise a whole host of other issues. Adult entertainment providers are already taxed as businesses, so what Lieberman is essentially proposing is a tax on a specific form of content or speech. That opens a big can of First Amendment worms and, even if it somehow passed constitutional muster when tested in the courts, it would be completely ineffective at stopping offshore sites from providing the same material tax-free.

Likewise, age-verification raises serious privacy concerns for adults and can be easily evaded or duped. And the legal issues aren’t settled here either. A legal battle continues to rage in the courts over the Child Online Protection Act of 1998 (COPA), which sought to block underage access to websites. COPA was held unconstitutional and blocked by the courts (although the Department of Justice is apparently still working hard to enforce it).

Thus, the regulatory solutions Lieberman endorses are only likely to create more legal wrangling in the courts and even if they went into effect they would be unable to deal with the global scope of the Internet and digital content.

CONCLUSION

Sen. Lieberman wants to protect kids. So do I. So does everybody else I know. But how we go about protecting them is important because, in a diverse culture like ours, different families will have different values and tolerance levels when it comes to speech and media content. Sen. Lieberman clearly has his values. My wife and I have our own, and I have a feeling they are quite different than the Senator’s. And I bet yours are different, too. And that’s OK. In fact, it’s a wonderful part of our pluralistic society.

I agree with Sen. Lieberman when he says in his address that “information is power.” Unlike him, however, I am far more wary of giving government too much power over information. I do, however, wholeheartedly agree with him that empowering parents (and kids!) with more information, education and tools to make choices in line with their values and preferences is an unambiguously good thing. Because at the end of the day I would hope we could all agree that Uncle Sam makes a lousy surrogate parent for a diverse nation of diverse families with diverse values.
