Reason magazine recently published my review of Franklin Foer’s new book, World Without Mind: The Existential Threat of Big Tech. My review begins as follows:

If you want to sell a book about tech policy these days, there’s an easy formula to follow. First you need a villain. Google and Facebook should suffice, but if you can throw in Apple, Amazon, or Twitter, that’s even better. Paint their CEOs as either James Bond baddies bent on world domination or naive do-gooders obsessed with the quixotic promise of innovation. Finally, come up with a juicy Chicken Little title. Maybe something like World Without Mind: The Existential Threat of Big Tech. Wait—that one’s taken. It’s the title of Franklin Foer’s latest book, which follows this familiar techno-panic template almost perfectly.

The book doesn’t break a lot of new ground; it serves up the same old technopanicky tales of gloom-and-doom that many others have said will befall us unless  something is done to save us. But Foer’s unique contribution is to unify many diverse strands of modern tech criticism in one tome, and then amp up the volume of panic about it all. Hence, the “existential” threat in the book’s title. I bet you didn’t know the End Times were so near!

On Tuesday, UN Secretary-General Ban Ki-Moon delivered an address to the UN Security Council “on the Non-Proliferation of Weapons of Mass Destruction.” He made many of the same arguments he and his predecessors have articulated before regarding the need for the Security Council “to develop further initiatives to bring about a world free of weapons of mass destruction.” In particular, he was focused on the great harm that could come about from the use of chemical, biological and nuclear weapons. “Vicious non-state actors that target civilians for carnage are actively seeking chemical, biological and nuclear weapons,” the Secretary-General noted. A stepped-up disarmament agenda is needed, he argued, “to prevent the human, environmental and existential destruction these weapons can cause . . . by eradicating them once and for all.”

The UN has created several multilateral mechanisms to pursue those objectives, including the Nuclear Non-Proliferation Treaty, the Chemical Weapons Convention, and the Biological Weapons Convention. Progress on these fronts has always been slow and limited, however. The Secretary-General observed that nuclear non-proliferation efforts have recently “descended into fractious deadlock,” but the effectiveness of those and similar UN-led efforts have long been challenged by the dual realities of (1) rapid ongoing technological change that has made WMDs more ubiquitous than ever, plus (2) a general lack of teeth in UN treaties and accords to do much to slow those advances, especially among non-signatories.

Despite those challenges, the Secretary-General is right to remain vigilant about the horrors of chemical, biological and nuclear attacks. But what was interesting about this address is that the Secretary-General continued on to discuss his concerns about a rising class of emerging technologies, which we usually don’t hear mentioned in the same breath as those traditional “weapons of mass destruction”:

I will now say a few words about new global threats emerging from the misuse of science and technology, and the power of globalization. Information and communication technologies, artificial intelligence, 3D printing and synthetic biology will bring profound changes to our everyday lives and benefits to millions of people. However, their potential for misuse could also bring destruction. The nexus between these emerging technologies and WMD needs close examination and action. As a starting point, the international community must step up to expand common ground for the peaceful use of cyberspace and, particularly, the intersection between cyberspace and critical infrastructure.  People now live a significant portion of their lives online. They must be protected from online attacks, just as effectively as they are protected from physical attacks. Disarmament and non-proliferation instruments are only as successful as Member States’ capacity to implement them.

And the Secretary-General concluded by calling on “all Member States to re-commit themselves and to take action. The stakes are simply too high to ignore.”

The Secretary-General’s inclusion of all these emerging technologies in a speech about WMDs and the dangers of chemical, biological and nuclear weapons raises an interesting question: Are all these things actually equivalent? Does a danger exist from the continued evolution of ICTs, AI, 3D printing, and synthetic biology that is equal to the very serious threat posed by chemical, biological and nuclear weapons?

On one hand, it is tempting to say, Yes! If nothing else, most of us have seen more than enough techno-dystopian Hollywood plots through the years to understand the hypothetical dangers that some of these technologies pose. But even if (like me) you dismiss most of the movie plots as far-fetched Chicken Little-ism meant to drum up big box office, plenty of serious scholars out there have sketched out more credible pictures of the threat some of these new technologies might pose to humanity. Information platforms can be hacked and our personal data or security compromised. 3D printers can be used to create cheap, undetectable firearms. Robotics and autonomous systems can be programmed to kill. Synthetic biology might help create genetically-modified super-soldiers. And so on.

These are serious questions with profound ramifications and I discussed them at much greater length in my lengthy review of Wendell Wallach’s important book, A Dangerous Master: How to Keep Technology from Slipping beyond Our Control. Like many other books and essays on these technologies, Wallach champions “the need for more upstream governance” as in “more control over the way that potentially harmful technologies are developed or introduced into the larger society. Upstream management is certainly better than introducing regulations downstream, after a technology is deeply entrenched or something major has already gone wrong,” he suggests. “Yet, even when we can access risks, there remain difficulties in recognizing when or determining how much control should be introduced. When does being precautionary make sense, and when is precaution an over-reaction to the risks?”

Indeed, that is the right question, and quite a profound one. The problem associated with all such “upstream governance” and preemptive controls on emerging technologies is determining how to avoid hypothetical future risks without destroying the potential for these same technologies to be used in life-enriching and even life-saving ways.

Solutions are illusive and involve myriad trade-offs. More generally, it’s not even clear that they would be workable. That is especially true when you expand the scale of governance to include the entire planet. It seems unlikely, for example, that a hypothetical UN-led Synthetic Biology Non-Proliferation Treaty, 3D-Printed Weapons Convention, or Agreement on the Peaceful Use of Cyberspace are going to be workable solutions in a world where these technologies are so radically decentralized and proliferating so rapidly. At least with some of the older technologies, the underlying materials were somewhat harder to obtain, manufacture, weaponize, and then distribute/use. But the same is not true of many of these newer technologies. It’s a heck of lot easier to get access to a computer and 3D printer than uranium and enrichment facilities, for example.

Moreover, when we discuss the risks associated with emerging technologies compared to past technologies, there needs to be some sort of weighing of the actual probability of serious harm coming about. In the expanded Second Edition of my Permissionless Innovation book, I tried to offer a rough framework for when formal precautionary regulation (i.e., operational restrictions, licensing requirements, research limitations, or even formal bans) might be necessary. In a section of Chapter 3 of my book entitled, “When Does Precaution Make Sense?” I argued that:

Generally speaking, permissionless innovation should remain the norm in the vast majority of cases, but there will be some scenarios where the threat of tangible, immediate, irreversible, catastrophic harm associated with new innovations could require at least a light version of the precautionary principle to be applied.  In these cases, we might be better suited to think about when an “anti-catastrophe principle” is needed, which narrows the scope of the precautionary principle and focuses it more appropriately on the most unambiguously worst-case scenarios that meet those criteria.

“But most [emerging technology] cases don’t fall into this category,” I concluded. It is simply not the case that most emerging technologies pose the same sort of tangible, immediate, irreversible, catastrophic, and highly probably risk that traditional “weapons of mass destruction” do.

And that gets at my problem with that recent address by UN Secretary-General Ban Ki-Moon. By so casually moving from a heated discussion of traditional WMDs into a brief discussion about the potential risks associated with ICTs, AI, 3D printing and synthetic biology, I really worry about the sort of moral equivalence that some might read into this speech. Again, these things, and the threats they pose, are simply not the same. Yet, when the UN Secretary-General sandwiches these technologies in between impassioned opening and closing statements about the need “to take action” because “the stakes are simply too high to ignore,” it seems to suggest he is prepared to speak of them all in the same breath as traditional “weapons of mass destruction” and suggest similar global control efforts are needed. I do not believe that is sensible.

Does this mean we just throw our hands up in the air and give up any inquiry into the matter? Of course not. As I noted in my review of Wallach’s book, some very sensible “soft law” approaches exist that are worth pursuing. Soft law approaches can include a wide variety of efforts to “bake a dose of precautionary directly into the innovation process through a wide variety of informal governance/oversight mechanisms,” as I noted in my review of Wallach’s book. “By embedding shared values in the very design of new tools and techniques, engineers improve the prospect of a positive outcome,” Wallach says in his book.

Many soft law or informal governance systems already exist in the forms of  so-called “multistakeholder governance” systems, informal industry codes of conduct, best practices, and other coordinating mechanisms. But these solutions would likely fall short of addressing some extreme scenarios that many people are worried about. Toward that end, when the case can be made that a particular application of a new general purpose technology will result in tangible, immediate, irreversible, catastrophic, and highly probably dangers, then perhaps some international action should be considered. For example, a case can be made that governments (and perhaps even the UN) should do more to preemptively curb the most nefarious uses of robotics. There’s already a major effort underway called the “Campaign to Stop Killer Robots” that seeks a multinational treaty to stop deadly uses of robotics. Again, I’m not sure how enforcement will work, but I think it’s worth investigating how some of the uses of “killer robots” might be limited through international accords and actions. Moreover, I could imagine an extension of existing the UN’s Biological Weapons Convention framework to cover some synthetic biology applications that involve extreme forms of human modification.

That being said, policymakers and international figures of importance like UN Secretary-General Ban Ki-Moon should be extremely cautious about the language they use to describe new classes of technologies lest they cast too wide a net with calls for controlling “weapons of mass destruction” that may be nothing of the sort.

How is it that we humans have again and again figured out how to assimilate new technologies into our lives despite how much those technologies “unsettled” so many well-established personal, social, cultural, and legal norms?

In recent years, I’ve spent a fair amount of time thinking through that question in a variety of blog posts (“Are You An Internet Optimist or Pessimist? The Great Debate over Technology’s Impact on Society”), law review articles (“Technopanics, Threat Inflation, and the Danger of an Information Technology Precautionary Principle”), opeds (“Why Do We Always Sell the Next Generation Short?”), and books (See chapter 4 of my new book, “Permissionless Innovation: The Continuing Case for Comprehensive Technological Freedom”).

It’s fair to say that this issue — how individuals, institutions, and cultures adjust to technological change — has become a personal obsession of mine and it is increasingly the unifying theme of much of my ongoing research agenda. The economic ramifications of technological change are part of this inquiry, of course, but those economic concerns have already been the subject of countless books and essays both today and throughout history. I find that the social issues associated with technological change — including safety, security, and privacy considerations — typically get somewhat less attention, but are equally interesting. That’s why my recent work and my new book narrow the focus to those issues.

Optimistic (“Heaven”) vs. Pessimistic (“Hell”) Scenarios

Modern thinking and scholarship on the impact of technological change on societies has been largely dominated by skeptics and critics.

In the past century, for example, French philosopher Jacques Ellul ( The Technological Society), German historian Oswald Spengler (Man and Technics), and American historian Lewis Mumford (Technics and Civilization) penned critiques of modern technological processes that took a dour view of technological innovation and our collective ability to adapt positively to it. (Concise summaries of their thinking can be found in Christopher May’s edited collection of essays, Key Thinkers for the Information Society.)

