A growing number of conservatives are calling for Big Government censorship of social media speech platforms. Censorship proposals are to conservatives what price controls are to radical leftists: completely outlandish, unworkable, and usually unconstitutional fantasies of controlling things that are ultimately much harder to control than they realize. And the costs of even trying to impose and enforce such extremist controls are always enormous.

Earlier this year, The Wall Street Journal ran a response I wrote to a proposal set forth by columnist Peggy Noonan in which she proposed banning everyone under 18 from all social-media sites (“We Can Protect Children and Keep the Internet Free,” Apr. 15). I expanded upon that letter in an essay here entitled, “Should All Kids Under 18 Be Banned from Social Media?” National Review also recently published an article penned by Christine Rosen in which she also proposes to “Ban Kids from Social Media.” And just this week, Zach Whiting of the Texas Public Policy Foundation published an essay on “Why Texas Should Ban Social Media for Minors.”

I’ll offer a few more thoughts here in addition to what I’ve already said elsewhere. First, here is my response to the Rosen essay. National Review gave me 250 words to respond to her proposal:

While admitting that “law is a blunt instrument for solving complicated social problems,” Christine Rosen (“Keep Them Offline,” June 27) nonetheless downplays the radicalness of her proposal to make all teenagers criminals for accessing the primary media platforms of their generation. She wants us to believe that allowing teens to use social media is the equivalent of letting them operate a vehicle, smoke tobacco, or drink alcohol. This is false equivalence. Being on a social-media site is not the same as operating two tons of steel and glass at speed or using mind-altering substances. Teens certainly face challenges and risks in any new media environment, but to believe that complex social pathologies did not exist before the Internet is folly. Echoing the same “lost generation” claims made by past critics who panicked over comic books and video games, Rosen asks, “Can we afford to lose another generation of children?” and suggests that only sweeping nanny-state controls can save the day. This cycle is apparently endless: Those “lost generations” grow up fine, only to claim it’s the  next generation that is doomed! Rosen casually dismisses free-speech concerns associated with mass-media criminalization, saying that her plan “would not require censorship.” Nothing could be further from the truth. Rosen’s prohibitionist proposal would deny teens the many routine and mostly beneficial interactions they have with their peers online every day. While she belittles media literacy and other educational and empowerment-based solutions to online problems, those approaches continue to be a better response than the repressive regulatory regime she would have Big Government impose on society.

I have a few more things to say beyond these brief comments.

First, as I alluded to in my short response to Rosen, we’ve heard similar “lost generation” stories before. Rosen might as well be channeling the ghost of Dr. Fredric Wertham (author of Seduction of the Innocent), who in the 1950s declared comics books a public health menace and lobbied lawmakers to restrict teen access to them, insisting such comics were “the cause of a psychological mutilation of children.” The same sort of “lost generation” predictions were commonplace in countless anti-video game screeds of the 1990s. Critics were writing books with titles like Stop Teaching Our Kids to Kill and referring to video games as “murder simulators,” Ironically, just as the video game panic was heating up, juvenile crime rates were plummeting. But that didn’t stop the pundits and policymakers from suggesting that an entire generation of so-called “vidiots” were headed for disaster. (See my 2019 short history: “Confessions of a ‘Vidiot’: 50 Years of Video Games & Moral Panics“).

It is consistently astonishing to me how, as I noted in 2012 essay, “We Always Sell the Next Generation Short.” There seems to be a never-ending cycle of generational mistrust. “There has probably never been a generation since the Paleolithic that did not deplore the fecklessness of the next and worship a golden memory of the past,” notes Matt Ridley, author of The Rational Optimist.

For example, in 1948, the poet T. S. Eliot declared: “We can assert with some confidence that our own period is one of decline; that the standards of culture are lower than they were fifty years ago; and that the evidences of this decline are visible in every department of human activity.” We’ve heard parents (and policymakers) make similar claims about every generation since then.

What’s going on here? Why does this cycle of generational pessimism and mistrust persist? In a 1992 journal article, the late journalism professor Margaret A. Blanchard offered this explanation:

“[P]arents and grandparents who lead the efforts to cleanse today’s society seem to forget that they survived alleged attacks on their morals by different media when they were children. Each generation’s adults either lose faith in the ability of their young people to do the same or they become convinced that the dangers facing the new generation are much more substantial than the ones they faced as children.”

In a 2009 book on culture, my colleague Tyler Cowen also noted how, “Parents, who are entrusted with human lives of their own making, bring their dearest feelings, years of time, and many thousands of dollars to their childrearing efforts.” Unsurprisingly, therefore, “they will react with extreme vigor against forces that counteract such an important part of their life program.” This explains why “the very same individuals tend to adopt cultural optimism when they are young, and cultural pessimism once they have children,” Cowen says.

Building on Blanchard and Cowen’s observation, I have explained how the most simple explanation for this phenomenon is that many parents and cultural critics have passed through their “adventure window.” The willingness of humans to try new things and experiment with new forms of culture—our “adventure window”—fades rapidly after certain key points in life, as we gradually settle in our ways. As the English satirist Douglas Adams once humorously noted: “Anything that is in the world when you’re born is normal and ordinary and is just a natural part of the way the world works. Anything that’s invented between when you’re fifteen and thirty-five is new and exciting and revolutionary and you can probably get a career in it. Anything invented after you’re thirty-five is against the natural order of things.”

There is no doubt social media can create or exacerbate certain social pathologies among youth. But pro-censorship conservatives wants to take the easy way out with a Big Government media ban for the ages.

Ultimately, it’s a solution that will not be effective. Raising children and mentoring youth is certainly the hardest task we face as adults because simple solutions rarely exist to complex human challenges–and the issues kids face are often particularly hard for many parents and adults to grapple with because we often fail to fully understand both the unique issues each generation might face, and we definitely fail to fully grasp the nature of each new medium that youth embrace.  Simplistic solution–even proposals for outright bans–will not work or solve serious problems.

An outright government ban on online platforms or digital devices is likely never going to happen due to First Amendment constraints, but even ignoring the jurisprudential barriers, bans won’t work for a reason that these conservatives never bother considering: Many parents will help their kids get access to those technologies and to evade restrictions on their use. Countless parents already do so in violation of COPPA rules, and not just because they worry that their kid won’t have access to what some other kids have. Rather, many parents (like me) both wanted to make sure I could more easily communicate with them, and also ensure that they could enjoy those technologies and use them to explore the world.

These conservatives might think some parents like me are monsters for allowing my (now grown) children to get on social media when they were teens. I wasn’t blind to the challenges, but recognized that sticking one’s head in the ground or hoping for divine intervention from the Nanny State was impractical and unwise. The hardest conversations I ever had with my kids were about the ugliness they sometimes experienced online, but those conversations were also countered by the many joys that I knew online interactions brought them. Shall I tell you about everything my son learned online before 13 about building model rockets or soapbox derby cars? Or the countless sites my daughter visited gathering ideas for her arts and crafts projects when, before the age of 13, she started hand-painting and selling jean jackets (eventually prompting her to pursue an art school degree)? Again, as I noted in my National Review response, Rosen’s prohibitionist proposal would deny teens these experiences and the countless other routine and entirely beneficial interactions that they have with their peers online every day.

There is simply no substitute for talking to your kids in the most open, understanding, and loving fashion possible. My #1 priority with my own children was not foreclosing all the new digital media platforms and devices at their disposal. That was going to be almost impossible. Other approaches are needed.

Yes, of course, the world can be an ugly place. I mean, have you ever watched the nightly news on television? It’s damn ugly. Shouldn’t we block youth access to it when scenes of war and violence are shown? Newspapers are full of ugliness, too. Should a kid be allowed to see the front page of the paper when it discusses or shows the aftermath of school shootings, acts of terrorism, or even just natural disasters? I could go on, but you get the point. And you could try to claim that somehow today’s social media environment is significantly worse for kids than the mass media of old, but you cannot prove it.

Of course you’ll have anecdotes, and many of them will again point to complex social pathologies. But I have entire shelves full of books on my office wall that made similar claims about the effects of books, the telephone, radio and television, comics, cable TV, every musical medium ever, video games, and advertising efforts across all these mediums. Hundreds upon hundreds of studies were done over the past half century about the effects of depictions of violence in movies, television, and video games. And endless court battles ensued.

In the end, nothing came out of it because the literature was inconclusive and frequently contradictory. After many years of panicking about youth and media violence, in 2020, the American Psychological Association issued a new statement slowly reversing course on misguided past statements about video games and acts of real-world violence. The APA’s old statement said that evidence “confirms [the] link between playing violent video games and aggression.”  But the APA has come around and now says that, “there is insufficient scientific evidence to support a causal link between violent video games and violent behavior.” More specifically, the APA now says: “Violence is a complex social problem that likely stems from many factors that warrant attention from researchers, policy makers and the public. Attributing violence to violent video gaming is not scientifically sound and draws attention away from other factors.”

This is exactly what we should expect to find true for youth and social media. Most of the serious scholars in the field already note studies and findings about youth and social media must be carefully evaluated and that many other factors need to be considered whenever evaluating claims about complex social phenomenon.

While Rosen belittles media literacy and other educational and empowerment-based solutions to online problems, those approaches continue to represent the best first-order response when compared to the repressive regulatory regime she would impose on society.

Finally, I want to just reiterate what I said in my brief  National Review response about the enormous challenges associated with mass criminalization or speech platforms. Rosen seems to image that all the costs and controversies will lie on the supply-side of social media. Just call for a ban and then magically all kids disappear from social media and the big evil tech capitalists eat all the costs and hassles. Nonsense. It’s the demand-side of criminalization efforts where the most serious costs lie. What do you really think kids are going to do if Uncle Sam suddenly does ban everyone under 18 from going on a “social media site,” whatever that very broad term entails? This will become another sad chapter in the history of Big Government prohibitionist efforts that fail miserably, but not before declaring mass groups of people criminals–this time including everyone under 18–and then trying to throw the book at them when they seek to avoid those repressive controls. There are better ways to address these problems than with such extremist proposals.

Where is “Progress Studies” Going? by Adam Thierer

What do we mean by “Progress Studies” and how can this field of study be advanced? I’ve been thinking about that question a lot since Patrick Collison and Tyler Cowen published their 2019 manifesto in  The Atlantic on why “We Need a New Science of Progress.” At present, there is no overarching “unified field theory” of what Progress Studies entails or what underpins it, and that may be holding up progress on Progress Studies. I recently attended an important conference on the “Moral Foundations of Progress Studies,” co-hosted by The Roots of Progress and the Salem Center at UT Austin, where I discovered that many others were grappling with these same issues.

While a broad range of people are interested in Progress Studies, their moral priors differ, sometimes significantly. For example, the UT Austin conference included scholars from diverse disciplines (philosophy, psychology, economics, political science, history, and others) whose thinking was rooted in different philosophical traditions (utilitarianism, effective altruism, individualism, and various hybrids). Everyone shared the goal of advancing human well-being, but participants had different conceptions of the moral foundations of well-being, and even some disagreement about what well-being meant in concrete terms. There were also differing perspectives about what the “studies” part of Progress Studies should entail. Specifically, does it include progress  advocacy, including the potential for specific policy recommendations?

Comprehension vs. Advocacy

Part of the confusion over the nature and goals of Progress Studies can be traced back to Collison and Cowen’s foundational essay. On one hand, their goal was progress  comprehension. “Progress itself is understudied,” Collison and Cowen argued. They lamented that “there is no broad-based intellectual movement focused on understanding the dynamics of progress.”

But Collison and Cowen went further. Their goal was not merely to inspire the development of a field of study that could give us a better understanding of the prerequisites of progress, but also to formulate a plan for advancing progress. They argued that “mere comprehension is not the goal,” and advocated for “the deeper goal of speeding it up.” They went on to say, “the implicit question is how scientists [and others]  should be acting” and that Progress Studies should be viewed as, “closer to medicine than biology: The goal is to treat, not merely to understand.” The presupposition here is that progress is important and that we need to take steps to get a lot more of it. Again, we can think of this part of Progress Studies as progress advocacy. And advocacy can entail both advocating for progress generally as well as specific types of policy advocacy.

This raises an interesting question we debated at the UT Austin conference: Can you study something and advocate for it at the same time? Some felt you really cannot separate them, while others believed that the broader questions about how progress has worked could be kept separate from any advocacy efforts. Of course, this same tension between comprehension and advocacy comes up in many other fields.

What Progress Studies Can Learn from STS

In this sense, Progress Studies might learn some important lessons by examining the older but loosely related field of Science and Technology Studies (STS). STS incorporates a wide variety of mostly “soft science” academic disciplines, such as law, philosophy, sociology, and anthropology. These scholars analyze the relationship between technology, society, culture, and politics.

One conclusion from studying STS is obvious: comprehension and advocacy frequently get blurred. Many of the STS scholars who engage in critical studies of the history of technology seamlessly transition into anti-technology advocates, even as many of them claim they are “just studying” the issues. As I’ve noted elsewhere:

When thinking about of technology, STS scholars commonly employ words like “anxiety,” “alienation,” “degradation,” and “discrimination.” Consequently, most of them suggest that the burden of proof lies squarely on scientists, engineers, and innovators to prove that their ideas and inventions will bring worth to society before they are deployed. In other words, STS scholars generally fall in the precautionary principle camp, and their policy prescriptions have grown increasingly radical over time.

Meanwhile, as I discussed in my latest book, many STS scholars describe themselves as “humanists” while implicitly suggesting that those who promote technological progress are somehow callous oafs who only care about the cold calculus of profit-seeking and creating shiny new gadgets we don’t need.

While some STS scholars continue to do important and largely objective work, many others routinely show their more radical leanings in books, essays, and social media posts. Most worrying is their newfound love of Luddism, as they spin revisionist histories of “Why Luddites Matter,” insisting that “There’s Nothing Wrong with Being a Luddite,” and that “I’m a Luddite. You Should Be One Too.” Neil Richards, a law professor and leading STS scholar declares bluntly on Twitter: “Less metaverse, less crypto, less disruptive innovation. More regulation, more ethics, more humanity.” In other words, public policy defaults should be set squarely to the Precautionary Principle and anyone opposed to that is unethical and anti-human. Taken to the extreme, STS scholars marry up this Luddite revisionism with the retrograde philosophy of “degrowth” and produce book chapters with titles like, “Methodological Luddism: A Concept for Tying Degrowth to the Assessment and Regulation of Technologies.”

The Progress Studies movement might consider framing its work as a response to the growing extremism of the STS movement. STS scholars have become so remarkably hostile to the very notion that science and technology are central to human advancement that the field might today better be labeled  Anti-Science & Technology Studies. Yet, these are the scholars that dominate many academic departments where students are learning about technological progress. Progress Studies scholars can push back against that radicalism and offer level-headed, empirical responses to it.

Ensuring A Big Tent 

To improve its chances of success, the Progress Studies movement should seek to broaden its appeal by avoiding a dogmatic party line on its moral foundations while ensuring that multiple disciplines and viewpoints are incorporated into it.

