I modified the language about the FCC “tolerating” it. I suppose it’s simply part of the game, but it can be and should be mitigated. Why the FCC shouldn’t encourage it is because Congress has given the agency a general mandate to move quickly on new technologies. Considering how quickly the tech and communications industries move, this bias for action seems reasonable and welfare enhancing. Investment dries up quickly when delays mount. The strategy of opposition groups for decades has been to slow FCC proceedings down in order to organize an opposition coalition or extract concessions. By taking seriously this statutory mandate, the FCC can limit what I (and Congress) consider to be pretty damaging delays.

Some are long, some are short. Some make good technical points not made elsewhere in the proceeding. I don’t see why the FCC should not tolerate it, nor what the FCC could do if it didn’t.