These critics worried about the subjugation of humans to “technique” or “technics” and feared that technology and technological processes would come to control us before we learned how to control them. Media theorist Neil Postman was the most notable of the modern information technology critics and served as the bridge between the industrial era critics (like Ellul, Spengler, and Mumford) and some of today’s digital age skeptics (like Evgeny Morozov and Nick Carr). Postman decried the rise of a “technopoly” — “the submission of all forms of cultural life to the sovereignty of technique and technology” — that would destroy “the vital sources of our humanity” and lead to “a culture without a moral foundation” by undermining “certain mental processes and social relations that make human life worth living.” We see that attitude on display in countless works of technological criticism since then.

Of course, there’s been some pushback from some futurists and technological enthusiasts. But there’s often a fair amount of irrational exuberance at work in their tracts and punditry. Many self-proclaimed “futurists” have predicted that various new technologies would produce a nirvana that would overcome human want, suffering, ignorance, and more.

In a 2010 essay, I labeled these two camps technological “pessimists” and “optimists.” It was a crude and overly-simplistic dichotomy, but it was an attempt to begin sketching out a rough taxonomy of the personalities and perspectives that we often seen pitted against each other in debates about the impact of technology on culture and humanity.

Sadly, when I wrote that earlier piece, I was not aware of a similar (and much better) framing of this divide that was developed by science writer Joel Garreau in his terrific 2005 book, Radical Evolution: The Promise and Peril of Enhancing Our Minds, Our Bodies — and What It Means to Be Human. In that book, Garreau is thinking in much grander terms about technology and the future than I was in my earlier essay. He was focused on how various emerging technologies might be changing our very humanity and he notes that narratives about these issues are typically framed in “Heaven” versus “Hell” scenarios.

Under the “Heaven” scenario, technology drives history relentlessly, and in almost every way for the better. As Garreau describes the beliefs of the Heaven crowd, they believe that going forward, “almost unimaginably good things are happening, including the conquering of disease and poverty, but also an increase in beauty, wisdom, love, truth, and peace.” (p. 130) By contrast, under the “Hell” scenario, “technology is used for extreme evil, threatening humanity with extinction.” (p. 95) Garreau notes that what unifies the Hell scenario theorists is the sense that in “wresting power from the gods and seeking to transcend the human condition,” we end up instead creating a monster — or maybe many different monsters — that threatens our very existence. Garreau says this “Frankenstein Principle” can be seen in countless works of literature and technological criticism throughout history, and it is still very much with us today. (p. 108)

Theories of Collapse: Why Does Doomsaying Dominate Discussions about New Technologies?

Indeed, in examining the way new technologies and inventions have long divided philosophers, scientists, pundits, and the general public, one can find countless examples of that sort of fear and loathing at work. “Armageddon has a long and distinguished history,” Garreau notes. “Theories of progress are mirrored by theories of collapse.” (p. 149)

In that regard, Garreau rightly cites Arthur Herman’s magisterial history of apocalyptic theories, The Idea of Decline in Western History, which documents “declinism” over time. The irony of much of this pessimistic declinist thinking, Herman notes, is that:

In effect, the very things modern society does best — providing increasing economic affluence, equality of opportunity, and social and geographic mobility — are systematically deprecated and vilified by its direct beneficiaries. None of this is new or even remarkable.” (p. 442)

Why is that? Why has the “Hell” scenario been such a dominant reoccurring theme in past writing and commentary throughout history, even though the general trend has been steady improvements in human health, welfare, and convenience?

There must be something deeply rooted in the human psyche that accounts for this tendency. As I have discussed in my new book as well as my big “Technopanics” law review article, our innate tendency to be pessimistic but also want to be certain about the future means that “the gloom-mongers have it easy,” as author Dan Gardner argues in his book, Future Babble: Why Expert Predictions Are Next to Worthless, and You Can Do Better. He continues on to note of the techno-doomsday pundits:

Their predictions are supported by our intuitive pessimism, so they feel right to us. And that conclusion is bolstered by our attraction to certainty. As strange as it sounds, we want to believe the expert predicting a dark future is exactly right, because knowing that the future will be dark is less tormenting than suspecting it. Certainty is always preferable to uncertainty, even when what’s certain is disaster. (p. 140-1)

Similarly, in his new book, Smarter Than You Think: How Technology Is Changing Our Minds for the Better, Clive Thompson notes that “dystopian predictions are easy to generate” and “doomsaying is emotionally self-protective: if you complain that today’s technology is wrecking the culture, you can tell yourself you’re a gimlet-eyed critic who isn’t hoodwinked by high-tech trends and silly, popular activities like social networking. You seem like someone who has a richer, deeper appreciation for the past and who stands above the triviality of today’s life.” (p. 283)

Another explanation is that humans are sometimes very poor judges of the relative risks to themselves or those close to them. Harvard University psychology professor Steven Pinker, author of The Blank Slate: The Modern Denial of Human Nature, notes:

The mind is more comfortable in reckoning probabilities in terms of the relative frequency of remembered or imagined events. That can make recent and memorable events—a plane crash, a shark attack, an anthrax infection—loom larger in one’s worry list than more frequent and boring events, such as the car crashes and ladder falls that get printed beneath the fold on page B14. And it can lead risk experts to speak one language and ordinary people to hear another. (p. 232)

Put simply, there exists a wide variety of explanations for why our collective first reaction to new technologies often is one of dystopian dread. In my work, I have identified several other factors, including: generational differences; hyper-nostalgia; media sensationalism; special interest pandering to stoke fears and sell products or services; elitist attitudes among intellectuals; and the so-called “third-person effect hypothesis,” which posits that when some people encounter perspectives or preferences at odds with their own, they are more likely to be concerned about the impact of those things on others throughout society and to call on government to “do something” to correct or counter those perspectives or preferences.

Some combination of these factors ends up driving the initial resistance we have see to new technologies that disrupted long-standing social norms, traditions, and institutions. In the extreme, it results in that gloom-and-doom, sky-is-falling disposition in which we are repeatedly told how humanity is about to be steam-rolled by some new invention or technological development.

The “Prevail” (or “Muddling Through”) Scenario

“The good news is that end-of-the-world predictions have been around for a very long time, and none of them has yet borne fruit,” Garreau reminds us. (p. 148) Why not? Let’s get back to his framework for the answer. After discussing the “Heaven” (optimistic) and “Hell” (skeptical or pessimistic) scenarios cast about by countless tech writers throughout history, Garreau outlines a third, and more pragmatic “Prevail” option, which views history “as a remarkably effective paean to the power of humans to muddle through extraordinary circumstances.”

That pretty much sums up my own perspective on things, and in the remainder of this essay I want sketch out the reasons why I think the “prevail” or “muddling through” scenario offers the best explanation for how we learn to cope with technological disruption and prosper in the process.

As Garreau explains it, under the “Prevail” scenario, “humans shape and adapt [technology] in entirely new directions.” (p. 95) “Just because the problems are increasing doesn’t mean solutions might not also be increasing to match them,” he rightly notes. (p. 154) As John Seely Brown and Paul Duguid noted in their excellent 2001, “ Response to Bill Joy and the Doom-and-Gloom Technofuturists”:

technological and social systems shape each other. The same is true on a larger scale. […] Technology and society are constantly forming and reforming new dynamic equilibriums with far-reaching implications. The challenge for futurology (and for all of us) is to see beyond the hype and past the over-simplifications to the full import of these new sociotechnical formations.  Social and technological systems do not develop independently; the two evolve together in complex feedback loops, wherein each drives, restrains and accelerates change in the other.

It is this process of “constantly forming and reforming new dynamic equilibriums” that interests me most. In a recent exchange with Michael Sacasas – one of the most thoughtful modern technology critics I’ve come across — I noted that the nature of individual and societal acclimation to technological change is worthy of serious investigation if for no other reason that it has continuously happened! What I hope to better understand is the process by which we humans have again and again figured out how to assimilate new technologies into their lives despite how much those technologies disrupted our personal, social, economic, cultural, and legal norms.

In a response to me, Sacasas put forth the following admonition: “That people eventually acclimate to changes precipitated by the advent of a new technology does not prove that the changes were inconsequential or benign.” This is undoubtedly true, but it does not undermine the reality of societal adaptation. What can we learn from this? What were the mechanics of that adaptive process? As social norms, personal habits, and human relationships were disrupted, what helped us muddle through and find a way of coping with new technologies? Likewise, as existing markets and business models were disrupted, how were new ones formulated in response to the given technological disruption? Finally, how did legal norms and institutions adjust to those same changes?

Of course, this raises an entirely different issue: What metrics are we using to judge whether “the changes were inconsequential or benign”? As I noted in my exchange with Sacasas, at the end of the day, it may be that we won’t be able to even agree on a standard by which to make that judgment and will instead have to settle for a rough truce about what history has to teach us that might be summed up by the phrase: “something gained, something lost.”

Resiliency: Why Do the Skeptics Never Address It (and Its Benefits)?

Nonetheless, I believe that while technological change often brings sweeping and quite consequential change, there is great value in the very act of living through it.

In my work, including my latest little book, I argue that humans have exhibited the uncanny ability to adapt to changes in their environment, bounce back from adversity, and learn to be resilient over time. A great deal of wisdom is born of experience, including experiences that involve risk and the possibility of occasional mistakes and failures while both developing new technologies and learning how to live with them. I believe it wise to continue to be open to new forms of innovation and technological change, not only because it provides breathing space for future entrepreneurialism and invention, but also because it provides an opportunity to see how societal attitudes toward new technologies evolve — and to learn from it. More often than not, I argue, citizens have found ways to adapt to technological change by employing a variety of coping mechanisms, new norms, or other creative fixes.

What we’re talking about here is resiliency. Andrew Zolli and Ann Marie Healy, authors of Resilience: Why Things Bounce Back, define resilience as “the capacity of a system, enterprise, or a person to maintain its core purpose and integrity in the face of dramatically changed circumstances.” (p. 7) “To improve your resilience,” they note, “is to enhance your ability to resist being pushed from your preferred valley, while expanding the range of alternatives that you can embrace if you need to. This is what researchers call preserving adaptive capacity—the ability to adapt to changed circumstances while fulfilling once core purpose—and it’s an essential skill in an age of unforeseeable disruption and volatility.” (p. 7-8, emphasis in original) Moreover, they note, “by encouraging adaptation, agility, cooperation, connectivity, and diversity, resilience-thinking can bring us to a different way of being in the world, and to a deeper engagement with it.” (p. 16)

Even if you one doesn’t agree with all of that, again, I would think one would find great value in studying the process by which such adaptation happens precisely because it does happen so regularly. And then we could argue about whether it was all really worth it! Specially, was it worth whatever we lost in the process (i.e., a change in our old moral norms, our old privacy norms, our old institutions, our old business models, our old laws, or whatever else)?

As Sacasas correctly argues, “That people before us experienced similar problems does not mean that they magically cease being problems today.” Again, quite right. On the other hand, the fact that people and institutions learned to cope with those concerns and become more resilient over time is worthy of serious investigation because somehow we “muddled through” before and we’ll have to muddle through again. And, again, what we learned from living through that process may be extremely valuable in its own right.