In terms of philosophical underpinnings, those interested in Progress Studies can take different approaches to the moral foundations of progress and human well-being. Many philosophers get frustrated when others fail to hammer out all the detailed nuances of the metaphysics, epistemology, and ethics of these matters. I understand that urge, but I’ve now spent over 30 years covering technology policy and have been constantly surprised about how many people can come together and agree on a broad set of principles about the importance of progress without sharing a common philosophical framework.

The same is true as it pertains to policy prescriptions. We need to ensure a “big tent” in this way, too. It is already the case that many people engaged in Progress Studies have very different perspectives on issues like intellectual property and industrial policy, for example. I have many friends on different sides of these issues. Importantly, there are not even clear sides on these issues but rather a very broad spectrum of viewpoints. Progress Studies scholars will likely always disagree on the finer points of both types of “IP” policy. Nonetheless, they can remain more unified in stressing the common goal of moving the needle on progress in a positive direction and highlighting the continuing importance of flexible experimentation with policies aimed at enhancing innovation and growth.

To the extent there is any litmus test for the Progress Studies movement, that’s it:  advancing opportunities for innovation and growth is paramount. Regardless of how one grounds their moral philosophy, or goes about constructing a theory of rights, many people can agree that granting humans the freedom to explore, experiment, and be entrepreneurial has important benefits for individuals, families, organizations, and entire nations. Openness to change is what unifies us. Stagnation and “steady state” thinking—and the Precautionary Principle-based policies that flow from such reasoning—are the enemy. 

Thus, the Progress Studies movement can focus on both studying progress and advancing it at the same time, even if some will devote more effort to one priority than the other. And we shouldn’t forget that these two objectives are reinforcing: Comprehension informs advocacy and vice-versa. Progress is a never-ending process of trial-and-error. It’s all about learning by doing. We try, we fail, we learn, and we try again. This is as true for the individuals attempting to make progress in the real-world as it is for scholars studying it and seeking to promote it.

Let us get on with this important work, regardless of what motivates us to do it.

Imagine a competition to design the most onerous and destructive economic regulation ever conceived. A mandate that would make all other mandates blush with embarrassment for not being burdensome or costly enough. What would that Worst Regulation Ever look like?

Unfortunately, Bill de Blasio has just floated a few proposals that could take first and second place prize in that hypothetical contest. In a new Wired essay, the New York City mayor and 2020 Democratic presidential candidate explains, “Why American Workers Need to Be Protected From Automation,” and aims to accomplish that through a new agency with vast enforcement powers, and a new tax.

Taken together, these ideas represent one of the most radical regulatory plans any America politician has yet concocted.

Politicians, academics, and many others have been panicking over automation at least since the days when the Luddites were smashing machines in protest over growing factory mechanization. With the growth of more sophisticated forms of robotics, artificial intelligence, and workplace automation today, there has been a resurgence of these fears and a renewed push for sweeping regulations to throw a wrench in the gears of progress. Mayor de Blasio is looking to outflank his fellow Democratic candidates for president with an anti-automation plan that may be the most extreme proposal of its kind.

First, de Blasio proposes a new federal agency, the Federal Automation and Worker Protection Agency (FAWPA), to “oversee automation and safeguard jobs and communities.” He continues:

FAWPA would create a permitting process for any company seeking to increase automation that would displace workers. Approval of those plans would be conditioned on protecting workers; if their jobs are eliminated through automation, the company would be required to offer their workers new jobs with equal pay, or a severance package in line with their tenure at the company.

Second, de Blasio proposed a “robot tax” that would be imposed on large companies “that eliminate jobs through increased automation and fail to provide adequate replacement jobs.” Those firms would “be required to pay five years of payroll taxes up front for each employee eliminated” and that revenue would be used to fund new infrastructure projects or jobs in new areas, including health care and green energy. “Displaced workers would be guaranteed new jobs created in these fields at comparable salaries,” he says.

Mayor de Blasio’s first idea would be one of the most far-reaching and destructive regulations in American history. A federal agency with “a permitting process for any company seeking to increase automation that would displace workers,” is essentially a political veto over workplace innovations at nearly every business in America. The result would be a de facto ban on productivity improvements across all professions.

After all, there aren’t too many sectors in the modern economy where automation isn’t playing at least a limited role. Even the oldest agricultural and industrial sectors and professions have undergone a certain amount of automation over time, and continue to do so today. These automation improvements have been essential to growing businesses and the economy more generally.

These automation advancements also create new and better jobs. It isn’t always clear initially how automation will affect workers, but the evolution of markets and innovations always provides interesting, and usually beneficial, surprises.

For example, in the early 1980s, many feared ATMs would make all bank tellers irrelevant. Instead, we got more bank workers, but they are now doing different jobs. How would de Blasio’s plan have worked back then? Would his regulatory permitting process have vetoed banking innovations such as ATMs or online banking in the name of protecting workers from automation and potential job losses, which never even materialized?

Now magnify this challenge across the entire American economy and ask how these decisions will be made for every business that is considering some form of workplace automation that could theoretically affect workers, but in ways that are difficult to foresee.

This is one reason why de Blasio’s proposal would quality for the Worst Regulation prize. It would let bureaucrats at the new Federal Automation and Worker Protection Agency sit in judgment of what constitutes beneficial forms of innovation and ask them to predict or plan our technological future.

This is a recipe for economic stagnation because these new FAWPA regulators would, like most other regulators, be incentivized to play it safe and disallow more automations than they approve. The precautionary principle would triumph over permissionless innovation; innovators would be treated as guilty until proven innocent in the resulting political circus.

Mayor de Blasio’s proposed robot tax is equally misguided. Robert D. Atkinson, president of the Information Technology and Innovation Foundation, and Robert Seamans, associate professor at NYU’s Stern School of Business, have both written about the dangers of the idea.

“The last thing policymakers should do is reduce the incentive for companies to invest in new machinery and equipment, as that would slow down needed productivity growth,” argues Atkinson in his study on, “The Case against Taxing Robots.” Likewise, Seamans notes that, in many cases, “robots are complements to labor, not substitutes for labor.” Therefore, “a robot tax would make it harder to achieve productivity growth,” and, he says, “may perversely lead to fewer rather than more jobs.”

Both scholars also point out the definitional difficulty associated with efforts to define what constitutes a “robot,” or “automation.” That problem will only be compounded once regulatory proceedings begin and various special interests begin lobbying lawmakers and regulators for favorable classifications and exemptions to avoid new rules and taxes—or get them imposed on potential competitors. Rather than helping consumers and workers, this will limit choices and drive up prices.

Importantly, regulating robots also means regulating their underlying software algorithms, which means Washington will need to send in teams of code cops to control programmers. At some point that could raise serious free speech issues since computer code can be a form of protected speech under the First Amendment. Practically speaking, however, we may not have to worry about that result because de Blasio’s command-and-control scheme would discourage many people from becoming programmers or roboticists in the first place. All those jobs and businesses would move offshore pretty quickly and America’s competitive standing would suffer globally.

It is tempting to dismiss Mayor de Blasio’s extreme proposals as a desperate move to appeal to the far-left wing of the Democratic Party base and win some more possible votes for the nomination. He likely won’t get the nomination, but his call for radical regulation of robotics in the name of protecting workers may move the party further toward the fringe by encouraging other candidates to concoct similar plans. Of course, it would be nearly impossible for any other candidate to outdo de Blasio’s plan without essentially just calling for an outright ban on robotics and all forms of automation altogether. Let’s hope that’s not next up in the competition for Worst Regulation Ever.

“The quickest way to find out who your enemies are is to try doing something new.” Thus begins Innovation and Its Enemies, an ambitious new book by Calestous Juma that will go down as one of the decade’s most important works on innovation policy.

Juma, who is affiliated with the Harvard Kennedy School’s Belfer Center for Science and International Affairs, has written a book that is rich in history and insights about the social and economic forces and factors that have, again and again, lead various groups and individuals to oppose technological change. Juma’s extensive research documents how “technological controversies often arise from tensions between the need to innovate and the pressure to maintain continuity, social order, and stability” (p. 5) and how this tension is “one of today’s biggest policy challenges.” (p. 8)

What Juma does better than any other technology policy scholar to date is that he identifies how these tensions develop out of deep-seated psychological biases that eventually come to affect attitudes about innovations among individuals, groups, corporations, and governments. “Public perceptions about the benefits and risks of new technologies cannot be fully understood without paying attention to intuitive aspects of human psychology,” he correctly observes. (p. 24)

Opposition to Change: It’s All in Your Head

Juma documents, for example, how “status quo bias,” loss aversion, and other psychological tendencies tend to encourage resistance to technological change. [Note: I discussed these and other “root-cause” explanations of opposition to technological change in Chapter 2 of my book, Permissionless Innovation: The Continuing Case for Comprehensive Technological Freedom, as well as in my 2012 law review article on “Technopanics, Threat Inflation, and the Danger of an Information Technology Precautionary Principle.”]  Juma notes, for example, that “society is most likely to oppose a new technology if it perceives that the risks are likely to occur in the short run and the benefits will only accrue in the long run.” (p. 5) Moreover, “much of the concern is driven by perception of loss, not necessarily by concrete evidence of loss.” (p. 11)

Juma’s approach to innovation policy studies is strongly influenced by the path-breaking work of Austrian economist Joseph Schumpeter, who long ago documented how entrepreneurial activity and the “perennial gales of creative destruction” were the prime forces that spurred innovation and propelled society forward. But Schumpeter was also one of the first scholars to realize that psychological fears about such turbulent change was what ultimately lead to much of the short-term opposition to new technologies that, in due time, we eventually come to see as life-enriching or even life-essential innovations.  Juma uses Schumpeter’s insight as the launching point for his exploration and he successfully verifies it using meticulously-detailed case studies.

Case Study-Driven Analysis

Short-term opposition to change is particularly acute among incumbent industries and interest groups, who often feel they have the most to lose. In this regard, Innovation and Its Enemies contains some spectacular histories of how special interests have resisted new technologies and developments throughout the centuries. Those case studies include: coffee and coffeehouses, the printing press, margarine, farm machinery, electricity, mechanical refrigeration, recorded music, transgenic crops, and genetically engineered salmon. These case studies are remarkably detailed histories that offer engaging and enlightening accounts of “the tensions between innovation and incumbency.”

My favorite case study in the book discusses how the dairy industry fought the creation and spread of margarine (excuse the pun!). I had no idea how ugly that situation got, but Juma provides all the gory details in what I consider one of the very best crony capitalist case studies ever penned.

In particular, in a subsection of that chapter entitled “The Laws against Margarine,” he provides a litany of examples of how effective the dairy industry was in convincing lawmakers to enact ridiculous anti-consumer regulations to stop margarine, even though the product offered the public a much-needed, and much more affordable, substitute for traditional butter. At one point, the daily industry successfully lobbied five states to adopt rules mandating that any imitation butter product had to be dyed pink! Other states enacted labelling laws that required butter substitutes to come in ominous-looking black packaging. Again, all this was done at the request of the incumbent dairy industry and the National Dairy Council, which would resort to almost any sort of deceptive tactic to keep a cheaper competing product out of the hands of consumers.

And so it goes in chapter after chapter of Juma’s book. The amount of detail in each of these unique case studies is absolutely stunning, but they nonetheless remain highly readable accounts of sectoral protectionism, special interest rent-seeking, and regulatory capture. In this way, Juma is plowing some familiar ground already covered by other economic historians and political scientists, such as Joel Mokyr and Mancur Olson, both of whom are mentioned in the book, as well as a long line of public choice scholars who are, somewhat surprisingly, not discussed in the text. Nonetheless, Juma’s approach is still fresh, unique, and highly informative. In fact, I don’t think I’ve ever seen so many distinct and highly detailed case studies assembled in one place by a single scholar.  What Juma has done here is truly impressive.

Related Innovation Policy Paradigms

Beyond Schumpeter’s clear influence, Juma’s approach to studying innovation policy also shares a great deal in common with two other unmentioned innovation policy scholars, Virginia Postrel and Robert D. Atkinson.

Postrel’s 1998 book, The Future and Its Enemies, contrasted the conflicting worldviews of “dynamism” and “stasis” and showed how the tensions between these two visions would affect the course of human affairs. She made the case for embracing dynamism — “a world of constant creation, discovery, and competition” — over the “regulated, engineered world” of the stasis mentality. Similarly, in his 2004 book, The Past and Future of America’s Economy, Atkinson documented how “American history is rife with resistance to change,” and in recounting some of the heated battles over previous technological revolutions he showed how two camps were always evident: “preservationists” and “modernizers.”

When Juma repeatedly recounts the fight between “innovation and incumbency” in his case studies, he is essentially describing the same paradigmatic divide that Postrel and Atkinson highlight in their works when they discuss “dynamist” vs. “stasis” tensions and the “modernizers” vs. “preservationists” battles that we have seen throughout history. [Note: In my 2014 essay on, “Thinking about Innovation Policy Debates: 4 Related Paradigms,” I discussed Postrel and Atkinson’s books and other approaches to understanding tech policy divisions and then related them to the paradigms I contrast in my work: the so-called “precautionary principle” vs. “permissionless Innovation” mindsets.]

Finally, Juma’s book could also be compared to another freshly released book, The Politics of Innovation, by Mark Zachary Taylor. Taylor’s book is also essential reading on this lamentable history of industrial protectionism and the resulting political opposition to change we have seen over time. [Note: Brent Skorup and provided many other high-tech cronyist case studies like these in our 2013 law review article, “A History of Cronyism and Capture in the Information Technology Sector.”]

To counter the prevalence of special interest influence and poor policymaking more generally, Juma stresses the need for evidence-based analysis and a corresponding rejection of fear-mongering and deceptive tactics by public officials and activist groups. He’s particularly concerned with “the use of demonization and false analogies to amplify the perception of risks associated with a new product.”

Accordingly, he would like to see improved educational and risk communication efforts aimed at better informing the public about risk trade-offs and the many potential future benefits of emerging technologies. “Learning how to communicate to the general public is an important aspect of reducing distrust [in new technologies],” Juma argues. (p. 312)

On the Pacing Problem

But Juma never really adequately squares that recommendation with another point he makes throughout the text about how “the pace of technological innovation is discernibly fast,” (p. 5) and how it is accelerating in an exponential fashion. “The implications of exponential growth will continue to elude political leaders if they persist in operating with linear worldviews.” (p. 14) But if it is indeed the case that things are moving that fast, then are we not potentially doomed to live in never-ending cycles of technopanics and misinformation campaigns about new technologies no matter how much education we try to do?

Regardless, Juma’s argument about the speed of modern technological change is quite valid and shared by many other scholars. He is essentially making the same case that Larry Downes did in his excellent 2009 book, The Laws of Disruption: Harnessing the New Forces That Govern Life and Business in the Digital Age. Downes argued that lawmaking in the information age is inexorably governed by the “law of disruption” or the fact that “technology changes exponentially, but social, economic, and legal systems change incrementally.”  This law, Downes said, is “a simple but unavoidable principle of modern life,” and it will have profound implications for the way businesses, government, and culture evolve going forward.  “As the gap between the old world and the new gets wider,” he argued, “conflicts between social, economic, political, and legal systems” will intensify and “nothing can stop the chaos that will follow.”

