I&#039;d like to see a more careful, and thoughtful working up of the subject, rather than this sloppy screed. What you&#039;re dancing around without quite nailing is that&#039;s it&#039;s a question of the balance between two constitutional rights: free speech vs. privacy. Now, you might try to argue that free speech trumps, as it is an explicit, rather than a &quot;penumbra&quot; right, but at least you&#039;d have a leg to stand on. Where you really go off the tracks is in section IV when you jump to that conclusion about creating property rights in personal data. Certainly, that&#039;s one model, but not the only one. And anyway I don&#039;t see how an opt-in regime gets you there.&lt;br&gt;&lt;br&gt;But anyway, you&#039;ve got a good start, and good ideas, and you make some valid points, but you need to do more homework to really know what you&#039;re talking about -- too many weak spots in your argument.&lt;/p&gt;