Of Course, Muddling Through Isn’t Always Easy

Now, let’s be honest about this process of “muddling through”: it isn’t always neat or pretty. To put it crudely, sometimes muddling through really sucks! Think about the modern technologies that violate our visceral sense of privacy and personal space today. I am an intensely private person and if I had a life motto it would probably be: “ Leave Me Alone!” Yet, sometimes there’s just no escaping the pervasive reach of modern technologies and processes. On the other hand, I know that, like so many others, I derive amazing benefits from all these new technologies, too. So, like most everyone else I put up with the downsides because, on net, there are generally more upsides.

Almost every digital service that we use today presents us with these trade-offs. For example, email has allowed us to connect with a constantly growing universe of our fellow humans and organizations. Yet, spam clutters our mailboxes and the sheer volume of email we get sometimes overwhelms us. Likewise, in just the past five years, smartphones have transformed our lives in so many ways for the better in terms of not just personal convenience but also personal safety. On the other hand, smartphones have become more than a bit of nuisance in certain environments (theaters, restaurants, and other closed spaces.) And they also put our safety at risk when we use them while driving automobiles.

But, again, we adjust to most of these new realities and then we find constructive solutions to the really hard problems – yes, and that sometimes includes legal remedies to rectify serious harms. But a certain amount of social adaptation will, nonetheless, be required. Law can only slightly slow that inevitability; it can’t stop it entirely. And as messy and uncomfortable as muddling through can be, we have to (a) be aware of what we gain in the process and (b) ask ourselves what the cost of taking the alternative path would be. Attempts to through a wrench in the works and derail new innovations or delay various types of technological change are always going to be tempting, but such interventions will come at a very steep cost: less entreprenurialism, diminished competition, stagnant markets, higher prices, and fewer choices for citizens. As I note in my new book, if we spend all our time living in constant fear of worst-case scenarios — and premising public policy upon such fears — it means that many best-case scenarios will never come about.

Social Resistance / Pressure Dynamics

There’s another part to this story that often gets overlooked. “Muddling through” isn’t just some sort of passive process where individuals and institutions have to figure out how to cope with technological change. Rather, there is an active dynamic at work, too. Individuals and institutions push back and actively shape their tools and systems.

In a recent Wired essay on public attitudes about emerging technologies such as the controversial Google Glass, Issie Lapowsky noted that:

If the stigma surrounding Google Glass (or, perhaps more specifically, “Glassholes”) has taught us anything, it’s that no matter how revolutionary technology may be, ultimately its success or failure ride on public perception. Many promising technological developments have died because they were ahead of their times. During a cultural moment when the alleged arrogance of some tech companies is creating a serious image problem, the risk of pushing new tech on a public that isn’t ready could have real bottom-line consequences.

In my new book, I spend some time think about this process of “norm-shaping” through social pressure, activist efforts, educational steps, and even public shaming. A recent Ars Technica essay by Joe Silver offered some powerful examples of how when “shamed on Twitter, corporations do an about-face.” Silver notes that “A few recent case-study examples of individuals who felt they were wronged by corporations and then took to the Twitterverse to air their grievances show how a properly placed tweet can be a powerful weapon for consumers to combat corporate malfeasance.” In my book and in recent law review articles, I have provided other examples how this works at both a corporate and individual level to constrain improper behavior and protect various social norms.

Edmund Burke once noted that, “Manners are of more importance than laws. Manners are what vex or soothe, corrupt or purify, exalt or debase, barbarize or refine us, by a constant, steady, uniform, insensible operation, like that of the air we breathe in.” Cristina Bicchieri, a leading behavioral ethicist, calls social norms “the grammar of society” because,

like a collection of linguistic rules that are implicit in a language and define it, social norms are implicit in the operations of a society and make it what it is. Like a grammar, a system of norms specifies what is acceptable and what is not in a social group. And analogously to a grammar, a system of norms is not the product of human design and planning.

Put simply, more than law can regulate behavior — whether it is organizational behavior or individual behavior. It’s yet another way we learn to cope and “muddle through” over time. Again, check out my book for several other examples.

A Case Study: The Long-Standing “Problem” of Photography

Let’s bring all this together and be more concrete about it by using a case study: photography. With all the talk of how unsettling various modern technological developments are, they really pale in comparison to just how jarring the advent of widespread public photography must have been in the late 1800s and beyond. “For the first time photographs of people could be taken without their permission—perhaps even without their knowledge,” notes Lawrence M. Friedman in his 2007 book, Guiding Life’s Dark Secrets: Legal and Social Controls over Reputation, Propriety, and Privacy.

Thus, the camera was viewed as a highly disruptive force as photography became more widespread. In fact, the most important essay ever written on privacy law, Samuel D. Warren and Louis D. Brandeis’s famous 1890 Harvard Law Review essay on “The Right to Privacy,” decried the spread of public photography. The authors lamented that “instantaneous photographs and newspaper enterprise have invaded the sacred precincts of private and domestic life” and claimed that “numerous mechanical devices threaten to make good the prediction that ‘what is whispered in the closet shall be proclaimed from the house-tops.’”

Warren and Brandeis weren’t alone. Plenty of other critics existed and many average citizens were probably outraged by the rise of cameras and public photography. Yet, personal norms and cultural attitudes toward cameras and public photography evolved quite rapidly and they became ingrained in human experience. At the same time, social norms and etiquette evolved to address those who would use cameras in inappropriate, privacy-invasive ways.

Again, we muddled through. And we’ve had to continuously muddle through in this regard because photography presents us with a seemingly endless set of new challenges. As cameras grow still smaller and get integrated into other technologies (most recently, smartphones, wearable technologies, and private drones), we’ve had to learn to adjust and accommodate. With wearables technologies (check out Narrative, Butterflye, and Autographer, for example), personal drones (see “Drones are the future of selfies,”) and other forms of microphotography all coming online now, we’ll have to adjust still more and develop new norms and coping mechanisms. There’s never going to be an end to this adjustment process.

Toward Pragmatic Optimism

Should we really remain bullish about humanity’s prospects in the midst of all this turbulent change? I think so.

Again, long before the information revolution took hold, the industrial revolution produced its share of cultural and economic backlashes, and it is still doing so today. Most notably, many Malthusian skeptics and environmental critics lamented the supposed strain of population growth and industrialization on social and economic life. Catastrophic predictions followed.

In his 2007 book, Prophecies of Doom and Scenarios of Progress, Paul Dragos Aligicia, a colleague of mine at the Mercatus Center, documented many of these industrial era “prophecies of doom” and described how this “doomsday ideology” was powerfully critiqued by a handful of scholars — most notably Herman Kahn and Julian Simon. Aligicia explains that Kahn and Simon argued for, “the alternative paradigm, the pro-growth intellectual tradition that rejected the prophecies of doom and called for realism and pragmatism in dealing with the challenge of the future.”

Kahn and Simon were pragmatic optimists or what author Matt Ridley calls “rational optimists.” They were bullish about the future and the prospects for humanity, but they were not naive regarding the many economic and scosial challenges associated with technological change. Like Kahn and Simon, we should embrace the amazing technological changes at work in today’s information age but with a healthy dose of humility and appreciation for the disruptive impact and pace of that change.

But the rational optimists never get as much attention as the critics and catastrophists. “For 200 years pessimists have had all the headlines even though optimists have far more often been right,” observes Ridley. “Arch-pessimists are feted, showered with honors and rarely challenged, let alone confronted with their past mistakes.” At least part of the reason for that, as already noted, goes back to the amazing rhetorical power of good intentions. Techno-pessimists often exhibit a deep passion about their particular cause and are typically given more than just the benefit of doubt in debates about progress and the future; they are treated as superior to opponents who challenge their perspectives or proposals. When a privacy advocate says they are just looking out consumers, or an online safety claims they have the best interests of children in mind, or a consumer advocate argues that regulation is needed to protect certain people from some amorphous harm, they are assuming the moral high ground through the assertion of noble-minded intentions. Even if their proposals will often fail to bring about the better state of affairs they claim or derail life-enriching innovations, they are more easily forgiven for those mistakes precisely because of their fervent claim of noble-minded intentions.

If intentions are allowed to trump empiricism and a general openness to change, however, the results for a free society and for human progress will be profoundly deleterious. That is why, when confronted with pessimistic, fear-based arguments, the pragmatic optimist must begin by granting that the critics clearly have the best of intentions, but then point out how intentions can only get us so far in the real-world, which is full of complex trade-offs.

The pragmatic optimist must next meticulously and dispassionately outline the many reasons why restricting progress or allowing planning to enter the picture will have many unintended consequences and hidden costs. The trade-offs must be explained in clear terms. Examples of previous interventions that went wrong must be proffered.

The Evidence Speaks for Itself

Luckily, we pragmatic optimists have plenty of evidence working in our favor when making this case. As Pulitzer Prize-winning historian Richard Rhodes noted in his 1999 book, Visions of Technology: A Century of Vital Debate About Machines Systems And The Human World:

it’s surprising that [many intellectual] don’t value technology; by any fair assessment, it has reduced suffering and improved welfare across the past hundred years. Why doesn’t this net balance of benevolence inspire at least grudging enthusiasm for technology among intellectuals? (p. 23)

Great question, and one that we should never stop asking the techno-critics to answer. After all, as Joel Mokyr notes in his wonderful 1990 book, Lever of Riches: Technological Creativity and Economic Progress, “Without [technological creativity], we would all still live nasty and short lives of toil, drudgery, and discomfort.” (p. viii) “Technological progress, in that sense, is worthy of its name,” he says. “It has led to something that we may call an ‘achievement,’ namely the liberation of a substantial portion of humanity from the shackles of subsistence living.” (p. 288) Specifically,

The riches of the post-industrial society have meant longer and healthier lives, liberation from the pains of hunger, from the fears of infant mortality, from the unrelenting deprivation that were the part of all but a very few in preindustrial society. The luxuries and extravagances of the very rich in medieval society pale compared to the diet, comforts, and entertainment available to the average person in Western economies today. (p. 303)

In his new book, Smaller Faster Lighter Denser Cheaper: How Innovation Keeps Proving the Catastrophists Wrong, Robert Bryce hammers this point home when he observes that:

The pessimistic worldview ignores an undeniable truth: more people are living longer, healthier, freer, more peaceful, lives than at any time in human history… the plain reality is that things are getting better, a lot better, for tens of millions of people around the world. Dozens of factors can be cited for the improving conditions of humankind. But the simplest explanation is that innovation is allowing us to do more with less.

This is framework Herman Kahn, Julian Simon, and the other champions of progress used to deconstruct and refute the pessimists of previous eras. In line with that approach, we modern pragmatic optimists must continuously point to the unappreciated but unambiguous benefits of technological innovation and dynamic change. But we should also continue to remind the skeptics of the amazing adaptability of the human species in the face of adversity. As Kahn taught us long ago, is that when it comes to technological progress and humanity’s ingenious responses to it, “we should expect to go on being surprised” — and in mostly positive ways. Humans have consistently responded to technological change in creative, and sometimes completely unexpected ways. There’s no reason to think we can’t get through modern technological disruptions using similar coping and adaptation strategies. As Mokyr noted in his recent City Journal essay on “The Next Age of Invention”:

Much like medication, technological progress almost always has side effects, but bad side effects are rarely a good reason not to take medication and a very good reason to invest in the search for second-generation drugs. To a large extent, technical innovation is a form of adaptation—not only to externally changing circumstances but also to previous adaptations.