Again, Juma makes that same point repeatedly throughout the chapters of his book. This is also a restatement of the so-called “pacing problem,” as it is called in the field of the philosophy of technology. I discussed the pacing problem at length in my recent review of Wendell Wallach’s important new book, A Dangerous Master: How to Keep Technology from Slipping beyond Our Control. Wallach nicely defined the pacing problem as “the gap between the introduction of a new technology and the establishment of laws, regulations, and oversight mechanisms for shaping its safe development.” “There has always been a pacing problem,” he noted but, like Juma, Wallach believes that modern technological innovation is occurring at an unprecedented pace, making it harder than ever to “govern” using traditional legal and regulatory mechanisms.

New Approaches to Technological Governance Needed

Both Wallach in A Dangerous Master and Juma in Innovation and Its Enemies struggle with how to solve this problem. Wallach advocates “soft law” mechanisms or even informal “Governance Coordinating Committees,” which would oversee the development of new technology policies and advise existing governmental institutions. Juma is somewhat ambiguous regarding potential solutions, but he does stress the general need for a flexible approach to policy, as he notes on pg. 252:

It is important to make clear distinctions between hazards and risks. It is necessary to find a legal framework for addressing hazards. But such a framework should not take the form of rigid laws whose adoption needs to be guided by evidence of harm. More flexible standards that allow continuous assessment of emerging safety issues related to a new product are another way to address hazards. This approach would allow for evidence-based regulation.

Beyond that Juma wants to see “entrepreneurialism exercised in the public arena” (p. 282) and calls for “decisive leaders to champion the application of new technologies.” (p. 283) He argues such leadership is needed to ensure that life-enriching technologies are not derailed by opponents of change.

On the other hand, Juma sees a broader role for policymakers in helping to counter some of the potential side effects associated with many emerging technologies. He highlights three primary areas of concern. First, he suggests political leaders might need to find ways “to help balance the benefits and risks of automation” due to the rapid rise of robotics and artificial intelligence. Second, he notes that synthetic biology and gene-editing will give rise to many thorny issues that require policymakers to balance “potentially extraordinary benefits and the risk of catastrophic consequences.” (p. 284)  Finally, he points out that medicine and healthcare are set to be radically transformed by emerging technologies, but they are also threatened by archaic policies and practices in many countries.

In each case, Juma hopes that “decisive,” “adaptive” and “flexible” leaders will steer a sensible policy course with an eye toward limiting “the spread of political unrest and resentment toward technological innovation.” (p. 284)  That’s a noble goal, but Juma remains a bit vague on the steps needed to accomplish that balancing act without tipping public policy in favor a full-blown precautionary principle-based regime for new technologies. Juma clearly wants to avoid that result, but it remains unclear how or where he would draw clear lines in the sand to prevent it from occurring while at the same time achieving “decisive leadership” aimed at balancing potential risks and benefits.

Similarly, his repeated calls in the closing chapter for “inclusive innovation” efforts and strategies sounds sensible in theory, but Juma speaks in abstract generalities about what the term means and doesn’t provide a clear vision for how that would translate into concrete actions that would not end up giving vested interests a veto over new forms of technological innovation that they disfavor.

Generally speaking, however, Juma wants this balance struck in favor of greater openness to change and an ongoing freedom to experiment with new technological capabilities. As he notes in his concluding chapter:

The biggest risk that society faces by adopting approaches that suppress innovation is that they amplify the activities of those who want to preserve the status quo by silencing those arguing for a more open future. […] Keeping the future open and experimenting in an inclusive and transparent way is more rewarding that imposing the dictum of old patterns. (pgs. 289, 316)

In that regard, the thing I liked most about Innovation and Its Enemies is the way throughout the text that Juma stressed the symbiotic relationship between risk-taking and progress. One of the ways he does so is by kicking off every chapter with a fun quote on that theme from some notable figure. He includes gems like these:

  • “Nothing will ever be attempted if all possible objections must be first overcome.” – Samuel Johnson
  • “Only those will risk going too far can possibly find out how far one can go.” – T.S. Eliot
  • “If you risk nothing, then you risk everything.” – Geena Davis
  • “Test fast, fail fast, adjust fast.” – Tom Peters

Of course, I was bound to enjoy his repeated discussion of this theme because that was the central thesis of my latest book, in which I made the argument that, “if we spend all our time living in constant fear of worst-case scenarios—and premising public policy upon such fears—then many best-case scenarios will never come about.” Or more simply, as the old saying goes: “nothing ventured, nothing gained.”

On Pastoral Myths

I also liked the way that Juma used his case studies to remind us how “the topics may have changed, but the tactics have not.” (p. 143) For example, much of the fear-mongering and deceptive tactics we have seen through the years are based on “pastoral ideals,” i.e., appeals to nature, farm life, old traditions, of just the proverbial “good old days,” whenever those supposedly were! “Demonizing innovation is often associated with campaigns to romanticize past products and practices,” Juma notes. “Opponents of innovation hark back to traditions as if traditions themselves were not inventions at some point in the past.” (p. 309)  So very true!

That was especially the case in battles over new farming methods and technologies, when opponents of change were frequently “championing a moral cause to preserve a way of life,” as Juma discusses in several chapters. (p. 129) New products or methods of production were repeatedly but wrongly characterized as dangerous simply because they were not supposedly “natural” or “traditional” enough in character.

Of course, if all farming and other work was to remain frozen in some past “natural” state, we’d all still be hunters and gathers struggling to find the next meal to put in our bellies. Or, if we were all still on the farms of the “good old days,” then we’d still be stuck using an ox and plow in the name of preserving the “traditional” ways of doing things.

Humanity has made amazing strides—including being able to feed more people more easily and cheaply than ever before—precisely because we broke with those old, “natural” traditions. Alas, many vested interests and even quite a few academics today still employ these same pastoral appeals and myths to oppose new forms of technological change. Juma’s case studies powerfully illustrate why that dynamic continues to be a driving force in innovation policy debates and how it has delayed the diffusion of many important new goods and services throughout history. When the opponents of change rest their case on pastoral myths and nostalgic arguments about the good old days we should remind them that the good old days weren’t really that great after all.

Conclusion

In closing, Innovation and Its Enemies earns my highest recommendation. Even though 2016 is only half done as I write this, Professor Juma’s book is probably already a shoo-in as my choice for best innovation policy book of the year. And I am certain that it will also go down as one of the decade’s most important innovation policy books. Buy the book now and read every word of it. It is well worth your time.

On the whiteboard that hangs in my office, I have a giant matrix of technology policy issues and the various policy “threat vectors” that might end up driving regulation of particular technologies or sectors. Along with my colleagues at the Mercatus Center’s Technology Policy Program, we constantly revise this list of policy priorities and simultaneously make an (obviously quite subjective) attempt to put some weights on the potential policy severity associated with each threat of intervention. Tech Policy Issue Matrix 2015

I use 5 general policy concerns when considering the likelihood of regulatory intervention in any given area. Those policy concerns are:

  1. privacy (reputation issues, fear of “profiling” & “discrimination,” amorphous psychological / cognitive harms);
  2. safety (health & physical safety or, alternatively, child safety and speech / cultural concerns);
  3. security (hacking, cybersecurity, law enforcement issues);
  4. economic disruption (automation, job dislocation, sectoral disruptions); and,
  5. intellectual property (copyright and patent issues).

I realize that some of these five categories could be sub-divided and refined. I also understand that these five groupings may not encapsulate the full range of potential policy issues out there, but I’ve tried to avoid having too many categories to keep this as conceptually tidy as is possible. However, I might need to add a separate category for civil rights and disabilities-related policy issues eventually. Likewise, “psychological considerations” might deserve its own category because they do not necessarily perfectly fit into either the privacy or safety buckets right now, even though that’s where I have them currently. For example, some privacy activists call for regulation of “big data” and large databases based on fears about how all that data collection makes people feel about themselves. I consider that a privacy-related concern now, but you could imagine that being in a separate category. Meanwhile, there’s long been calls to regulate various types of media content (music, movies, video games, online porn, etc) based on the psychological impact they have on children. Those “media effects” theories have always been considered a child safety issue, which is where I currently have them slotted, but they could probably be its own category that also included concerns about distraction and addiction (which could come to haunt VR technologies in the future).

Anyway, my colleagues and I use this current matrix to help us determine what we should be paying more attention to and what sort of scholarly outputs are needed to address regulatory threats on each front. Generally speaking, this is the portfolio of issues I try to stay on top of full-time at Mercatus as part of our ongoing “Permissionless Innovation” project.

Several people who have seen that matrix in my office tell me I should do something more with it, but I’m not really sure what that something would be. In any event, I thought it might make sense to post it here to give others a feel for the current set of emerging tech policy issues that interest us at Mercatus. I will try to upload new versions of the matrix as that giant whiteboard in my office morphs over time and the list of technologies and regulatory threats changes or grows.

Incidentally, I am often asked to explain the relative weights I’ve assigned to each potential regulatory threat, so I will try to justify some of those rankings here briefly. (Again, it’s all quite subjective and I’m always open to hearing the case for tweaking the rankings.)

  • Big Data / Online Marketing / the Internet of Things (IoT): Privacy is the #1 policy threat for these sectors. From a public policy perspective, what unifies these technologies is a growing concern about how expanding private sector data collection efforts could affect our privacy or reputations. We’ve already seen a flurry of legislative and regulatory activity here in the U.S. aimed at placing restrictions on data collection or use. And it goes without saying that other countries, especially in Europe, already impose a wide variety of controls on data collection in the name of privacy protection. There also exists a variety of closely-related security concerns here. But the rise of IoT technologies have introduced safety concerns into the mix in a major way, too. That’s especially true because of the large number of Big Data services and IoT devices that are health and medical related.  Taken together, this is the issue set I spend the majority of my time covering because the privacy and security implications of a data-driven economy already occupies the attention of countless regulatory activists and public policymakers across the globe. I think that will continue to be the case for many years to come.
  • Robotics: Safety concerns tend to be the biggest driver of calls for regulation of robotic and autonomous technology. For example, new laws and regulations are already being proposed for driverless cars based on fears about the hacking of connected vehicles. And commercial drones attract policy attention based on safety-related concerns such as whether a drone could strike an airplane, or even just fall on our heads. Proposals have been floated to mandate the equivalent of DRM for drones, which would force drone innovators to embed federally-approved technological controls into their systems designating where they are allowed to fly. Even if most of these concerns are overstated or are currently being dealt with, we can expect more safety-related policy proposals for robotic tech in coming years.  Economic concerns would be a close second here due to the increasing worry that robots will eat all our jobs. At least so far, however, that concern has tended to be more of an academic nature rather than a public policy consideration. And it remains unclear what the policy prescription would be in this regard without becoming a neo-Luddite, “smash-the-machines” sort of proposal. That could change in coming years, however. It all depends on the labor market situation over time. Meanwhile, academics are floating the idea of a Federal Robotics Commission to provide greater policy “expertise” in the form of yet another technocratic Beltway bureaucracy.
  • Additive manufacturing / 3D printingSafety is probably the #1 concern here, although depending on what type of 3D-printed object we are talking about, it could be the case that intellectual property concerns will be a bigger driver of calls for regulatory intervention. A lot of the policy-related concerns around 3D printing today are being driven by worries over things like 3D-printed guns. That’s mostly a safety concern, of course. But it we are talking about the replication of branded commercial objects (3D-printed toys or other things, for example), then IP tends to be the bigger concern. The question of product liability also looms large here and it remains unclear how claims might be sorted out when there are fewer large, deep-pocketed intermediaries to go after in a world of decentralized production. Hopefully, those liability norms will be left to the courts and common law to sort out over time, but I wouldn’t be surprised to see more calls for preemptive legislative interventions here in both directions: i.e., some will call legislators to impose greater liability on certain parties while others will push to immunize intermediaries from punishing forms of liability for the downstream actions of others (like a Sec. 230 norm for 3D printing).
  • Medical tech innovation: It goes without saying that traditional safety concerns will drive policy for advanced medical technologies, just as they have for earlier drugs, devices, and treatments. As software continues to “eat the world” and invade the world of health and medicine, regulators are increasingly going to be trying to figure out how to pigeonhole new technologies into old regulatory constructs. That’s why I have been watching how the FDA continues to deal with 3D-printed prosthetics and mobile medical apps on our smartphones. Eventually, the continuing decentralized democratization of 3D printing (driven by rapidly falling costs) will collide with old medical device regulatory realities and a century’s worth of FDA command-and-control style regulation. Oh my, what a fight that will be! And then chemical printers will become more widespread and this issue will get even more intense. The policy fight here is even more interesting because of all the thorny ethical issues pertaining to the rise of embeddable technology, biohacking, and genome innovation. I have a feeling that my policy portfolio will shift rapidly in this direction in coming years as the modern info-tech revolution spreads to the world of medicine and health. I already have two new papers coming out on these issues in the next few weeks.
  • Sharing economyEconomic disruption is clearly the big policy issue here. Specifically, many policymakers and incumbent industries aren’t very happy about new entrants coming into their sectors and offering consumers services without strictly complying with traditional regulations. But safety issues often pop up in these debates when regulators or advocates claim we can’t trust sharing economy operators. What’s particularly interesting about this space is how these policy battles are playing out at almost every level of government: federal, state, local, and international. At least thus far, sharing economy innovators tend to be winning most of those battles. But the fight continues.
  • Crypto & Bitcoin: I think safety would probably be the biggest issue here, in the sense that policymakers fear a world of unregulated crypto and decentralized blockchain applications are a world in which the “bad guys” will be able to use those technologies to harm the public in some fashion. We’ve heard this all before, of course, but (going all the way back to the Clipper Chip wars) you can always bank on law enforcement officials resorting to Chicken Little claims about terrorists and child predators thriving in a world of unregulated crypto. In many ways, this is the most important of all these policy fights because if the government can regulate crypto and blockchain technologies, it severely undermines the fabric of almost all the other technologies and platforms discussed herein. This is why the current debate over government-mandated “backdoors” is so important; it has profound ramifications for every other tech regulation debate that follows.
  • Immersive Tech (VR and augmented reality): This is an amorphous and evolving area that I am getting increasingly interested in, but the policy issues here have yet to come into clear focus. However, when Google Glass was launched, there was a brief technopanic of sorts over its privacy and security ramifications. Those concerns have subsided a bit as Google Glass has seemingly faded away (probably because of its high price point more than because of its privacy concerns), but I suspect that future iterations of augmented reality technologies will raise similar concerns. That will especially be true as more sophisticated biometric (and facial recognition) capabilities are integrated into them. Academics are already wondering how to enforce “notice and consent” privacy norms and rules in a world where everyone is wearing miniature body cams and heads-up displays in their sunglasses. I’m not sure it’s even possible, but that debate will continue and include all sorts of calls for technological controls. OK, that’s augmented reality, but what about virtual reality technologies? I think safety concerns could drive some policy proposals as critics grow concerned about the psychological implications of people (especially kids) spending more and more time in immersive virtual worlds. In that sense, we might see a replay of the earlier debate over violent video games and/or video game addition. But it remains to be seen.

