The issue is that the manufacturer has built the cost of the software into how much they charge for the hardware.
I love my modded XBox - it's the best value $300 PC I could buy at the time. The issue is it is sold this cheap becuse MS make money from the develoement kits and software licences. Maybe they should sell an "unlocked" xbox a tthe approproate cost? Nah, I'll just use the frimware I dwonloaed thanks.

That WOULD be funny. A deal between GM and Exxon that required you to commit to a contract to exclusively buy gas from Exxon if you wanted to buy the car. Or maybe it would be with Mobil, with the little speedpass RFID built right into the car...

But you can’t do this with the chip when it first arrives in the mail. Although the device is (or was) legal on its own terms, it couldn’t unlock the full potential of the Xbox without running custom firmware — firmware that was based on code to which Microsoft owns the copyright.

Of course, couldn't someone develop code that achieved the same result, but was based on their own work?