In sum, we need to have a little faith in the ability of humanity to adjust to an uncertain future, no matter what it throws at us. We’ll muddle through and come out better because of what we have learned in the process, just as we have so many times before.

I’ll give venture capitalist Marc Andreessen the last word on this since he’s been on an absolute tear on Twitter lately when discussing many of the issues I’ve raised in this essay. While addressing the particular fear that automation is running amuck and that robots will eat all our jobs, Andreessen eloquently noted:

We have no idea what the fields, industries, businesses, and jobs of the future will be. We just know we will create an enormous number of them. Because if robots and AI replace people for many of the things we do today, the new fields we create will be built on the huge number of people those robots and AI systems made available. To argue that huge numbers of people will be available but we will find nothing for them (us) to do is to dramatically short human creativity. And I am way long human creativity.

When Google announced it was acquiring digital thermostat company Nest yesterday, it set off another round of privacy and security-related technopanic talk on Twitter and elsewhere. Fear and loathing seemed to be the order of the day. It seems that each new product launch or business announcement in the “Internet of Things” space is destined to set off another round of Chicken Little hand-wringing. We are typically told that the digital sky will soon fall on our collective heads unless we act preemptively to somehow head-off some sort of pending privacy or security apocalypse.

Meanwhile, however, a whole heck of lot of people are demanding more and more of these technologies, and American entrepreneurs are already engaged in heated competition with European and Asian rivals to be at the forefront of the next round Internet innovation to satisfy those consumer demands. So, how is this going to play out?

This gets to what becoming the defining policy issue of our time, not just for the Internet but for technology policy more generally: To what extent should the creators of new technologies seek the blessing of public officials before they develop and deploy their innovations? We can think of this as “the permission question” and it is creating a massive rift between those who desire more preemptive, precautionary safeguards for a variety of reasons (safety, security, privacy, copyright, etc.) and those of us who continue to believe that permissionless innovation should be the guiding ethos of our age. The chasm between these two worldviews is only going to deepen in coming years as the pace of innovation around new technologies (the Internet of Things, wearable tech, driverless cars, 3D printing, commercial drones, etc) continues to accelerate.

Sarah Kessler of Fast Company was kind enough to call me last night and ask for some general comments about Google buying Nest and she also sought out the comments of Marc Rotenberg of EPIC about privacy in the Internet of Things era more generally. Our comments provide a useful example of the divide between these two worldviews and foreshadow debates to come:

With an estimated 50 billion connected objects coming online by 2050, some see good reason to put policies in place that regulate the new categories of data they will collect about the people who use those products. “The basic problem with the Internet of Things, unless privacy safeguards are established up front, is that users will lose control over the data they generate,” Marc Rotenberg, the president of the Electronic Privacy Information Center, told Fast Company in an email. Others see the emerging category as a perfect reason to block omnibus attempts to regulate user data. “If we spend all of our time living in fear of hypothetical worst-case scenarios, then the best-case scenarios will never come about,” says Adam Thierer, a Senior Research Fellow at George Mason University’s Mercatus Center. “That’s the nature of how innovation works. You have to allow for risks and experimentation, and even accidents and failures, if you want to get progress.”

Last week, I wrote about this conflict of visions in my dispatch from the CES show and this topic is also the focus of my forthcoming eBook, “Permissionless Innovation: The Continuing Case for Comprehensive Technological Freedom.” To reiterate what I already said, my book will describe the future of the Internet of Things and all technology policy as a grand battle the “precautionary principle” and “permissionless innovation.” The “precautionary principle” refers to the belief that new innovations should be curtailed or disallowed until their developers can prove that they will not cause any harms to individuals, groups, specific entities, cultural norms, or various existing laws, norms, or traditions. The other worldview, “permissionless innovation,” refers to the notion that experimentation with new technologies and business models should generally be permitted by default. Unless a compelling case can be made that a new invention will bring serious harm to society, innovation should be allowed to continue unabated and problems, if they develop at all, can be addressed later.

While those adhering to the precautionary principle mindset tend to favor “top-down” legalistic approaches to solving those potential problems that might creep up, those of us who favor the premissionless innovation approach favor “bottom-up” solutions that evolve over time but do not interrupt the ongoing experimentation and innovation that consumers demand. What does a “bottom-up” approach mean in practice? Education and empowerment, social pressure, societal norms, voluntary self-regulation, and targeted enforcement of existing legal norms (especially through the common law) are almost always superior to top-down, command-and-control regulatory edits and bureaucratic schemes of a “Mother, May I” (i.e., permissioned) nature.

We really should not underestimate the power of norms and public pressure to “regulate” in this regard, perhaps even better than law, which tends to be too slow-moving to make much of a difference. In my book I spend a great deal of time talking about how other technological innovations have been shaped by social norms, public pressure, and press attention. That same will be true for the Internet of Things and various new technologies I discuss in my book. Others will gradually adapt to the new technological realities and integrate these new devices and services into their lives over time.

Perhaps, then, it will be the case that if Google does something particularly bone-headed with Nest that a public backlash will ensue. Or maybe some consumers will just reject Nest and look for other options, which is apparently what Rotenberg is doing according to the Fast Company article. Of course, as I noted in concluding the interview, others may act quite differently and accept Nest and other new Internet of Things technologies, even if there are some privacy or security downsides. As I told Sarah Kessler, while I was visiting the consumer electronics show last week, I heard it was freezing back here in DC. If I would have had Nest in my house, perhaps Google Now could have alerted me to the dangerously low temps in my house and suggested that I raise the temp remotely before my pipes froze. As I noted to Kessler:

“Would that have been creepy?” he says. “To me it would have been helpful. So for everything that people regard as a negative, I can usually find a positive. And if there’s that balance there, then it should be left to individuals to decide for themselves how to decide that balance.”

Finally, since I often get accused of being some sort of nihilist in these debates, I want to make it clear that ethics should influence all these discussions, but I prefer that we not impose ethics in a heavy-handed, inflexible way through preemptive, proscriptive regulatory controls. It makes more sense to wait and see how things play out before regulating to address harms, once we figure out which ones are real. (See the second and third essays listed below for more on ethics and technological innovation.) But we absolutely need to be engaging in robust societal discussions about digital ethics, digital citizenship, privacy and security by design, and sensible online etiquette. I’ve spent a lifetime writing about the power of that approach in the context of online child safety and I think it is equally applicable for privacy and security-related matters. In particular, we need to talk to our kids and our future technologists and innovators about smarter digital habits that respect the safety, security, and privacy of others. Those conversations can help us chart a more sensible path forward without sacrificing the many benefits that accompany the ongoing technological revolution we are blessed to be experiencing today.

There are few things I find more annoying in the Net neutrality wars than the silly assertion by groups like Free Press and other regulatory radicals that “Net neutrality is the Internet’s First Amendment.”  It’s utter rubbish as I have documented here many times before.  But now Sen. Al Franken is running around sputtering such nonsense, as he did in this recent CNN.com editorial, claiming that “Net neutrality is foremost free speech issue of our time.”   The folks at CNN invited me to response and below you will find the piece PFF press director Mike Wendy and I submitted.


Big Government the Real Threat to Internet

In his recent CNN.com opinion piece, “Net neutrality is foremost free speech issue of our time,” Sen. Al Franken claims that “our free speech rights are under assault — not from the government but from corporations seeking to control the flow of information in America.”

He alludes to potential corporate blocking of online products and speech and says, “If that scares you as much as it scares me, then you need to care about net neutrality.”

Chicken Little, call your office!

Such sky-is-falling scare tactics are all too common in the heated debate over net neutrality regulation, but actual evidence of such nefarious corporate scheming is nowhere to be found. Perhaps that’s why Franken resorts to such tall tales.

Moreover, his reading of the First Amendment is at odds with the one most of us learned about in civics class (“Congress shall make no law…”). His would empower regulators by converting the First Amendment from a shield against government action into a sword that bureaucrats could wield against private industry.

We should be skeptical of any claims that net neutrality regulation is consistent with the First Amendment, let alone required by it. As First Amendment attorney Robert Corn-Revere has noted (“The First Amendment, the Internet & Net Neutrality: Be Careful What You Wish For“), “It should not be forgotten that the federal government’s initial impulse [in the mid-1990s] was to censor the internet and to subject it to a far lower level of First Amendment protection.”

The real “Big Brother” threat here is a government with the power to completely foreclose all speech under threat of fine or imprisonment — a power the private sector lacks even if you buy into the silly notion that it is out to bottle up speech or speakers.

And really, why would any company want “to control the flow of information in America,” as Franken suggests? First, it’s bad for business. There’s just no good business case for censorship. Internet service providers make more money by delivering more bits, not fewer. Second, censorship is hard. Internet service providers simply don’t have the technology or manpower necessary to effectively filter online content by viewpoint. Third, trying to control information would quickly create public relations nightmares for carriers. There’d be hell for them to pay with the press, industry watchdogs and especially their subscribers. The white-hot spotlight of public attention is the best disinfectant. Finally, any attempt to censor would backfire and actually draw attention to the speech or speaker in question.

Simply stated, the Internet’s First Amendment is the First Amendment — not some new, top-down, heavy-handed regulatory regime that puts the Federal Communications Commission in control of the digital economy.

Net neutrality regulation is also tantamount to a declaration of surrender on broadband competition and a call to return to the era of public utility-style regulation. We shouldn’t give up so easily on the idea of facilities-based competition that only got started 14 years ago with the Telecommunications Act of 1996.

If broadband providers ever possessed “gatekeeper” or “bottleneck” power that required regulation, that rationale for regulation no longer exists. The internet has clearly changed the communications landscape, mooting old regulatory ideas once used to justify heavy-handed government regulation of mass media speech and its underlying infrastructure.

Today, 95 percent of America has access to robust broadband, and the vast majority can choose from multiple broadband providers (e.g., wire, wireless and satellite technologies). The investment and innovation that’s made this possible would never have happened in Franken’s world of heavily regulated infrastructure.

Just as certain is the slippery slope of regulation: Neutrality mandates will eventually spread to other layers of the internet to cover content and applications. (The FCC is already hinting at its interest in regulating in the cloud and other internet services and content). Google and Apple’s necks may be next on the neutrality chopping block.

Corporations go out of business if they no longer serve consumers. The government and its agencies do not. For the former, the combination of technological innovation, consumer education, industry best practices and competitive markets all work to blunt the abuses — real or imagined — of broadband providers. But only the Constitution and the Bill of Rights restrain the government.

If Al Franken has his way, these roles would be reversed and our government would be empowered to control the most important medium of human expression the world has ever known. We should think twice before going down that path.