Here’s the first of two essays I’ve recently penned making “The Case for Internet Optimism.” This essay was included in the book, The Next Digital Decade: Essays on the Future of the Internet (2011), which was edited by Berin Szoka and Adam Marcus of TechFreedom.  In these essays, I identify two schools of Internet pessimism: (1) “Net Skeptics,” who are pessimistic about the Internet improving the lot of mankind; and (2) “Net Lovers,” who appreciate the benefits the Net brings society but who fear those benefits are disappearing, or that the Net or openness are dying.  (Regular readers of this blog will be familiar with these themes since I sketched them out in previous essays here such as, “Are You an Internet Optimist or Pessimist?” and “Two Schools of Internet Pessimism.”) The second essay is here.

This essay focuses on the first variant of Internet pessimism, which is rooted in general skepticism about the supposed benefits of cyberspace, digital technologies, and information abundance. The proponents of this pessimistic view often wax nostalgic about some supposed “good ‘ol days” when life was much better (although they can’t seem to agree when those were). At a minimum, they want us to slow down and think twice about life in the Information Age and how it’s personally affecting each of us.  Occasionally, however, this pessimism borders on neo-Ludditism, with some proponents recommending steps to curtail what they feel is the destructive impact of the Net or digital technologies on culture or the economy.  I identify the leading exponents of this view of Internet pessimism and their major works. I trace their technological pessimism back to Plato but argue that their pessimism is largely unwarranted. Humans are more resilient than pessimists care to admit and we learn how to adapt to technological change and assimilate new tools into our lives over time. Moreover, were we really better off in the scarcity era when we were collectively suffering from information poverty?  Generally speaking, despite the challenges it presents society, information abundance is a better dilemma to be facing than information poverty.  Nonetheless, I argue, we should not underestimate or belittle the disruptive impacts associated with the Information Revolution.  But we need to find ways to better cope with turbulent change in a dynamist fashion instead of attempting to roll back the clock on progress or recapture “the good ‘ol days,” which actually weren’t all that good.

[I’ve been working on an outline for a book I hope to write surveying technological skepticism throughout history. I first started thinking about this topic two years when I noticed that a great number of recent books about Internet policy could generally be grouped into one of two camps: Internet optimists vs. Internet pessimists. I subsequently penned an essay on the subject that generated a fair bit of attention. So, I figured I must be on to something, and the more Net policy books I read, the more I realized that the divisions between these two camps were growing wider and increasingly heated. Thus, I thought I would share this very rough draft (much of it still in outline form) of the opening chapter of that book I want to write about this great intellectual war over the impact of technology on society. The impact of technological change on culture, learning, and morality has long been the subject of intense debate, and every technological revolution brings out a fresh crop of both pessimists and pollyannas. Indeed, a familiar cycle has repeat itself throughout history whenever new modes of production (from mechanized agriculture to assembly-line production), means of transportation (water, rail, road, or air), energy production processes (steam, electric, nuclear), medical breakthroughs (vaccination, surgery, cloning), or communications techniques (telegraph, telephone, radio, television) have appeared on the scene.

The cycle goes something like this. A new technology appears. Those who fear the sweeping changes brought about by this technology see a sky that is about to fall. These “techno-pessimists” predict the death of the old order (which, ironically, is often a previous generation’s hotly-debated technology that others wanted slowed or stopped).  Embracing this new technology, they fear, will result in the overthrow of traditions, beliefs, values, institutions, business models, and much else they hold sacred.

The pollyannas, by contrast, look out at the unfolding landscape and see mostly rainbows in the air. Theirs is a rose-colored world in which the technological revolution du jour is seen as improving the general lot of mankind and bringing about a better order.  If something has to give, then the old ways be damned! For such “techno-optimists,” progress means some norms and institutions must adapt—perhaps even disappear—for society to continue its march forward.

Our current Information Revolution is no different. It too has its share of techno-pessimists and techno-optimists. Indeed, before most of us had even heard of the Internet, people were already fighting about it—or at least debating what the rise of the Information Age meant for our culture, society, and economy.

Web 1.0 Fight: Postman vs. Negroponte

In his 1992 anti-technology screed Technopoly: The Surrender of Culture to Technology, the late social critic Neil Postman greeted the unfolding Information Age with a combination of skepticism and scorn.  Indeed, Postman’s book was a near-perfect articulation of the techo-pessimist’s creed.  “Information has become a form of garbage,” he claimed, “not only incapable of answering the most fundamental human questions but barely useful in providing coherent direction to the solution of even mundane problems.”  If left unchecked, Postman argued, America’s new technopoly—“the submission of all forms of cultural life to the sovereignty of technique and technology”—would destroy “the vital sources of our humanity” and lead to “a culture without a moral foundation” by undermining “certain mental processes and social relations that make human life worth living.”

Postman opened his polemic with the well-known allegorical tale from Plato’s Phaedrus about the dangers of the written word.  Postman reminded us how King Thamus responded to the god Theuth, who boasted of how his invention of writing would improve the wisdom and memory of the masses relative to the oral tradition of learning.  King Thamus shot back, “the discoverer of an art is not the best judge of the good or harm which will accrue to those who practice it.”  King Thamus then passed judgment himself about the impact of writing on society, saying he feared that the people “will receive a quantity of information without proper instruction, and in consequence be thought very knowledgeable when they are for the most part quite ignorant.”

And so Postman—fancying himself a bit of a modern King Thamus—cast judgment on today’s comparable technological advances and those who would glorify them:

we are currently surrounded by throngs of zealous Theuths, one-eyed prophets who see only what new technologies can do and are incapable of imagining what they will undo. We might call such people Technophiles. They gaze on technology as a lover does on his beloved, seeing it as without blemish and entertaining no apprehension for the future. They are therefore dangerous and to be approached cautiously. … If one is to err, it is better to err on the side of Thamusian skepticism.

Nicholas Negroponte begged to differ. An unapologetic Theuthian technophile, the former director of the MIT Media Lab responded on behalf of the techno-optimists in 1995 with his prescient polemic, Being Digital.  It was a paean to the Information Age, for which he served as one of the first high prophets—with Wired magazine’s back page frequently serving as his pulpit during the many years he served as a regular columnist.

Appropriately enough, the epilogue of Negroponte’s Being Digital was entitled “An Age of Optimism” and, like the rest of the book, it stood in stark contrast to Postman’s pessimistic worldview.  Although Negroponte conceded that technology indeed had a “dark side” in that it could destroy much of the old older, he believed that was inevitable, but also not cause for much concern. “Like a force of nature, the digital age cannot be denied or stopped,” he insisted, and we must learn to appreciate the ways “digital technology can be a natural force drawing people into greater world harmony.” (This sort of techno-determism is a theme we would see on display in many of the works by other Internet optimists that followed in Negroponte’s footsteps.)

To Postman’s persistent claim that America’s technopoly lacked a moral compass, Negroponte again conceded the point but took the glass-is-half-full view: “Computers are not moral; they cannot resolve complex issues like the rights to life and to death. But being digital, nevertheless, does give much cause for optimism.”  His defense of the digital age rested on the “four very powerful qualities that will result in its ultimate triumph: decentralizing, globalizing, harmonizing, and empowering.” Gazing into his techno-crystal ball in 1995, Negroponte forecast the ways in which those qualities would revolutionize society:

The access, the mobility, and the ability to effect change are what will make the future so different from the present. The information superhighway may be mostly hype today, but it is an understatement about tomorrow. It will exist beyond people’s wildest predictions. As children appropriate a global information resource, and as they discover that only adults need learner’s permits, we are bound to find new hope and dignity in places where very little existed before.

In many ways, that’s the world we occupy today; a world of unprecedented media abundance and unlimited communications and connectivity opportunities.

But the great debate about the impact of digitization and information abundance would not end with Postman and Negroponte. Theirs would only be Act I in a drama that continues to unfold, and it is growing more heated and complex with each new character that comes on the stage.

Web War II

 

The disciples of Postman and Negroponte are a colorful, diverse lot. The players in Act II of this drama occupy many diverse professions—journalists, technologists, business consultants, sociologists, economists, lawyers, etc.—and they are disagreeing even more vehemently and vociferously about the impact of the Internet and digital technologies than Postman and Negroponte did.

When you boil it all down, there are two major points of contention between the optimists and pessimists:

  1. The impact of technology on learning & culture & the role of experts vs. amateurs in that process.
  2. The promise—or perils—of personalization.

The Debate over Learning & Culture

  • Internet optimists and pessimists have engaged in heated debates over role of amateur production and benefits of abundant media
  • pessimists fear impact of Net and “cult of amateur” on “professional” media
  • without “enforceable scarcity” and protection for the “enlightened class,” the pessimists wonder how “high quality” news or “high art” will get funded and disseminated; and they worry about the decline of authority & truth
  • optimists argue that new modes of production (namely peer-production) will be an adequate (if not superior) alternative
    • or they believe new business models will evolve to support professional media
  • but pessimists argue that all the new choices are largely false choices
    • participatory democracy all bunk (“mob rule” and rumor mill mongering)
    • just more force-fed commercial propaganda; concerns about advertising
    • also worry about “digital sharecropping” where small group of elites make money off backs of free labor
  • optimists counter that Web 2.0 offers real choices and voices
    • optimists argue that many (perhaps most) aren’t in it for the money
    • they do it for love of knowledge & “free culture”
  • pessimists argue that “free” culture isn’t free at all; often just parasitic copying / piracy
    • could have profound ramifications for future of news, journalism, “high culture”
    • fear loss of trusted intermediaries & authorities
    • could “dumb down” the masses
  • the centrality of Wikipedia to the discussion serves as a microcosm of the entire debate
    • does Wikipedia mark the decline of authority?
    • what is “truth,” the pessimists ask? [“truthiness” fear, a la S. Colbert & Manjoo]
    • who and what can be trusted if everyone is considered an authority?
    • on the other hand, what if it works (at least reasonably well)?
    • what does that tell us about peer production / crowdsourcing?

The Debate over the Promise or Perils of Personalization

  • both optimists and pessimists agree that Net & Web 2.0 is leading to more “personalized” media experience
    • but they vehemently disagree on whether that is good or bad
    • what will it mean for participatory democracy?
  • pessimists fear Negroponte’s “Daily Me” (i.e., hyper-personalization) leads to:
    • homogenization
    • close-mindedness
    • an online echo-chamber
    • overload of choices + just more corporate brainwashing
  • optimists counter that personalization leads to:
    • heterogeneity / chance for everyone to be heard
    • openness
    • exposure to new thinking and opinions
    • abundance of choices = diversity of thought / participation
  • in the extreme, some pessimists fear the “mechanization of the soul” and the “surrender to the machine”
  • while that may sound a bit over the top, it doesn’t help that some optimists speak of the noosphere & “global consciousness” and seem to long for the eventual singularity

Who’s Got It Right?

  • On balance, I believe the optimists generally have the better of the argument today
  • But pessimists make many fair points that deserve to be taken seriously; they just need a more reasonable articulation of (some of) those concerns
  • The better approach is what I call “pragmatic optimism,” which attempts to rid the optimist paradigm of its kookier, pollyannish thinking while also taking into account some of the very legitimate concerns raised by the pessimists, but rejecting its Luddite fringe in the process.

Thoughts on the Pessimists…

  • First and foremost, the pessimists need better spokespersons! Or, they at least need a more moderated, less hysterical tone when addressing concerns raised by technological progress (many of which are quite legitimate).
  • It’s often difficult to take the pessimists seriously when they persist with their seeming outright hostility to most forms of technological progress / change. Every one of them claim they are not a Luddite, and often I believe them. But the tone of some of their writing, and the thrust of some of their recommendations, have clear Luddite tendencies.
  • Moreover, their endless name-calling and derision for the digital generation is, at times, just as insulting and immature as they “mob” they repeatedly castigate in their works. Too often, their criticism devolves into philosophical snobbery and blatant elitism. Constantly looking down their noses at digital natives and all “amateur” production doesn’t help them win any converts.
  • It’s quite shocking how the pessimists have almost nothing good to say about Wikipedia and demonize it endlessly. Much the same goes for open source and other collaborative efforts. They don’t appear willing to accept the possibility of any benefits coming from collective efforts. And they wrongly treat the rise of collective / collaborative efforts as a zero-sum game; they seem to imagine it represents a net loss of individual effort & “personhood.” That simply doesn’t follow.
  • Most importantly, the pessimists need to come to grips with the Information Revolution and offer more constructive and practical solutions to legitimately difficult transitional problems created by disintermediating influences of the digital technologies and Net.
  • The nostalgia the pessimists typically espouse for the past is a common refrain of cultural and technological critics who fear that the “good ‘ol days” are behind us and the current good-for-nothing generation and their new-fangled gadgets are steering us straight into a moral abyss.  The truth typically proves less cataclysmic, of course.  The great thing about humans is that we adapt better than other creatures. When it comes to technological change, resiliency is hard-wired into our genes.  We learn how to use the new tools that are given to us and gradually assimilate them into our lives and culture.  Indeed, we have lived through more radical revolutions than the Information Revolution. We can adapt and learn to live with some of the legitimate difficulties & downsides of the Information Age.
  • The pessimists are at their best when highlighting the very legitimate concerns about the challenges that accompany technological change, including the impact of the digital revolution on “professional” media and the decline of authority among trusted experts and intermediaries.
    • we absolutely don’t want to lose all that
    • there are real benefits associated with it
    • and we need to find a way to fund “professional” media / art going forward
  • But, practically speaking, what would the pessimists have us do if we can’t mitigate these problems? Would they roll back the clock with burdensome restrictions? As Ben Casnocha noted recently: “the wind at the backs of all techno-optimists … [is] the forward momentum of technological development. You cannot turn back the clock. It is impossible to envision a future where there is less information and fewer people on social networks. It is very possible to envision increasing abundance along with better filters to manage it. The most constructive contributions to the debate, then, heed Moore’s Law in the broadest sense and offer specific suggestions for how to harness the change for the better.”  That’s what many pessimists have failed to do in their works.