A Brief History of Media Merger Hysteria: From AOL-Time Warner to Comcast-NBC

Although the pending union of Comcast and NBC Universal has not yet made it to the altar, Chicken Little-esque wails about the marriage have already begun in earnest. For example, the pro-regulatory media organization Free Press has already set up a website to complain about the deal.[1] And Jeff Chester, executive director of the Center for Digital Democracy, has called it “an unholy marriage.”[2] The fever only promises to spread once the deal is formally announced, and a lengthy fight over the deal is expected at the Federal Communications Commission (FCC) and whichever antitrust agency reviews the deal.[3]

But reality tends to play out somewhat less dramatically than the script penned by the media worrywarts. It’s worth looking back at some of the more prominent examples of media merger hysteria in recent years to understand why such panic is unwarranted, and why a deal between Comcast and NBC Universal is unlikely to lead to the sort of problems that the pessimists suggest.[4]

AOL-Time Warner: From the “New Totalitarianism” to Digital Divorce Court in Less Than a Decade

When the mega-merger between media giant Time Warner and Internet superstar AOL was announced in early 2000, the marriage was greeted with a cacophony of righteous indignation and apocalyptic predictions.  When referring to the dangers of the deal, syndicated columnist Norman Solomon, a longtime associate of the media watch group Fairness & Accuracy In Reporting, summoned the ghost of Aldous Huxley when he and referred to the transaction in terms of “servitude,” “ministries of propaganda,” and “new totalitarianisms.”[5] Similarly, USC Professor of Communications Robert Scheer wondered if the merger represented “Big Brother” and claimed, “Diversity is out, niches are gone, it’s Skippy peanut butter time. AOL is the Levitown of the Internet, mom and apple pie, ‘50s boredom, conformity and dullness as a virtue: A Net nanny reigning in potentially restless souls.”[6]

Such pessimistic predictions proved wildly overblown. To say that the merger failed to create the sort of synergies (and profits) that were originally hoped for would be an epic understatement.[7] The titles of two popular books about the deal summed up the firm’s troubles: One was entitled Fools Rush In (by Nina Munk) and the other, There Must Be a Pony in Here Somewhere (by Kara Swisher and Lisa Dickey).[8]

The numbers were mind-boggling. By April 2002, just two years after the deal was struck, AOL-Time Warner had already reported a staggering $54 billion loss.[9] By January 2003, losses had grown to $99 billion.[10] By September 2003, Time Warner decided to drop AOL from its name altogether and the deal continued to slowly unravel from there.[11] In a 2006 interview with the Wall Street Journal, Time Warner President Jeffrey Bewkes famously declared the death of “synergy” and went so far as to call synergy “bullsh*t”![12] In early 2008, Time Warner decided to shed AOL’s dial-up service[13] and now is set to spin off AOL entirely.[14] Looking back at the deal, Fortune magazine senior editor at large Allan Sloan called it the “turkey of the decade”:

The day the deal was announced, Jan. 10, 2000, Time Warner closed at the equivalent of $184.50 a share. After almost 10 years of travail, the $184.50 has shrunk to about $42.25, consisting of one Time Warner share and a quarter of a Time Warner Cable share. The 77 percent decline is triple the decline in the Standard & Poor’s 500-stock index over the same period.[15]

And the Time Warner-AOL split wasn’t the end of this messy divorce process. In 2008, Time Warner Cable and Time Warner Entertainment decided to split.[16] Time Warner has even spun off some of its oldest properties. In 2006, it announced that it was putting 18 of the 50 magazines in its Time magazine division up for sale.[17]

As is always the case, these divestitures and down-sizing efforts garnered little attention compared with the hullaballoo and hysteria that accompanied the announcement of the deal back in 2000.[18]

News Corp/DirecTV: Murdoch’s “Digital Death Star” Blows Up

No media industry personality attracts more attention (or angst) than News Corp. Chairman and CEO Rupert Murdoch. The popular leftist blog The Daily Kos has likened him to “a fascist Hitler antichrist.”[19] And CNN founder Ted Turner once compared the popularity of the News Corp.’s Fox News Channel to the rise of Adolf Hitler prior to World War II.[20] Alternatively, Murdoch has been accused of being a Marxist.[21] Meanwhile, Karl Frisch, a Senior Fellow at Media Matters for America, speaks of Murdoch’s “evil empire”[22] and a recent MSNBC poll has asked people to vote on the question: “Is Rupert Murdoch evil?”[23] In 2003, when asked by talk show host Chris Matthews, “Would you break up [News Corp.-owned] Fox?” then Democratic presidential candidate Howard Dean answered, “On ideological grounds, absolutely yes.”[24] And in their book Our Media, Not Theirs, John Nichols and Robert McChesney took the Murdoch-as-evil-overlord storyline to its logical extreme when they suggested Hollywood was on to something by scripting a media tycoon like Murdoch as the bad guy in a James Bond movie: “No wonder conspiracy theories are so popular in America; no wonder, when the makers of James Bond movies look for believable villains these days, they eschew Eurotrash bad guys for more credibly threatening villains such as the Rupert Murdoch-like media baron of 1997’s Tomorrow Never Dies.”[25]

These Murdochian fears came to a head in 2003 when News Corp. announced it was pursuing a takeover of satellite television operator DirecTV.  Paranoid predictions of a pending media apocalypse followed.  A group of regulatory activists filed joint comments to the FCC claiming that if News Corp. and DirecTV were allowed to merge, “the result will be unprecedented concentration within all aspects of the television marketplace, as well as increased prices for consumers of cable and satellite television.”[26] Similarly, then-FCC Commissioner Jonathan Adelstein worried that the deal would “result in unprecedented control over local and national media properties in one global media empire. Its shockwaves will undoubtedly recast our entire media landscape.” He continued; “With this unprecedented combination, News Corp. could be in a position to raise programming prices for consumers, harm competition in video programming and distribution markets nationwide, and decrease the diversity of media voices.”[27]

Not to be outdone, full-time media fussbudget Jeff Chester predicted that Murdoch would use this “Digital Death Star” as the base of a nefarious scheme to conquer the media universe:

Murdoch will use DirecTV as a ‘death star’ to force his programming on cable companies by threatening a price war unless they give Fox favorable access. Since News Corp will control cable TV’s principal multichannel competitor, it will easily create new channels—unlike anyone else in the TV business.  Rather than engage in open combat and competition, cable powerbrokers such as Comcast and AOL-Time Warner will likely accommodate Murdoch and add his new channels to their own services. Imagine Fox News on steroids. Worse, with DirecTV’s capacity to ‘spotbeam’ channels to serve distinct communities, localized versions of Fox programs could be available in major cities across the nation.[28]

Imagine the horror of new, “spotbeamed” local media competition!  However, unlike the destruction of the planet Alderaan by the Death Star in Star Wars,[29] no one was harmed in the making of the News Corp-DirecTV marriage.  Indeed, the rebels would get the best of Darth Murdoch since his “Digital Death Star” was abandoned just three years after construction.  In December 2006, News Corp. decided to divest the company to Liberty Media Corporation in an effort to win back more controlling News Corp. stock.[30]

Ironically, many of the same groups that had vociferously protested the original News Corp-DirecTV deal again found reason to complain when the deal was being undone! The FCC’s failure to implement various restrictions as part of the license transfer, they claimed, would “result in continuing control by News Corp. over content distribution, harming competition in both the programming and distribution markets, reducing consumer choice and raising cable prices.”[31] Unsurprisingly, little mention was made of the previous round of pessimistic predictions or whether there had ever been any merit to the lugubrious lamentations of the media critics.

Sirius-XM: “Merger to Monopoly” or Prelude to Bankruptcy?

Some of the most entertaining and wrong-headed predictions about the future of the media marketplace often come from media moguls themselves. For example, back in 2003, when he was still President and Chief Operating Officer of Viacom, Mel Karmazin said in reference to Microsoft, AOL Time Warner, and Comcast: “I can’t imagine being a competitor with any of these guys.”[32] Just six years later, however, plenty of others are competing with those companies. Microsoft finds itself in a heated war with Google on all fronts, AOL-Time Warner has fallen apart, and Comcast is squaring off against telco (e.g., Verizon’s FiOS and AT&T U-Verse) and online video competitors (e.g., YouTube, Hulu) that were unfathomable in 2003—not to mention the traditional satellite TV competitors they still face. Meanwhile, Karmazin abandoned Viacom and is now struggling to find a way to make subscription-based satellite radio survive the ongoing digital music bloodbath caused by the rise of online music services and a little thing called the iPod.

Of course, hysteria ran rampant when Sirius and XM were merging, too.  Critics called it a “merger to monopoly” and predicted a variety of coming calamities.[33] National Association of Broadcasters Vice President Dennis Wharton described the merger as a “monopoly platform for offensive programming” that would be “anti-consumer.”[34] Mr. Wharton later remarked that the merged firms “will raise prices, won’t improve their technology and will limit their offerings.”[35] A coalition of six non-profits claimed that the merger was “perhaps the worst offense against the basic principle that competition is the consumer’s best friend” and, if approved, “a tsunami of mergers could ripple through the digital space at the worst possible moment.”[36] They predicted that “once the competition is eliminated, prices will rise over time,” “innovation will slow to the pace preferred by the monopolist and consumers will be much worse off in the long run.”[37] Another coalition argued that the new company would “abuse consumers, artists and other input suppliers in the satellite radio market.”[38]

In the end, the merger took an astonishing 500-plus days for the FCC to finally approve[39] and was conditioned with a lengthy set of “voluntary concessions” to supposedly rectify these potential harms—including pricing constraints that could limit the firm’s ability to cover costs and pay down debt over time.

Unsurprisingly, things haven’t turned out so well for Sirius XM. When the merger was finally approved by the FCC in August 2008, Commissioner Copps dissented vigorously on various grounds but specifically insisted that, “We must assume that the marketplace can support two financially viable competitors.”[40] Unfortunately for Commissioner Copps—as well as Sirius XM—it’s not even clear that the market can sustain one satellite radio provider. The company’s stock went into freefall following completion of the deal and, at one point, its stock fell below 10 cents per share. The company flirted with bankruptcy in February of this year as “satellite radio failed to win over many younger listeners, and competition from other sources slowed subscriber growth.”[41] In March 2009, Karmazin orchestrated a cash-for-stock swap with Liberty Media to get a $530 million lifeline and avoid bankruptcy.[42] But even with the cash infusion Sirius XM faces an uncertain future with stiff competition.[43] “Sirius is girding for slower growth than in the past,” notes Olga Kharif of Business Week, “and analysts remain concerned about the company’s ability to control costs.”[44] Former stockbroker and RealMoney.com contributor Tim Melvin predicts the overleveraged company “will disappear from the landscape. The subscribers will go to another tech or entertainment company in bankruptcy proceedings. Subscription radio just does not have that much appeal to most people.”[45]

Whether Melvin’s dour forecast for satellite radio proves accurate remains to be seen. What’s clear, however, is that the fears bandied about by critics when the Sirius-XM deal was pending have not come to pass.