Thoughts on the Optimists…

  • The optimists currently have the better of the debate as the abundance of Web 2.0 riches is generally benefiting culture / society.
  • Relative to the past it is almost impossible to see how one could argue society has not benefited from the Internet and new digital technologies. The Digital Revolution has greatly empowered masses and offered them more informational inputs.
  • An age of abundance is certainly preferable to an age of information scarcity!
  • But optimists need to be less Pollyanna-ish and avoid becoming the “technopolists”  (or digital utopians) that Postman feared were taking over our society
    • Way too much Rousseauian romanticism at work in some optimist writings. All this talk of the Net “remaking man” or human nature is pure rubbish.
    • Not all change is good change; the optimists need to be mature enough to understand and address the occasional downsides of digital life without dismissing the critics.
    • And they need to acknowledge that sometimes the wisdom of crowds really can = the stupidity of crowds (when does collective intelligence devolve into herd mentality?) And all this crazy talk of “the hive mind” and the “noosphere” must end.  Some of optimists sound like they long for life in The Matrix; bring on the Singularity!  That’s when you know an optimists has crossed over into the realm of quixotic techno-utopianism.
  • Optimists often overplay the benefits of collective intelligence, collaboration, and the role of amateur production.  They need to frame Wiki / peer-production models as a complement to professional media, not a replacement for it.
    • Could The New York Times really be cobbled together by amateurs each day?
    • Why aren’t there any really compelling open source video games?
    • There is a big difference between “remix culture” and “rip-off culture”
    • “The Long Tail” is not “the future of all business”; but it is an increasingly important part of it, and it is wonderful that it is so much more accessible than it was in the past.
    • Will we really be better off if all professionals & intermediaries disappear? Optimists play the “old media just don’t get it” card too often and snobbishly dismiss all their concerns and efforts to reinvent themselves
  • Optimists need to place technological progress in context and appreciate that, as Postman argued, there are some moral dimensions to technological progress that deserve attention.
  • Of course, on the other hand, some of those moral consequences are profoundly positive, which the pessimists usually fail to appreciate or even acknowledge.

Conclusion: Toward “Pragmatic Optimism”

 

  • Generally speaking, I believe the optimists currently have the better of the debate. It is impossible for me to believe that we were better off in an era of information poverty & un-empowered masses.
  • But there’s a kernel of truth to what the pessimists predict about how the passing of the old order leaving society without some things that might be worth preserving.  And they are certainly correct that each of us should think about how to better balance new technologies and assimilate them into our lives.
  • The sensible middle ground position is “pragmatic optimism”: We should embrace the amazing technological changes at work in today’s Information Age but do so with a healthy dose of humility and appreciation for the disruptive impact and pace of that change. [See my “Pragmatic (Internet) Optimist’s Creed” below]
  • We need to think about how to mitigate the negative impacts associated with technological change without adopting the paranoid tone or Luddite-ish recommendations of the pessimists.
  • And it is important for us to personally exercise some personal restraint in terms of the role technology plays in our life. While pessimists from Plato and Postman certainly went too far, there is a kernel of truth to their claim that, taken to an extreme, technology can have a negative impact on life and learning.  We need to focus on the Aristotelian mean. We must avoid neo-Luddite calls for a return to “the good ‘ol days” on the one hand, while also rejecting techno-utiopian Pollyanna-ism on the other
  • Regardless, the old Theuth-Thamus debate about the relationship between technological change and its impact on culture and society will continue to rage. There is no chance this debate will die down anytime soon. And just wait till virtual reality goes mainstream!  Oh brother, now that is going to be a lively debate. I might turn into a Thamusian once I find my son playing a virtual gangster or pimp in “Grand Theft Auto 12: The Immersive Experience.”
  • Nonetheless, generally speaking, I remain quite bullish about the prospects for technology to generally improve the human condition.

The Pragmatic (Internet) Optimist’s Creed

I believe that the Internet and digital technologies are reshaping our culture, economy, and society in most ways for the better, but not without some serious heartburn along the way.

I believe that the world of information abundance that has dawned is vastly superior to the world of information poverty that we just left. But I also understand that not all information is equal and that that the rise of abundance raises concerns about information overload, objectionable content, and the role of “authority” and “truth.”

I believe the era of traditional Mass Media is coming to an end, but “professional” media institutions and creators continue to play a vital role in the creation, aggregation, and dissemination of news, information, culture, and entertainment. The Internet, however, will force gut-wrenching changes on traditional media institutions and some of the more traditionally vital ones (ex: daily local newspapers) will struggle to re-invent themselves, or may wither away entirely. And while I believe that “professional” journalism faces very serious challenges from the rise of the Internet and user-generated content, but I also believe that hybrid forms of news-gathering and reporting are offering society exciting new ways to learn about the world around them.

I believe Wikipedia is an amazing example of collection action / intelligence at work, but I also understand it is not without flaws and limitations. I believe Wikipedia is a wonderful complement, but not a complete substitute, for other media and information sources and inputs.

I believe that free and open source software (FOSS) has produced enormous social / economic benefits, but I do not believe that FOSS (or “wiki” models) will replace all proprietary business models or methods.  Each model or mode of production has its place and purpose and they will continue to co-exist going forward, albeit in serious tension at times.

I believe the Long Tail is a powerful phenomenon, but not “the future of all business.” It is now a more important part of the future of business, but not the entirety of it. But it is wonderful that it is more accessible than ever and that we have found ways to monetize it to benefit less well know creators and innovators.

I believe there is a difference between “remix culture” and “ripoff culture.”  Remix culture generally enhances and extends culture and creativity. Blatant content piracy, on the other hand, can discourage the creative efforts of the citizenry and deprive some of society’s most gifted creators of the incentive to produce culturally beneficial works. Likewise, hacking, circumvention, and reverse-engineering all play an important and legitimate role in our new digital economy, but one need not accept the legitimacy of those activities when conducted for nefarious purposes (think identity theft or chip-modding to facilitate video game piracy.)

I believe that the Internet has empowered the masses and created a world of “pro-sumers” that gives every man, woman, and child a soapbox on which to speak to the world. But that does not mean that all of them will have something interesting to say, and I won’t praise user-generated content as a good in and of itself. It’s quality, not volume, that counts.

I believe that the Internet’s empowering nature has changed much about society and culture, but I do not believe in the romanticism some espouse about how the Net “remaking man” or changing human nature in any fundamental way. The Internet does not liberate us from all earthly constraints and it cannot magically solve all of civilization’s problems.

I believe that the Internet is reinvigorating deliberative democracy and giving us increased exposure to a breathtaking diversity of views previously inaccessible. On the other hand, I understand that some will often seek out only those views that reinforce their pre-existing biases.

I believe in the liberating power of freedom of speech and expression, and appreciate that the Internet and the rise of user-generated content has given us a world of unprecedented information and cultural riches. I also understand, however, that unrestricted freedom of speech and expression permits an increase in the prevalence of objectionable, even loathsome, speech and content. On net, however, (excuse the pun) the Internet is the most important medium of human communication and expression yet.

In sum, there are more reasons to be optimistic than pessimistic about the Internet and its role in shaping our lives, culture, economy, and society. But that doesn’t mean it will be all roses going forward.

2009 was not as big of a year for Internet and information technology (“info-tech”) policy books as 2008 was, but there were still some notable titles released that offered interesting perspectives about the future of the Net and the impact the Digital Revolution is having on our lives, culture, and economy.  So, like last year, I figured I would throw together my list of the 10 most important info-tech policy books of the year.

book covers collage 2009First, let me repeat a few of the same caveats and disclaimers that I set forth last year.  What qualifies as an “important” info-tech policy book? Simply put, it’s a title that many people are currently discussing and that we will likely be referencing for many years to come.  However, I want to be clear that merely because a book appears on my list it does not necessarily mean I agree with everything said in it. In fact, as was the case in previous years, I found much with which to disagree in my picks for the most important books of 2009 and I find that the cyber-libertarianism I subscribe to has very few fans out there.

Another caveat: Narrowly-focused titles lose a few points on my list. For example, if a book deals mostly with privacy issues, copyright law, or antitrust policy, it does not exactly qualify as the same sort of “tech policy book” as other titles found on this list since it is a narrow exploration of just one set of issues with a bearing on technology policy.

With those caveats in mind, here are my choices for the Most Important Info-Tech Policy Books of 2009.

(1) Chris Anderson Free: The Future of a Radical Price

Anderson FreeChris Anderson’s 2006 book The Long Tail will be remembered as one of the most influential tech policy books of the decade.  It changed the way we talk about the digital marketplace and it instantly garnered a huge audience outside of the nerdy world of Internet policy.  While Free: The Future of a Radical Price will forever live in the shadow of The Long Tail, it too is an important book and in many ways it is a much better one.

In The Long Tail, Anderson tried too hard to invent the latest business theory du jour, and in doing so he went much too far in proclaiming that, as the subtitle of the book argued, “the future of the business is selling less of more.”  That’s just not true. While there’s certainly a lot more action in the long tail than ever before since it is so much more accessible, that does not mean the entire future of business lies in “selling less of more.”  To the contrary, the fat head of the tail is just as profitable as ever.

Free certainly contains some of the flamboyance on display in The Long Tail, but Anderson has matured as a writer and is now far more willing to point out the limitations of his theories in a business sense.  He does a splendid job in Free of creating a taxonomy of free-oriented business models to guide discussions about these issues.  And he explains how “free” can be part of many different business models and strategies. His historical treatment of the issues is outstanding and includes many entertaining examples of how these “free” strategies have been used over time to offer innovative new goods and services.

The reason his book is important for Internet policy discussions is obvious: “free” is increasingly viewed as a threat to many existing companies, industry sectors, and traditional media business models.  For example, battles about the future of journalism and search engine indexing of news sites are obviously tied up with battles over “free.”  And, it goes without saying that the traditional entertainment industry business models are increasingly challenged by “free” as many struggle to adapt to the new realities of the online world, in which “free” (primarily advertising-supported  and “freemium” models) seems to be the only model with any legs.

Much like my top pick for 2008 book of the year, Jonathan Zittrain’s The Future of the Net and How to Stop It, Chris Anderson’s Free is the most important information technology book of the year because it is the one we will still be talking about the most a decade from now.  However, unlike Zittrain’s book and thesis, which I think will be largely discredited in another ten years, Anderson’s book will likely be viewed as an important and lasting contribution to the field.

(2) Larry DownesThe Laws of Disruption: Chaos and Control in Your Virtual Future

Laws of Disruption Downes The Laws of Disruption is the closest thing you will find to a genuine cyber-libertarian manifesto these days.  But Downes isn’t a rigid ideologue; his skepticism of government regulation of the high-tech economy is based more on practical considerations and the fundamental “law of disruption”: “technology changes exponentially, but social, economic, and legal systems change incrementally.” Downes says this law is “a simple but unavoidable principle of modern life” and that it will have profound implications for the way businesses, government, and culture evolve going forward. “As the gap between the old world and the new gets wider,” he argues, “conflicts between social, economic, political, and legal systems” will intensify and “nothing can stop the chaos that will follow.” In this sense, The Laws of Disruption reads like an addendum to one of Alvin Toffler’s old books on technology and futurism in that Downes is essentially walking us through the practical consequences of life in a “post-industrial society.”

In terms of what it all means for public policy, Downes doesn’t so much fear legal and regulatory over-reach the way many cyber-libertarians do. Rather, he thinks most regulatory schemes just won’t work. In essence, he is a technological fatalist or consequentialist: Progress happens whether we like it or not, so get used to it!  Thus, the “laws of disruption” he articulates serve primarily as “Just-Don’t-Bother” warnings to over-eager government meddlers. “The best way to regulate innovation is to leave it alone,” he counsels.

In terms of structure, The Laws of Disruption resembles Blown to Bits: Your Life, Liberty, and Happiness After the Digital Explosion by Abelson, Ledeen, and Lewis, (which I reviewed here last year and named to my 2008 list). Both books survey a vast swath of territory — privacy, copyright, security, etc — and each chapter offers unique perspectives on each debate. In that sense, the book is useful to readers if for no other reason than you get a taste for how a wide variety of issues are playing out. Downes also owes much to Clayton M. Christensen and his seminal 1997 book The Innovator’s Dilemma: When New Technologies Cause Great Firms to Fail. Like that book, The Laws of Disruption is a business book with a strong policy hook.  That is, both books focus on advice-dishing for companies and innovators looking to “stay ahead of the curve” in the midst of relentless, gut-wrenching technological change, but the books also include important lessons regarding the public policies that should govern high-tech sectors.

I highly recommended The Laws of Disruption and found it to be the most enjoyable of all the books I read this year.

(3) Dawn C. NunziatoVirtual Freedom: Net Neutrality and Free Speech in the Internet Age

Virtual Freedom NunziatoDawn Nunziato is the perfect foil for Larry Downes. Her book is a manifesto for cyber-collectivism and “media access theory.”  (For those unfamiliar with media access theory, see my old essay: “Your Soapbox is My Soapbox! Thoughts on the Media Access Movement in General and the Media & Democracy Coalition’s ‘Bill of Media Rights’ in Particular.”)  She attempts to bring media access theory up to date by taking the ideas made famous by Jerome Barron, Owen Fiss, Cass Sunstein, and others, and applying them to the Internet and digital technologies.  Like those earlier legal thinkers, she argues for “an affirmative conception” of the First Amendment that would allow government to use the First Amendment to “facilitate the conditions necessary for democratic self-government” (whatever that means). Net neutrality regulation becomes one of many ways she would put this theory into action. Importantly, she would not stop with ISPs. She makes the case for extending the entire regulatory regime to Google and search platforms. Welcome to the Brave New World of the the FCC as the Federal Search Commission or Federal Cloud Commission!

Her attempt to cast Net neutrality as the Internet’s First Amendment is a grotesque contortion of the real First Amendment, and a complete betrayal of the Founder’s original intentions.  As I made clear in my recent essay on “Net Neutrality Regulation & the First Amendment,” the Internet’s First Amendment is the First Amendment, not some new, top-down, heavy-handed regulatory regime that puts the Federal Communications Commission in control of the Digital Economy. Her conception of the First Amendment would convert it from a shield against government control into a sword that the government could use as it wished. It would mean that “Congress shall make no law…” would suddenly be replaced by “Congress shall make whatever law it wants” so long as it serves some amorphous “public interest.” Can you say “tyranny of the majority”?

Regardless, event though I find her views to be morally repugnant and the antithesis of true digital freedom, Nunziato’s book is a concise articulation of that vision and it deserves everyone’s attention. It serves as a blueprint for where the Net neutrality wars are taking us.

(4) David BollierViral Spiral: How the Commoners Built a Digital Republic of Their Own

Viral Spiral BollierDavid Bollier’s Viral Spiral is the first major history of the “digital commons” / “free culture” movement, and despite my many person disagreements with him and this movement, it is an excellent treatment of the topic. Bollier surveys this growing intellectual movement from its early open source days to the rise of the Creative Commons and on into the present.  The cast of characters in this drama will be well-known to anyone involved in modern tech policy debates: Richard Stallman, Lawrence Lessig, Jonathan Zittrain, Yochai Benkler, et al.

There is absolutely no doubt that this intellectual movement is winning the war of ideas in cyberlaw front today, as I noted in a recent debate with Lessig and Zittrain over at Cato Unbound.  As a cyber-libertarian, I find myself occasionally at odds with these guys and this movement on a variety of policy issues, but that didn’t stop me from enjoying David Bollier’s treatment of this movement and these issues.

(5) David PostIn Search of Jefferson’s Moose: Notes on the State of Cyberspace

Jefferson Moose PostDavid Post is one of the early intellectual giants in the field of cyberlaw. Back in the days when most of us were still just trying to get our 14.4 modems to work properly to get on Al Gore’s “Information Highway,” David Post was writing essays and law review articles that were a decade ahead of their time.  In particular, his work on Internet governance and jurisdictional matters was path-breaking, and much of it is updated and extended in Jefferson’s Moose.

I must admit, however, that I was hoping for a bit more from David in this book.  Beyond just being a first-rate intellectual in this space, he is also one of the few remaining defenders of “Internet exceptionalism,” and he has genuine cyber-libertarian leanings.  After waiting almost 10 years for David to wrap this thing up after he first told me about it back around 2000, I was thinking he might come up with the sort of cyber-libertarian manifesto I’ve always hoped he would write.  Although he fell a bit short in that regard, it doesn’t mean it’s not a good book. It is. You will enjoy it no matter what cyber-philosophy you subscribe to.

(6) Dennis BaronA Better Pencil: Readers, Writers, and the Digital Revolution

A Better Pencil book coverBaron’s A Better Pencil is a splendid history of techno-pessimism and the endless battles about the impact of new technologies on life and learning, something I have written about here before in my essays on “Internet optimists vs. pessimists” (See: 1, 2, 3).   Baron notes that almost as soon as people learned to put chisel to stone and then quill to paper, a great debate began about the impact of new communications technology on culture and education. And that debate rages on today with a new generation of optimists and skeptics battling over the impact that computing, the Internet, and digital technologies have on our lives and on how we learn about the world.

Baron walks us through a litany of historical examples—the printing press, the telegraph, telephones, typewriters, pocket calculators, personal computers, word processors, webpages, blogs, social-networking sites, and more—and identifies the usual pattern: we greet each new technology with deep distrust and dire warnings, but in time we adapt to the new realities. Indeed, as a species, we have an unparalleled ability to learn new ways of doing things. We don’t always like technological change, and often we deeply resent or fear it, but in the end, we learn to live with it and eventually to embrace it.  With the rise of the Internet and digital technologies, we see this pattern unfolding once again. But Baron counsels patience and understanding instead of the sort f hysteria and backlash we see from the likes of Andrew Keen, Lee Siegel and others.  It’s a refreshing and uplifting perspective.

(7) Mark HelprinDigital Barbarism: A Writer’s Manifesto

Digital Barbarism HelprinNo book has been more disappointing to me in recent memory than Mark Helprin’s Digital Barbarism. As someone who still finds a lot to defend in copyright law, I was excited when I learned that one of America’s most gifted authors–and the author of my favorite literary work of the late 20th century (A Soldier of the Great War)–was taking a crack defending copyright in a short manifesto.

Alas, as I argued in my review of the book for National Review, while Helprin occasionally rises to great heights in his defense of copyright, he too often sinks to lamentable lows–by resorting to the same unbecoming rhetorical tactics used by the “cyber-mob” he seeks to condemn. Indeed, his book is filled with gratuitous vitriol and neo-Luddite ramblings about the Internet and Information Age that severely detract from his defense of copyright. Channeling the ghost of the late social critic Neil Postman, Helprin’s critique of copyright skeptics quickly turns into an all-out assault on modern digital culture and cyberspace. He argues that we are witnessing “the decline of culture,” the “mechanization of the soul,” our “intellectual and spiritual destruction,” and the rise of a movement of “wacked-out muppets led by little professors in glasses” that “threatens in a decade or two to dissolve the accomplishments of millennia, reordering the ways in which we think, write, and communicate.” And it just gets worse from there. Much like recent rants by Andrew Keen and Lee Siegel, Helprin speaks repeatedly about the “surrender of human nature” to “the machine revolution” and the corresponding need to “control the machine.”

How a man who has penned some of the most beautiful prose in modern times could craft an off-the-rails screed of this magnitude remains incomprehensible  to me.  What’s worse is that he set back the cause of defending what’s best about copyright in the process. Luckily for Helprin, there’s plenty of hysteria on the other side, as the next book on my list makes clear.

(8) William PatryMoral Panics and the Copyright Wars

Moral Panics PatryBill Patry is an angry man. He is the anti-Helprin. The vitriol that Helprin directs against the copyright-haters is reversed in this screed and turned against not just copyright holders and content creators, but against the entire capitalist system. Patry, who is the author of a multi-volume treatise on copyright law, has done the intellectual equivalent of “going postal” within his own intellectual community. He has turned his intellectual guns on anyone and everyone who has ever had a kind word to say about copyright. He cannot find one nice thing to say about copyright or anyone who defends copyright in this book. Not one.

What’s most ironic about the book is that Patry seems utterly oblivious to the fact that in the process of critiquing the inflammatory rhetoric and “misuse of language” occasionally emanating from some copyright defenders, he goes completely over the top himself and engages in even more egregious rhetorical flourishes. Choice gems from the book include: “digital guillotines,” copyright as “cancer,” “copyright dwarves,” Maoism, the “sins” of copyright, “socialism for the wealthy,” and a comparison of the DMCA to “Mussolini’s Fascist Italy.”  Apparently when it comes to the “misuse of language,” Patry believes that two wrongs make a right.

And then there is his mind-boggling conclusion that: “I cannot think of a single significant innovation in either the creation or distribution of works of authorship that owes its origins to the copyright industries.”  Apparently, every great book, every great movie, every great video game, and ever great musical composition of the past century was done solely for the love of it all. Copyright had apparently had absolutely nothing to do with it according to Patry’s logic. That is just an astonishingly naive notion, in my opinion. Apparently this man’s hatred for copyright-related industries is so intense that it has blinded him to any potentially positive effects of copyright law. If nothing else, it would have been nice to see Mr. Patry address how it is that America is the world’s leading creator and exporter of creative arts.  Certainly copyright law must have had something to do with that!

Chapter 5 of his book makes it clear that Patry’s critique of copyright is actually rooted in a much deeper suspicion about capitalism itself.  He speaks of “the myth of economic freedom” and claims that “free market fundamentalism… destroyed much of the world’s economies.”  He then launches into a neo-Marxist critique of property rights more generally, treating property as a zero-sum game of winners and losers.  At times it all begins to sound like a rant from an old Herbert Marcuse book with questions like: “why are the interests of one social group favored over another?” and “What social objective is being furthered by the decision to privilege one group over another?”  And there’s all sorts of talk about “regulation in the public interest,” which I have critique as a meaningless non-standard here many times before.

In the end, Patry’s book will–along with Helprin’s–long be remember as marking the nadir in the “copyright wars;” a moment when grown men of great intelligence decided to trade in their integrity for the opportunity to engage in below-the-belt rhetorical cheap shots that would typically be reserved for college student debating politics over beers and shots at two in the morning.  They should both be ashamed of themselves.

(9) Gary RebackFree the Market!  Why Only Government Can Keep the Marketplace Competitive

Reback book coverGary Reback’s over-the-top ode to antitrust as the great savior of capitalism reads like an extended love letter. As I noted in my lengthy critique of his book, his fairy tale narrative of antitrust as the savior of capitalism is hopelessly one-sided, and his recommendations to expand antitrust enforcement wouldn’t “Free the Market” as he argues in his book’s shameful title, but would instead wrap it in regulatory chains.

He repeatedly insults the intelligence of the reader by claiming antitrust is supposedly not a form of economic regulation and that is can only have beneficial effects. He wants antitrust officials to intervene early and often in high-tech markets to guide markets to a supposedly better place. Reback considers just about everything “the Chicago School” taught us to be antitrust apostasy and he would like to erase four decades worth of economic literature and evidence that suggests antitrust law is a form of economic regulation and does have unintended consequences that often hurt consumer welfare.  Even if you are not an inherent antitrust skeptic like me, I think most people would hope for a better treatment of the other side of this story.

(10) tie – Tyler CowenCreate Your Own Economy: The Path to Prosperity in a Disordered World and John FreemanThe Tyranny of E-Mail: The Four-Thousand-Year Journey to Your Inbox

Create Your Own EconomyOK, so I just couldn’t figure out which of these two to cut from the list so I took the easy way out by having them tie for the last slot!  In this case, however, there’s another reason it makes sense for both of them to round out the list: Both Freeman and Cowen explore how humans are coping with information overload–albeit from two very different perspectives.

As I noted in my lengthy essay on the topic earlier this year, Cowen is an unrepentant optimist. He believes humans have the ability to adapt to new technological realities and a world of information abundance. In fact, Cowen argues, new tools and information gathering and processing technologies actually “lengthens our attention spans in another way, namely by allowing greater specialization of knowledge.”

The Tyranny of EmailJohn Freeman, by contrast, wants us all to take a high-tech time out. Like other Internet skeptics, he is worried that cyberspace and digital technologies are reshaping humanity–and not for the better. “If we are to step off this hurtling machine, we must reassert principles that have been lost in the blur,” he argues. “It is time to launch a manifesto for a slow communication movement, a push back against the machines and the forces that encourage us to remain connected to them.”

Unlike most other Internet pessimists, however, Freeman’s tone is more measured and his recommendations more reasonable.  Of course, it helps that he is magical wordsmith. Even if you find yourself disagreeing with many of his ultimate conclusions–as I did–you should read The Tyranny of E-Mail for a lesson in how to construct an argument and to appreciate the gift of fine writing. It’s easily the best tract by any Net skeptic since Nick Carr’s The Big Switch, and a much better one in many ways. It will force you to ask tough questions about the impact of the Information Age on you and the world around you.  Nonetheless, I remain an unrepentant techno-optimist (albeit a pragmatic one)!

A Better Pencil book coverI very much enjoyed Dennis Baron’s new book, A Better Pencil: Readers, Writers, and the Digital Revolution, and highly recommend you pick it up. Baron does a wonderful job exploring the history of techno-pessimism and the endless battles about the impact of new technologies on life and learning, something I have written about here before in my essays on “Internet optimists vs. pessimists” (See: 1, 2, 3).

Plato Wrote it Down by Adam Thierer

a review of A Better Pencil: Readers, Writers, and the Digital Revolution, by Dennis Baron (Oxford University Press, 280 pp., $24.95)

In the beginning, Dennis Baron reminds us in his new book, A Better Pencil, there was the word—the spoken word, that is. Oral tradition, the passing of knowledge through stories and lectures, was the primary method of instruction and learning throughout early human civilization. But then a few innovative souls decided to start writing everything down on stones and clay. Almost as soon as they did, a great debate began on the impact of new communications technology on culture and education. And it rages on today, with a new generation of optimists and skeptics battling over the impact that computing, the Internet, and digital technologies have on our lives and on how we learn about the world.

Baron, a professor of English and linguistics at the University of Illinois, begins his splendid history of these debates with the well-known tale from Plato’s Phaedrus about the dangers of the written word. The Egyptian god Theuth boasts to King Thamus about how his invention of writing will improve the wisdom and memory of the masses. Thamus shoots back, “The discoverer of an art is not the best judge of the good or harm which will accrue to those who practice it.” Thamus then passes judgment on writing’s impact on society, saying he fears that the people “will receive a quantity of information without proper instruction, and in consequence be thought very knowledgeable when they are for the most part quite ignorant.”

Of course, as Baron points out, we remember this warning only “because Plato wrote it down.” It’s one of the recurrent ironies in the history of techno-skepticism that while “the shock of the new often brings out critics eager to warn us away,” those critics often embrace—or, at the very least, benefit from—the very tools that they want the rest of us to shun. Whether it’s Luddites On-Line winning Yahoo’s “Cool Site of the Day” award, or the Writing Instrument Manufacturers Association promoting National Handwriting Day via the Internet, or Ted Kaczynski’s Unabomber Manifesto attracting unprecedented readership thanks to its availability on the Web, those who have a “common tendency to romanticize the good old ways” of doing things often fail to appreciate how new technology can benefit society—including themselves.

Baron walks us through a litany of historical examples—the printing press, the telegraph, telephones, typewriters, pocket calculators, personal computers, word processors, webpages, blogs, social-networking sites, and more—and identifies the usual pattern: we greet each new technology with deep distrust and dire warnings, but in time we adapt to the new realities. Indeed, as a species, we have an unparalleled ability to learn new ways of doing things. We don’t always like technological change, and often we deeply resent or fear it, but in the end, we learn to live with it and eventually to embrace it.

With the rise of the Internet and digital technologies, we see this pattern unfolding once again. “According to the latest generation of critics and naysayers,” Baron notes, “today it is computers that are producing texts whose value and credibility we question; computers that are giving too many people control over the creation and publication of text; computers that are wreaking havoc with our handwriting.” Contemporary critics also fret over “information overload.”

The backlash against computers and digitization began while the Internet was still in its cradle, with the 1992 publication of Neil Postman’s anti-technology screed, Technopoly: The Surrender of Culture to Technology. Postman’s intellectual descendants include Internet critics such as Lee Siegel, Andrew Keen, and Mark Helprin, whose works drip with disdain for all things digital. They warn of a coming dystopia where truth and authority vanish, culture crumbles, and political polarization breeds closed-mindedness and even the death of deliberative democracy.

These overly pessimistic critics turn a blind eye to both the wonders of the digital age and humanity’s ability to adapt. As Baron persuasively argues, “English survives, conversation thrives online as well as off, and on balance, digital communications seems to be enhancing human interaction, not detracting from it.” In fact, we live in a world of unprecedented media abundance that previous generations would have found unimaginable. As Baron puts it: “The Internet is a true electronic frontier where everyone is on his or her own: all manuscripts are accepted for publication, they remain in virtual print forever, and no one can tell writers what to do.” Such human empowerment is worth celebrating, even if it does have the occasional downside. Abundance is better than a world of scarce choices and few voices.

Baron’s retelling of the history of techno-skepticism is edifying, but it leaves one with the nagging feeling that these debates will never cease. Each generation will witness a technological watershed that brings out a fresh crop of both pollyannas and pessimists. Like Plato, however, most of us will embrace whatever’s next and move forward.

Fred Vogelstein’s essay in Wired, “Great Wall of Facebook: The Social Network’s Plan to Dominate the Internet — and Keep Google Out” describes the intensifying clash between Google and Facebook—a clash that focuses on the ability to target advertising:

Like typical trash-talking youngsters, Facebook sources argue that their competition is old and out of touch. “Google is not representative of the future of technology in any way,” one Facebook veteran says. “Facebook is an advanced communications network enabling myriad communication forms. It almost doesn’t make sense to compare them.”

Apart from noting that Facebook directs users to Microsoft’s Bing as its default search engine for the Internet at large, the most interesting part of the article is Facebook’s “4-Step Plan for Online Domination”:

1. Build critical mass. In the eight months ending in April, Facebook has doubled in size to 200 million members, who contribute 4 billion pieces of info, 850 million photos, and 8 million videos every month. The result: a second Internet, one that includes users’ most personal data and resides entirely on Facebook’s servers. 2. Redefine search. Facebook thinks its members will turn to their friends—rather than Google’s algorithms—to navigate the Web. It already drives an eyebrow-raising amount of traffic to outside sites, and that will only increase once Facebook Search allows users to easily explore one another’s feeds. 3. Colonize the Web. Thanks to a pair of new initiatives—dubbed Facebook Connect and Open Stream—users don’t have to log in to Facebook to communicate with their friends. Now they can access their network from any of 10,000 partner sites or apps, contributing even more valuable data to Facebook’s servers every time they do it. 4. Sell targeted ads, everywhere. Facebook hopes to one day sell advertising across all of its partner sites and apps, not just on its own site. The company will be able to draw on the immense volume of personal data it owns to create extremely targeted messages. The challenge: not freaking out its users in the process.