Murdoch’s Wall Street Journal Quest

In 2007, Rupert Murdoch announced his desire to purchase The Wall Street Journal.  Once again, a great deal of hand-wringing ensued. “This takeover is bad news for anyone who cares about quality journalism and a healthy democracy,” argued Robert McChesney. “Giving any single company—let alone one controlled by Rupert Murdoch—this much media power is unconscionable.”[46] And FCC Commissioner Copps warned that “It will create a single company with enormous influence over politics, art and culture across the nation and especially in the New York metropolitan area.”[47]

Today, however, the Journal keeps humming along and continues to produce some of the finest journalism on the planet. Meanwhile, “politics, art and culture” seem largely unaffected by the deal—either in New York or the nation.

And the deal certainly hasn’t made Murdoch or News Corp. any richer. “His purchase of The Wall Street Journal is widely seen as one of the worst moves of his career,” notes Michael Wolff of Vanity Fair.[48] News Corp. has already taken a whopping $3 billion write-down on the deal.  Considering the $5 billion price tag Murdoch paid two years ago, one wonders if he’ll hold on to this property any longer than he did DirecTV.

Comcast-NBC Universal: Debunking the Fears Preemptively

No doubt we’ll soon be hearing many of these same apocalyptic predictions about the Comcast-NBC deal. Free Press has said the new entity “will have an incentive to prioritize NBC shows over other local and independent voices and programs, making it even harder to find alternatives on the cable dial.”[49] And Free Press Executive Director Josh Silver has called for the Obama Administration to block the deal saying “it would further starve Americans of [media] diversity.”[50] Even competitors are complaining. Liberty Media Corp. Chairman John Malone, which owns DirecTV, has suggested that they might push the government to reject the deal.[51] Many other rivals will likely join that bandwagon.

These critics will likely raise vertical integration fears and claim that Comcast will act as a “gatekeeper” by limiting the ability of independent voices to get a slot on cable distribution systems, or by withholding NBC-Universal content from other platforms and providers. But there’s little historical evidence that suggests this will be a problem. As the adjoining exhibit illustrates, the overall number of video programming channels available in America has skyrocketed, from just 70 channels in 1990 to 565 channels in 2006, the last year for which the FCC has made data available.

More importantly—and despite claims to the contrary—vertical integration in the video marketplace has plummeted over the past two decades. While many more cable and satellite networks are available today than ever before, the greatest share of the growth in the multichannel video marketplace has come from independently owned video networks. Since 1990, the number of cable-owned or affiliated channels has increased slightly, but it pales in comparison with the growth of independently owned and operated video networks. In real terms, therefore, the percentage of the overall video marketplace controlled (i.e., owned and operated) by cable companies has plummeted—from 50% in 1990 to just 14.9% in 2006. Moreover, in the wake of the Time Warner Cable and Time Warner Entertainment divorce, vertical integration in the cable sector has probably fallen into the single digits. Even if the merger of Comcast and NBC-Universal results in slight increase in industry vertical integration, it almost certainly will not surpass 20 percent.  Consequently, as far as vertically integrated industries go, it is impossible to conclude that this market could be characterized as being controlled by “gatekeepers.”

Video marektplace choice and integration

It is difficult to imagine that Comcast would buck these trends and begin restricting independent options on its systems or withhold its content from others.  Video distributors don’t make money by restricting choice. Consumers would flock to alternative video providers and media services if Comcast played such games. The great thing about the modern media marketplace is that there is always another place for consumers to turn to find something they want.[52] Sports programming could be an exception to the rule, and is the one issue that Comcast may need to bargain over with FCC regulators or antitrust officials since they own regional sports networks that other video distributors want access to.[53] But traditional concerns about access to over-the-air broadcast signals (namely, the NBC local broadcast television properties) shouldn’t be as much of an issue today as it was the past.  Frankly, local broadcasters need all the eyeballs they can get these days. Thus, it’s unlikely that Comcast would try to withhold those stations from other video distributors, especially since a great deal of NBC programming is already available through other means. And intense competition exists for some of the most important news and informational services that NBC offers, such as local news, weather, and traffic.

Overall, therefore, it’s hard to see the case for the FCC rejecting the deal. Regulators need to be forward-looking about what is driving this deal.  This deal isn’t about protecting old markets but instead about building new ones. “The real motivation behind this deal,” argues Mike Berkley, former CEO of SplashCast Media, “is survival.”

Comcast understands that the price point for distributing TV into homes is going to fall dramatically in the coming years. Comcast’s 3 distribution products, Voice – TV – Internet, are collapsing into just one, single product: Internet. This poses a huge threat to Comcast’s top line. As such, Comcast is hedging through diversification into content, moving up the media value chain. Comcast will be looking to replace lost revenue in distribution with revenue from content (advertising, subscriptions, etc).[54]

Similarly, Wall Street Journal business columnist Holman Jenkins points out that Comcast is scrambling to find a way to rework their business model as the era of set-top box-delivered video slowly gives way to a world of ubiquitously available online video:

This would be a merger, after all, of two businesses that seem headed toward some combination of the fates of newspapers, music CDs and the old wireline telephone business. Customers want the product for free. Comcast’s lifeblood, the $100-a-month cable bill and the $50-a-month broadband bill, increasingly look like duplicative expenses. And so on. True, the number of households that have actually dropped their cable subscriptions in favor of subsisting on TV streamed or downloaded from the Internet is not yet large. But for the Roberts family and its Comcast property, their worst fears lurk just around the corner—being reduced to a “dumb pipe,” subject to commodity pricing while somebody else (Google) makes all the money. Yet an escape route is vexingly hard to envision. Time Warner and Comcast have been talking up plans to make their respective cable lineups available by computer—as long as you keep paying your cable bill. This is a stopgap, especially appealing to anyone who owns two homes but wants to pay only one cable bill. Never mind, too, that hundreds of shows are already available online for free, via Web sites operated by none other than Comcast and the TV networks themselves.[55]

In light of such technological upheaval and marketplace uncertainty, it’s important that regulators proceed cautiously when reviewing this deal or future deals.

Conclusion: Let Markets Evolve

The point here is not that media mergers are inherently good or always make sense. Indeed, as the examples discussed above illustrate, mergers sometimes prove to be huge blunders.[56] But the hysteria sometimes heard before media mergers are consummated rarely bears any relationship to reality once the deals move forward. Media markets are extremely dynamic and prone to disruptive change and technological leap-frogging. Mergers are often one response to that turbulence.

But mergers are no panacea, and they often fail to produce the “synergies” hoped for. A 2004 survey by McKinsey & Co. found that “Nearly 70 percent of the mergers in our database failed to achieve the revenue synergies estimated by the acquirer’s management.”[57] Perhaps, therefore, the best argument for blocking media mergers is not their potentially pernicious effect on markets or consumers, but rather to save the merging firms (and their stockholders) from a miserable marriage!

On the other hand, experimenting with alternative business models and ownership structures is an important part of any dynamic market, because markets are not static but represent and ongoing processes of entrepreneurial “discovery.”[58] Thus, policymakers would be wise to avoid micro-managing mergers and instead let things run their course.  Sometimes collaboration makes a great deal of sense, especially when the significant costs of providing a media service becomes impossible absent a partnership. Indeed, federal officials and agencies are currently exploring how (or whether) journalism can survive an era of seeming perpetual media upheaval.[59] Healthy media companies certainly must be part of the answer and new ownership arrangements might be part of the solution.

Given how difficult it is to predict the future course of events in this chaotic sector, humility—not hubris—is the sensible disposition when it comes to media merger policy. At a minimum, policymakers should insist that ongoing debates are governed by facts instead of fanaticism, because, if the past decade is any guide, discussions about media mergers have been more often rooted in hyperbolic rhetoric and unsubstantiated hysteria.

A few months ago, I penned a mega book review about the growing divide between “Internet optimists and pessimists.” I noted that the Internet optimists — people like Chris Anderson, Clay Shirky, Yochai Benkler, Kevin Kelly, and others — believe that the Internet is generally improving our culture, economy, and society for the better. They believe the Net has empowered and liberated the masses, sparked unparalleled human creativity and communication, provided greater personalization and customization of media content, and created greater diversity of thought and a more deliberative democracy. By contrast, the Internet pessimists — including Nick Carr, Andrew Keen, Lee Siegel, and others — argue that the Internet is destroying popular culture and professional media, calling “truth” and “authority” into question by over-glamorizing amateurism and user-generated content, and that increased personalization is damaging deliberative democracy by leading to homogenization, close-mindedness, and an online echo-chamber. Needless to say, it’s a very heated debate!

I am currently working on a greatly expanded version of my “Net optimists vs. pessimists” essay for a magazine in which I will draw out more of these distinctions and weigh the arguments made by those in both camps. I plan on concluding that article by arguing that the optimists generally have the better of the argument, but that the pessimists make some fair points about the downsides of the Net’s radically disintermediating role on culture and economy.

So, this got me thinking that I needed to come up with some sort of a label for my middle-of-the-road position as well as a statement of my personal beliefs. As far as labels go, I guess I would call myself a “pragmatic optimist” since I generally side with the optimists in most of these debates, but not without some occasional reservations. Specifically, I don’t always subscribe to the Pollyanna-ish, rose-colored view of the world that some optimists seem to adopt. But the outright Chicken Little-like Ludditism of some Internet pessimists is even more over-the-top at times. Anyway, what follows is my “Pragmatic (Internet) Optimist’s Creed” which better explains my views. (Again, read my old essay first for some context about the relevant battle lines in this intellectual war).

The Pragmatic (Internet) Optimist’s Creed

I believe that the Internet is reshaping our culture, economy, and society – in most ways for the better, but not without some heartburn along the way.

I believe that the world of information abundance that has dawned is vastly superior to the world of information poverty that we just left. But I also understand that not all information is equal and that that the rise of abundance raises concerns about information overload, objectionable content, and the role of “authority” and “truth.”

I believe the era of traditional Mass Media is coming to an end, but “professional” media institutions and creators continue to play a vital role in the creation, aggregation, and dissemination of news, information, culture, and entertainment. The Internet, however, will force gut-wrenching changes on traditional media institutions and some of the more vital ones (ex: daily local newspapers) will struggle to re-invent themselves, or may wither away entirely.

I believe that “professional” journalism faces very serious challenges from the rise of the Internet and user-generated content, but I also believe that hybrid forms of news-gathering and reporting are offering society exciting new ways to learn about the world around them.

I believe Wikipedia is an amazing example of collection action / intelligence at work, but I also understand it is not without flaws and limitations. I believe Wikipedia is a wonderful complement, but not a complete substitute, for other media and information sources and inputs.

I believe that free and open source software (FOSS) has offered society enormous benefits, but I do not believe that FOSS (or “wiki” models) will replace all proprietary business models or methods. Each model or mode of production has its place and purpose and they will continue to co-exist going forward, albeit in serious tension at times.

I believe the Long Tail is a powerful phenomenon, but not “the future of all business.” It is now a more important part of the future of business, but not the entirety of it.