Facebook can’t keep losing money forever.  Indeed, investors are willing to keep sinking money into Facebook during Phases 1-3 because they think it will pay off in Phase 4—when Facebook really threatens to be a fGoogle-killer.  But rather the fact that investors are willing to subsidize the creation of a wonderful platform now used by 200 million people (one fifth of all Internet users worldwide), or that Facebook might finally provide a counter-weight to the fearsome Google, the People for the Ethical Treatment of Data (PETD) are appalled.  One commenter on the Wired story put it best:

I find it amazing that people will willingly post personal information to websites that will only use it for data mining and advertising revenue. They lay their entire life open to a corporation that’s only looking to profit from the information said corporation can gather for itself or it’s affiliates. When the government reads our emails, listens to our phone conversations, reads our text messages and monitors what we do online people are outraged at the invasion of our privacy. But then they log in to Facebook or Myspace or Twitter and reveal all. The Facebook “community”. Please. It’s a way for Big Business to pry into our private lives and exploit us in any way they can for the money they can make.

Such arrogant entitlement is astonishing—but hardly atypical: What makes this person (or his PETD comrades) so certain that they really know what’s best for everyone else and that Facebook users are poor, ignorant suckers being victimized by corporate greed?  As Adam Thierer and I have been sayingthere is no free lunch! Do the PETD folks expect investors to pour hundreds of millions into building innovative social networks like Facebook out of… love?  As Adam Smith put it, “It is not from the benevolence of the butcher, the brewer, or the baker that we expect our dinner, but from their regard to their own interest.”

While most in the PETD crowd are too young (or just historically deprived) to know the words to  The Internationale (my favorite line: “Masses, slaves, arise, arise!”), one can easily imagine them kicking off PETD meetings with a somewhat more recent anthem, Aquarius, from the hit 1967 rock musical Hair:

When the moon is in the Seventh House And Jupiter aligns with Mars Then peace will guide the planets And love will steer the stars This is the dawning of the age of Aquarius Harmony and understanding Sympathy and trust abounding No more falsehoods or derisions Golden living dreams of visions Mystic crystal revalation And the mind’s true liberation

Yes, Virginia, the marijuana-induced socialist-utopian delusions of the Sixties live on in a new generation of Techno-Aquarians, who want to have their digital cake—and eat yours too.  Something for nothing, free lunch for everyone!  Down with profit, up with privacy!  The “vision” (as in “Golden living dreams of”) behind this frenzy of frustration with online capitalism and PETD’s demands for regulation is what Thomas Sowell has called the “Vision of the Anointed,” “the talented few” who consider themselves wiser than everyone else, and therefore seek to impose their preferences on others, as Adam Thierer and I have both discussed.

But back to Wired:

The drumbeat of controversy surrounding Facebook illustrates the catch-22 the social network faces: It has a massive storehouse of user data, but every time it tries to capitalize on that information, its members freak out. This isn’t an academic problem; the company’s future depends on its ability to master the art of behavioral targeting—selling customized advertising based on user profiles. In theory, this should be an irresistible opportunity for marketers; Facebook’s performance advertising program allows them to design and distribute an ad to as narrow an audience as they would like. (It has also developed a program to create ads that are designed to be spread virally.) But as the Beacon debacle showed, there is a fine line between “targeted and useful” and “creepy and stalkerish”—and so far, not enough advertisers have been willing to walk that line… In a way, Facebook’s dilemma extends from its success. Users see the site as sanctified space, a place to engage in intimate conversations with friends—not to be laser-beamed by weirdly personal advertising. But with initiatives like Connect and Open Stream, Facebook can sell ads beyond its own site. Just as Google’s AdSense program sells ads on any participating Web site, Connect and Open Stream will eventually push Facebook-brokered advertising to any member site or app. But unlike with AdSense, Facebook’s ads could be exquisitely tailored to their targets. “No one out there has the data that we have,” says COO Sandberg.

Better targeted ads?  More useful information for Internet users?  A strong competitor for Google that could provide an alternative channel for advertisers and help drive up advertising revenue for publishers of “free” content and services?  Sounds great for all concerned.  Oh, but some people find relevant advertising “creepy?”  Ah, well, let’s call the whole thing off!  I’m sure Facebook will get by just fine selling crudely targeted ads on its own site for pennies a click.  Maybe they could ask for donations or hold a digital bake-sale (including tie-dyed t-shirts, of course)? Or we could just have “the government” support the most popular social networks (along with newspapers, banks, hedge funds and car manufacturers). And while they’re at it, why not have wise bureaucrats use antitrust laws to cripple Google and thus make up for the lack of a competitive threat from Facebook and the other Google-killers-that-might-have-been?

Wired suggests that Facebook’s strategy played some role in causing Google to embrace Interest-Based (behavioral) Advertising, playing catch-up to No.2 Yahoo!:

Google has even shown a willingness to join Facebook in gingerly tapping the third rail of Internet marketing—behavioral targeting. The search giant has long assured its users that it would never use their personal information to deliver targeted advertising, relying instead on aggregate data or search activity that preserves anonymity. (“There is a line with users that you don’t want to cross,” Google CEO Eric Schmidt said in the wake of the Beacon controversy.) But in March, Google started its own behavioral targeting campaign—tracking users’ browsing to deliver more-customized ads. Users have the option to either edit their profiles or opt out entirely.

With Google in the game, the fight is on.  The grand prize is clear—tapping into the most lucrative advertising purchased by leading brands:

Today, global online brand advertising accounts for just $50 billion a year. Offline brand advertising, meanwhile, accounts for an estimated $500 billion.

But I doubt there will ever be any clear “winner” in this race.  Instead, we’re likely to see fierce competition and ongoing one-upsmanship over the coming decade (and beyond) for users, for user data, and for they ad dollars they bring, among a variety of paradigms for what the Internet of the future should look like.  Facebook has already started implementing its paradigm with  Connect (launched Dec. 2008) and  Open Stream API (launched April 2009):

Connect and Open Stream don’t just allow users to access their Facebook networks from anywhere online. They also help realize Facebook’s longtime vision of giving users a unique, Web-wide online profile. By linking Web activity to Facebook accounts, they begin to replace the largely anonymous “no one knows you’re a dog” version of online identity with one in which every action is tied to who users really are. To hear Facebook executives tell it, this will make online interactions more meaningful and more personal…  But you don’t build a competitor to Google with people alone. You need data. And Connect and Open Stream are intended to make Facebook a much more powerful force for collecting user information. Any time someone logs in to a site that uses Connect or Open Stream, they give Facebook the right to keep track of any activity that happens there—potentially contributing tons more personal data to Facebook’s servers. Facebook Connect and Open Stream are also designed to make each user’s friend network, which belongs to Facebook, even more valuable and crucial to the Web experience. Together, they aim to put Facebook users’ social networks at the center of all they do online.

I, for one, think this competition will create enormous value for users by driving innovation that improves the usefulness of the Internet and increases the amount of funding available for an ever-greater, ever-richer torrent of “free” (ad-supported) content and services.  But if the Techno-Aquarians at PETD succeed in imposing regulatory mandates on the collection and use of online data through legislation or creeping regulation at the FTC, the Internet of the future won’t look all that different from the Internet of today: online content and services will continue to attract a small share of all ad dollars (just 7% in 2008), search engines will reap the bulk of that (42% in 2008), and most online content-publishers and service-providers will continue to get literally pennies per click while only a few are able to meet evolving standards of quality with purely ad-supported business models.

Heaven forbid we should allow those who offer “free” content and services to extract… profit from the unwashed masses of helpless consumers who are either too stupid, too lazy or too ignorant to manage their own privacy, no matter how powerful the privacy management tools at their disposal! The better alternative is empower users to make their own decisions about privacy, rather than imposing top-down “Industrial Policy for the Internet” on the entire country through outright prohibitions or restrictive defaults concerning data collection and use for targeting advertising—as Adam and I have said:

The ideal state of affairs would be to create a system of tools and data disclosure practices that would empower each user to implement their personal privacy preferences while also recognizing the freedom of those who rely on advertising revenues to “condition the use of their products and services on disclosure of information”—not to mention the viewing of ads!

As Google and Facebook do battle with each other, Microsoft, Yahoo! and other upstart rivals as-yet-unknown, I only hope they all—particularly their government affairs departments—remember that their common enemy is the Techno-Aquarians who seek to impose their subjective preferences about privacy on everyone else, no matter the costs to innovation, consumers, culture or media. A few months ago, I penned a mega book review about the growing divide between “Internet optimists and pessimists.” I noted that the Internet optimists — people like Chris Anderson, Clay Shirky, Yochai Benkler, Kevin Kelly, and others — believe that the Internet is generally improving our culture, economy, and society for the better. They believe the Net has empowered and liberated the masses, sparked unparalleled human creativity and communication, provided greater personalization and customization of media content, and created greater diversity of thought and a more deliberative democracy. By contrast, the Internet pessimists — including Nick Carr, Andrew Keen, Lee Siegel, and others — argue that the Internet is destroying popular culture and professional media, calling “truth” and “authority” into question by over-glamorizing amateurism and user-generated content, and that increased personalization is damaging deliberative democracy by leading to homogenization, close-mindedness, and an online echo-chamber. Needless to say, it’s a very heated debate!

I am currently working on a greatly expanded version of my “Net optimists vs. pessimists” essay for a magazine in which I will draw out more of these distinctions and weigh the arguments made by those in both camps. I plan on concluding that article by arguing that the optimists generally have the better of the argument, but that the pessimists make some fair points about the downsides of the Net’s radically disintermediating role on culture and economy.

So, this got me thinking that I needed to come up with some sort of a label for my middle-of-the-road position as well as a statement of my personal beliefs. As far as labels go, I guess I would call myself a “pragmatic optimist” since I generally side with the optimists in most of these debates, but not without some occasional reservations. Specifically, I don’t always subscribe to the Pollyanna-ish, rose-colored view of the world that some optimists seem to adopt. But the outright Chicken Little-like Ludditism of some Internet pessimists is even more over-the-top at times. Anyway, what follows is my “Pragmatic (Internet) Optimist’s Creed” which better explains my views. (Again, read my old essay first for some context about the relevant battle lines in this intellectual war).

The Pragmatic (Internet) Optimist’s Creed

I believe that the Internet is reshaping our culture, economy, and society – in most ways for the better, but not without some heartburn along the way.

I believe that the world of information abundance that has dawned is vastly superior to the world of information poverty that we just left. But I also understand that not all information is equal and that that the rise of abundance raises concerns about information overload, objectionable content, and the role of “authority” and “truth.”

I believe the era of traditional Mass Media is coming to an end, but “professional” media institutions and creators continue to play a vital role in the creation, aggregation, and dissemination of news, information, culture, and entertainment. The Internet, however, will force gut-wrenching changes on traditional media institutions and some of the more vital ones (ex: daily local newspapers) will struggle to re-invent themselves, or may wither away entirely.

I believe that “professional” journalism faces very serious challenges from the rise of the Internet and user-generated content, but I also believe that hybrid forms of news-gathering and reporting are offering society exciting new ways to learn about the world around them.

I believe Wikipedia is an amazing example of collection action / intelligence at work, but I also understand it is not without flaws and limitations. I believe Wikipedia is a wonderful complement, but not a complete substitute, for other media and information sources and inputs.

I believe that free and open source software (FOSS) has offered society enormous benefits, but I do not believe that FOSS (or “wiki” models) will replace all proprietary business models or methods. Each model or mode of production has its place and purpose and they will continue to co-exist going forward, albeit in serious tension at times.

I believe the Long Tail is a powerful phenomenon, but not “the future of all business.” It is now a more important part of the future of business, but not the entirety of it.

I believe there is a difference between “remix culture” and “ripoff culture.” Remixing (including mash-ups of all sorts) generally enhances and extends culture and creativity. Blatant content piracy, on the other hand, can discourage the creative efforts of the masses. Likewise, hacking, circumvention, and reverse-engineering all play an important and legitimate role in our new digital economy, but one need not accept the legitimacy of those activities when conducted for nefarious purposes (think identity theft or chip modding to facilitate video game piracy.)

I believe that the Internet has empowered the masses and created a world of “pro-sumers” that gives every man, woman, and child a soapbox on which to speak to the world. But that does not mean that all of them will have something interesting to say, and I won’t praise user-generated content as a good in and of itself. It’s quality, not volume, that counts.

I believe that the Internet’s empowering nature has changed much about society and culture, but I do not believe in the romanticism espoused by some about how the Net “remaking man” or changing human nature in a fundamental way. The Internet does not liberate us from all earthly constraints and it cannot magically solve all of humanity’s problems.

I believe that the Internet is reinvigorating deliberative democracy and giving us increased exposure to a breathtaking diversity of views that were previously inaccessible, at least for most of us. On the other hand, I understand that some Netizens will often seek out only those views that reinforce their pre-existing biases.

I believe in the power of freedom of speech and expression, and appreciate that the Internet and the rise of user-generated content has given us a world of unprecedented information and cultural riches. I also understand, however, that unrestricted freedom of speech and expression permits an increase in the prevalence of objectionable, even harmful, speech and content. On net, however, (excuse the pun) the Internet is the most important medium of human communication and expression that the world has ever known.

In sum, I believe there are more reasons to be optimistic than pessimistic about the Internet and its role in shaping our lives, culture, economy, and society. But that doesn’t mean it will be all roses going forward.

Carr Big Switch book coverI just finished reading through The Economist’s new 14-page special report on cloud computing, “Let It Rise” in which Ludwig Siegele provides an outstanding overview of cloud computing and why it is so important:

The rise of the cloud is more than just another platform shift that gets geeks excited. It will undoubtedly transform the information technology (IT) industry, but it will also profoundly change the way people work and companies operate. It will allow digital technology to penetrate every nook and cranny of the economy and of society, creating some tricky political problems along the way.

Even if you are very familiar with cloud computing, I recommend you take a look at the article. Anyway, while I was reading it, I was unsurprised to come across some comments from Nicholas Carr, whose new book The Big Switch: Rewiring the World, from Edison to Google, is essentially an early history of cloud computing and an investigation into its effects on our economy, culture, and society. And that also reminded me that, even though I have mentioned Carr’s book here several times since it was released earlier this year, I have failed to give it a dedicated review. And it certain deserves one because “The Big Switch” is easily one of the most important technology policy books of 2008.

One of the reasons Carr’s book will be high up on my end of the year list of best tech books has nothing to do with substance. It’s his style. Carr is one of most gifted writers in the tech policy field today. His eloquence and brilliant story-telling skills remind me of George Gilder in his prime. Carr nicely places modern developments in a historical context and relates the changes we are witnessing today to previous technological innovations and eras.