I believe there is a difference between “remix culture” and “ripoff culture.” Remixing (including mash-ups of all sorts) generally enhances and extends culture and creativity. Blatant content piracy, on the other hand, can discourage the creative efforts of the masses. Likewise, hacking, circumvention, and reverse-engineering all play an important and legitimate role in our new digital economy, but one need not accept the legitimacy of those activities when conducted for nefarious purposes (think identity theft or chip modding to facilitate video game piracy.)

I believe that the Internet has empowered the masses and created a world of “pro-sumers” that gives every man, woman, and child a soapbox on which to speak to the world. But that does not mean that all of them will have something interesting to say, and I won’t praise user-generated content as a good in and of itself. It’s quality, not volume, that counts.

I believe that the Internet’s empowering nature has changed much about society and culture, but I do not believe in the romanticism espoused by some about how the Net “remaking man” or changing human nature in a fundamental way. The Internet does not liberate us from all earthly constraints and it cannot magically solve all of humanity’s problems.

I believe that the Internet is reinvigorating deliberative democracy and giving us increased exposure to a breathtaking diversity of views that were previously inaccessible, at least for most of us. On the other hand, I understand that some Netizens will often seek out only those views that reinforce their pre-existing biases.

I believe in the power of freedom of speech and expression, and appreciate that the Internet and the rise of user-generated content has given us a world of unprecedented information and cultural riches. I also understand, however, that unrestricted freedom of speech and expression permits an increase in the prevalence of objectionable, even harmful, speech and content. On net, however, (excuse the pun) the Internet is the most important medium of human communication and expression that the world has ever known.

In sum, I believe there are more reasons to be optimistic than pessimistic about the Internet and its role in shaping our lives, culture, economy, and society. But that doesn’t mean it will be all roses going forward.

Carr Big Switch book coverI just finished reading through The Economist’s new 14-page special report on cloud computing, “Let It Rise” in which Ludwig Siegele provides an outstanding overview of cloud computing and why it is so important:

The rise of the cloud is more than just another platform shift that gets geeks excited. It will undoubtedly transform the information technology (IT) industry, but it will also profoundly change the way people work and companies operate. It will allow digital technology to penetrate every nook and cranny of the economy and of society, creating some tricky political problems along the way.

Even if you are very familiar with cloud computing, I recommend you take a look at the article. Anyway, while I was reading it, I was unsurprised to come across some comments from Nicholas Carr, whose new book The Big Switch: Rewiring the World, from Edison to Google, is essentially an early history of cloud computing and an investigation into its effects on our economy, culture, and society. And that also reminded me that, even though I have mentioned Carr’s book here several times since it was released earlier this year, I have failed to give it a dedicated review. And it certain deserves one because “The Big Switch” is easily one of the most important technology policy books of 2008.

One of the reasons Carr’s book will be high up on my end of the year list of best tech books has nothing to do with substance. It’s his style. Carr is one of most gifted writers in the tech policy field today. His eloquence and brilliant story-telling skills remind me of George Gilder in his prime. Carr nicely places modern developments in a historical context and relates the changes we are witnessing today to previous technological innovations and eras.

At the same time, however, Carr has also become one of the America’s leading Internet skeptics and vocal critics of techno-utopianism, as I noted in an essay a few months ago about Internet optimists and pessimists. He is, by far, the most reasonable and respected of those Net skeptics, using a measured tone when attacking those who have adopted a more pollyanna-ish, rose-colored view of the world. [For similar reasons, Carr’s “Rough Type” blog is must-reading for anyone who monitors technology policy.]

Electric Parallels

But on to the substance of the book. Carr’s thesis is that we are in the midst of “another epochal [technological] transformation” that parallels what happened with the “democratization of electricity” a century ago:

What happened to the generation of power a century ago is now happening to the processing of information. Private computer systems, built and operated by individual companies, are being supplanted by services provided by a common grid — the Internet — by centralized data-processing plants. Computing is turning into a utility, and once again the economic equations that determine the way we work and live are being rewritten. (p. 12)

“That shift,” Carr continues, “promises not only to change the nature of corporate IT departments but to shake up the entire computer industry.” (p. 13) Indeed, the “revolutionary potential of the information utility” promises to have profound implications:

In the years ahead, more and more of the information processing tasks that we rely on, at home and at work, will be handled by big data centers located out on the Internet. The nature and economics of computing will change as dramatically as the nature and economics of mechanical power changed in the early years of the last century. The consequences for society — for the way we live, work, learn, communicate, entertain ourselves, and even think — promise to be equally profound. (p. 21)

Unsurprisingly, Google is the central player in Carr’s drama because it is “a giant information utility” (p. 13) that has capitalized on the movement of so much knowledge and technology into the cloud and off of our desktops. Carr argues that “once utility services mature, the idea of getting rid of your PC will become much more attractive” (p. 80) and “We may find, twenty or so years from now, that the personal computer has become a museum piece, a reminder of a curious time when all of us where forced to be amateur computer technicians.” (p. 81)

Carr’s Critique of “Techno-Utopianism”

Part One of The Big Switch is primarily concerned with this progression of computing and IT from specialized service to mainstream utility, and I believe that most readers will find it as engrossing and enlightened as I did. But the tone and focus of Carr’s book change dramatically as Part Two opens. Whereas Carr keeps Part One fairly value- or viewpoint-neutral, Part Two is a more spirited critique of the economic and cultural consequences of “The Big Switch.”

In Part Two, he launches into his attack of the “techno-utopianism” that sometimes accompanies discussions about the implications of the Information Age and life in the cloud. “[O]ptimism is a natural response to the arrival of a powerful and mysterious new technology,” but, Carr warns, “it can blind us to more troubling portents.” And “there is reason to believe that our cybernetic meadow may be something less than a new Eden.” (p. 125)

It is here that Carr’s critique becomes familiar to those of us who follow the modern Internet policy debates. As I noted in my “Internet Optimists and Pessimists” essay, Carr is joining the ranks of other Net skeptics like Andrew Keen, Lee Siegel, and others. In my recent review of Lee Siegel’s Against the Machine: Being Human in the Age of the Electronic Mob, I traced this strand of social criticism back to the late Neil Postman, author of the 1992 anti-technology manifesto, Technopoly: The Surrender of Culture to Technology.

Carr’s concerns about the consequences of cloud computing and the rise of “techno-utopianism” parallel those found in those other “pessimistic” tracts, although Carr is far more level-headed in articulating those fears. As I noted in the Siegel review, those concerns can generally be grouped as follows:

  1. The Net is destroying (or at least greatly diminishing) the role of experts, authority, “truth”, and traditional societal norms and institutions. This is having (or eventually will result in) dangerous ramifications for our culture, economy, and democracy.
  2. The personalization and customization that the Information Age and the Internet have spawned could have troubling ramifications for our society and culture.

Dangers of Disintermediation and the Problem with “Free”

Regarding the first of these concerns, Carr argues that “while it’s true that the reduction in production and distribution costs is bringing us many more options, it would be a mistake to leap to the conclusion that nothing will be sacrificed in the process. More choices don’t necessarily mean better choices,” he says. (p. 151) He continues:

Many cultural goods remain expensive to create or require the painstaking work of talented professionals, and it’s worth considering how the changing economics of media will affect them. Will these goods be able to find a large enough paying audience to underwrite their existence, or will they end up being crowded out of the marketplace by the proliferation of free, or easily accessible products? Even though the Internet can in theory accommodate a nearly infinite variety of information goods, that doesn’t mean that the market will be able to support all of them. Some of the most cherished creative works may not survive the transition to the Web’s teeming bazaar. (p. 151)

More specifically, Carr is worried about what “The Great Unbundling” — i.e., the radically disruptive disintermediation associated with the Internet Age — will mean for the future of “hard news,” investigative journalism, and prized forms of culture. The cross-subsidies that have supported the creation of such content are at risk, Carr fears, as the Net’s relentless drive for increased efficiency rolls like a digital wrecking ball through the old media and cultural landscape. “[T]he largest threat posed by social production won’t be to big corporations but to individual professionals — to the journalists, editors, photographers, researchers, analysts, librarians, and other information workers who can be replaced,” Carr says, by “crowdsourcing.” (p. 142)

In this way, Carr’s concerns are quite similar to those raised by Andrew Keen and others about how the Internet is potentially “killing our culture” (or at least the best of it as they would define it). But Carr extends this social critique in an important way by claiming that the problem with the emerging model of social production and “free” business models that dominate the online marketplace today is that they are built on a “sharecropper model.” The Net’s dominant giants, he argues, are reaping their riches on the back of free labor. These new sites and services “are essentially agglomerations of the creative, unpaid contributions of their members. In a twist on the old agricultural practice of sharecropping, the site owners provide the digital real estate and tools, let the members do all the work, and then harvest the economic riches.” (p. 137-8)

I have some sympathy for these arguments, especially as they have been articulated by Carr here in The Big Switch. Compared to the way other critics like Keen and Siegel have used over-the-top apocalyptic, neo-Luddite rhetoric when discussing their related concerns, Carr generally avoids such hysteria and does a better job of laying out his concerns about the Net and cloud computing in a more reasonable fashion. And there is little doubt that the Internet and social production models are placing enormous strain on many traditional professions and professionals.

I have problems with his “sharecropper” argument, however. This logic ignores the non-monetary benefits that many of us feel we extract from today’s online business models and social production processes. Most of us feel we get a lot back as part of this new value exchange. Carr is certainly correct that Google, Facebook, MySpace, and a lot of other Net middlemen are getting big and rich based on all the user-generated content flowing over their sites and systems. On the other hand, most cyber-citizens extract enormous benefits from the existence of those (mostly free and constantly improving) platforms and services. It’s a very different sort of value exchange and business model than most of us have been accustomed to in the past, but we are adjusting to it. We humans are resilient, adaptable creatures and we can usually learn to cope with such changes and find a way to use them to our advantage. It’s not all about companies getting rich; we are getting richer too, but in a different way. We have an abundance of information, culture, and communications opportunities at our disposal today that were simply unthinkable even a generation ago.

Carr and other Net skeptics certainly raise some very legitimate questions about the limitations of the “free culture” mindset, however. There are times when the net optimists really do sound like the pollyannish “utopians” that Carr claims they are. When I am reading the work of Benkler and other optimists, it sometimes comes across as techno-Rousseauian gibberish (or what Carr labels “the Internet’s liberation mythology.”) The Internet isn’t remaking man or changing human nature in any fundamental way, which is what some optimists seem to imply. Moreover, when it comes to economics, all this talk about the Long Tail being “the future of business” (Chris Anderson) and of “Wikinomics… changing everything through mass collaboration,” (Don Tapscott & Anthony Williams) goes much too far in my opinion. It’s irrational (techno-) exuberance.

On the other hand, Carr and the other pessimists occasionally go to the opposite extreme in critiquing new models of social production, open source, and other collaborative creative endeavors. Their obsession with Wikipedia is particularly curious. If one views Wikipedia and Wiki- models as supplements or compliments to traditional media and communications models and activities, then where is the harm? Most of us understand they are not perfect, but we can appreciate the benefits they bring society despite their limitations.

When it comes to the true impact of the Internet on our economy and culture, the truth is somewhere in between the two extremes staked out by optimists and pessimists. My own position in this regard might best be labeled “pragmatic optimism”: One can appreciate how much better off the Internet has made society while also recognizing that it has created new challenges that we need to think through.