At the same time, however, Carr has also become one of the America’s leading Internet skeptics and vocal critics of techno-utopianism, as I noted in an essay a few months ago about Internet optimists and pessimists. He is, by far, the most reasonable and respected of those Net skeptics, using a measured tone when attacking those who have adopted a more pollyanna-ish, rose-colored view of the world. [For similar reasons, Carr’s “Rough Type” blog is must-reading for anyone who monitors technology policy.]

Electric Parallels

But on to the substance of the book. Carr’s thesis is that we are in the midst of “another epochal [technological] transformation” that parallels what happened with the “democratization of electricity” a century ago:

What happened to the generation of power a century ago is now happening to the processing of information. Private computer systems, built and operated by individual companies, are being supplanted by services provided by a common grid — the Internet — by centralized data-processing plants. Computing is turning into a utility, and once again the economic equations that determine the way we work and live are being rewritten. (p. 12)

“That shift,” Carr continues, “promises not only to change the nature of corporate IT departments but to shake up the entire computer industry.” (p. 13) Indeed, the “revolutionary potential of the information utility” promises to have profound implications:

In the years ahead, more and more of the information processing tasks that we rely on, at home and at work, will be handled by big data centers located out on the Internet. The nature and economics of computing will change as dramatically as the nature and economics of mechanical power changed in the early years of the last century. The consequences for society — for the way we live, work, learn, communicate, entertain ourselves, and even think — promise to be equally profound. (p. 21)

Unsurprisingly, Google is the central player in Carr’s drama because it is “a giant information utility” (p. 13) that has capitalized on the movement of so much knowledge and technology into the cloud and off of our desktops. Carr argues that “once utility services mature, the idea of getting rid of your PC will become much more attractive” (p. 80) and “We may find, twenty or so years from now, that the personal computer has become a museum piece, a reminder of a curious time when all of us where forced to be amateur computer technicians.” (p. 81)

Carr’s Critique of “Techno-Utopianism”

Part One of The Big Switch is primarily concerned with this progression of computing and IT from specialized service to mainstream utility, and I believe that most readers will find it as engrossing and enlightened as I did. But the tone and focus of Carr’s book change dramatically as Part Two opens. Whereas Carr keeps Part One fairly value- or viewpoint-neutral, Part Two is a more spirited critique of the economic and cultural consequences of “The Big Switch.”

In Part Two, he launches into his attack of the “techno-utopianism” that sometimes accompanies discussions about the implications of the Information Age and life in the cloud. “[O]ptimism is a natural response to the arrival of a powerful and mysterious new technology,” but, Carr warns, “it can blind us to more troubling portents.” And “there is reason to believe that our cybernetic meadow may be something less than a new Eden.” (p. 125)

It is here that Carr’s critique becomes familiar to those of us who follow the modern Internet policy debates. As I noted in my “Internet Optimists and Pessimists” essay, Carr is joining the ranks of other Net skeptics like Andrew Keen, Lee Siegel, and others. In my recent review of Lee Siegel’s Against the Machine: Being Human in the Age of the Electronic Mob, I traced this strand of social criticism back to the late Neil Postman, author of the 1992 anti-technology manifesto, Technopoly: The Surrender of Culture to Technology.

Carr’s concerns about the consequences of cloud computing and the rise of “techno-utopianism” parallel those found in those other “pessimistic” tracts, although Carr is far more level-headed in articulating those fears. As I noted in the Siegel review, those concerns can generally be grouped as follows:

  1. The Net is destroying (or at least greatly diminishing) the role of experts, authority, “truth”, and traditional societal norms and institutions. This is having (or eventually will result in) dangerous ramifications for our culture, economy, and democracy.
  2. The personalization and customization that the Information Age and the Internet have spawned could have troubling ramifications for our society and culture.

Dangers of Disintermediation and the Problem with “Free”

Regarding the first of these concerns, Carr argues that “while it’s true that the reduction in production and distribution costs is bringing us many more options, it would be a mistake to leap to the conclusion that nothing will be sacrificed in the process. More choices don’t necessarily mean better choices,” he says. (p. 151) He continues:

Many cultural goods remain expensive to create or require the painstaking work of talented professionals, and it’s worth considering how the changing economics of media will affect them. Will these goods be able to find a large enough paying audience to underwrite their existence, or will they end up being crowded out of the marketplace by the proliferation of free, or easily accessible products? Even though the Internet can in theory accommodate a nearly infinite variety of information goods, that doesn’t mean that the market will be able to support all of them. Some of the most cherished creative works may not survive the transition to the Web’s teeming bazaar. (p. 151)

More specifically, Carr is worried about what “The Great Unbundling” — i.e., the radically disruptive disintermediation associated with the Internet Age — will mean for the future of “hard news,” investigative journalism, and prized forms of culture. The cross-subsidies that have supported the creation of such content are at risk, Carr fears, as the Net’s relentless drive for increased efficiency rolls like a digital wrecking ball through the old media and cultural landscape. “[T]he largest threat posed by social production won’t be to big corporations but to individual professionals — to the journalists, editors, photographers, researchers, analysts, librarians, and other information workers who can be replaced,” Carr says, by “crowdsourcing.” (p. 142)

In this way, Carr’s concerns are quite similar to those raised by Andrew Keen and others about how the Internet is potentially “killing our culture” (or at least the best of it as they would define it). But Carr extends this social critique in an important way by claiming that the problem with the emerging model of social production and “free” business models that dominate the online marketplace today is that they are built on a “sharecropper model.” The Net’s dominant giants, he argues, are reaping their riches on the back of free labor. These new sites and services “are essentially agglomerations of the creative, unpaid contributions of their members. In a twist on the old agricultural practice of sharecropping, the site owners provide the digital real estate and tools, let the members do all the work, and then harvest the economic riches.” (p. 137-8)

I have some sympathy for these arguments, especially as they have been articulated by Carr here in The Big Switch. Compared to the way other critics like Keen and Siegel have used over-the-top apocalyptic, neo-Luddite rhetoric when discussing their related concerns, Carr generally avoids such hysteria and does a better job of laying out his concerns about the Net and cloud computing in a more reasonable fashion. And there is little doubt that the Internet and social production models are placing enormous strain on many traditional professions and professionals.

I have problems with his “sharecropper” argument, however. This logic ignores the non-monetary benefits that many of us feel we extract from today’s online business models and social production processes. Most of us feel we get a lot back as part of this new value exchange. Carr is certainly correct that Google, Facebook, MySpace, and a lot of other Net middlemen are getting big and rich based on all the user-generated content flowing over their sites and systems. On the other hand, most cyber-citizens extract enormous benefits from the existence of those (mostly free and constantly improving) platforms and services. It’s a very different sort of value exchange and business model than most of us have been accustomed to in the past, but we are adjusting to it. We humans are resilient, adaptable creatures and we can usually learn to cope with such changes and find a way to use them to our advantage. It’s not all about companies getting rich; we are getting richer too, but in a different way. We have an abundance of information, culture, and communications opportunities at our disposal today that were simply unthinkable even a generation ago.

Carr and other Net skeptics certainly raise some very legitimate questions about the limitations of the “free culture” mindset, however. There are times when the net optimists really do sound like the pollyannish “utopians” that Carr claims they are. When I am reading the work of Benkler and other optimists, it sometimes comes across as techno-Rousseauian gibberish (or what Carr labels “the Internet’s liberation mythology.”) The Internet isn’t remaking man or changing human nature in any fundamental way, which is what some optimists seem to imply. Moreover, when it comes to economics, all this talk about the Long Tail being “the future of business” (Chris Anderson) and of “Wikinomics… changing everything through mass collaboration,” (Don Tapscott & Anthony Williams) goes much too far in my opinion. It’s irrational (techno-) exuberance.

On the other hand, Carr and the other pessimists occasionally go to the opposite extreme in critiquing new models of social production, open source, and other collaborative creative endeavors. Their obsession with Wikipedia is particularly curious. If one views Wikipedia and Wiki- models as supplements or compliments to traditional media and communications models and activities, then where is the harm? Most of us understand they are not perfect, but we can appreciate the benefits they bring society despite their limitations.

When it comes to the true impact of the Internet on our economy and culture, the truth is somewhere in between the two extremes staked out by optimists and pessimists. My own position in this regard might best be labeled “pragmatic optimism”: One can appreciate how much better off the Internet has made society while also recognizing that it has created new challenges that we need to think through.

Downsides of Hyper-Personalization

The other important theme developed by Carr in the second half of The Big Switch, which also runs throughout the work of other techno-pessimist tracts, is that the increased personalization and customization facilitated by the Internet is breeding dangerous anti-social attitudes and tendencies. Building on an argument first put forth by Cass Sunstein in his 2001 book Republic.com , Carr worries about the impact of the “Daily Me.” The “Daily Me” was the term Nicholas Negroponte coined in his prescient 1995 book Being Digital, to describe the new digital world he hoped would develop, filled with hyper-personalized, instantaneously-delivered content. And that’s largely the Web 2.0 world we live in today.

But Carr, Sunstein, and many other Net skeptics, refer to Negroponte’s “Daily Me” in contemptuous terms, arguing that the hyper-customization of websites and online technologies is causing extreme social “fragmentation,” “polarization,” “balkanization,” and “single-mindedness.” Carr warns:

Every time we subscribe to a blog, add a friend to our social network, categorize an email message as spam, or even choose a site from a list of search results, we are making a decision that defines, in some small way, whom we associate with and what information we pay attention to. (p. 160)

Thus, he fears, we could be “click[ing] our way to a fractured society” (p. 160) because of the “ideological amplification” (p. 164) bred by the Daily Me. There’s even the risk of increased fanaticism, radicalization, and extremism, he warns.

I have addressed this argument at length in my 2005 book, Media Myths (p. 39) but, to summarize, the fundamental problem with this logic is that it ignores the fact that, thanks to the rise of the Net, most of us are experiencing far more diverse voices and viewpoints than we ever did in the past. Sure, it is true that we also can now find our little niche groups and bunk-up with them online for extended periods, but I find it absurd to claim that we humans are less exposed to diverse viewpoints today than in the past.

Regardless, even if Carr and the other Net skeptics are correct and the Net is breeding such isolation and balkanization, what are we suppose to do about it? Should we roll back the clock to the good ol’ days? Carr doesn’t give us a straight answer. But, again, there are good reasons to question whether society was really better off in the pre-Internet days. The Analog / Scarcity Era had it’s own share of problems, beginning with the fact that it was extremely difficult for niche interests in our society to be served when media was catering to a mass audience through newspapers and broadcast stations. Certainly, the old model of media delivery had its advantages, but the drawbacks were enormous, and not just as it pertained to entertainment. Consider news: If we all weren’t home sitting in front of our TV sets at exactly 6:30 each night, then we missed our chance to hear the same three old white guys in bad suits tells us what the important news of the day was. Look, I liked Cronkite, Brinkley & Co., but I will take today’s 24/7 news cycle of instantaneous news over that old system any day of the week.

Again, there are trade-offs at work here. Things are not all roses like Net optimists would claim. The downside of an endless news cycle is that people can just find a niche news channel or program that feeds them news more closely in line with their own ideological tendencies. Moreover, there very well may be — to use Glenn Reynolds’s phrase — “An Army of Davids” out there in the blogosphere today taking on traditional media and expressing themselves however they wish, but that doesn’t automatically mean they all have something interesting to say! Even when they do, there is still a useful role played by mass media providers or “professional” media in steering news and culture. Indeed, they provide an essential editing function in terms of helping us decide what types of news or culture may be more important. I personally rely on the Wall Street Journal to help guide my investigation of what financial market news is worth exploring each week. I wouldn’t want to just set up my Google Alerts to feed me “financial news” and then trust that everything that came into my RSS reader was worth reading. In this sense, the WSJ is what I call a “trusted information intermediary” (or “old school filter” if you will) that many of us could not live without.

But that traditional intermediary editing and filtering function, which used to be total in its applicability to news and culture, is now shrinking rapdily. “Mass media” just isn’t quite as MASS-ive as it once was, and the rise of personalized “Daily Me” media and culture certainly has had something to do with that since it has allow us to filter news and culture ourselves.  But why can’t we have the best of both worlds — some old school filtering by trusted information intermediaries along with plenty of personalized filtering? In many ways, I think we have that balance today — and it is a wonderful thing. Pessimists like Carr seem to only focus on the downsides of customized media, and that’s unfortunate. Nonetheless, they are right to ask the tough questions about how long those old school filters (traditional media intermediaries) will survive if all of us flock to an extreme “Daily Me” mindset. My contention, however, is that we won’t. Most of us appreciate the balanced approach and are willing to support some — but not all — of those old intermediaries and filters.

I have far less sympathy for Carr’s argument that increased specialization and customization are breeding “fanaticism” and “radicalization.” Last time I checked, mobs weren’t rioting in the streets or rushing out to join the Nazi or Communist parties! Those knuckleheads still exist, of course, but they have always existed. And let’s not forget, it was during the age of scarcity and mass media that those movements gained traction and took control in some countries. In the Internet Age, by contrast, such extremist loonies usually get exposed and widely ridiculed. As the old saying goes, the answer to bad speech is more speech. The Internet has given it to us and helped us counter such societal extremism, even if it has simultaneously given such extremists a new soapbox to stand on and spew their hatred and stupidity. Let them spew it and we will respond! And we will marginalize them in the process. There’s just no chance some sort of mini-Hitler is going to use the Net to revive fascism and build a mass audience today.

Finally, I believe Carr makes a similar mistake when he argues that computers and the Internet are really more “technologies of control” than “technologies of emancipation.” (p. 191)  “While the Net offers people a new medium for discovering information and voicing opinions, it also provides bureaucrats with a powerful new tool for monitoring speech, identifying dissidents, and disseminating propaganda.” (p. 200)  In this sense, Carr is adopting the same pessimistic tone set forth by Jack Goldsmith and Tim Wu in their book Who Controls the Internet? While I agree that computers and the Net give the big bad statist bureaucrats new tools of control, I persist in my belief that these digital tools offer the masses more methods of evading and minimizing the power of government over their lives and liberties.  Again, I think it is important to put things in some historical context. In the past, governments could completely control the media and disseminate incessant propaganda. It is far more difficult for them to get away with that today, and citizens have many tools and outlets at their disposal to respond.  Digital technologies really are technologies of emancipation, but we can’t expect them to break the backs of the statist thugs overnight.

Conclusion

Carr’s pessimism on the two issues discussed above is succinctly captured on pg. 167 of his book when he argues that:

it’s clear that two of the hopes most dear to the Internet optimists — that the Web will create a more bountiful culture and that it will promote greater harmony and understanding — should be treated with skepticism. Cultural impoverishment and social fragmentation seem equally likely outcomes.

That almost perfectly delineates the battle lines in the great debate taking place today between Internet optimists and pessimists. The Big Switch probably makes the best case for the pessimists that has been penned thus far, and for that reason alone it deserves your attention. However, I continue to remain cautiously optimistic that the Net is moving our economy, culture, and society in a better direction — at least compared to a past, which had its own share of drawbacks and problems.