Downsides of Hyper-Personalization

The other important theme developed by Carr in the second half of The Big Switch, which also runs throughout the work of other techno-pessimist tracts, is that the increased personalization and customization facilitated by the Internet is breeding dangerous anti-social attitudes and tendencies. Building on an argument first put forth by Cass Sunstein in his 2001 book Republic.com , Carr worries about the impact of the “Daily Me.” The “Daily Me” was the term Nicholas Negroponte coined in his prescient 1995 book Being Digital, to describe the new digital world he hoped would develop, filled with hyper-personalized, instantaneously-delivered content. And that’s largely the Web 2.0 world we live in today.

But Carr, Sunstein, and many other Net skeptics, refer to Negroponte’s “Daily Me” in contemptuous terms, arguing that the hyper-customization of websites and online technologies is causing extreme social “fragmentation,” “polarization,” “balkanization,” and “single-mindedness.” Carr warns:

Every time we subscribe to a blog, add a friend to our social network, categorize an email message as spam, or even choose a site from a list of search results, we are making a decision that defines, in some small way, whom we associate with and what information we pay attention to. (p. 160)

Thus, he fears, we could be “click[ing] our way to a fractured society” (p. 160) because of the “ideological amplification” (p. 164) bred by the Daily Me. There’s even the risk of increased fanaticism, radicalization, and extremism, he warns.

I have addressed this argument at length in my 2005 book, Media Myths (p. 39) but, to summarize, the fundamental problem with this logic is that it ignores the fact that, thanks to the rise of the Net, most of us are experiencing far more diverse voices and viewpoints than we ever did in the past. Sure, it is true that we also can now find our little niche groups and bunk-up with them online for extended periods, but I find it absurd to claim that we humans are less exposed to diverse viewpoints today than in the past.

Regardless, even if Carr and the other Net skeptics are correct and the Net is breeding such isolation and balkanization, what are we suppose to do about it? Should we roll back the clock to the good ol’ days? Carr doesn’t give us a straight answer. But, again, there are good reasons to question whether society was really better off in the pre-Internet days. The Analog / Scarcity Era had it’s own share of problems, beginning with the fact that it was extremely difficult for niche interests in our society to be served when media was catering to a mass audience through newspapers and broadcast stations. Certainly, the old model of media delivery had its advantages, but the drawbacks were enormous, and not just as it pertained to entertainment. Consider news: If we all weren’t home sitting in front of our TV sets at exactly 6:30 each night, then we missed our chance to hear the same three old white guys in bad suits tells us what the important news of the day was. Look, I liked Cronkite, Brinkley & Co., but I will take today’s 24/7 news cycle of instantaneous news over that old system any day of the week.

Again, there are trade-offs at work here. Things are not all roses like Net optimists would claim. The downside of an endless news cycle is that people can just find a niche news channel or program that feeds them news more closely in line with their own ideological tendencies. Moreover, there very well may be — to use Glenn Reynolds’s phrase — “An Army of Davids” out there in the blogosphere today taking on traditional media and expressing themselves however they wish, but that doesn’t automatically mean they all have something interesting to say! Even when they do, there is still a useful role played by mass media providers or “professional” media in steering news and culture. Indeed, they provide an essential editing function in terms of helping us decide what types of news or culture may be more important. I personally rely on the Wall Street Journal to help guide my investigation of what financial market news is worth exploring each week. I wouldn’t want to just set up my Google Alerts to feed me “financial news” and then trust that everything that came into my RSS reader was worth reading. In this sense, the WSJ is what I call a “trusted information intermediary” (or “old school filter” if you will) that many of us could not live without.

But that traditional intermediary editing and filtering function, which used to be total in its applicability to news and culture, is now shrinking rapdily. “Mass media” just isn’t quite as MASS-ive as it once was, and the rise of personalized “Daily Me” media and culture certainly has had something to do with that since it has allow us to filter news and culture ourselves.  But why can’t we have the best of both worlds — some old school filtering by trusted information intermediaries along with plenty of personalized filtering? In many ways, I think we have that balance today — and it is a wonderful thing. Pessimists like Carr seem to only focus on the downsides of customized media, and that’s unfortunate. Nonetheless, they are right to ask the tough questions about how long those old school filters (traditional media intermediaries) will survive if all of us flock to an extreme “Daily Me” mindset. My contention, however, is that we won’t. Most of us appreciate the balanced approach and are willing to support some — but not all — of those old intermediaries and filters.

I have far less sympathy for Carr’s argument that increased specialization and customization are breeding “fanaticism” and “radicalization.” Last time I checked, mobs weren’t rioting in the streets or rushing out to join the Nazi or Communist parties! Those knuckleheads still exist, of course, but they have always existed. And let’s not forget, it was during the age of scarcity and mass media that those movements gained traction and took control in some countries. In the Internet Age, by contrast, such extremist loonies usually get exposed and widely ridiculed. As the old saying goes, the answer to bad speech is more speech. The Internet has given it to us and helped us counter such societal extremism, even if it has simultaneously given such extremists a new soapbox to stand on and spew their hatred and stupidity. Let them spew it and we will respond! And we will marginalize them in the process. There’s just no chance some sort of mini-Hitler is going to use the Net to revive fascism and build a mass audience today.

Finally, I believe Carr makes a similar mistake when he argues that computers and the Internet are really more “technologies of control” than “technologies of emancipation.” (p. 191)  “While the Net offers people a new medium for discovering information and voicing opinions, it also provides bureaucrats with a powerful new tool for monitoring speech, identifying dissidents, and disseminating propaganda.” (p. 200)  In this sense, Carr is adopting the same pessimistic tone set forth by Jack Goldsmith and Tim Wu in their book Who Controls the Internet? While I agree that computers and the Net give the big bad statist bureaucrats new tools of control, I persist in my belief that these digital tools offer the masses more methods of evading and minimizing the power of government over their lives and liberties.  Again, I think it is important to put things in some historical context. In the past, governments could completely control the media and disseminate incessant propaganda. It is far more difficult for them to get away with that today, and citizens have many tools and outlets at their disposal to respond.  Digital technologies really are technologies of emancipation, but we can’t expect them to break the backs of the statist thugs overnight.

Conclusion

Carr’s pessimism on the two issues discussed above is succinctly captured on pg. 167 of his book when he argues that:

it’s clear that two of the hopes most dear to the Internet optimists — that the Web will create a more bountiful culture and that it will promote greater harmony and understanding — should be treated with skepticism. Cultural impoverishment and social fragmentation seem equally likely outcomes.

That almost perfectly delineates the battle lines in the great debate taking place today between Internet optimists and pessimists. The Big Switch probably makes the best case for the pessimists that has been penned thus far, and for that reason alone it deserves your attention. However, I continue to remain cautiously optimistic that the Net is moving our economy, culture, and society in a better direction — at least compared to a past, which had its own share of drawbacks and problems.

With Google celebrating its 10th anniversary this week, many panicky pundits are using the occasion to claim that Google has become the Great “Satan” of the Internet.  Nick Carr wonders what the future holds for “The OmniGoogle.” The normally level-headed Mike Malone worries that Google is “turning into Big Brother.”  And Washington Post’s Rob Dubbin says that he can’t escape Google’s “tentacles,” even for just 24 hours.  Meanwhile, speculation abounds that the Justice Department is preparing a major antitrust lawsuit against Google concerning its advertising partnership with Yahoo! or perhaps even a broader suit concerning Google’s “dominance” of online advertising generally.

Carr quotes Google co-founder Sergey Brin’s now-famous 2003 interview:

I think people tend to exaggerate Google’s significance in both directions.  Some say Google is God.  Others say Google is Satan.  But if they think Google is too powerful, remember that with search engines, unlike other companies, all it takes is a single click to go to another search engine. People come to Google because they choose to.  We don’t trick them.

In the last five years, Google has become far more than just a search engine.  As Google’s suite of suite of complementary products continues to grow, so too does the specter of Google as an all-knowing and therefore all-powerful economic colossus.  Yet Google isn’t even close to being the sort of nefarious monopolist out to destroy user privacy at every turn, as some seem to imply—if not exclaim.  Indeed, in our view, the Net is overall a far better place because of the existence of Google and the many free services it provides consumers.

Our point is not that Google should be immune from criticism.  Indeed, healthy criticism of corporate actions plays a vital role in the free market by disciplining corporate policies and behavior—often thus providing an effective alternative to government regulation.  This is particularly important in the area of consumer privacy protection, as demonstrated by Google’s quick response to public concern about its Chrome EULA.

We hold no brief for Google and our aim is not to be Google apologists.  In fact, we’ve had more than a few run-ins with Google on many important policy issues in the past ( e.g., on net neutrality, spectrum policy, and the need for “baseline Federal privacy legislation”) and will likely continue to do so in the future.  We are always willing to engage serious, rational discussions about other policy issues involving Google, such as concerns about its alleged market power, but it seems to us that the hysteria about Google’s supposed dominance of the Internet is clouding rational discussion of the policy issues raised by Google, its innovations and its success.  Indeed, the creeping paranoia about all things Google-related that is most evident throughout the blogosphere (but that reaches far beyond it) has produced an environment that resembles nothing so much as a lynch mob:  Angry, short-tempered, out for corporate blood, and unwilling to engage in reasoned discussion.

Gates_of_BorgThe specter of Google’s market power driving—and confusing—so many of today’s Internet policy debates is reminiscent of the previous generation of conspiracy theories about how Microsoft, like the Borg (perhaps sci-fi’s scariest villains), would assimilate all in its path—forever controlling the digital revolution.  We don’t want Google to become the victim of the same regulatory & antitrust ordeal that Microsoft has endured over the past decade, with the kind of hysterical claims of Chicken Little-ism that drove a ten-year crusade against Microsoft.  Short-sighted, heavy-handed government intervention can cripple a creative company while doing little to actually benefit consumers because regulators cannot keep pace with technological change—perhaps the only constant fact in the every-changing digital world.

Of course, like all temporal things, Microsoft’s seemingly permanent “monopoly” has faded, and the bulk of the criticism it once faced has shifted focus to Google.  Microsoft continues to be the subject of many unfair attacks because of its success (a/k/a “dominance”) in the OS, office product, and browser markets.  Other companies have experienced similar attacks on a smaller scale:  Facebook and the once-angelic Apple have both been subject to increasing criticism for their success in certain sectors of the digital economy, customer complaints about openness ( e.g., “locked” devices or portability of social networking data) and privacy policies.  The hysteria surrounding Google is not unique in kind, yet it is clear that the mantle of “Great (digital) Satan” has clearly passed from Microsoft to Google.

Thus, we have decided to start a new series of essays on “Googlephobia” (a term that seems to have taken off in the spring of 2005, when the French government seriously proposed creating its own alternative to the Google search engine).  We’ve already penned a few essays on the topic here (as have a number of our TLF colleagues) and, therefore, our next installment in the series will be #5—in which we will outline the many competitors to Google’s many products.
